If road construction, resurfacing or hot bitumen has damaged your trees, soil, drainage, fence, building or other property, first make the area safe, then preserve dated evidence and notify the authority responsible for the road in writing. Ask whether a contractor or utility carried out the work. A report to the road authority and a compensation claim are often separate processes, and payment is not automatic: you generally must show what caused the damage, who was responsible and what loss you suffered.
The correct deadline, claim form, liability test and environmental rules depend on the country, state or province, the road owner and the status of the land. Use the steps below to organize the incident, then follow the current instructions of the responsible authority or obtain local legal advice.

1. Make people and the site safe
Do not enter an active work zone to inspect damage. Keep people, pets and vehicles away from hot tar or bitumen, moving machinery, unstable road edges, fallen or weakened trees, exposed utilities, smoke, spills and areas that may be contaminated. Do not touch an unknown substance or attempt to wash bitumen into a drain or watercourse.
- If there is an immediate threat to life, serious injury or major ongoing property damage, call the emergency service or the road authority’s urgent reporting channel for your location.
- Ask the authority or contractor to make the area safe, stop the source of damage, control traffic, fence off hazards, remove a spill or stabilize a tree.
- Do not cut a damaged tree, remove deposited material or excavate compacted soil unless necessary to prevent immediate harm. Premature cleanup can destroy evidence and may breach tree, conservation, water or contamination rules.
Photograph or video only from a safe place. The Department for Infrastructure in Northern Ireland specifically says photographs of a road defect and incident location should be taken only when it is safe to do so.

2. Build an evidence record before conditions change
Start a dated incident file. Write down the road name, exact location, nearest address or landmark, date and time, weather, what work was occurring and when you first noticed the damage. Record the crew, company name, vehicle registration, project sign or supervisor details if visible without entering the site. Note witnesses and preserve relevant messages, notices or conversations.
Photographs and video
- Take wide images showing the road, work limits, boundary and affected property.
- Take closer images of crushed vegetation, cut roots, broken fencing, bitumen deposits, tire tracks, erosion, blocked drains, cracks and other individual defects.
- Keep original files with their metadata. Make a backup and do not edit the originals.
- Use a ruler, tape measure or familiar object for scale, and photograph the same viewpoint over time if the condition is changing.
Physical items and samples
Keep damaged fencing components, broken fixtures or other items where practical and lawful. Do not collect soil, water or bitumen samples casually; an environmental professional may need to specify safe sampling, storage and laboratory handling. Northern Ireland guidance advises keeping damaged items where possible.
Costs and expert observations
Keep every estimate, invoice, receipt, insurer letter and payment record. Obtain written opinions when the cause or remedy is technical. Depending on the damage, this could be an arborist or forester, structural engineer, surveyor, drainage engineer, geotechnical specialist or environmental consultant. Ask the expert to distinguish construction-related damage from pre-existing defects and to explain the proposed repair and expected cost.

3. Identify the road owner and the party that performed the work
Responsibility is not determined simply by who was operating the machinery. Identify who owns or manages the road and who commissioned the project. Possible parties include a municipal council, state or provincial department, national road authority, utility, private developer or a contractor working for one of them.
| Question | Why it matters | What to request |
|---|---|---|
| Who owns or manages the road? | That body normally controls the incident-reporting and claim channel. | The official reporting address, claim form, deadline and reference number. |
| Who commissioned the work? | The road owner may have hired a contractor or utility whose conduct is assessed separately. | Project name, principal contractor and site supervisor contact. |
| What caused the loss? | Cutting, root injury, soil compaction, fire, tar deposition, drainage alteration and an unrelated third party raise different evidence issues. | An inspection and written explanation of the alleged cause. |
| What outcome do you need? | An urgent hazard report is different from restoration or a money claim. | Containment, cleanup, reinstatement, repair, reimbursement or compensation, stated separately. |
Ask the road authority to confirm whether the work was done by its own staff, a contractor or a utility. Oxfordshire says it may refer a claim to a contractor or utility company when that party caused the problem. A referral is not the same as an admission of liability.
4. Send a prompt written incident report
Use the authority’s official online form, email or postal process and retain a complete copy. A concise report should contain:
- Your name, contact details, property address and proof of ownership or authority to act.
- The road name, precise location and the date and time of the event or discovery.
- A factual chronology of the work and the resulting damage.
- A list of affected assets: trees and vegetation, soil, drains, watercourses, fences, gates, vehicles, buildings or other structures.
- Photographs, a site plan and a list of witnesses or attached expert reports.
- Immediate risks and the action needed now, such as isolation, cleanup, drainage control or tree stabilization.
- A request for an inspection, the responsible contractor’s details and instructions for making a formal claim.
Ask for an acknowledgement and reference number. Do not rely on a telephone conversation alone. If you speak with an inspector, send a short email afterward recording what was said and any promised action.

5. Make a separate compensation claim when appropriate
Reporting a defect or requesting an inspection may not start a compensation claim. Follow the road owner’s claim form, evidence rules and submission method, and keep proof of delivery. List each item of loss separately: emergency protection, cleanup, tree assessment, replacement planting, fence or building repair, professional fees and other directly documented costs. Explain how each amount was calculated and attach estimates or receipts.
An inspection does not necessarily mean the authority accepts responsibility. Northern Ireland states that an inspection undertaken during an investigation does not constitute acceptance of liability. Victoria’s Department of Transport and Planning also uses a distinct incident-and-claim process and says it is not liable for every road incident.
How liability may be assessed
Authorities commonly examine whether the work or omission caused the damage, whether the risk was foreseeable, what maintenance or control measures were reasonable, and whether another party was responsible. Queensland Transport and Main Roads states:
“To receive compensation for damage to your property, you will need to show that we didn’t take reasonable steps to maintain the road network to prevent foreseeable risks of harm.”

That is a Queensland-specific description, not a universal legal test. Queensland also lists damage resulting from a third party among matters it normally does not accept. Victoria identifies limits that can include tar damage, compliance with road-management standards and different treatment where a contractor is involved. Tasmania says roadworks claims may be referred to the responsible contractor. These examples show why the road owner, contract arrangement, cause and local law must be established before predicting an outcome.
Independent reader supportYour contribution helps us test, update, and keep practical guides available for everyone.6. Match the evidence and remedy to the type of damage
Trees and forest
Record species if known, trunk diameter, height, canopy loss, broken limbs, exposed or severed roots, bark wounds, leaning and soil depth changes. An arborist or forester can assess structural stability, remaining viability, root-zone compaction and whether pruning, support, soil remediation, monitoring or removal is justified. Distinguish direct construction damage from a pre-existing hazard or a tree unrelated to the project. If a road authority’s own tree allegedly damaged your property, use that authority’s dedicated tree-reporting route; National Highways provides such a route for its trees in the United Kingdom.
Tar, bitumen and chemical deposits
Do not scrape hot material from bark, roofs, vehicles or paving unless a qualified contractor says the method is safe. Photograph the material before removal, identify where it flowed and protect drains and waterways. Request the product or safety information from the contractor. A specialist can determine whether contaminated soil, plants or porous surfaces require removal and how waste must be handled.
Drainage, erosion and soil compaction
Map blocked culverts, altered flow paths, standing water, ruts, sediment deposits and washouts after rainfall. A drainage or geotechnical professional may need levels, soil testing and a survey to separate construction effects from ordinary storm damage. Ask for temporary diversion or erosion control while the cause is investigated.

Fences, buildings and other structures
Photograph foundations, cracks, gates, walls and utility connections before emergency repairs. Obtain a condition report and itemized estimate. Keep replaced components where safe, and tell the authority before destructive testing or demolition so it can inspect the original condition.
7. Check environmental, tree and land-status rules
Before clearing, cutting, burning, moving soil or undertaking major remedial work, check whether the land includes protected forest, conservation habitat, a protected tree, wetland or watercourse, and whether contamination controls apply. Contact the relevant environmental, forestry or planning authority if you are unsure.
South African road specifications illustrate the distinction between contract requirements and a universal legal remedy: they require contractors to comply with applicable environmental requirements outside the road reserve and address reinstatement or compensation for property used or damaged. Those specifications do not establish rights everywhere. Your local rules may require permits, ecological surveys, notification of a conservation body or specialist handling of contaminated material.

8. If the authority or contractor rejects or ignores the matter
- Request the decision and reasons in writing, including the evidence relied on.
- Use the authority’s internal complaint review or reconsideration route and provide any missing causation or cost evidence.
- Notify your insurer if the policy requires prompt notice. Do not accept a settlement or sign a release without understanding what losses it covers.
- Check an ombudsman, public-sector complaints body, legal-aid service or local solicitor for the correct jurisdiction.
- Confirm the civil claim limitation period immediately. It can differ for property damage, environmental harm, injury, government defendants and claims involving minors or unknown damage.
Queensland says an unsuccessful departmental claim cannot be appealed through that departmental process, although court action may remain available. That statement applies to Queensland only; another jurisdiction may provide a different review or tribunal route.
Quick Recap
9. A practical incident checklist
- Make the site safe and report any immediate danger.
- Record the date, time, location, weather, work activity and responsible parties.
- Take safe, dated wide and close photographs; preserve originals and damaged items.
- Notify the road owner in writing and obtain a reference number.
- Ask whether a contractor or utility caused the work and request its contact details.
- Obtain appropriate arboricultural, structural, drainage, geotechnical or environmental advice.
- Keep estimates, invoices, receipts, insurance correspondence and proof of ownership.
- Submit the formal claim separately, following the local form and deadline.
- Obtain permission or advice before removing trees, soil, tar or contaminated material.
- Escalate through the local review, ombudsman or legal route if the matter remains unresolved.
What you should not assume
- That the nearest council owns the road; a state, national, utility or private developer may be responsible.
- That the crew’s presence proves the crew caused the loss.
- That an inspection, contractor referral or incident number means liability has been accepted.
- That a tree is safe to remove or that bitumen can be washed away without specialist advice.
- That a claim deadline is the same as the deadline for reporting a hazard.
- That guidance from Queensland, Victoria, Northern Ireland, Oxfordshire, South Africa or another jurisdiction applies where you live.
