What to Check Before Buying or Renovating a Georgian Property

Before you pay a deposit or start design work on property in Georgia, verify four things in this order: the registered owner and transaction documents, the parcel’s land category and restrictions, the approvals required for your proposed work, and any cultural-heritage designation. Then have the building and site checked by appropriate technical professionals. A listing, seller’s statement or old plan cannot establish title, development rights or structural safety on its own.

What should I check before buying property in Georgia?

“Georgia” here means the country. The legal and technical checks below are a framework for a particular apartment, house, commercial building or plot; they are not a substitute for a Georgian lawyer, the responsible municipality or an independent inspection. Rules and records can change, and the answer for one parcel may differ from the answer for a neighboring parcel.

Use this sequence before signing an unconditional contract:

  1. Identify the exact property. Obtain the cadastral reference, address, floor and unit details (where relevant), site plan and the seller’s identification. Make sure the physical property you are viewing is the same property described in the documents.
  2. Check the Public Registry record. Confirm the registered owner, the recorded area and boundaries, and any mortgages, seizures, easements, leases or other encumbrances shown in the current extract. Ask a Georgian lawyer to explain entries you do not understand.
  3. Confirm the contract and registration route. Georgian real-estate acquisition is described as a written transaction followed by registration of ownership in the Public Registry. Your lawyer should check that the seller has authority to sign, that the contract identifies the correct parcel or unit, and that payment and registration conditions are clear.
  4. Establish the land category. Do not infer eligibility from the fact that a building is residential or commercial. Agricultural land can be subject to special rules, including rules that affect foreign purchasers. Confirm the classification and any current restrictions for the specific cadastral parcel before committing funds.
  5. Match existing construction to approved documents. Ask which plans, notices or permits were issued for the building and for later additions. Compare the approved drawings with what exists on site, including enclosed balconies, extensions, extra floors, retaining walls and changes to structural elements.
  6. Define your intended work. List demolition, layout changes, façade work, roof work, new openings, extensions, changes of use and new utility connections. Give that scope and the address to the responsible municipality and ask which notice or permit route applies.
  7. Screen for heritage controls. Establish whether the property is designated cultural property or lies within a protection regime. Identify the competent authority before you budget, design or begin treatment of the building.
  8. Commission independent technical checks. A surveyor, structural engineer, geotechnical professional or building-services specialist may be needed depending on the site and project. Legal registration does not prove that a building is sound or that its services are safe.

Ownership, registration and the sale contract

Read the current Public Registry record

The registry record is the starting point for title due diligence. Request a current extract rather than relying on a scan supplied months earlier. Check the owner’s name and identity details, the cadastral number, the registered area, the unit designation and the nature of the registered right. If there are multiple owners, all required signatures or powers of attorney must be addressed.

Review every recorded burden. A mortgage, court seizure, lease, easement or other restriction can affect possession, financing, access or your ability to alter the property. Ask your lawyer what must be discharged, assigned or expressly accepted before completion. A clean-looking advertisement is not evidence that the registry is clear.

Make the written transaction match the property

The legal orientation available for Georgia describes acquisition as a written transaction followed by registration of ownership in the Public Registry. Treat both parts as essential: a signed agreement alone is not the same as a completed registered transfer. The contract should identify the exact cadastral parcel or unit, the agreed price and currency, deposit and refund conditions, completion date, responsibility for taxes and fees, and the documents the seller must provide.

Have a lawyer check signatures, marital or corporate authority where relevant, powers of attorney, translations and the process for releasing an existing mortgage. Do not make a large, non-refundable payment merely because a seller promises to “register later.” Your lawyer can set conditions so that registration, discharge of encumbrances and handover occur in a controlled sequence.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Check boundaries and what is actually included

For a house or plot, compare the cadastral map and registered area with a site walk. Fences, driveways, sheds, terraces and retaining structures may sit outside the registered boundary or on land used by someone else. For an apartment, confirm the unit number, floor, storage room, parking space and any common-area rights in the title and building documents. If the physical footprint and registry plan do not agree, pause the transaction until a survey and legal explanation resolve the discrepancy.

Can a foreigner buy property in Georgia?

Secondary legal guidance dated 11 February 2025 says foreign buyers may buy residential and commercial property on terms similar to Georgian citizens, while agricultural land is an exception. That is a useful starting question, not a blanket eligibility guarantee. The parcel’s legal classification, the buyer’s structure and citizenship, and rules in force at the time of purchase all matter.

Ask your lawyer to confirm, in writing for the specific parcel:

Land category, planning limits and access

Confirm the parcel’s legal status

Obtain the cadastral map and registry information for the exact parcel. Record the stated land category, area, boundaries and any easements or restrictions. If the property is part of a larger development, establish whether roads, courtyards, parking and utility corridors are privately owned, shared or subject to an easement.

Ask the municipality whether a zoning, planning or development condition affects the intended use or building envelope. The available legal material does not provide one universal national checklist for every municipality, so local confirmation is necessary.

Test practical access and services

Walk the route to the property in different conditions if possible. Confirm who controls the access road and whether a recorded right of way exists. Obtain written information, where available, about electricity, water, sewerage, gas, drainage and telecommunications connections. Check meter locations, capacity and outstanding connection work. These are property-level questions that a title extract alone cannot answer.

What construction and renovation documents should you ask for?

Separate the existing building from your proposed project

Ask the seller for the original approval package and records for additions or alterations. Useful items may include approved architectural drawings, site plans, structural information, completion or acceptance documents, utility approvals and correspondence with the municipality. Compare dates and areas: an unrecorded enclosed balcony or extra room can create a legal and technical problem even when the main building was properly approved.

Understand what a permit file can contain

The official Spatial Planning, Architectural and Construction Activities Code lists permit-related documentation that includes ownership information for the land and building, a detailed architectural design and, where applicable, engineering-geological surveys and structural schemes or designs. The exact documents and authority depend on the project and legal context.

That means you should not assume either that every cosmetic repair needs a permit or that every renovation is exempt. A replacement of finishes may be treated differently from moving a load-bearing wall, cutting a new opening, changing a façade, adding a storey, excavating near a neighboring foundation or changing a building’s use. Give the municipality a written scope and ask for the applicable notice or permit route before work starts.

Use a scope-of-work schedule

Prepare a room-by-room and site schedule for your designer and authority. Note demolition, structural changes, waterproofing, insulation, windows, roof work, façade treatment, stairs, retaining walls, drainage, electrical capacity, plumbing, heating and ventilation. Mark any work that affects a shared wall, common area, public sidewalk or neighboring land. This makes it easier for the authority to classify the work and for contractors to price the same project.

Can I renovate a property in Tbilisi without a permit?

There is no safe yes-or-no answer based only on the word “renovate.” Tbilisi projects must be assessed against the precise work, building and location. Ask the responsible municipal authority which route applies; do not rely on a contractor’s assumption or on the fact that a previous owner carried out similar work.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Work that needs careful classification

  • Interior finishes: painting, flooring and replacing fixtures may be lower-impact, but confirm whether the work affects services, fire safety or protected fabric.
  • Layout changes: removing or building partitions can affect structure, escape routes and services. Obtain a professional assessment before demolition.
  • Structural work: new openings, beam or slab changes, underpinning, roof alterations and additional floors require design input and may require engineering-geological and structural documentation.
  • Exterior and common areas: façade changes, balcony enclosures, windows visible from the street, signage, roof equipment and work in shared courtyards can involve municipal or co-owner permissions.
  • Change of use: converting a home to an office, shop, guest accommodation or other use can trigger planning, fire, accessibility and service requirements beyond ordinary repair.

A safe municipal enquiry

  1. Write the address, cadastral number, existing use and a concise description of every proposed intervention.
  2. Attach photographs, the registry information, available drawings and a sketch showing affected areas.
  3. Ask which authority handles the application and whether the work requires a permit, notification, design review or additional technical reports.
  4. Request the answer and submission list in a form your designer and lawyer can retain with the project records.
  5. Do not start demolition or order irreversible work until the required route is confirmed and approvals are issued.

How do I check if a Georgian property is in a heritage zone?

Check designation, not just age or appearance

An old façade, a historic neighborhood or a building with traditional details does not by itself prove protected status. Ask whether the property is individually designated cultural property or lies within an applicable protection zone. Request the designation decision, map or other official confirmation and identify the authority responsible for approvals.

Plan for heritage treatment approvals

The Law on Cultural Heritage addresses permits for treatment of cultural property. For immovable property, the cited application provisions include proof of ownership and a cadastral map; when the applicant is not the owner, authorization from the owner is required. A buyer should establish the exact application requirements with the competent authority before appointing a contractor.

Heritage controls can affect windows, façades, roofs, paint, signage, interior historic fabric and structural interventions. Build time for documentation, specialist design and review into the programme. Do not remove historic elements to “make the application easier”; unauthorized work can create enforcement and reinstatement risks.

Independent building and site inspection

Legal title and a permit file do not certify condition. Commission an inspection that matches the property’s risks and your intended work. For a sloping site, extension or major alteration, include a qualified structural engineer and, where indicated, an engineering-geological professional. For a simple apartment refresh, a surveyor or experienced building inspector may identify moisture, movement and service defects that a viewing misses.

Ask the inspector to document

  • cracks, settlement, deflection, corrosion and signs of movement;
  • roof, façade, balconies, waterproofing, damp and drainage;
  • foundations, retaining walls and slope or ground-water concerns where relevant;
  • electrical, gas, plumbing, heating, ventilation and sewer connections;
  • fire exits, smoke protection and access constraints for the intended use;
  • evidence that extensions, enclosed balconies or altered openings match approved drawings; and
  • urgent safety measures, probable repair scope and items requiring specialist testing.

Require photographs, locations, severity ratings and assumptions in the report. A visual inspection has limits; concealed defects, asbestos or soil conditions may need separate investigations. Use the findings to renegotiate, require rectification, obtain insurance advice or walk away before the contract becomes unconditional.

Due-diligence checklist for a Georgian purchase or renovation

Check Evidence to obtain Who should confirm it Decision point
Identity and title Current Public Registry extract, cadastral number, seller authority and written contract Georgian property lawyer Do not complete until ownership and signatures are clear
Encumbrances Registry entries for mortgages, seizures, leases, easements and restrictions; discharge documents where needed Lawyer and registry professional Price and completion conditions must address each entry
Land category Recorded classification and cadastral map; written advice on restrictions Lawyer and relevant authority Confirm foreign-buyer eligibility and intended use
Existing construction Approved plans, permits or notices, completion records and alteration history Architect, engineer and municipality Resolve mismatches before relying on the building’s area or legality
Proposed work Scope, drawings and municipal determination of permit or notice route Designer and responsible municipality Set programme and budget only after the route is known
Heritage status Designation or protection-zone confirmation, maps and authority requirements Heritage authority and conservation professional Obtain treatment approval before altering protected fabric
Condition Independent inspection, structural or geotechnical reports and service checks Qualified technical professionals Cost urgent work and hidden-risk allowances before exchange
Services and access Connection evidence, meter details, easements and access arrangements Surveyor, utility providers and lawyer Confirm the property can be occupied and built as planned

Red flags that should stop or slow the transaction

  • The seller refuses to provide a current registry extract or says registration is unnecessary.
  • The cadastral number, area, floor or boundaries differ between the registry, contract and site.
  • An agricultural classification is dismissed because the property contains a house or shop.
  • Extensions, extra floors or enclosed balconies appear on site but not in the plans.
  • A contractor promises that “no permit is needed” without reviewing drawings and the address with the municipality.
  • The property is historic, but nobody can identify its designation or the authority for façade and interior work.
  • Cracks, damp, leaning walls, slope movement or overloaded balconies are treated as cosmetic without an engineer’s opinion.
  • Access, parking or utility rights are described verbally but are absent from title or service documents.
  • You are pressured to pay a non-refundable deposit before legal and technical conditions are written into the contract.

How to budget and programme the project responsibly

Separate the acquisition budget from the renovation budget. The purchase side should include legal review, registry documents, survey work, translation or notarization where applicable, and any cost of discharging an encumbrance. The project side should distinguish design, surveys, permit or review fees, heritage documentation, construction, utility upgrades, waste removal and contingency.

Do not price a renovation from floor area alone. A compliant design may require structural calculations, engineering-geological work, drainage or temporary works. Heritage review can add specialist design and approval time. Existing unapproved work may need redesign, legalization where available, removal or reinstatement. Obtain a written scope and staged programme from the designer and contractor after the authority has confirmed the route.

Insurance, tax treatment, utility liabilities and building-management rules also require property-specific advice. They are not settled by a national-level title or permit check.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

A practical order of operations

  1. Before an offer: collect the cadastral reference, registry extract, seller identity, plans and a preliminary condition inspection.
  2. Before signing: have a Georgian lawyer verify title, encumbrances, land category, foreign-buyer issues and contract protections.
  3. Before design is fixed: obtain a measured survey, define the work and screen heritage status and municipal planning constraints.
  4. Before construction: secure the required permit, notice, heritage approval and technical designs; confirm contractor insurance, responsibilities and site safety arrangements.
  5. During work: keep approved drawings, authority correspondence, inspection records and change orders together. Ask the designer before deviating from approved documents.
  6. Before handover: record completed areas, test services, collect warranties and completion documents, and update the registry or other records if the project requires it.

What a professional team should do for you

A Georgian property lawyer should interpret the registry and contract, not merely witness a signature. An architect or designer should translate your brief into a scope that can be submitted. A structural engineer should assess load paths and proposed interventions. A surveyor should reconcile boundaries and levels. A geotechnical professional should advise where ground conditions, excavation or slope stability justify it. A heritage specialist should identify protected fabric and prepare treatment information when required.

Ask each professional to state the documents reviewed, the limitations of the inspection and the decisions that remain with the authority. Professional involvement reduces avoidable risk, but no adviser can guarantee approval or reveal defects that were outside the agreed scope.

Bottom line for buyers and renovators

Buy the property described in the current registry, on land whose category you have confirmed, under a written contract that leads to registered ownership. Before altering it, reconcile the existing building with approved documents, obtain the municipality’s decision on your precise scope, and check cultural-heritage status. Then use independent technical professionals to test condition, boundaries, access and services. These steps are slower than relying on a listing or verbal assurance, but they are the most reliable way to discover a legal or construction problem while you can still change the deal.

Frequently Asked Questions

Does owning a Georgian property automatically allow me to rebuild it?

No. Ownership does not by itself establish development rights or the approvals for a particular project. Confirm the proposed scope, existing approvals, land category, planning context and any heritage controls with the responsible municipality and qualified professionals.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Is every repair in Tbilisi subject to a permit?

The applicable route depends on the work and location. Do not assume that every cosmetic repair needs a permit or that every renovation is exempt; submit a written scope to the responsible municipality for a project-specific answer.

What if the building is old but not listed as heritage?

Age or appearance alone does not prove designation. Obtain official confirmation of whether the property or area is protected, then follow the competent authority’s requirements for any treatment or alteration.

Can a registry extract prove that a building is structurally safe?

No. The registry addresses recorded rights and property information, not concealed defects, settlement, services or structural capacity. Commission an independent inspection and specialist reports appropriate to the building and proposed work.
