What to Check Before Buying a Flat in a High-Rise Development

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Before you offer on a high-rise flat, verify three things in documents rather than relying on the viewing: the building is safe and properly managed, the lease gives you a workable ownership position, and the likely total cost—including major works—is affordable. The exact rules depend on location. The regulatory detail below is primarily for England; a separate section flags questions used in Victoria, Australia. Ask a conveyancer and an appropriately qualified surveyor to apply the rules to the particular building.

Start by identifying the building’s legal category

Ask which country, state or local regime governs the building, then establish the building’s height, storeys, use and number of homes. A label such as “high-rise” in an estate agent’s listing has no universal legal meaning.

England’s higher-risk threshold

For the Building Safety Regulator’s residential guidance in England, a building is in the relevant high-rise category when it has at least seven storeys or is at least 18 metres high and contains at least two residential units. Buildings meeting that definition must be registered with the Building Safety Regulator before people live in them. This threshold and registration regime are England-specific; do not apply them automatically in another country.

Find the accountable person and building owner

Ask the seller, owner or managing agent who is legally responsible for the structure and common parts, who performs day-to-day management, and who is the accountable person under the applicable safety regime. Obtain those details in writing. The identity of the responsible party matters when you need safety records, permission for works or a response to an urgent defect.

Obtain a building-wide safety pack

A flat can look immaculate while the expensive or life-safety risks sit in the façade, structure, common corridors or management records. Request documents before you commit to an offer, and make the contract conditional on satisfactory legal and survey investigations.

Fire-risk assessment and follow-up

In England, ask the building owner, managing agent or landlord for the current fire-risk assessment and evidence that its actions have been completed or scheduled. Government resident guidance says you can ask:

  • whether fire-safety risks have been identified;
  • what is being done to fix them; and
  • for a copy of the fire-risk assessment.

Check that the assessment addresses the whole building, not only your flat. Relevant topics include escape routes, alarms and other equipment, external walls, the structure, flat entrance doors, evacuation arrangements and the needs of residents who may be vulnerable or require assistance.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Ask for the risk register and remediation programme

Request a schedule of identified defects, the risk rating, interim measures, the person responsible, funding arrangements and target dates. Look for records of compartmentation, fire-stopping, fire doors, smoke control, alarms, emergency lighting, evacuation policy and resident communications. A statement that “the building is compliant” is not a substitute for the underlying assessment and follow-up records.

External walls, cladding and structural work

If the building has cladding, balconies, unusual façade systems or a history of leaks, ask for external-wall assessments, intrusive investigation reports where available, fire-engineering advice, structural reports and details of any completed or planned remediation. Ask who commissioned each report, its date, scope, conclusions and whether recommendations remain open. Your surveyor should explain whether a façade or structural specialist is needed.

Government cladding guidance says most leaseholders will not pay for fixing unsafe cladding, and qualifying-leaseholder protections can cap or prevent some contributions for building-safety works. Eligibility depends on the lease and property facts, and other defects may be treated differently. Have your conveyancer test the specific flat and building against the current rules rather than assuming every defect is covered.

Registration and safety information in England

If the building meets England’s seven-storey/18-metre and two-unit definition, ask for evidence of Building Safety Regulator registration and the accountable-person information. Registration alone does not prove that every defect has been resolved; it is one check in a wider document trail.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Read the lease and title as an ownership contract

Most flats are leasehold, so you are buying a time-limited right to occupy the flat plus rights and obligations concerning the building. Have a conveyancer read the actual lease, title and plans, not just the sales particulars.

Confirm exactly what is included

  • Check the internal floor area and the plan attached to the lease.
  • Confirm whether balconies, terraces, parking spaces, storage cages, roof areas or gardens are demised to the flat, held under a licence or shared.
  • Identify rights to use entrances, lifts, refuse areas, cycle storage and other common parts.
  • Check whether pipes, ducts, windows, doors and structural elements are included in your repairing responsibility or the landlord’s.

Check the unexpired term and rent clauses

Record the lease’s years remaining. A short term can affect mortgageability, resale and the cost of extending the lease. Read the ground-rent amount and review mechanism where applicable, including dates, formulas and any doubling or index-linked provisions. Your conveyancer should explain the practical effect for this flat and lender.

Map service-charge liability

Find the service-charge percentage or apportionment method, payment dates, reserve or sinking-fund provisions, consultation procedures and landlord’s right to recover major works costs. Check whether the lease allows recovery of building-safety, insurance, lift, concierge, management and legal expenses. Ask about arrears, disputes, tribunal or court proceedings and any breaches connected with the flat.

Check alteration and use restrictions

Look for consent requirements before removing walls, changing flooring, replacing windows, installing air-conditioning, keeping pets, subletting or running a business. Ask whether previous alterations have the required licences, planning permission and building-control approvals. A cheap flat that cannot be adapted to your needs may be a poor purchase.

Test the building’s management and finances

The managing organisation’s competence and finances determine whether lifts work, defects are repaired and major bills arrive with warning. Request the latest accounts, current budget, reserve-fund balance, insurance schedule and policy excesses, recent meeting minutes, repair history and planned-works information.

Documents to request

Document What to look for Why it matters
Recent service-charge accounts Actual expenditure, arrears, unusual legal or professional fees and year-end deficits Shows whether historic charges match the budget and whether costs are being deferred
Current budget and service-charge schedule Line items for lifts, cleaning, security, utilities, insurance, management and reserve contributions Provides the recurring cost you should model, rather than relying on an agent’s estimate
Reserve or sinking-fund statement Current balance, planned drawdowns and whether contributions are ring-fenced Indicates the building’s ability to pay for cyclical works
Meeting minutes Complaints, leaks, safety issues, disputes, contractor problems and votes on major works Often reveals risks not prominent in the listing
Insurance schedule and claims history Buildings cover, excesses, exclusions, claims and renewal terms Shows whether a future claim could leave owners with a significant contribution
Major-works notices and tenders Scope, estimates, consultation stage, funding and expected timing Identifies one-off bills that may follow completion

Ask whether the freeholder, residents’ management company or owners’ corporation has disputes with contractors, unpaid charges or enforcement action. Confirm who can approve emergency work and how residents are notified during outages or evacuations.

Commission an inspection that covers more than the flat interior

Arrange an independent survey before exchange. Tell the surveyor it is a high-rise apartment and provide available fire, façade, structural and major-works documents. Request a report that considers the flat and relevant common parts, and ask the surveyor to state exclusions plainly.

Compare ordinary and specialist inspections

Choice Use it when Check before appointing
Independent building survey You need an overall assessment of the flat, visible common-part condition and material defects Inspection scope, roof and façade access, services checked, exclusions, report detail, qualifications, turnaround, fee and professional indemnity cover
Specialist structural or external-wall follow-up The initial survey or records indicate cracking, movement, water ingress, unusual cladding, balcony issues or unresolved fire concerns Relevant technical competence, proposed tests, areas to be opened or accessed, deliverables, limitations, fee and insurance

No single survey type covers every high-rise risk. A general inspection may not assess concealed fire-stopping, intrusive façade construction or the full structure. If the first report recommends specialist advice, obtain it before exchange or renegotiate on documented evidence.

Check services and the practical experience of living there

Visit at different times, including a busy weekday and an evening if possible. Ask residents or the manager how the building performs during faults, not only how it looks on a quiet viewing.

Lifts, access and outages

  • Review lift maintenance records, recent breakdowns, renewal plans and the number of lifts serving the flat.
  • Ask what happens when a lift is out of service, including accessibility arrangements for residents, deliveries and emergency response.
  • Test entry systems, door closers, intercoms and visitor procedures.
  • Confirm outage communications and backup arrangements for power, water, heating, hot water and ventilation.

Noise, comfort and building fabric

  • Listen for traffic, plant, neighbours, refuse collection, alarms and lift machinery.
  • Check daylight, overheating, draughts, condensation, mould, water pressure and ventilation.
  • Inspect windows, balcony interfaces, ceilings and service risers for staining, cracking or patch repairs.
  • Confirm refuse, recycling, parcel, cycle and storage arrangements and any associated charges.

Rights that affect daily use

Verify parking, visitor bays, storage, communal rooms, roof terraces, gardens and work-from-home use in the lease or formal rules. Estate-agent statements and informal resident custom are not reliable substitutes for legal rights.

Build the true cost before making an offer

Use documents and written quotations where available. Model both the normal annual cost and the plausible one-off cost of works.

Cost category What to confirm
Service charge Current budget, payment frequency, apportionment, historical increases and balancing charges
Reserve contribution Required annual amount, fund balance, planned drawdowns and whether the fund is adequate for lift, roof, façade or plant cycles
Insurance Your share of the buildings premium, excesses, exclusions and any separate contents or liability cover you need
Ground rent Current amount and review clause, where the lease contains one
Utilities and systems Heating, hot water, ventilation, metering, communal energy and outage-related charges
Major works Known estimates, consultation notices, remediation contributions, financing and likely timing
Transaction and ownership costs Conveyancing, survey, mortgage, taxes applicable in your jurisdiction, moving, parking and alterations

Ask the conveyancer to identify charges that could become payable after exchange. A low current service charge can signal underfunding rather than value.

Use this pre-offer and conveyancing sequence

  1. Identify the jurisdiction and regime. Record the building’s storeys, height, residential units, tenure and responsible owner or manager.
  2. Request the core pack. Obtain the fire-risk assessment, safety action plan, external-wall or cladding records, structural reports, registration information where relevant, lease, title plan, accounts, budgets, reserve-fund statement, minutes, insurance and major-works papers.
  3. Compare documents with the listing. Resolve differences in floor area, parking, tenure, service charge, permissions and completion dates in writing.
  4. Appoint the conveyancer early. Ask for a written list of missing records and specific advice on lease liabilities, safety protections, planning, building control and completion documentation.
  5. Commission the survey. Give the surveyor the building documents and ask whether specialist structural, façade, fire or services advice is warranted.
  6. Price unresolved work. Obtain the scope, estimate, funding route and timing for each known defect or major project. Do not treat “under review” as zero cost.
  7. Check lender requirements directly. Ask the actual lender and conveyancer what evidence they require for this building.
  8. Revisit the flat and common parts. Visit at different times and test noise, access, lifts, services, storage and practical suitability.
  9. Decide before exchange. Proceed only when material records are satisfactory, specialist questions are answered and your budget includes recurring and one-off costs.

Understand EWS1 and other lender requests in England

An EWS1 form is a lender-requested assessment document, not a legal requirement for selling a flat. Some lenders may ask for one, while others may accept different evidence. Ask the actual lender and conveyancer what the transaction requires and whether an existing form covers this building, elevation and date. Do not infer that the presence or absence of an EWS1 proves the building is safe or unsafe.

Questions specific to Victoria, Australia

Victoria uses owners-corporation arrangements and its own disclosure and safety rules. The terminology, documents and buyer rights differ from England. Consumer guidance prompts buyers to review owners-corporation funds and visible structural damage and to consider an independent building inspection.

Ask for the owners-corporation plan, fees, budgets, fund balance, meeting records, insurance, maintenance and defect history, proposed special levies and disputes. Confirm what the contract includes and what the owners corporation maintains. Have a Victorian conveyancer explain disclosure rights, cooling-off or contract conditions and any records that must be supplied before signing.

Red flags that should pause the purchase

  • The owner or manager will not provide the fire-risk assessment, accounts, minutes or major-works information.
  • Safety reports are undated, incomplete, contradictory or show overdue actions without an owner or programme.
  • There is no clear answer about who controls the structure, façade, fire systems or common parts.
  • The reserve fund is small while minutes discuss lifts, roofs, façades, balconies or major plant replacement.
  • Service charges, lease terms, parking rights or remediation liabilities differ between the listing and legal papers.
  • Repeated leaks, cracking, corrosion, failed fire doors, broken access controls or persistent lift outages are dismissed as routine.
  • The survey excludes the relevant risk and no qualified specialist is willing to investigate it.
  • Your lender’s evidence requirements remain unresolved close to exchange.

A red flag is not automatically a reason to walk away, but it is a reason to stop, obtain evidence, quantify the exposure and make the decision conditional on satisfactory advice.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Decision framework: proceed, renegotiate or walk away

Proceed

Proceed when the building’s responsible parties are identifiable, core safety and financial records are available, the survey raises no unquantified material issue, the lease works for your plans and your lender and conveyancer are satisfied.

Renegotiate or make conditions explicit

Renegotiate when a defect or major work is documented but its scope, cost or timing can be verified. Use written obligations, retention or price adjustment only on your conveyancer’s advice; informal promises are difficult to enforce.

Walk away

Walk away when material records are withheld, responsibility is disputed, safety actions have no credible plan, costs cannot be estimated, or the lease and financing position do not fit your needs. The most attractive view cannot compensate for an ownership liability you cannot understand.

Official guidance to discuss with your advisers

The Building Safety Regulator’s guidance for accountable persons, updated 18 September 2024, states: “The Building Safety Act 2022 says accountable persons must take all reasonable steps to: prevent building safety risks from happening; reduce the severity of any incidents if they do happen.” Treat that as a description of the responsible person’s duty, not as proof that a particular building meets it. Ask your advisers to verify the building’s current position and records.
