Do not wait for foreclosure notices or assume a partial payment will be handled as you intend.
At the same time, apply for unemployment through the state where you generally performed the work, contact a HUD-approved housing counselor, and protect cash for essentials. The right solution depends on your state, mortgage type, investor, servicer, income prospects, and payment status.

What do I do if I can’t pay my mortgage after losing my construction job?
Start with a documented call to the servicer. The Consumer Financial Protection Bureau’s guidance is direct: “If you can’t pay your mortgage or are worried about missing a mortgage payment, call your mortgage servicer right away.” Use the phone number on your monthly statement or the servicer’s official website, and ask to speak with a mortgage-assistance or loss-mitigation specialist.
Tell the specialist when the construction work ended, when income stopped, whether another job or income is expected, whether a payment has already been missed, and what amount you could realistically pay. Explain whether the hardship appears temporary or permanent, then describe household income, expenses, and assets. Ask which programs can apply to your specific loan, how to submit a complete application, which documents are required, and how the decision will be delivered.

Write down the date, time, representative’s name or identification number, case number, deadlines, and every instruction. Keep copies of statements, portal messages, applications, uploaded files, and confirmation screens. A servicer—not a general article—will determine whether you qualify and what terms it can offer.
Your first-day action plan
1. Make the servicer call before the due date
- Find the servicer’s number on your mortgage statement or its verified website. Do not use a number from an unsolicited text, email, or “rescue” letter.
- Request the mortgage-assistance, hardship, or loss-mitigation department.
- State the facts plainly: the construction job ended, the date income stopped, expected future income, current payment status, and the amount you can pay.
- Ask for the complete-assistance application, document checklist, submission methods, and response timeline.
- Ask how any partial payment would be applied before sending less than the scheduled amount. A partial payment may not stop delinquency or be credited in the way you expect.
2. Open every notice and meet every deadline
Check physical mail, the online mortgage portal, and email every day. Respond by the deadline printed in the notice. HUD cautions borrowers not to ignore lender communications. If you cannot obtain a document, tell the servicer immediately and ask what substitute proof it accepts. Send files through the servicer’s approved channel and retain proof of delivery.
3. Build a hardship file
Create one folder—paper, digital, or both—with your mortgage statement, income records, bank statements, tax or benefit documents, monthly expenses, job-separation information, and all servicer correspondence. Add a call log and a calendar of due dates. This prevents a lost document or missed callback from delaying review.
Within the next few days: replace income and get independent help
Apply for unemployment through the correct state
States administer unemployment insurance and set their own eligibility and filing rules. Apply through the official state system where you generally performed the work. If jobs crossed state lines or were performed remotely, contact the state agency for instructions. “Construction job” alone does not establish eligibility: the agency may consider work history, how the work was classified, the reason work ended, and other state requirements. Do not budget around an unapproved claim or an assumed payment amount.

Use reemployment services
An American Job Center can connect you with job-search assistance, training, and reemployment resources. These services can help restore income while the mortgage application is being reviewed; they do not replace the servicer’s loss-mitigation process.
Talk with a HUD-approved housing counselor
Housing counseling is free or low cost. The CFPB lists the HOPE Hotline at (888) 995-HOPE and a counselor search at consumerfinance.gov/mortgagehelp. HUD lists (800) 569-4287. Confirm current phone details on the agencies’ official pages when you call. A counselor can help organize documents, understand an offer, and communicate with the servicer, but cannot guarantee approval.
Check other public benefits
Use USAGov’s benefits finder and your state social-services agency to check potential help with food, utilities, health coverage, and essential household costs. Reducing those bills may free cash for the mortgage. These programs are not a promise of mortgage assistance, and eligibility varies.

| Option | What it generally does | Questions to ask the servicer |
|---|---|---|
| Forbearance | Temporarily pauses or reduces payments. The unpaid amount is not forgiven; it remains due under the agreed arrangement. | How much will be owed at the end? Is repayment a lump sum, an added monthly amount, or another arrangement? What payment is due when forbearance ends? |
| Repayment plan | Adds an agreed amount to regular payments so past-due sums are brought current over time. FHA describes this as a possible home-retention option for eligible borrowers. | How much extra is required each month and for how long? Can the household sustain that payment with current income? |
| Loan modification | Changes loan terms to address affordability or delinquency. Eligibility and terms depend on the loan and servicer. | What will the new rate, payment, term, principal balance, and total cost be? Is there a trial-payment period, and what completes it? |
| Refinance | Replaces the existing mortgage with another loan if the borrower qualifies. | Does the household qualify despite the income loss or delinquency? What are the new rate, payment, closing costs, and total repayment? |
| Short sale or deed-in-lieu | Provides possible ways to leave the home when keeping it is not sustainable. Servicer approval and eligibility are required. | What happens to any remaining debt, taxes, credit reporting, moving schedule, and other obligations? Obtain advice suited to your circumstances. |
FHA-insured mortgages have FHA-specific procedures and options described by HUD; those rules do not automatically apply to conventional or other loans. Ask who owns or insures your loan and request the rules that govern your account.
Can I get mortgage forbearance if I lost my job?
Job loss can be a hardship reason to request forbearance, but approval, length, payment reduction, and repayment method depend on the loan, servicer, investor, and your application. Forbearance is a temporary arrangement, not a cancellation of payments. Before agreeing, obtain the terms in writing and identify the first payment after the pause, the amount then due, and the consequences of missing that payment.
Do not stop paying simply because you submitted a request. Continue paying the scheduled amount unless the servicer confirms a different amount or suspension. If you cannot pay, tell the servicer what you can pay and follow its written instructions.
How long before foreclosure starts if I miss mortgage payments?
Under a general federal rule described by the CFPB, the first legal foreclosure notice or filing generally cannot occur until the borrower is more than 120 days behind. The CFPB page documenting this rule was last reviewed January 2, 2025. The 120-day threshold is not a four-month waiting period or a guarantee that nothing happens during delinquency: late fees, credit reporting, collection contacts, and loss-mitigation deadlines may occur earlier.

After a legal foreclosure process begins, the time to a sale varies substantially by state. State law, court procedures, loan type, servicing rules, bankruptcy, military protections, and individual facts can change the timeline. If legal papers arrive, a sale is scheduled, or foreclosure appears imminent, contact a qualified attorney or legal-aid program in your state promptly and notify the servicer.
Servicing rules generally require direct contact after delinquency within 36 calendar days and written loss-mitigation information no later than 45 days, subject to applicable exceptions. Those are servicer duties, not a reason for you to wait. Contacting the servicer yourself gives you more time to assemble a complete application.
Independent reader supportYour contribution helps us test, update, and keep practical guides available for everyone. How to avoid mortgage-relief scams
Use your servicer and a HUD-approved counselor as your first contacts. CFPB and HUD warn about companies that exploit homeowners in distress. Walk away from anyone who:
Do these 3 things before closing this tab:
1Clear out junk files and repair common Windows errors2Fix the driver behind crashes, sound loss and screen glitches3Repair Windows errors before they cause bigger problems- Demands an upfront fee before providing help.
- Guarantees a modification, stopped foreclosure, or specific result.
- Pressures you to sign over the deed or ownership.
- Instructs you to stop communicating with the servicer or stop making payments without a written servicer agreement.
- Directs you to send mortgage payments to a person or account other than the servicer.
- Asks you to sign documents you do not understand or leave blanks for someone else to complete.
Legitimate counseling may be free or very low cost, and you should not have to pay a company simply to obtain foreclosure-prevention assistance. Verify every contact through your mortgage statement or an official government page.

Decide which path fits your household
Use a written budget covering housing, utilities, food, transportation, insurance, taxes, medical costs, minimum debt payments, and realistic replacement income. Then evaluate each proposal against these questions:
- What payment is due immediately, during any trial period, and after the arrangement ends?
- How much will be added to the principal or future payments?
- What fees, interest, or escrow changes apply?
- How long must the household maintain the arrangement?
- What happens if the next job search takes longer than expected?
- Will the arrangement affect credit reporting, refinancing, sale of the home, or remaining debt?
- What event causes the agreement to fail, and how quickly must you notify the servicer?
If the numbers work only under an uncertain start date or an assumed benefit approval, tell the servicer that plainly and ask about a more sustainable alternative. A counselor can help compare the written terms without making the decision for you.
When keeping the home may not be sustainable
If a complete review shows that future payments remain unaffordable, ask the servicer about approved alternatives such as a short sale or deed-in-lieu. These options can involve approval, property-marketing requirements, moving deadlines, credit consequences, and possible claims for remaining debt or taxes. Rules differ by state and loan, so obtain qualified legal or tax advice for your circumstances before signing.
Do not abandon the property or ignore notices while an option is being considered. Continue opening mail, answer requests by their deadlines, protect the home from damage, and keep the servicer informed about your address and phone number.
A practical checklist for the next seven days
- Today: Call the servicer’s loss-mitigation team and request the complete application and document list.
- Today: Record the representative, case number, deadlines, and instructions; save every confirmation.
- Today: Gather the mortgage statement, bank and income records, expenses, assets, and proof of the job ending.
- Within a few days: File the state unemployment claim and save the confirmation number.
- Within a few days: Contact an American Job Center and a HUD-approved housing counselor.
- This week: Check official state and USAGov benefit resources for food, utilities, health coverage, and other essentials.
- Before any agreement: Read the written payment, duration, balance, fees, and default terms; compare them with a conservative budget.
- At every stage: Open notices, meet deadlines, and seek state-specific legal help immediately if foreclosure papers or a sale date appears.
A sudden construction-job loss does not determine the outcome by itself. Prompt contact, a complete application, careful recordkeeping, and independent counseling give you the clearest chance to identify a workable repayment arrangement or an orderly alternative.
