What to Do if a Construction-Zone Pothole Damages Your Car

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Move to safety, stop driving if the tire, wheel or suspension may be damaged, and document the scene before the work zone changes. Record the exact location and time, photograph the pothole, warning signs and your vehicle, collect witness and contractor details, notify your insurer, and identify the agency or contractor that controls the road. Whether anyone else reimburses you depends on the road owner, proof that the condition was dangerous, notice and repair time, your policy, deadlines and any statutory cap.

This is U.S.-focused general information, not legal advice. Government liability rules, sovereign-immunity exceptions, notice periods, caps and contractor duties vary by the state and local road owner where the impact occurred.

1. Make the scene safe before investigating the damage

Leave the travel lane

Turn on your hazard lights and move to a shoulder, breakdown area or other protected location if the car can be driven safely. In a live construction zone, do not stand in a lane or walk into traffic to take a picture. If the vehicle will not steer, brake or accelerate normally, call 911 for an immediate hazard or roadside assistance for a tow.

Do not continue on a visibly damaged tire or wheel

A pothole can bend a wheel, cut a tire sidewall, damage a tire’s internal cords, or disturb steering, suspension and alignment. Stop driving if you see a flat or bulge, hear scraping or repeated thumping, feel strong vibration or pulling, or cannot keep the steering wheel centered. Driving farther can turn a repairable tire or wheel claim into additional mechanical damage and creates a safety risk.

Check only what can be checked safely

From a protected position, look for an obviously deflated tire, a cracked or visibly bent rim, fluid leaks, loose body parts and warning lights. A portable 12V inflator can restore pressure after a minor loss, and a digital gauge can verify pressure, but neither tool can detect structural tire damage, a bent wheel or compromised suspension. Treat an impact-related warning light or abnormal handling as a reason for professional inspection, not as a problem an inflator can solve.

2. Preserve evidence before the pothole or work zone changes

Road crews may fill the hole, move barriers or change traffic control soon after the incident. Document from a safe place as soon as practical, then arrange the inspection and repair.

Record the location precisely

  • Date and exact time of impact.
  • Highway or street name, direction of travel, lane, nearest exit, intersection, mile marker or construction-project reference.
  • Which lane feature caused the impact: pothole, uneven pavement, missing plate, trench edge, construction barrel or debris.
  • Weather, lighting and traffic conditions.

Photograph the roadway and warnings

Take wide images that show the pothole in relation to lane lines, signs, barriers and fixed landmarks, followed by close images showing depth, width and edge damage. Photograph every warning sign, cone, barrel or absent warning that a driver would have encountered. Do not enter the roadway for a better angle. If you have a dash-camera clip, preserve the original file rather than only a compressed social-media copy; a dash camera is prospective documentation, not a guarantee that a claim will succeed.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Photograph and preserve the vehicle condition

Capture all four sides of the vehicle, the damaged tire and wheel, the odometer, dashboard warning lights and any underbody or suspension damage visible without removing parts. Keep the damaged tire or wheel until the insurer or an adjuster has had a reasonable opportunity to inspect it. Ask the repair shop to photograph hidden damage discovered during disassembly.

Collect people and project identifiers

  • Names and contact details of witnesses, plus a short description of what each person observed.
  • Police, highway-patrol or incident-report number if an officer attended.
  • Contractor name, project sign, company vehicle, truck or equipment number and any posted project telephone number.
  • Names of the road agency, construction manager or traffic-control company shown on signs, if available.

Caltrans states that a claimant must provide “clear proof, such as time, location, and photos, of the dangerous condition of the roadway.” That standard illustrates why a precise scene record matters even when another driver or a contractor witnessed the impact.

3. Identify who controls the road and the work zone

The same pothole can produce different claim paths depending on ownership and whether construction is active. Start with the incident location, not the company name on a nearby truck.

State highway

State transportation departments generally handle state-numbered highways, but a city or county may control a frontage road, ramp or parallel street. Look for route shields, mileposts and project signs, then confirm the owner through the relevant transportation department’s claim or maintenance office.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

County or city road

Use the county highway department, public works department or city transportation office for a locally owned road. A state police report may identify the route but does not necessarily establish which public entity is legally responsible. Submit the incident to the owner that maintains the pavement and ask where its property-damage claim form belongs.

Active construction contract

Construction signs often identify a project owner and the prime contractor. North Carolina DOT says: “If a vehicle was damaged in a work zone for a contracted project, NCDOT will forward the driver’s claim to the contractor, who is responsible for the road conditions in the construction area.” Provide the agency with the project and contractor details even if you also notify your insurer.

Ordinary maintenance pothole

If no construction project was active, the road agency may evaluate whether it knew, or should have known, about the defect and had enough time to repair it. A report made after your impact can help the agency locate the defect, but it does not by itself prove prior notice.

4. Notify your insurer promptly

What collision coverage usually does

Collision coverage generally pays for damage from hitting a pothole, subject to the deductible and the policy’s terms. The Insurance Information Institute says potholes most often damage wheels and tires but can also affect steering, suspension and alignment. The Institute reported that 73 percent of insured U.S. drivers had collision coverage in 2015, the most recent NAIC year identified in that article; do not assume your policy includes it today.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Ask about related benefits

When you report the loss, ask whether the policy includes towing, roadside assistance, rental reimbursement and inspection of hidden suspension or alignment damage. Give the adjuster the scene photographs, location, police or incident number, repair estimate and invoices. Do not authorize extensive teardown or discard a damaged part before the insurer explains its inspection requirements, unless safety requires immediate work.

Compare the repair bill with the deductible

If the verified repair is less than or only slightly above the deductible, paying the shop directly may be financially simpler. If damage is substantial, a collision claim can provide a faster and more predictable payment route, but the deductible remains your responsibility initially. Ask how a paid claim could affect renewal or claim history in your state and policy before choosing.

5. Decide whether to pursue the road agency or contractor

An agency or contractor claim is not an automatic substitute for insurance. Public entities often have statutory immunity with narrow exceptions, strict notice rules, proof requirements and payment caps. Contractors may have contractual duties, but the agency may still be the required intake point.

Proof and notice requirements

Caltrans explains that it does not pay every vehicle-damage claim and that drivers must carry adequate insurance. Its legal standard requires proof that the state highway was dangerous, Caltrans knew or should have known about the condition, and Caltrans had sufficient time to fix it before the damage. Your photographs should therefore show not only the hole but also its relationship to traffic control and visibility; maintenance logs, prior reports or a long-standing defect may be relevant if the agency requests them.

Agency practices differ

Wisconsin DOT states: “If your car is damaged due to a pothole, hitting a construction barrel or debris in the road, the state or county is not liable for your damage.” That agency directs drivers to contact their insurer for the situations described on its page. Ohio DOT asks motorists to submit an incident report so it can identify the appropriate claim contact. These examples are not nationwide rules; they show why you must read the procedure for the road where your impact happened.

Construction contractor responsibility

For an active contracted project, send the agency’s claim office the project number and contractor information and ask whether it forwards claims. Also preserve evidence of inadequate plating, an unmarked edge, displaced barrels or a hole created by the project. Do not accuse a worker or sign a release at the scene; describe observable conditions and let the designated claims process determine responsibility.

6. Deadlines and caps can decide the outcome

Find the controlling deadline immediately after the incident. Calling an agency does not necessarily satisfy a written-notice statute, and an insurer’s claim file does not necessarily count as notice to a government defendant.

Jurisdiction or route Published requirement or figure How to use it
Rhode Island Department of Transportation pothole claim Claim must be received within seven days; reimbursement is capped at $300. Submit the agency’s required information so it is received within seven days, and do not assume costs above $300 will be paid.
Connecticut state-highway defective-condition procedure cited by its Department of Transportation FAQ 90-day written-notice period. Send the specified written notice to the required recipient within 90 days; verify whether another statute or route applies.
Other states and local agencies Rules vary; a deadline or cap is not established here. Use the incident location to obtain the current claim form, notice address, filing period and maximum recovery.

Keep proof of delivery, such as a dated online confirmation, certified-mail receipt or agency acknowledgment. A late submission can defeat an otherwise well-documented claim.

7. File an organized claim

  1. Open the insurance claim. Provide the policy number, impact date and time, exact location, symptoms, photographs, tow information and shop contact.
  2. Obtain a written diagnosis. Ask the shop to separate tire, wheel, alignment, steering, suspension, underbody and cosmetic items, and to identify which damage is consistent with the impact.
  3. Find the road owner’s form. Use the state, county or city identified from the route and project signs. Ask whether construction claims go to the agency, prime contractor or both.
  4. Attach evidence in a readable package. Include a short chronology, a location map or marked photo, original images, witness contacts, estimates, invoices, tow receipt, registration and proof of insurance if requested.
  5. Describe facts, not conclusions. State what you saw, where the vehicle was, what warning devices were present, how the car behaved and when the damage was found. Avoid guessing how long the pothole existed.
  6. Track every communication. Record the date, person, department, claim number, requested documents and promised response date.
  7. Protect your deadlines while negotiating. A request for more information or an insurer’s adjustment does not automatically extend a statutory notice period.

8. When a claim is denied or payment is too low

Ask for the reason in writing

Request the specific policy exclusion, lack-of-notice finding, immunity provision, missing document or causation issue. Compare the explanation with your photographs, repair diagnosis and the agency’s published procedure.

Correct factual errors

If the file lists the wrong lane, route, date, vehicle or road owner, send a concise correction with supporting records. Ask the shop to explain disputed alignment or suspension findings in writing rather than relying on a verbal opinion.

Escalate in the proper order

  • Use the insurer’s supervisor, appraisal or internal appeal process if the policy provides one.
  • Ask the government claims office for reconsideration or the correct statutory notice channel.
  • Contact your state insurance department for insurance-regulation questions, not for a decision on a government agency’s legal liability.
  • Consult a local attorney promptly when injuries, major repair costs, a disputed deadline, sovereign immunity or a contractor-release document is involved.

Do not sign a broad settlement or release covering unknown damage until the vehicle has been inspected and the claim’s scope is clear.

9. A practical route-selection guide

Situation Most useful first route Evidence or issue that controls the next decision
Minor tire or wheel damage; collision coverage and a deductible apply Get a written estimate and notify the insurer before authorizing work. Repair cost compared with deductible; hidden damage inspection.
Severe damage or unsafe vehicle Tow, preserve the parts and open the insurance claim immediately. Safety, coverage for towing or rental, and complete diagnosis.
Active work zone with contractor signs Notify the road agency and identify the prime contractor while filing with insurance. Project number, traffic-control condition and whether the agency forwards claims.
State highway with an established pothole Check the state claim procedure and notice rule. Proof of dangerous condition, agency notice or constructive notice, repair time, deadline and cap.
City or county road Contact the maintaining public-works or transportation office. Correct owner, local form, local immunity exception and filing period.
Road agency says it is not liable Read the written reason and preserve your insurance option. Published exclusion, statutory immunity, missing notice or insufficient proof.

10. What to keep in your records

  • Original photographs and video with metadata intact.
  • Dash-camera file, if available, plus a note explaining the camera’s date and time settings.
  • Incident, police and claim numbers.
  • Tow, rental, repair, alignment and parts invoices.
  • Written estimates, diagnostic reports and photographs from the shop.
  • Every letter, email, online submission receipt and telephone note.
  • A calendar reminder for each agency, insurer or statutory deadline.

After the vehicle is repaired, keep the final invoice and alignment results. They establish what was actually replaced and can help resolve a later dispute about whether additional damage came from the pothole or from continued driving.

11. The key distinction: insurance payment versus legal liability

Collision insurance is a contract between you and your insurer; it may pay covered impact damage without proving that a public entity or contractor was negligent, subject to your deductible and policy terms. A road-agency or contractor claim asks a separate question: whether the responsible party can legally be required to reimburse you under the applicable state or local rule. A successful insurance payment does not automatically establish government liability, and a denied agency claim does not necessarily mean your collision coverage is unavailable. Treat the two processes as separate, meet both sets of deadlines and provide consistent facts in each.
