What to Check Before Buying a Preconstruction Condo in Cancún: A Document-First Checklist

Before paying a reservation fee or signing for a preconstruction condo in Cancún, verify five things in the project’s own records: the seller’s authority and land title, permits and the executive construction file, the exact contract’s registration with Mexico’s consumer-protection agency (Profeco), the unit’s specifications and delivery obligations, and the condominium regime. A foreign buyer must also establish the project-specific ownership structure in Mexico’s coastal restricted zone with independent Mexican counsel and the notary. Brochures and verbal assurances cannot establish that a particular development is permitted, financed, on schedule, or legally ready to transfer.

Why preconstruction requires a different check

A completed condo can be inspected, measured and compared with its deed and condominium records. A preconstruction purchase asks you to pay against a future result. The central question is therefore not whether the sales presentation looks attractive; it is whether the provider can document the land, authority to sell, approved project, contract terms, unit definition and path to legal delivery.

As an Amazon Associate I earn from qualifying purchases.

No named development is identified here, so no project-specific conclusion is possible. The checklist below tells you what to request and what an independent lawyer, notary and—when appropriate—construction professional should reconcile before money becomes difficult to recover.

The minimum evidence set before any payment

Ask for a complete, dated document package before transferring a deposit. Keep the files exactly as supplied, including annexes and plan revisions, so you can compare later versions.

  • For a foreign buyer, the proposed fideicomiso or beneficiary-assignment documents, bank fiduciary information, term, fees, succession provisions and closing mechanics.

If the seller will not provide these materials for review, treat that refusal as a decision point rather than trying to fill the gaps with marketing claims.

1. Identify every party and its authority to sell

Match names across all documents

Record the provider’s full legal name and tax identification, the developer, the landowner if different, the broker or sales intermediary, and the person signing for each entity. Names should match the contract, ownership evidence, permits, invoices and payment instructions. A brand name used in advertising is not enough to establish which legal entity owes you performance.

Mexico’s residential-consumer standard, NOM-247-SE-2021, requires the provider to identify itself and make documents concerning ownership and authority to market the property available. Read the official standard published by the Secretaría de Economía and Diario Oficial de la Federación on 2022-02-16: NOM-247-SE-2021. Have counsel verify that the entity taking your money is entitled to sell this land and this unit, not merely that it has a connection with the project.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Check payment instructions independently

Use the legal entity and bank-account details stated in the reviewed contract. Confirm any change of account through a known contact and your lawyer, not solely through an emailed instruction. A reservation receipt should state what it buys, whether it is refundable, the deadline for signing, and how it is credited toward the price.

2. Verify the land, title and liens

Request ownership evidence and current registry information

Profeco’s pre-sale guidance says a buyer should be shown documents evidencing ownership and information about liens. Its 2025-03-14 consumer guidance is available at Profeco’s housing guidance. Ask for the public deed or other valid title document, current registry information and the legal description of the parcel. Your counsel should compare the owner named in the registry with the provider and the entity named in the contract.

Understand what a lien disclosure means

Request written disclosure of mortgages, seizures, easements, restrictions, tax or service arrears and any other burden that could affect transfer. Profeco states that liens affecting the property must be cancelled by deed signing. Ask the notary to explain the cancellation evidence and sequence: a promise that a lien will be removed later is not the same as proof that the transfer can be completed free of the relevant burden.

Confirm the land and unit can be created as promised

For a building still under construction, the legal unit may not yet exist as an individual registry entry. The project must nevertheless identify the parcel, proposed unit, boundaries and process by which the condominium units will be constituted. Ask counsel to identify every dependency between the land title, subdivision or condominium approval, trust documents and final deed.

  • One-Handed Loading - Keep one hand free with a 1/4 in. hex chuck that accepts 1 in. bit tips

3. Check project authority, permits and the executive file

Ask for the complete executive construction project

Profeco’s pre-sale materials identify the complete executive construction project, a model and, where applicable, a show unit as information buyers should be shown. NOM-247 addresses architectural, structural and installation plans or documentation concerning structural condition, as applicable. Request the plan set and a written specification schedule rather than relying on renderings.

List permits by the approval they serve

Depending on local law and project stage, relevant authorizations can include land use, construction, building, subdivision and condominium approvals. Ask for each permit number, issuing authority, date, scope, validity and the plan set to which it relates. A permit’s existence does not by itself prove that construction is on schedule, financially secure or compliant in every respect; your professional reviewer must check that the work being sold matches the authorized scope.

Reconcile construction stage with the paperwork

Request a dated construction schedule, current percentage or stage description, and evidence of which approvals remain outstanding. Compare photographs or site reports with the approved plans, but treat undated images and future-dated promises cautiously. If the project has changed height, unit count, parking layout, amenities or structural systems, ask for the amended approval and a contract amendment that explains the effect on your unit.

4. Verify the exact contract in Profeco’s registry

Search before signing

Profeco advises buyers to confirm that a purchase contract, including a pre-sale contract, is registered and to understand its terms. Search the registry for the provider and contract number, then compare the registered version with every document presented to you. Do not assume that a registered contract for one project, phase or seller covers a different unit or entity.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

NOM-247 states:

“Los contratos que utilicen los proveedores, incluyendo a las personas físicas o morales que hagan uso de fideicomisos para realizar la venta de inmuebles, para la prestación de servicios inmobiliarios, la compraventa de inmuebles, así como cualquier acuerdo que sostengan entre el proveedor y consumidor respecto a la comercialización del inmueble, deben ser registrado ante la PROFECO y estar a disposición para consulta de los consumidores, previo a la firma de los mismos.”

Read the official text at NOM-247-SE-2021. The wording expressly includes arrangements involving trusts and other agreements about marketing the property. Save the registry result and the version you reviewed.

Compare every document that creates an obligation

Put the reservation form, promise or purchase agreement, pre-sale contract, trust-beneficiary designation, broker agreement, financing document and annexes in one folder. Look for inconsistent unit numbers, prices, currencies, dates, cancellation clauses, signatures or references to a different phase. The document you sign should identify the same provider, project, unit and price that you investigated.

5. Make the unit description measurable

Define private area, boundaries and included rights

The contract and annexes should let you identify the exact floor, unit number, boundaries, measured area and layout. Ask whether the stated area is private interior area, a total including terraces or another measurement, and what tolerance or adjustment applies. Identify parking and storage by number and legal status: an assigned use, accessory unit, common element or separate title can create different rights.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Turn finishes and equipment into an itemized schedule

Compare marketing images with the plans and a written schedule covering windows, doors, flooring, cabinets, appliances, plumbing fixtures, air-conditioning equipment, lighting, balconies and other included accessories. Record model or performance specifications where they matter. If a brand or model can be substituted, require the contract to state the permitted standard and notice or approval process.

Separate amenities from enforceable rights

For pools, gyms, rooftop areas, beach clubs, parking, storage, elevators and services, ask whether the feature is part of the condominium, a separately owned facility, a neighboring project or an operating service. Confirm who owns it, who pays to operate it and what right your unit receives. A rendering or brochure statement should not be treated as a permanent legal entitlement unless the executed documents make it one.

6. Audit price, currency and payment mechanics

Build a complete payment schedule

Create a table from the contract showing the total price, currency, reservation amount, deposit or advance, installment dates, construction milestones, balance at closing, taxes, trust fees, notarial charges and any other stated payment. Mark which amounts are credited to the purchase price and which are separate charges. If a currency-conversion formula applies, identify the reference rate, date and party responsible for conversion.

Money item What to verify in writing Why it matters
Reservation or deposit Amount, recipient, deadline, refund or forfeiture rule, and credit toward price Determines your exposure before the definitive contract
Installments Due dates, construction milestones, payment method and late charges Prevents a disputed trigger or unexpected default
Currency Contract currency and conversion formula, if any Exchange movements can change the peso amount you must pay
Closing amounts Balance, taxes, notary, registry, trust and other stated charges Shows what is due before title or trust documentation is delivered
Changes or extras Approval process, pricing and effect on delivery Stops informal upgrades from becoming an open-ended obligation

Ask what happens if either side defaults

Have counsel explain late-payment charges, seller delay, cancellation, refunds, assignment or resale, and dispute provisions. Check whether a seller extension is automatic, capped, tied to objective events or accompanied by compensation. The practical topics above must be checked against the actual contract; the available guidance does not establish that every possible clause is mandated in exactly this form.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

7. Define delivery, changes and guarantees

Use an objective handover definition

“Delivery” can mean substantial completion, physical access, a certificate, utility connection, a deed, trust execution or condominium registration. The contract should state the target date, permitted extensions, objective completion or handover criteria, notice procedure and consequences of missing the date. Ask what must be complete in your unit, the common areas and the services before you are required to accept or pay the balance.

Control substitutions and design changes

Compare the contract’s change clause with the plans and specifications. Identify what the provider may change unilaterally, what requires your consent, how equivalent materials are defined and whether a material change permits cancellation or a price adjustment. Keep written approvals for any customization; a sales conversation is difficult to audit later.

Read the guarantee process

NOM-247 requires information about guarantee conditions. Confirm the duration, covered components, exclusions, response times, claim channel, evidence required and whether common-area defects follow a different process. At handover, record defects and missing items in a signed list with dated photographs and retain proof of each notice.

8. Understand the condominium regime and operating obligations

Request the regime instrument and plans

The Municipality of Benito Juárez describes a condominium regime as combining an individually owned private unit with co-owned common areas and formalizing that arrangement before a notary. Its municipal information is available at Autorización de régimen en condominio. Ask for the regime instrument or draft, unit and common-area plans, bylaws, rules, voting structure and any master-condominium documents.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Identify what you will own, share and pay for

Mark each area as private, common, limited common or separately owned. Confirm maintenance obligations, assessments, reserve arrangements, insurance responsibilities, utilities, parking and rules governing alterations, rentals, pets, noise and commercial use. Request the proposed operating budget and maintenance charge methodology. A municipal description explains the legal concept; it does not establish the fees, approvals or rights of any particular development.

Test amenity rights against ownership documents

Ask whether an advertised facility is included in the condominium regime, subject to a license, operated by a third party or dependent on a future phase. Confirm that the buyer’s right to use it is written into the regime, contract or enforceable rules, and identify what happens if the facility is delayed, relocated or not approved.

9. Foreign-buyer ownership in Cancún’s restricted zone

Start with the geographic rule

Cancún lies in Mexico’s coastal restricted zone. Secretaría de Relaciones Exteriores (SRE) guidance states that foreign persons cannot acquire direct ownership of land within 50 kilometers of the coast. For residential use and enjoyment in that zone, SRE describes an authorized fideicomiso, formalized in a public deed, for a maximum term of 50 years. The official page, last updated 2020-10-02, is Permiso para constituir un fideicomiso en zona restringida. Confirm current procedure and fees directly because the page’s update date is 2020.

SRE’s guidance states: “solo se permite el uso y aprovechamiento de bienes inmuebles localizados dentro de esta zona restringida, mediante la constitución de un fideicomiso” (only the use and enjoyment of real estate located within this restricted zone is permitted through the constitution of a trust).

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Have counsel map the proposed structure

Ask whether you will become a beneficiary of an existing trust, acquire a beneficiary interest, or establish a new trust. Independently confirm the bank fiduciary, beneficiary rights, permitted residential purpose, unit’s legal description, maximum term, renewal or succession provisions, annual and transaction fees, powers of attorney, sale or assignment process and the documents required at closing. The notary should explain how the trust, condominium regime, payment and final deed or beneficiary documents fit together.

10. Add an independent construction and site review

Review the design as a buildable commitment

An architect or engineer who is independent of the seller can compare structural, architectural and installation plans with the specification schedule and the observed stage of work. Ask the reviewer to note missing information, apparent conflicts, material substitutions, accessibility or service issues and dependencies that could affect your unit or common areas. This is a practical risk-control step, not evidence that any particular project has a defect.

Inspect near completion against the contract

When access is safe and authorized, use the executed plans and finish schedule as an inspection list. Check dimensions, openings, equipment locations, drainage, ventilation, waterproofing details, common-area completion and utility connections. Photograph each room and material, record serial numbers where available and send a dated punch list through the contract’s notice channel.

11. Prepare for handover and the final documents

  1. Before accepting, compare the unit and common areas with the executed contract, approved plans and annexes.
  2. Record defects, missing equipment, incomplete amenities and unresolved utility or service items in writing, with dated photographs.
  3. Obtain a written repair or completion schedule and the process for verifying each item.
  4. Confirm delivery of the final deed or trust documents, condominium-regime records, rules, warranties, manuals and contact details for the operator.
  5. Reconcile final amounts, receipts, taxes, notarial charges, trust fees and any approved change orders before releasing the balance.
  6. Keep a complete closing file containing the signed contract, registry result, plans, permits supplied, inspection records, notices and receipts.

NOM-247 requires the delivered property to match the terms and conditions offered or agreed, subject to the applicable agreement and law. Read the standard at the Diario Oficial text; the steps above are a practical way to document whether that match occurred.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Use the same comparison axes for every project

If you are considering more than one development, score each one using identical evidence rather than comparing renderings or promises.

Axis Evidence to compare Decision question
Seller and title Legal seller, authority to sell, ownership evidence, liens and restrictions Can this entity legally sell this unit from this land?
Permits and construction Land-use, building, condominium or subdivision authorizations; permitted scope; construction stage Does the documented project match what is being marketed and built?
Contract and money Profeco registration match, price and currency, deposit, milestones, default and cancellation terms Do the signed obligations match the registered contract and your budget?
Unit and delivery Measured area, plans, finishes, accessories, delivery definition and delay terms Can you prove what must be delivered and when?
Condominium governance Private and common areas, amenity rights, rules, maintenance obligations and budget What will you own, use, pay for and be governed by?
Foreign-buyer structure Direct-ownership eligibility or trust route, beneficiary rights, term, fees and succession Will the proposed structure give you the intended legal use and exit path?

Red flags that justify pausing the transaction

  • The seller will not identify the legal provider, landowner or person authorized to sign.
  • The ownership deed, registry information or lien disclosure is unavailable or does not match the contract.
  • The project is being sold with no identifiable permit set, or the plans supplied do not match the advertised unit count, height, parking or amenities.
  • The contract number cannot be matched to the version presented for signature in the Profeco registry.
  • Price, currency, unit area, parking, delivery date or refund terms appear only in a brochure or chat message.
  • The seller demands a non-refundable payment before allowing reasonable contract and title review.
  • A foreign buyer is told that a direct deed is automatic, or is offered a trust structure without clear fiduciary, term, fee and succession documents.
  • Material design changes are described as inevitable but the contract gives no objective limit, notice process or remedy.
  • Common amenities are advertised without an identified owner, approval, operating obligation or enforceable buyer right.

A red flag is not proof of fraud or noncompliance. It is a signal to stop sending money until an independent professional resolves the specific inconsistency in writing.

What this checklist cannot establish

The available official materials do not establish any named development’s ownership, current permits, construction progress, unit specifications, completion date, closing cost, maintenance charge, rental income, resale outlook or financial viability. They also do not provide a market-wide delay rate, completion rate, price statistic or investment return. General legal requirements should never be presented as proof that a particular project complies.

Use the project’s actual records, current registry information and current advice from independent Mexican counsel and the notary. For a near-complete building, add an independent inspection; for a foreign purchase, confirm the trust and closing structure before signing or transferring funds.
