Keep people away, record what you can safely see, report the incident to the right authority, and arrange lawful removal through an appropriately authorised waste carrier. In England, Scotland and Wales, the local council is the usual first contact for small-scale fly-tipping. Large deposits or waste that threatens health or the environment should be reported to the Environment Agency. The fact that the dumping is illegal does not normally make the council responsible for clearing private land: the landowner generally has to arrange and pay for disposal.
Take these steps before anyone handles the waste
Keep people, workers and equipment away
Stop work in the affected area and prevent children, visitors, employees and subcontractors from approaching the material. Fly-tipped loads can contain sharp metal, chemicals, asbestos, clinical waste, contaminated soil or unstable objects. Do not open bags, move furniture, compact the pile, burn it or put any of it in your own skips. Disturbing the load can expose people to hazards and destroy evidence.

Do not approach a suspected dumper. If you see someone actively tipping, keep your distance and prioritise safety rather than trying to obtain a confrontation or a closer photograph.
Preserve the scene
Leave the waste where it is unless an immediate safety action is unavoidable. If a gate, road or work area must be made safe, isolate the location without sorting the contents. A council investigation may consider the scene, witness accounts and CCTV, so an undisturbed pile can be important.

Make a safe record
From a safe position, write down:
- the exact address, access point, nearby landmarks and the type of land involved;
- the date and time you discovered the waste and, if known, when dumping may have occurred;
- what the material appears to be, its approximate amount and whether it is spread, leaking, burning or blocking access;
- anything you personally saw, including people, clothing, vehicles, company markings and registration numbers; and
- possible effects on people, watercourses, roads, buildings or the wider environment.
Take photographs or video only when you can do so without entering an unsafe area or handling anything. Keep the original files, note when they were made and do not edit the scene before reporting it.
Report the fly-tipping to the correct authority
Small-scale waste in England, Scotland or Wales
Use your local council’s fly-tipping reporting route for ordinary, small-scale incidents. Examples include several bin bags, one or two items of furniture, a small commercial load, garden waste or a small amount of hazardous waste. Councils may use different online forms, telephone numbers and evidence requirements, so follow the instructions for the area where the waste is located.
Large-scale dumping or an immediate risk
Report large-scale dumping to the Environment Agency. The GOV.UK public reporting service lists the Environment Agency incident hotline, 0800 80 70 60, as available 24 hours. Use it when the waste presents a risk to human health or the environment, as well as for a deposit that is clearly beyond a routine small-scale report. Describe the risk and location first, then give the material and quantity information you have observed without attempting to measure or inspect dangerous waste.

How to judge whether a deposit needs escalation
Size, material and suspected criminal involvement can change the reporting route. Defra’s council guidance, last updated 28 March 2024, gives practical referral indicators. They are for authorities and should not prompt a landowner to weigh, measure or sample the waste.
| Situation | Guidance indicator | What you should do |
|---|---|---|
| Large mixed load | More than 20 tonnes, described as about 20 cubic metres | Tell the council or Environment Agency the best safe estimate and report as large-scale; do not enter the pile to calculate it. |
| Fibrous asbestos | More than 5 cubic metres | Keep everyone away and obtain specialist instructions; suspected asbestos should not be handled. |
| Potentially hazardous waste in drums or containers | More than 75 litres | Report the hazard and container details; do not open, decant or move them. |
| Possible criminal business activity or organised crime | Any credible indication | Provide the observations and vehicle or company details to the authority handling the incident. |
These figures are referral thresholds in council guidance, not permission to investigate the waste yourself. A smaller quantity can still be dangerous, and an apparently ordinary load can conceal hazardous contents. The Environment Agency hotline remains the appropriate escalation for an immediate health or environmental risk.
Who removes fly-tipped waste from private land?
For private property, the landowner generally decides how the waste will be dealt with and pays for proper disposal. Reporting the incident is still worthwhile: a council may investigate, but it can choose whether to investigate a report concerning waste on private land, and an investigation does not promise a council-funded cleanup.
Defra guidance says councils must remove and dispose of fly-tipped waste on “relevant land”. That public or otherwise designated land responsibility should not be confused with a private owner’s position. A construction company, developer, farm owner, landlord or occupier should therefore plan for lawful removal while the report is being assessed.

GOV.UK states that a person could be fined up to £200 for failing to dispose properly of waste dumped on their land. That is the possible fine stated on the public reporting page; it is not a complete description of every legal consequence or a universal penalty for every case.
Arrange removal without creating a second waste offence
Choose the right type of contractor
For ordinary, non-hazardous material, obtain a quote from a private waste-removal company that is authorised to carry the waste. Hazardous, chemical, contaminated or suspected asbestos loads require a contractor with the appropriate specialist competence and permissions. Do not let a general labourer “sort out” a mixed pile simply because the visible items look like household rubbish.
Verify the carrier before collection
- Check that the company’s waste-carrier registration or other required authorisation is current.
- Ask what facility will receive the load and whether that destination is authorised for the waste type.
- Describe the contents honestly, including suspected asbestos, oils, chemicals, sharps, electrical equipment or contaminated soil.
- Request a written price that identifies loading, transport, treatment or disposal and any additional hazardous-waste charges.
- Keep the quote, invoice, waste transfer information and disposal or treatment records.
Do not accept a vague promise that the waste will be “taken away”. If a contractor refuses to identify its authorisation or destination, choose another route and report the concern to the authority handling the incident.

Keep the paperwork with the incident file
Retain photographs, your chronology, council or Environment Agency reference numbers, contractor checks, transfer documentation, invoices and final disposal records. This establishes what was found, who removed it and where it went. It also helps if an authority later asks whether the material was disposed of lawfully.

What to do if asbestos or another hazardous material is suspected
Do not test, break or package it yourself
Do not take a sample, sweep fragments, wet the material, place it in bags or load it into a skip. Do not rely on colour or appearance to identify asbestos. Keep people out of the area and tell the reporting authority and any prospective contractor exactly what has raised your concern.
Asbestos reporting route
Defra’s council guidance says that if asbestos is found in fly-tipped waste, the incident should be reported to the Health and Safety Executive. The same guidance distinguishes fibrous-asbestos quantities above 5 cubic metres as a referral indicator. Those instructions do not make it safe for an untrained person to measure or disturb the material.
Other hazards
Leaking drums, strong fumes, batteries, gas cylinders, clinical waste, needles, unknown powders, burning material or waste near a stream should be described as an immediate hazard when you report it. Keep ignition sources and unprotected workers away. Follow the authority’s instructions and use a specialist contractor where required rather than treating the load as normal construction waste.
Give investigators useful evidence
A concise, factual report is more useful than speculation about who dumped the waste. Include the precise location, land type, discovery and suspected dumping times, material and quantity, access routes, witness details, vehicle registration numbers, photographs and any CCTV location. Note whether cameras cover the entrance, track or unloading area and preserve relevant footage in its original form before it is overwritten.

Authorities may compare witness claims with the scene and CCTV. Do not post identifiable footage or accusations publicly while an investigation is pending; provide the material through the reporting route and avoid contacting a suspected offender yourself.
Manage the site while you wait
Prevent exposure and spread
Use existing barriers, gates or signs to keep people away if they can be installed without approaching the waste. Do not drive plant through the pile or allow rainwater, wind or vehicle movements to spread it. If material is close to a public highway, watercourse or occupied building, tell the authority that location and the potential pathway of exposure.
Keep normal construction controls in place
Tell the site manager, principal contractor and relevant workers that the area is isolated. Update the site risk assessment or induction notice so nobody unknowingly loads the waste, scavenges materials or sends it to a standard skip. Record who has been given the instruction and when.
After removal: reduce the chance of another incident
Review access
Look at how a vehicle reached the dumping point: unlocked gates, a missing barrier, a track visible from a public road or a turning area that is unused at night. Consider proportionate changes such as repairing gates, controlling keys, closing an unnecessary entrance or improving lighting and sightlines. Do not create a new obstruction or hazard for legitimate users.
Consider CCTV as evidence, not a guarantee
CCTV can provide material an authority may review, particularly when it covers approach roads, gates and unloading areas. It does not guarantee prevention. If you install or reposition cameras, use a lawful, proportionate setup, maintain the system and set retention long enough to preserve footage for a report. Cameras are an optional prevention and evidence measure, not a substitute for safe reporting or authorised disposal.
Keep a site response plan
For construction and managed properties, write down who reports incidents, who isolates the area, who checks a carrier’s authorisation and where records are stored. A short plan prevents well-meaning workers from moving unknown waste and makes it easier to give the council or Environment Agency a consistent account.
Quick Recap
Common mistakes to avoid
- Touching or sorting the pile: this can cause injury, exposure and loss of evidence.
- Confronting a suspected dumper: observation from a safe distance is preferable to a conflict.
- Assuming private land means no report is needed: reporting can help identify offenders and hazards even when the owner must pay for clearance.
- Assuming the council will clear it: a council may investigate private-land reports but does not thereby accept cleanup responsibility.
- Using an unverified “man with a van”: waste passed to an unauthorised carrier can be fly-tipped again and may leave you unable to show lawful disposal.
- Putting hazardous material in a normal skip: disclose suspected hazards and obtain specialist advice first.
- Measuring dangerous waste to meet a threshold: report your safe observations; the thresholds guide authorities, not amateur inspection.
- Letting CCTV overwrite: preserve relevant footage promptly and record its date and time.
A practical response checklist
- Stop access to the affected area and do not touch or move the waste.
- Record the location, timing, material, apparent quantity, witnesses, vehicles and visible effects from a safe distance.
- Photograph the scene only when it is safe and preserve original files and CCTV.
- Report small-scale waste in England, Scotland or Wales to the local council.
- Report large-scale dumping or any immediate health or environmental risk to the Environment Agency; its listed hotline is 0800 80 70 60 and operates 24 hours.
- Use the separate Northern Ireland route if the property is there.
- Plan and pay for lawful private-land removal unless the authority confirms another arrangement.
- Check the carrier’s current registration or authorisation, destination and paperwork before collection.
- Escalate suspected asbestos or other hazardous waste and use an appropriately qualified specialist.
- After clearance, address access and visibility weaknesses and keep an incident record.
