Start by finding the official application and the notice that controls public participation. A landfill proposal normally has at least two distinct decisions: a planning decision about whether the use and site are acceptable, and an environmental permit covering design, pollution controls, monitoring and operation. Different agencies may handle them, with different documents, deadlines and hearing rights. Identify both processes before you submit anything.
Then replace general fears with site-specific questions. Ask where groundwater flows, which wells and waterways could be affected, how landfill gas will be controlled, which roads trucks will use, what hours will apply, how dust, odour, noise and litter will be managed, and what monitoring and contingency measures are enforceable. A proposal alone does not prove that nearby residents will be exposed or harmed; the decision must be based on evidence about this site and its pathways.

1. Find out exactly what has been proposed
Do not rely on a social-media post, a campaign leaflet or a map pin. Obtain the formal notice and record the site address, parcel numbers, applicant, proposed landfill footprint, waste categories, capacity, access roads and project stage. A scheme described as a “landfill” may include a new access junction, temporary construction compounds, borrow areas, leachate infrastructure, gas plant, screening berms and a long operating period. Those elements can have different planning and permit conditions.

Identify every decision-maker
Make a one-page contact list with the planning authority, environmental regulator, applicant and the council or agency responsible for highways, public health and waste planning. In England, the local waste planning authority decides where landfills will be located, while the Environment Agency assesses the environmental permit. The planning file and permit file can therefore contain different assessments and deadlines.

Ask each authority for the application or permit number and the name of the case officer. Save the current notice as a PDF or paper copy. Notices can be amended, and the version in force on the day you comment determines the closing date, submission address and hearing arrangements.
2. Build a project file before forming conclusions
Create a folder, digital or physical, with the notice, plans, technical reports, correspondence and your own observations. Use a spreadsheet to log document titles, revision dates, authors, page numbers and questions. This prevents you from commenting on an obsolete drawing or asking an agency to answer a point already resolved in a later revision.
Documents worth requesting
- Planning drawings showing the landfill cells, cap, drainage, gas plant, offices, weighbridge, lighting, landscaping, access and haul roads.
- The environmental assessment and non-technical summary, including alternatives and cumulative impacts.
- Site investigation reports, geology and hydrogeology, the conceptual site model, groundwater and surface-water assessments, and information on drinking-water wells.
- Landfill-gas generation and migration assessments, odour and dust assessments, slope-stability calculations, flood-risk information and proposed leachate controls.
- Traffic, transport and road-safety studies: vehicle numbers, vehicle types, routes, turning movements, hours, construction traffic and operating traffic.
- Proposed monitoring locations, baseline data, trigger levels, reporting arrangements, contingency plans and financial or operational responsibility for corrective action.
- Agency comments, requests for further information, revised plans, draft conditions and the current public notice.
Read the executive summary first, but check the underlying drawings and assumptions. A summary may say that a receptor is “nearby” without identifying its distance, elevation, groundwater relationship or monitoring location.

| Process | Main question | Typical evidence | What you must verify |
|---|---|---|---|
| Planning approval | Is the use, layout and development acceptable at this location? | Land use, highways, landscape, amenity, flood risk, noise, odour and construction impacts | Planning authority, application number, consultation deadline and any hearing or committee date |
| Environmental permit | Can the facility operate without unacceptable pollution or environmental harm? | Waste acceptance, containment, leachate, gas, groundwater, surface water, monitoring and closure controls | Regulator, permit reference, technical attachments, comment route and permit-specific deadline |
| Post-permit compliance | Is the permitted facility operating as required? | Monitoring results, inspection reports, incident records and enforcement notices | Public register, reporting frequency and procedure for reporting a suspected breach |
Comments sent to the wrong agency may not be considered in the decision you care about. Submit separately when the notices provide separate routes, and label each submission with the correct reference.
4. Track the deadline and participation rules
Use the official notice, not a deadline copied from another campaign. Confirm the closing date, time zone, submission address or portal, file-size rules, whether late comments are rejected, and whether comments are published. Ask whether a hearing is automatic, discretionary or available only to qualifying participants.
Why deadlines differ by jurisdiction
Wisconsin Department of Natural Resources guidance describes a 30-day comment period after a complete feasibility report. It also describes opportunities for qualifying groups to request an informational or contested-case hearing. Connecticut’s process describes a 30-day public-comment period after a tentative determination and requires a hearing for a new landfill application under the conditions set out in its fact sheet. These are jurisdiction-specific examples, not a general rule. The notice and governing regulations for your project control.
Check whether you must sign a petition, meet a minimum number of signatures, state a legal basis, or file a separate hearing request. If you are unsure whether you have standing, ask the case officer in writing and keep the response.

5. Write comments that a decision-maker can act on
Effective comments connect a document, a local fact, a consequence and a requested response. “I oppose this landfill” records your position but does not identify an error or a condition the agency can address.
A useful four-part format
- Identify the source. Name the report, drawing or page, including its revision date.
- State the local fact or omission. For example, a private well, culvert, school, care facility, steep slope or regularly flooded road is missing from the assessment.
- Explain the pathway or impact. Describe how a change in groundwater flow, truck routing, gas migration, dust or noise could affect that receptor.
- Request a specific action. Ask for corrected data, additional monitoring, a revised route, restricted hours, an enforceable trigger level, a contingency plan or a written explanation.
Use measured observations where possible: dates and times of existing congestion, photographs of road width or flooding, publicly available well records, and a map showing distances and elevations. Distinguish what you observed from what you infer.
Questions that commonly require a written answer
- What is the direction and seasonal range of groundwater flow, and where are the nearest drinking-water wells?
- Which streams, drains, wetlands or ponds could receive contaminated runoff or leachate, and what controls protect them during extreme rainfall?
- Which homes, schools, workplaces and outdoor recreation areas are the nearest sensitive receptors?
- How will landfill gas be collected, treated and monitored, and how will migration toward buildings be detected?
- What assumptions support the slope-stability analysis, including cell height, cover, settlement and wet-weather conditions?
- What monitoring locations, sampling frequency, trigger levels and public reporting are proposed?
- What happens if a monitoring result exceeds a trigger, a liner or drainage system fails, or an odour complaint pattern emerges?
6. Examine traffic and construction impacts separately
Large vehicles can affect residents before the first waste load arrives. Construction traffic may be concentrated over a short period, while operating traffic can continue for years. Request separate estimates for each phase and ask how the estimates were calculated.
Road and route questions
- How many daily vehicle movements are expected at peak construction and normal operation?
- What vehicle weights and dimensions were assumed, and can local bridges, culverts and pavements carry them?
- Which route, junctions and turning movements will be used, and what happens during roadworks, school arrival periods or emergencies?
- What hours, weekend restrictions, idling rules and delivery booking system will apply?
- Who will inspect road damage, clean mud or litter, and respond to unsafe conditions?
Ask for enforceable conditions rather than informal assurances. A route shown on an illustrative plan is not the same as a binding condition. If a highway improvement is promised, ask when it must be completed and who is responsible.
Dust, noise, odour and litter
Request the controls for wheel washing, covered loads, stockpile management, road sweeping, boundary planting, acoustic barriers, equipment maintenance and complaint response. Ask whether the operator must keep a log, investigate within a stated time and publish trends. Odour management should identify likely sources, weather conditions, detection methods and corrective steps, not merely state that odour will be “minimised.”
Independent reader supportYour contribution helps us test, update, and keep practical guides available for everyone.7. Treat health concerns as a site-specific investigation
Concern is reasonable, but distance alone cannot establish exposure. UK government health guidance discusses possible annoyance and stress associated with off-site odour, dust, traffic or uncertainty about wastes and chemicals; it does not establish that every nearby resident will become ill. Ask agencies to explain the exposure pathway, measured or modelled concentrations, duration, sensitive groups and uncertainty.
If you have symptoms or believe a private well, soil or air may be affected, contact your local health department and environmental regulator. Provide dates, location, symptoms, odour descriptions and any relevant medical advice. Do not infer causation from timing alone, and do not use unsupervised consumer testing as a substitute for a qualified, site-specific assessment.

In the Keyport legacy-landfill case, the New Jersey environmental and health departments described determining whether contamination had migrated off site as an initial step in assessing possible health impacts. That illustrates the correct order: establish whether a contaminant moved, identify who could be exposed, then evaluate risk.
8. Address property-value concerns without overstating the evidence
Property value is a legitimate community concern, but a predicted loss is not established merely because a landfill is proposed nearby. Market effects can depend on visibility, traffic, odour, operating history, zoning, buyer knowledge and the eventual controls. Ask the planning authority what evidence it considered and whether the applicant assessed visual, amenity and access effects. If you need an appraisal, use an independent professional who states the comparable sales, assumptions, geography and date of the opinion.
Keep valuation arguments distinct from pollution arguments. A request for screening or a quieter route may be a planning and amenity issue even when no contamination pathway is demonstrated.
9. Coordinate with neighbours and keep an audit trail
Share the notice, source documents and deadline rather than forwarding unverified claims. A shared issue log can assign one person to groundwater, another to traffic and another to public-health procedure. Each person should still submit an individual statement if the rules allow; copied form letters may show numbers but can obscure the specific evidence.
- Save submitted comments exactly as filed, with confirmation receipts or screenshots.
- Record calls in a dated log and follow important answers with an email.
- Keep agency replies, revised plans, hearing notices and meeting minutes in the same folder.
- Map sensitive receptors and observations using the same scale and north arrow as the application where possible.
- Ask whether environmental-justice participation rules apply. Connecticut describes a participation-plan requirement for certain facilities in designated communities.
10. Choose the right next step after commenting
After the comment period, monitor the public file for a response document, revised application, draft conditions, hearing decision or permit. A planning approval may not authorize waste acceptance if an environmental permit is still outstanding, and a permit does not erase planning conditions.
If the proposal is approved
Read the final conditions and identify measurable requirements: truck hours, route, monitoring wells, sampling frequency, gas controls, complaint response, financial security, closure and aftercare. Ask the responsible agency how residents can report a suspected breach and where inspection or monitoring results are published. Keep a dated record of incidents with photographs, weather, time, vehicle details and the condition you believe may apply.
If information is missing
Use the formal mechanism available in your jurisdiction: a request for further information, hearing request, administrative review or other appeal route. Deadlines can be short and eligibility rules technical, so obtain advice from the responsible agency or a qualified local adviser rather than assuming a general petition will preserve your rights.
