What to do if construction traffic damages your property

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

If construction vehicles or roadworks appear to have damaged your house, act quickly but do not assume that the nearest council or contractor is automatically liable. First make the area safe, then create a dated record, notify the project and road authority, tell your insurer, and find out which claim route and deadline apply where you live. Compensation depends on the type of loss, the responsible party, proof of causation and local law.

1. Check for immediate danger

Move away from any area showing rapidly widening cracks, falling masonry, significant distortion, flooding, exposed services or another immediate hazard. Keep children and others out of the affected space. Call emergency services or the relevant building-safety authority if there is an urgent threat. Do not try to decide from photographs whether a building is structurally safe; arrange an inspection by an appropriately qualified professional when the condition is serious, changing or worrying.

Prevent further loss only where it is safe and reasonable. For example, isolate a leaking service, cover an opening or move belongings from a wet area. Keep receipts and photograph the condition before and after temporary measures. Do not carry out permanent repairs or discard damaged materials before the damage has been documented and, where appropriate, inspected.

2. Preserve a clear record from the first day

Evidence should show what changed, when it changed and what construction activity was taking place. Create a simple timeline in a notebook or digital file. Record when heavy vehicles, piling, excavation, road closures or other works began; when you first noticed a symptom; the location and size of each crack or defect; vibration, dust, mud, water or access problems; and every later change.

Take wide photographs that identify the room, elevation or boundary, followed by close views of each defect. Include a ruler, tape measure or another scale where useful, and keep the original files with their dates and metadata. Video can capture vibration, falling material, recurring flooding or vehicle movements. Photograph undamaged adjoining areas for comparison. Save pre-work photographs, inventories, surveys, mortgage or purchase condition reports and any pre-construction condition survey you received.

Keep copies of contractor notices, traffic-management plans, letter drops, emails, text messages, complaint references, diaries of vehicle movements and names of people you spoke to. Retain repair estimates, invoices, receipts, engineer or surveyor reports and records of temporary accommodation or other directly related expenditure. Northern Ireland’s official claim guidance asks for photographs and repair receipts or estimates, while Oxfordshire County Council says a claim may require a structural report and relevant monitoring information (nidirect guidance; Oxfordshire County Council guidance).

Using a crack monitor

A crack gauge or tell-tale can record whether a crack is moving and by how much over time. It cannot prove that construction caused the crack, calculate your repair bill or establish that the building is safe. Photograph the gauge at consistent intervals and give the readings to a qualified professional. Do not delay an inspection because a gauge appears unchanged.

3. Notify every potentially relevant party

Send a concise written report to the project’s public-enquiry or site contact, the project owner or commissioning body, and the highway or local authority responsible for the road. State the property address, location of the damage, dates, photographs available and the construction activity you believe may be connected. Describe the suspected connection as an allegation, not an established fact. Ask for an incident reference, the organisation handling property-damage claims, the claim form and the applicable response timetable.

The party running the work may be a principal contractor, subcontractor, utility, developer or public body. Ownership of the road does not by itself identify the liable party. An authority may refer a claim to its contractor or insurer and provide that organisation’s contact details. For example, Salford City Council’s claim information explains how it handles reports of damage or loss and may direct matters to the appropriate party.

Notify your property insurer promptly, even if you intend to pursue the project or authority. Follow the policy’s notification, mitigation and consent-to-repair requirements. Ask whether an excess applies, whether an adjuster will inspect, and whether the insurer may seek recovery from another party. Northern Ireland’s process asks for insurer details when a claimant is claiming under insurance for the same incident (nidirect). Do not settle with a contractor or sign a release before understanding how it affects your policy and other claims.

4. Separate damage from proof of causation

Showing a crack or broken item is only the damage part of a claim. You generally also need evidence linking it to the alleged construction activity and evidence of your financial loss. Older movement, settlement, tree roots, plumbing leaks, weather, poor maintenance, nearby excavation or road defects may provide alternative explanations. Heavy traffic can be relevant without being the only possible cause.

For significant, progressive or disputed damage, engage a structural engineer, building surveyor or other professional whose qualifications fit the problem. Ask the project’s claim handler what reports are needed before commissioning expensive specialist work. A useful report should identify the observed defects, likely mechanisms, timing, relevant construction operations, any necessary monitoring and reasonable remedial options. It should distinguish observation from opinion and say what remains uncertain.

Queensland’s transport department provides a jurisdiction-specific example of a claim test requiring a claimant to show causation, loss and failure by the department to take reasonable steps (Queensland Department of Transport and Main Roads, updated 26 February 2025). That test is not a universal rule, but it illustrates why photographs alone may not establish liability.

5. Identify the type of loss before choosing a route

“Construction traffic damage” can describe legally different problems. Classifying the harm helps you ask the right organisation for the right remedy.

Problem Typical evidence Possible route
Physical damage during construction Dated photos, pre-work condition records, timeline, structural or engineering opinion, estimates and invoices Project owner, contractor, authority or their insurer; court if liability remains disputed
Damage attributed to a road defect or ordinary road use Exact location, defect reports, warning or inspection history, photographs, repair evidence and causation material Highway or local-authority claim process, insurer or other responsible road operator
Temporary loss of access, nuisance or interference Dates and duration, notices, access restrictions, extra costs and communications Project complaint or contractual/statutory process; legal advice may be needed for private rights
Reduced property value after a new or altered public road Valuation evidence and proof of qualifying physical factors from use of the road A location-specific statutory compensation route, not simply a repair claim

The last category is distinct from the cost of repairing a construction-period crack. In England, GOV.UK explains a Part I route for certain depreciation caused by pollution or disturbance from the use of a new or altered road. Its overview says a claim may be made after the road has been open to traffic for one year (GOV.UK overview). The detailed compensation guidance is at GOV.UK’s guide for residential owners and occupiers. Eligibility is fact-specific and does not turn every crack, vibration complaint or temporary loss into a Part I claim. Related principles are discussed in the Land Compensation Manual practice note.

6. Jurisdiction examples and what they do—and do not—tell you

England

There is no single general payment rule for every property complaint involving roadworks. Government guidance distinguishes statutory compensation for particular public works and property-value effects from ordinary negligence, nuisance, highway or insurance disputes. Check which organisation commissioned the work and obtain advice on the facts, legal basis and limitation period.

The Local Government and Social Care Ombudsman does not decide private property-damage liability. In its decision about Salford City Council dated 28 September 2025, it stated: “Only an insurer or the courts can determine questions of legal liability for property damage.” That statement explains the Ombudsman’s role in that English case; it is not universal legal advice. The decision is available at 25 005 722 – Salford City Council. A separate Ombudsman decision, 22 015 777, illustrates why an administrative complaint and a damages claim may follow different paths.

Northern Ireland

nidirect provides a route to claim from the Department for Infrastructure for property damage attributed to a road or street problem. Its instructions request supporting material such as photographs and repair receipts or estimates and state that there is no automatic entitlement. Follow the current form and requirements at nidirect. A claim concerning a construction contractor or utility may need to be directed to that organisation instead.

Queensland

The Queensland Department of Transport and Main Roads accepts claims involving infrastructure or works it manages and describes its own test concerning reasonable steps, causation and loss. Use its process only for matters within that department’s responsibility; it should not be generalised to other Australian states, councils or countries. The current information is at Make a claim for property damage.

Elsewhere

For any other location, identify the local highway authority and project owner, ask who administers property claims, check your insurance policy and obtain local advice on liability and limitation periods. The rules in England, Northern Ireland and Queensland cannot be combined into a worldwide compensation standard.

7. Assemble a claim file that another person can understand

Arrange your documents chronologically and label photographs by date and location. Include:

  • a one-page incident summary and contact list;
  • the construction and symptom timeline;
  • pre-work and current-condition photographs or surveys;
  • copies of notices, traffic plans, complaints and reference numbers;
  • structural, engineering, survey or monitoring reports;
  • itemised estimates, invoices and receipts;
  • insurance correspondence and policy instructions; and
  • a schedule separating completed costs, estimated costs and any continuing loss.

Send copies, not irreplaceable originals, and keep a log of when each document was supplied. Ask for written confirmation of what the handler has received and whether further information is required. If an inspection is arranged, attend if possible, take notes and correct factual errors promptly in writing.

8. If the claim is rejected, delayed or redirected

Request the decision and reasons in writing. Ask which factual evidence is missing, whether responsibility has been transferred to a contractor or insurer, and what review or complaint procedure applies. Keep communicating while checking any court or statutory deadline independently; a complaint process may not stop a limitation period.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Where the issue is administrative—such as failure to answer, mishandling of a report or poor communication—an ombudsman or formal council complaint may be available. That route may investigate administration but may not determine private legal liability or award the full repair cost. Where liability, causation or limitation is contested, obtain prompt advice from a lawyer or other qualified adviser in the relevant jurisdiction.

Common mistakes that weaken a property-damage claim

  • Waiting months to photograph the original condition.
  • Describing causation as proven before an inspection.
  • Repairing or disposing of damaged material without preserving evidence.
  • Assuming the road owner, rather than the project contractor or utility, must pay.
  • Paying for an expensive report without asking what the claim handler requires.
  • Ignoring insurer notification terms or signing a settlement release too early.
  • Treating a crack gauge as a structural diagnosis or proof of liability.
  • Relying on a general internet deadline instead of checking the specific route and location.

A prompt, neutral record gives the authority, contractor, insurer or court the best chance of testing what happened. It also protects you if the damage changes or if responsibility moves between organisations.
