What to Check Before Buying a Home in a New-Build Development

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

What should I check before buying a new-build home? Before paying a reservation fee or exchanging contracts, have a conveyancer or solicitor explain the contract, verify the written specification, investigate title and searches, understand tenure and every recurring charge, test the completion and delay provisions, confirm the warranty and approval documents, and arrange a snagging inspection. For an off-plan home, check the long-stop date, deposit protection and what happens if construction finishes late or early.

This guide uses England and Wales-style UK buying guidance as its principal frame. Property law, taxes, permits, tenure terminology and warranty rights differ across the UK and internationally. A local conveyancer or solicitor must explain the documents and remedies that apply to your actual home. Victoria-specific construction guidance is identified as such and is not UK law.

1. Get independent advice before you commit

Use an independent conveyancer or solicitor before signing a reservation agreement, paying a non-refundable fee or exchanging contracts. The developer’s sales team can explain the development, but cannot replace legal advice. A mortgage valuation only helps the lender assess security; it is not a survey, title investigation or inspection of workmanship.

The UK Government’s home-buying guide puts the point plainly: “Make sure your legal representative fully explains the details of the contract so you know what you are signing up to.” Ask your representative to explain:

  • where the deposit is held and what happens if the purchase does not proceed;
  • completion notices, notice periods and the consequences of missing them;
  • delay, early completion, substitutions, access for inspections and snag reporting;
  • the procedure and deadlines for remedial work and unresolved complaints; and
  • any limits on claims, warranties or rights to terminate.

Do not rely on a verbal promise about a view, appliance, parking space, finish or completion date. Ask for every material promise to appear in the signed contract or in a specification expressly incorporated into it.

2. Match the promised home to the written specification

A show home demonstrates a style, not necessarily the exact property being sold. Compare the contract plans and specification with the sales particulars, floor plan and what you were shown. Flag any difference before exchange.

Check the physical details

  • Room dimensions, ceiling heights, window positions and the direction of the main outlook.
  • External and internal doors, glazing, ironmongery, flooring, tiling, sanitaryware and kitchen finishes.
  • Heating, ventilation, lighting, sockets, broadband provisions and other fixed installations.
  • Appliances, including the promised make and model, capacity and energy rating.
  • Parking, garages, bin stores, loft or other storage, gardens, fencing and boundaries.
  • Landscaping, play areas, roads, paths, lighting and shared facilities.
  • Which items are included, optional upgrades or subject to an approved substitution.

Consumer Affairs Victoria advises putting agreed fixture details, including makes and models, into the written contract. That is practical corroboration rather than a rule for a UK sale; your conveyancer should identify what your contract actually incorporates. Its building-contract checklist is available at Consumer Affairs Victoria.

Ask how substitutions work

Contracts often allow equivalent materials or appliances to be substituted. Ask who decides whether an alternative is equivalent, whether you must be notified, and what happens if a change affects appearance, performance or value. Keep dated copies of the specification and any variation notice.

3. Investigate title, searches and the wider development

Your conveyancer should investigate the title, rights and restrictions affecting the plot and recommend appropriate searches. Ask for a plain-English explanation of:

  • the registered owner and the party selling the home;
  • rights of way, access, drainage, utilities and shared driveways;
  • restrictive covenants, estate rules and limits on alterations or use;
  • the exact plot, parking space, garden and boundary shown on the title plan;
  • planning obligations and infrastructure agreements affecting the development; and
  • who will own and maintain roads, paths, landscaping, play spaces and other common areas.

Find out whether roads, sewers, open spaces and lighting will be adopted by a public authority or remain privately managed. If private, ask who appoints contractors, who pays and how maintenance decisions are made.

Look beyond a clean search result

Searches can reveal restrictions and some external factors, but they do not guarantee that neighbouring land will remain undeveloped. The UK Government guide warns that searches may not identify development on nearby land. Check the local planning authority’s records for proposed phases, major roads, commercial uses, substations, schools or other projects that could change noise, traffic, views or value. The guide is at GOV.UK.

Ask the developer for the masterplan and the anticipated sequence of future phases. Treat marketing language such as “planned park” or “future facilities” as provisional unless the contract states what is being delivered, by whom and by when.

4. Understand tenure and recurring charges

Confirm tenure from the legal documents, not from sales shorthand. The structure determines what you own, what you must pay and who controls shared areas.

Arrangement Questions to answer before exchange
Freehold house Are there estate-management charges or covenants despite the freehold? Which communal roads, landscaping or facilities do they fund, who sets the budget and how can charges change?
Leasehold home What are the lease term, ground rent, service charge, review mechanism, restrictions, repairing obligations, subletting rules and permissions for alterations or sale?
Managed estate or shared facilities Who owns and maintains roads, paths, landscaping, play areas and private services? What reserve funds, insurance, contractor arrangements and cost-sharing rules apply?

Have the lease, transfer, estate-management documents and management information explained. Ask whether charges can rise without a fixed cap, whether there are event or exit fees, and what happens if a service provider or management company changes. Establish the first year’s budget and the method used to calculate your share; do not assume the figure in a sales brochure is permanent.

5. Protect yourself against off-plan timing and finance risk

For an incomplete home, distinguish an estimated completion date from a contractual deadline. The contract should state how the developer gives notice, how much notice you receive and what happens if the home is ready earlier than expected or substantially later.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Check the long-stop and termination rights

A long-stop date is the contractual backstop after which the buyer may have a right to withdraw if completion has not occurred. Confirm the exact date, any extensions, whether you receive your deposit back and whether other costs are recoverable. Do not assume that a delayed build automatically lets you cancel; the wording and jurisdiction control.

Keep the mortgage valid

Ask the lender how long the mortgage offer remains valid and what evidence is needed to extend or refresh it. A significant delay can require a new valuation, updated affordability checks or a different product. Tell the lender and conveyancer promptly about any change to the build programme, specification or price. A sales representative’s estimate does not override the contract or your lender’s deadline.

Check deposit and developer protections

Ask where the deposit is held, what protection applies if the developer becomes insolvent and which warranty or insurance scheme backs the transaction. Your conveyancer should check the actual documents and explain exclusions rather than relying on a scheme name alone.

6. Verify approvals, handover documents and the warranty

Before completion, obtain the documents required for the property’s jurisdiction. Ask who secured planning and building approvals, whether final inspection or completion sign-off has been issued, and which certificates will be handed over with the keys.

Consumer Affairs Victoria’s completion checklist says buyers of a new home there should obtain an occupancy permit and retain project certificates and records. Victoria’s requirements do not transfer to UK purchases, but the principle is useful: ask your local conveyancer for the equivalent approval and completion evidence. The Victoria checklist is at Consumer Affairs Victoria; its permits guidance is at Plans and permits – checklist.

Read the policy, not just the warranty logo

Ask for the warranty certificate and policy, provider details, start date, covered defects, exclusions, claim deadlines and dispute route. The UK Government guide says many new homes have ten years of cover for major structural problems and two years for general defects, while warning that cover may not extend to every part of the property or attached land. Those periods are typical guide figures, not a guarantee for your home. Confirm the actual policy, including whether external works, garages, retaining walls and communal areas are included.

Separate builder obligations from warranty claims

Find out which defects the developer must remedy during its after-sales period and which must be claimed under the warranty. Ask who logs the defect, how you receive a reference number, expected response times and the escalation route if work is incomplete or disputed.

7. Plan the snagging inspection

Snagging is the process of finding incomplete, damaged or poorly finished work and recording it for correction. GOV.UK says you can use a professional snagging company or inspect the home yourself. Arrange access after construction is substantially complete and, where possible, before completion so serious defects can be discussed with the developer.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Use a room-by-room inspection

  • Check walls, ceilings, floors, skirting, joinery, paint, sealant, tiles and visible damage in good daylight.
  • Open and close every window, door, cupboard and drawer; check locks, handles, alignment and restrictors.
  • Run taps, flush toilets and inspect visible joints, traps, radiators and signs of leaks.
  • Test heating controls, hot water, ventilation, extractor fans, smoke and carbon-monoxide alarms where accessible.
  • Check sockets, switches, lights, appliance connections and the consumer unit labelling without removing covers.
  • Confirm that supplied appliances, fittings and finishes match the signed specification.
  • Inspect loft access, insulation visible from the hatch, stairs, handrails and garage or storage areas.
  • Walk the outside: brickwork, render, paving, drainage covers, gates, fencing, turf, planting, boundaries and parking.

Record defects so they can be fixed

  1. Number each snag and describe its exact location and required outcome.
  2. Take a close photograph and a wider photograph showing the room or elevation.
  3. Send the list through the contractually specified channel and keep proof of delivery.
  4. Ask who owns each item, the target completion date and how you will be told it is complete.
  5. Reinspect repaired work and keep a dated record of outstanding items.

A professional inspection can add independent expertise; a self-led inspection avoids that fee and lets you check the home repeatedly. Neither approach guarantees that every concealed defect will be found. Ask the conveyancer whether a significant defect should delay completion and whether the contract permits retention or another remedy. Do not withhold money or cancel solely because of minor snags without legal advice.

8. Compare the main buying choices

Choice What is easier to verify Main risk to investigate
Completed home You can inspect the actual rooms, finishes, external works and immediate surroundings. Unresolved snags, missing certificates, warranty gaps or charges that are still unclear.
Off-plan home Price, plot and design may be agreed earlier, subject to the contract and specification. Construction delay, substitutions, changing surroundings, mortgage expiry and long-stop rights.
Professional snagging An independent inspector may identify finishing issues and document them systematically. Cost, limited access or an inspection that occurs too early to see later work.
Self-led snagging You can inspect at convenient times and revisit after repairs. You may miss defects or lack leverage on technical and contractual questions.

9. Ask the developer and management company the questions that sales brochures omit

  • Who is the contracting seller, who built the home and who handles after-sales issues?
  • What is the written complaint procedure and escalation route?
  • When will roads, landscaping, utilities and shared facilities be finished?
  • Who controls the management company and can that arrangement change?
  • What services do estate or service charges cover, and how are budgets, reserves and increases approved?
  • Which future phases remain, and what construction traffic or temporary access should you expect?
  • Can you inspect before completion, bring an independent surveyor and return after remedial work?

Keep one file containing the reservation agreement, contract, plans, specification, variations, title documents, searches, warranty, approvals, inspection reports, snag lists and every email. A clear paper trail helps your conveyancer, lender, developer and warranty provider distinguish a promised item from a later request.

10. A practical decision sequence

  1. Before reservation: obtain the draft reservation terms, identify the refund rules and appoint your conveyancer.
  2. Before exchange: have the contract, title, searches, lease or transfer, charges, specification, warranty and delay provisions explained in writing.
  3. While the home is being built: monitor formal notices, approved variations, lender deadlines and any change to the masterplan or completion estimate.
  4. Before completion: obtain the required approval and warranty documents, inspect the home, submit the numbered snag list and ask how serious defects affect completion.
  5. At handover: collect keys, manuals, certificates, meter information, emergency contacts and the after-sales procedure; photograph the condition of the home and keep copies.
  6. After handover: report defects promptly in the required format, track repair dates and escalate unresolved items through the developer and then the warranty or contractual route.

The safest purchase is not the one with the most attractive show-home presentation. It is the one where the legal rights, promised specification, future costs, completion evidence, delay remedies and defect process are all documented and understood before you become bound.
