What to Do if a Road Project Blocks Your Property Access

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Contact the project engineer or road agency as soon as access is restricted. Describe exactly which entrance is blocked, when the problem began, and whether residents, customers, deliveries, mobility devices, farm equipment or emergency vehicles can still get through. Ask for a safe temporary route, the expected closure period, and a written restoration date. Keep a dated record of every notice, conversation, photograph and effect on the property. If the agency proposes to close or relocate the access permanently, request the written decision and review deadline; obtain advice from a lawyer licensed where the property is located if the issue remains unresolved.

This is a U.S.-oriented practical guide, not a ruling on whether a particular closure is lawful. Access rights, notice, permits, appeals and compensation depend on state and local law, the road authority, project documents and recorded easements or other access rights. Start by identifying the agency responsible for the road and the project-specific contact shown on posted notices, the project webpage or municipal and county public-works information.

What to do in the first 24 hours

  1. Identify the project and decision-maker. Write down the project name, road, limits, contractor, project engineer and public-information contact. Ask whether the restriction is scheduled construction, an emergency measure or a permanent access decision; what work is causing it; which entrance is affected; and whether another entrance is officially open.
  2. Describe the access problem in operational terms. State the property address and entrance, the date and time access was lost, the vehicles or people who must reach it, and any safety or accessibility consequence. Say explicitly if an ambulance, fire apparatus, caregiver, wheelchair user, school transport, commercial truck, customer or delivery vehicle cannot use the remaining route.
  3. Request a workable temporary arrangement. Ask whether the crew can keep one entrance open, stage work in sections, provide a temporary driveway or ramp, sign an alternate route, or limit the closure to defined work hours. Explain turning-radius, grade, load, surface and accessibility needs rather than simply asking for “access.”
  4. Get dates and commitments in writing. Request the planned start and end of the restriction, daily access windows, route instructions, the condition in which the entrance will be restored, and the name and phone number for urgent changes. Save the reply, maps and notices.
  5. Start a contemporaneous log. Record each closure and reopening, missed delivery, additional travel, unsafe condition, repair, photograph and communication. Note who said what and when. A short factual log is more useful than relying on memory if the restriction continues or becomes a property-rights dispute.

How to request temporary access that actually works

Access is not just a gap wide enough for a passenger car. Match the proposed route to the property’s real use and ask the agency to confirm those requirements in its traffic-control plan or daily instructions.

Property need Questions to put to the project team
Residents and visitors Can ordinary cars enter and leave at all times, or only during stated windows? Is the route signed and lit after dark?
Mobility and accessibility Is the surface stable, reasonably level and wide enough for mobility devices? Is there a safe pedestrian path rather than a route through active equipment?
Deliveries and commercial vehicles What vehicle length, width, weight and turning movement can the temporary route handle? Where should drivers wait if the route is closed during a work window?
Farm, utility or service equipment Can the route support the equipment’s axle loads and width, and can gates, overhead clearances or drainage structures be used safely?
Emergency response Has the fire, ambulance or other emergency route been checked with the responsible local service? What number should be called if the promised route is blocked?
Customers and appointments Will signs direct visitors from the open approach, and can the agency provide advance notice when the route changes?

Agency guidance shows that temporary access can be a planned construction measure, but it is not a guaranteed remedy everywhere. Connecticut DOT’s Construction Manual, Version 3.1 (January 2020), tells project personnel to meet affected businesses before work explains the work, duration and access plan. Its Business Access section states: In all cases, access is maintained to all business properties. That is Connecticut agency guidance, not a nationwide legal rule.

Wisconsin project specifications likewise address temporary access, emergency access and notice. One Wisconsin Department of Transportation project proposal issued in 2025 required at least 48 hours’ notice before restricting or closing property access and called for maintaining local access where no alternate access exists. That 48-hour term belongs to that particular project proposal; it is not a general deadline for every road project. Ask for the applicable contract clause, traffic-control plan and local rule instead of assuming a universal notice period.

Notice, closure authority and what you should ask for

There is no single U.S. notice period for driveway or business-access closures. A state highway project, county resurfacing job, municipal utility excavation and emergency repair may operate under different statutes, permits, contracts and emergency powers. Ask the agency to identify the document authorizing the restriction and the rule or contract provision that governs notice.

  • Request the project traffic-control plan or the portion showing your entrance and any detour.
  • Ask whether the restriction is full-time, limited to a work window, or expected to change day by day.
  • Ask how residents, deliveries, accessible users and emergency responders are supposed to enter while the work is active.
  • Ask what condition must be met before the original entrance is reopened and who verifies restoration.
  • Request an escalation contact if the field crew’s conditions differ from the written plan.

If a closure was made without the notice you expected, do not assume that proves it is illegal or that you have waived your rights. Record the facts, ask for the authority and seek local legal advice if the agency cannot explain the restriction or if the effect is substantial.

Escalate a continuing, unsafe or unusable blockage

Begin with the project engineer or agency contact. If that person does not respond, send the same factual description to the construction office, project manager and the public-works or road authority responsible for the road. Include photographs, dates and the specific remedy requested. Ask for a written response and a time by which the route will be made safe.

For an immediate threat to life or safety, use local emergency services. Tell the dispatcher that construction has blocked the normal approach and give the exact alternate route, gate or entrance that responders can use, if any. Do not enter an active work zone or move barricades yourself; request direction from the agency or emergency personnel.

Escalation is more effective when it distinguishes a missing convenience from a failed safety measure. “Customers are inconvenienced” and “a delivery truck cannot turn without backing into live traffic” require different responses. State whether the proposed route is physically impossible, unsafe, inaccessible or simply slower, and identify the vehicle or user affected.

When the project may permanently change your access

Ask a direct question: is the agency only restricting the approach during construction, or is it deciding to close, relocate or modify the property’s highway approach? A permanent approach decision can involve access-management rules, driveway permits, right-of-way interests, easements and administrative review that are different from a temporary work-zone closure.

  1. Request the written decision, project plan, maps and the authority relied upon.
  2. Ask whether the decision is final, the date it becomes effective and the deadline for review or appeal.
  3. Ask which forum handles a challenge: an agency discussion, dispute board, administrative hearing or court proceeding.
  4. Collect the deed, recorded easements, access agreements, prior permits, surveys and photographs showing historic use.
  5. Have a locally licensed property, land-use or eminent-domain attorney evaluate the documents before an appeal or settlement deadline expires.

Oregon Department of Transportation guidance, in the process it describes for covered approach decisions, says: A final decision to close, modify or relocate an approach must be sent in a notice letter that provides the property owner the option to appeal the decision through a Collaborative Discussion, and/or Dispute Review Board and/or Hearing at the Office of Administrative Hearings. That language describes Oregon’s stated process; it should not be treated as an appeal route in another state.

Indiana provides another example of why the type of action matters. Indiana Department of Transportation says a driveway permit is necessary to connect private property to an INDOT-controlled roadway and sets out distinct categories with estimated review periods. That requirement concerns connections to Indiana state roads; it does not decide whether a construction crew elsewhere may temporarily close an entrance.

Caltrans’ Right of Way Manual includes example clauses for temporary access and temporary interests used in highway construction. The practical lesson is to read the project’s right-of-way documents: a temporary construction interest, an easement and a permanent approach permit can create different obligations and remedies.

Compensation: do not assume lost revenue is reimbursable

Keep records of additional hauling, cancelled appointments, spoiled materials, repair costs and other measurable effects, but do not promise yourself reimbursement before checking the governing law and documents. A temporary inconvenience, interference with a recorded access right, physical damage and a taking can be treated differently.

Alaska DOT&PF’s business information page states: DOT&PF does not compensate businesses for lost revenues. That is an Alaska agency statement about its position and does not establish the rule in another jurisdiction, determine whether a property right was taken, or answer every kind of property-loss claim. If the access impairment is permanent, unusually long, physically damaging or materially affects the property’s use, consult a lawyer licensed in that state. Bring the project notices, photographs, logs, financial records and title documents to the consultation.

How to compare a proposed route with alternatives

When an agency offers more than one temporary arrangement, compare the proposals against the property’s actual operations rather than choosing the shortest map distance.

Decision factor What to verify
Safety and accessibility Can every required user travel the route without entering the work zone, crossing unsafe traffic or losing an accessible path?
Duration and predictability Are start, end, daily hours and the restoration milestone stated in writing, with notice of changes?
Practical capacity Can the route handle emergency vehicles, deliveries, farm equipment, customers and waste or utility service as applicable?
Authority and recourse Is the arrangement reflected in the project plan or contract, and is there a named person to resolve a failure?
Temporary or permanent effect Will the existing approach be restored, or does the proposal alter the property’s access permanently?

A concise written request you can send

Use the project’s stated contact method and keep a copy of your message:

“I am the owner/occupier of [property address]. The entrance at [location] has been restricted since [date/time] by [project or road]. The restriction prevents [specific users, vehicles or emergency access] from reaching the property. Please confirm the work causing the restriction, the applicable traffic-control or access plan, the safe temporary route and any access hours, the expected reopening date, and the standard for restoring the entrance. Please also provide the name and phone number for urgent changes and advise whether this is a temporary construction restriction or a proposed permanent approach decision. I have attached dated photographs and will keep a log of conditions.”

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Replace the bracketed text with facts, not conclusions about legality. If you need an accessible route, emergency access or a route for a particular truck or machine, state its dimensions or operating requirement.

When professional legal advice is warranted

  • The agency says the entrance will be closed, relocated or modified permanently.
  • You have a recorded easement, access agreement or other document the project appears to impair.
  • The closure prevents the property’s ordinary use for a substantial period or causes significant physical or financial loss.
  • You received a formal notice with an appeal, hearing or response deadline.
  • The agency and contractor give conflicting instructions, refuse to identify the authority for the closure, or fail to provide a safe route.

Choose counsel licensed in the property’s jurisdiction and experienced with property, land-use or eminent-domain matters. Bring the project plans and notices, your title and easement documents, photographs, correspondence, access log and a clear chronology. Local advice is necessary because this broad guidance cannot determine the legality of a specific closure, the deadline that applies or whether compensation is available.
