If roadworks or a road defect damage your car, make safety your first priority, record the incident without putting yourself at risk, preserve proof of the actual loss, and claim from the organisation responsible for that specific road. The responsible body differs between England, Scotland, Wales and Northern Ireland, and a claim is never automatic. A journey delay is treated separately: National Highways says its ordinary statutory roadworks do not normally create an entitlement to compensation for disruption, inconvenience, extra costs or lost business, although improper conduct such as blocking access without authority may be different.
What to do immediately after roadworks damage your car
1. Get out of danger
Move to a safe place if the vehicle can be driven and the manoeuvre is safe. Switch on hazard lights, use a warning triangle only where it is lawful and safe, and contact your breakdown provider or the emergency services if anyone is injured or the vehicle is obstructing traffic. Never stop in a live lane to inspect a wheel, suspension or tyre.

Do not return to a motorway or enter its carriageway to take photographs. GOV.UK warns that trespassing on a motorway is a criminal offence and specifically says not to visit or try to photograph the damage location. A photograph is not worth risking a second collision.

As soon as you are safely parked, note:
- the road name and, where relevant, the motorway or A-road number;
- your direction of travel and lane;
- the nearest marker post, junction, exit, landmark or property;
- the date and exact time;
- what you hit or what feature caused the damage (for example, a pothole, raised ironwork, loose surface, debris or an unmarked roadworks edge);
- the damage you can see and any warning, diversion or roadworks signs; and
- weather, lighting and traffic conditions if they affected what you could see.
These are the core location and incident details the responsible organisation will need to identify the site and investigate its maintenance records.

3. Photograph only from a safe, lawful position
Take close photographs of the damage to the car, wheel or other property, and a wider view showing the surrounding context, landmarks and signs when you can do so without entering traffic or restricted land. Northern Ireland’s official process asks for both close-up and contextual photographs. If it is unsafe to photograph the defect itself, say so in your report and rely on photographs taken later from a permitted position, witness evidence and repair records.
Collect evidence of the damage and your actual loss
Vehicle and road evidence
Keep the original files from your phone or camera where possible. Do not edit out signs, lane markings or other context. Ask passengers or independent witnesses for their names and contact details, and keep any contemporaneous messages in which you reported the incident. A dash camera is optional: footage may preserve what happened around the impact, but the official guidance reviewed does not say that dash-camera footage proves liability or that you need one to claim.
Financial evidence
Obtain a written repair estimate and retain the final invoice, parts or recovery invoices, taxi or hire-car receipts and any other expenditure directly connected with the incident. National Highways asks for details of losses and expenditure, copies of documents and receipted invoices, and advises claimants to retain the originals. Keep a dated record of every payment and avoid presenting an estimate or a possible future loss as though it were an established cost.
Recommended Free Tools
Repair damaged property promptly where that is reasonably possible and keep losses to a minimum. Tell the repairer what happened, ask them to photograph hidden damage before replacing parts, and preserve removed parts if they may help establish causation. Do not authorise unnecessary work merely to increase a claim; an authority can investigate whether the work and amount were reasonable.

Find the organisation responsible for that exact road
The contractor working at the site is not automatically the correct claims recipient. Responsibility depends on the road class, location and the maintenance arrangement. Use the current official road-claims route for the precise location before sending documents.
| Where and road type | Usual route for a vehicle-damage claim |
|---|---|
| England red routes | Transport for London. |
| England motorways and A roads managed nationally | National Highways. |
| Other English roads | The relevant local council or highway authority. |
| Scotland trunk roads and motorways | BEAR Scotland or Amey, according to the area they maintain. |
| Scotland local roads | The relevant council. |
| Wales trunk roads managed by the national network | Traffic Wales’ claims route. |
| Other Welsh roads | The relevant council. |
| Northern Ireland, all road types | The Department for Infrastructure. |
Road appearance, temporary barriers or a contractor’s logo may not identify the legal highway authority. Confirm the organisation through the official service for the road and location. If you send a claim to the wrong body, ask it to identify the correct authority and keep a record of the transfer; do not assume that a contractor’s presence makes it liable.
How to submit a roadworks or pothole damage claim
- Identify the road authority. Use the official route for the nation and road class shown above. Check whether the authority has a specific vehicle-damage form or asks for a written claim.
- Describe the incident precisely. Give the road, direction, marker or landmark, date and time, lane, defect or roadworks feature, signs and traffic conditions. Explain how the impact occurred rather than simply stating that the car was damaged.
- Attach evidence. Include safe photographs, witness details, the vehicle registration, repair estimates or invoices, recovery records and receipted expenditure. Send copies unless the authority specifically requests originals, and retain the originals.
- State the amount claimed. Separate completed expenditure from an estimate, identify any insurer payment or excess, and do not include speculative losses as settled figures.
- Explain why the authority may be responsible. Point to the defect or roadworks condition, its location and any evidence that it was dangerous or inadequately managed. The authority will investigate maintenance history, inspections, warnings and the conduct of any contractor or statutory undertaker.
- Keep the acknowledgement and reference. Save the submitted form, attachments, photographs and correspondence. If more evidence is requested, answer by the deadline and keep proof of what you sent.
GOV.UK describes the possibility of making a claim, not a guaranteed payment. The authority may reject a claim if the evidence and applicable law indicate that a court would reject it.

Damage alone does not establish liability. The investigation normally considers what made the road dangerous, what inspections and repairs were carried out, whether warnings or traffic management were adequate, and whether the authority took reasonable steps to keep the highway safe. National Highways describes a statutory defence where an authority can show that it took reasonable steps; therefore, a defect can exist without creating an automatic right to damages.

Roadworks may be performed by an independent contractor or statutory undertaker. The responsible party may depend on who controlled the work, who had the maintenance duty and what the contract or statutory powers require. Identify those facts rather than assuming that the organisation whose name appears on a barrier is the defendant.
Keep your account factual. State what you saw, what you did, the speed and conditions if known, and the immediate damage. Do not claim that a warning sign was absent unless your evidence supports that statement, and do not exaggerate the defect or the financial loss. A clear chronology is more useful than a conclusory assertion that the authority was negligent.
How long will a decision take?
Timescales vary by authority and by the evidence needed. The following figures are service aims or averages for particular bodies, not a UK-wide promise:
| Authority or service | Published timing | What it means |
|---|---|---|
| National Highways | Acknowledgement within 21 days of a completed claim | An aim to confirm receipt, not an acceptance of liability. |
| National Highways | Liability decision within 90 days after acknowledgement | A target for its investigation; complex cases can take longer. |
| Northern Ireland Department for Infrastructure | Average vehicle-damage decision time of four months | An average reported for that service, not a deadline or prediction for every claim. |
Local councils and other bodies may publish different forms, response times, limitation information or review procedures. The material available for this guide does not establish a single deadline or appeal process for every authority, so check the instructions attached to the exact road’s claims service and obtain independent legal advice if a limitation date may expire.

Can you claim compensation for a roadworks delay?
Usually, not merely because statutory roadworks made a journey longer. National Highways states that it is not obliged to reimburse disruption, inconvenience, costs or loss of business caused by its statutory maintenance and improvement works. Planned lane closures, queues and diversions are generally part of the authorised work rather than a compensable loss.
That is different from saying that every delay claim is impossible. National Highways gives improper conduct, such as blocking access without authority, as an example where a business may have a claim. Whether any compensation is available depends on the authority, project powers, contract, the precise conduct and proof of loss. The official material does not establish a general entitlement for every driver, business or roadworks scheme.
What to record if access or trading is affected
- the date, duration and exact location of the closure or obstruction;
- photographs of signs, barriers and alternative access, taken from a safe place;
- the authority or contractor’s notices and any permission or reference number;
- sales, booking or delivery records showing an identifiable loss rather than a general estimate; and
- reasonable steps you took to reduce the effect, such as communicating an alternative route to customers.
Do not describe ordinary congestion as vehicle damage, and do not add lost profits to a car-damage claim without evidence that the loss is recoverable and directly connected.
Report the hazard separately from making a claim
A compensation claim deals with your past loss; a hazard report alerts the authority to a risk for other road users. Make both reports when appropriate. Use the GOV.UK road-reporting route or the relevant authority’s own reporting service, giving the precise location, direction, defect, photographs if safe and whether traffic is currently at risk.

National Highways provides travel-information and reporting tools for the network it manages. Checking current travel updates before setting off can help you avoid a closure, but a travel update is not a claim and a hazard report is not evidence that liability has been accepted.
Special cases: debris, insurers and breakdown recovery
Debris dropped by another vehicle
If an identifiable vehicle dropped the object that caused the damage, GOV.UK directs you to that driver’s insurer rather than the road authority. Record the registration, vehicle description, witnesses and any safe footage. The fact that debris was later found on the carriageway does not by itself show that the highway authority caused or negligently allowed the damage.
When to notify your insurer
Check your motor policy promptly, especially if the car is unsafe or you need recovery. Tell the insurer whether you intend to pursue the road authority and keep the claim reference, repair assessment and evidence. An insurer may arrange repairs or pay an excess before the authority investigates; keep documents showing what was paid and by whom so you do not seek the same loss twice.

Keep the recovery company’s invoice, the reason recovery was necessary and any advice that the vehicle was unsafe to drive. Whether those costs are recoverable depends on liability and the authority’s rules; an invoice proves the amount, not that the authority must pay it.
Common mistakes that weaken a claim
- Stopping on a motorway or walking into traffic to photograph the defect.
- Submitting a vague location such as only a town name, without a direction, junction, marker or landmark.
- Sending edited or undated images that do not show the road layout or warning signs.
- Throwing away damaged tyres, wheels or parts before the insurer or authority has had a reasonable opportunity to inspect them.
- Repairing the car without keeping estimates, invoices and photographs of hidden damage.
- Claiming a round figure for inconvenience, lost work or business without evidence of an actual recoverable loss.
- Assuming the visible roadworks contractor, rather than the highway authority or statutory undertaker, must receive the claim.
- Treating a hazard report, an insurance notification and a compensation claim as the same process.
- Expecting National Highways’ 21-day and 90-day aims, or Northern Ireland’s four-month average, to apply to a council or another nation.
A practical evidence checklist
- Safe photographs of the vehicle damage, defect, signs and wider context.
- Road name or number, direction, lane, marker post, junction or landmark.
- Date, time, weather, lighting and a short chronological account.
- Witness names and contact details, plus any permitted dash-camera footage.
- Repair estimates, final invoices, recovery bills, receipts and insurance correspondence.
- Records of payments, policy excess and any amounts already reimbursed.
- The authority’s claim reference, acknowledgement and every follow-up message.
What a clear claim should say
Use the authority’s form if one exists. If it accepts a letter or email, organise it so an investigator can match each loss to evidence:
- Identify yourself, the vehicle and the incident date.
- Give the exact road location and direction of travel.
- Describe the defect or roadworks feature and the impact.
- List the visible and subsequently diagnosed damage.
- Set out completed costs and estimates in separate lines, with document numbers.
- List the photographs, witness information and other attachments.
- Ask the authority to confirm the claim reference and tell you if further evidence is needed.
Keep the wording measured: the authority must investigate responsibility, maintenance and causation. A well-indexed evidence pack helps it do that without turning an uncertain allegation into an unsupported promise of compensation.
Bottom line for drivers and businesses
For a damaged car, safety, a precise location and proof of actual expenditure matter more than a dramatic description of the road. Send the evidence to the authority responsible for that road, understand that reasonable-steps defences and contractor arrangements can defeat a claim, and keep the originals. For a delay, ordinary authorised roadworks normally do not create a compensation right through National Highways; only a fact-specific case involving improper conduct or another legal basis may be different. Report the hazard separately so it can be made safer for the next road user.
