Random freezes, missing sound and display glitches usually trace back to one bad driver. Find and replace yours safely.Free scan · under a minuteBefore spending money on a government construction bid in Kenya, establish five things: your legal and technical eligibility for that exact package, the NCA category and licence required, every pass/fail document and bid-security condition, the real submission procedure and deadline, and whether the contract can be delivered profitably under its risk and payment terms.
Use the live invitation and complete tender document as the controlling source. General checklists cannot override an amendment, a special condition, a procuring entity’s portal instruction, or a requirement in the actual bill of quantities.

1. Confirm the procurement and the rules that govern it
Start by identifying the procuring entity, the contract type and the legal framework cited in the tender. Kenya’s public procurement framework is based on the Public Procurement and Asset Disposal Act, 2015 (PPADA), together with regulations and amendments. The Public Procurement Regulatory Authority (PPRA) lists a revised 2022 Act and the Public Procurement and Asset Disposal Regulations, 2020. Use the edition and regulations identified in the tender, and check the current official texts when a legal point affects your decision.

PPRA publishes separate standard tender-document formats for building and civil works; roads, water and bridges; small works; and design-build procurement. Its current standard-document set took effect on 21 April 2021 and discontinued earlier issued forms. Those templates are useful for understanding the usual structure, but the named tender, its addenda and its special conditions control your bid.
2. Ask whether the company is eligible for this exact package
Which NCA category and value class are required?
The National Construction Authority (NCA) states that a person may not carry on the business of a contractor unless registered by the Board and holding a valid practising licence. NCA registration is organised into eight categories, NCA 8 through NCA 1, with different value ceilings by discipline. Do not infer the required class from another project or from the contract title alone. Read the tender’s exact category, subcategory, discipline and value requirement, then confirm that your current licence covers both the work type and its stated value.
Check whether the package is building, roads, water, bridges, general civil works, mechanical and electrical services, or a narrower specialist activity. If the tender combines disciplines, determine whether one contractor must hold all relevant permissions or whether an eligible specialist subcontractor may satisfy part of the requirement.
Are specialist licences or registrations required?
Some specialist electrical and communications subclasses require authorisation from the Energy and Petroleum Regulatory Authority (EPRA) or the Communications Authority. Ask exactly whose licence must be submitted: the prime contractor’s, a named subcontractor’s, or a consultant’s. Verify validity through the tender’s required evidence and do not assume that an NCA licence replaces a sector-specific authorisation.
Are there restrictions on who may compete?
Read the notice and eligibility clauses for reserved competition, preference or set-aside requirements. The applicable group may be defined by the tender rather than by a general assumption about public contracts. Check ownership, local-content, youth, women, disability or other preference evidence only where the actual document requires it.

Will a joint venture or subcontracting arrangement qualify?
If bidding as a joint venture or consortium, identify the required agreement, lead-member responsibility, combined experience rules, signature authority and liability allocation. For subcontractors, check whether the tender demands named firms, written commitments, licences, evidence of capacity or approval by the procuring entity. A subcontracting plan cannot cure a prime bidder’s failure on a mandatory NCA or legal requirement unless the tender expressly allows it.
What changes if the bidder is foreign?
NCA describes a different sequence for foreign contractors: registration is sought after award and before contract signing, with project-specific credentials. A foreign bidder should therefore ask about incorporation or local-presence evidence, the documents needed for post-award NCA registration, the time available before signing, and which local technical partners or approvals are required. Do not apply the local-contractor checklist to a foreign bidder without reconciling it with the tender and NCA’s foreign-contractor requirements.
3. Build a pass/fail compliance matrix before estimating
Read the invitation, instructions to tenderers, eligibility provisions, evaluation criteria, schedules and forms as one document. Create a line-by-line matrix before committing estimating hours. Every row should identify the requirement, the evidence, the responsible person, an expiry date, the signature or certification needed, and the final verification date.
| Requirement to test | Question to answer | Evidence or control |
|---|---|---|
| Corporate status | Is the bidding entity registered in the form and jurisdiction required? | Current incorporation, ownership and director records, plus any tender-specific declarations. |
| Tax compliance | Is the tax certificate valid on the deadline and does the tender require verification or certification? | Current certificate and the prescribed verification printout or authentication. |
| NCA standing | Does the practising licence cover the exact discipline and contract value? | Current NCA registration certificate and practising licence. |
| Specialist permission | Are EPRA, Communications Authority or another professional authorisation required? | Licence for the bidder, named specialist or approved subcontractor, as the tender specifies. |
| Experience | Do completed projects match the required size, type, client and completion period? | Completion certificates, contracts, references and the precise experience schedule. |
| Personnel and equipment | Can the named staff and plant be demonstrated as available for the stated period? | CVs, professional registrations, employment or commitment letters, ownership or lease records and equipment schedules. |
| Financial capacity | Can the company meet the tender’s turnover, liquidity, banking or audited-account test? | Audited statements, bank letters, credit facilities and calculations in the required format. |
| Integrity declarations | Have non-debarment, anti-corruption, independent-bid and code-of-ethics forms been completed exactly? | Signed forms by the authorised representative, with dates, seals and witnessing where required. |
| Beneficial ownership | Does the current form require disclosure and does the information match corporate records? | Completed beneficial-ownership schedule and consistent company information. |
| Bid form and price schedules | Are every page, BOQ item, schedule and arithmetic check complete and signed? | Controlled final file, independent arithmetic review and authorised signature. |
| Bid security | Is security required, and are amount, issuer, instrument, beneficiary and validity correct? | Exact prescribed form or instrument, checked against the tender clause and deadline. |
NCA’s registration guidance lists corporate documents, KRA tax compliance, technical qualifications, business licensing, financial information and experience among registration evidence. That list is not a substitute for the tender’s own mandatory-document schedule. PPRA has also indicated that its current standard documents include beneficial-ownership disclosure. A 2026 portal works tender illustrates that a live procurement may require certified tax and non-debarment declarations and verify NCA registration; treat that as an example, not a universal rule.
4. Make the deadline and submission method unambiguous
Record the deadline exactly as printed, including time zone, delivery location or portal, and the rule for late submissions. A technically strong bid is disqualified if it arrives through the wrong channel or after the stated time.

- Check the tender notice and all addenda. Save each version and record which one governs your final submission.
- Confirm the clarification calendar. Note the last date for questions and how formal answers and amendments will be issued.
- Verify site-visit and pre-bid obligations. Determine whether attendance is mandatory, how it is recorded and whether a certificate or attendance list must be included.
- Map the packaging rules. Identify separate technical and financial envelopes, original and copy counts, encryption, upload limits, file naming, seals and prescribed forms.
- Test the delivery route early. For a portal, check account access, user permissions, file size and format. For physical delivery, allow for printing, sealing, transport and receipt evidence.
- Set an internal cut-off. Finish the upload or delivery before the official deadline so an authentication, traffic or printer problem does not become a late bid.
PPRA Circular 02/2025 described a transition to E-GPS and integration with the Public Procurement Information Portal, stating that required reports would be generated through E-GPS from 1 July 2025. That circular does not establish the operational workflow for every procuring entity. Confirm the current channel and file instructions in the live notice and tender document rather than relying on a general portal assumption.
5. Test whether the scope can actually be priced
Resolve document conflicts
Compare drawings, specifications, bills of quantities, schedules, site information and every addendum. Ask which document prevails if they conflict, how discrepancies must be reported, and whether a clarification changes the price or programme. Keep a written assumptions register; an omitted assumption can become an unfunded obligation after award.
Inspect the site and logistics
Attend the site when permitted or required. Check access for people and heavy vehicles, storage, utilities, water and power, working hours, security, weather exposure, neighbouring operations, land or wayleave constraints and disposal routes. Confirm whether the employer has supplied reliable surveys, geotechnical information, existing-service records and possession dates. Price the conditions you can evidence, and identify matters that require a formal clarification.
Include the complete cost, not just the BOQ total
Build a cost plan that captures materials, labour, plant, fuel, transport, accommodation, taxes, insurance, permits, testing, temporary works, traffic or environmental controls, supervision and specialist subcontractors. Separate direct cost, preliminaries, overhead, financing cost, contingency and profit so management can see which assumption drives the margin.
6. Examine the contract’s financial and legal exposure
Read the proposed contract, not only the pricing pages. Ask how the following are handled:

Independent reader supportYour contribution helps us test, update, and keep practical guides available for everyone.7. Check capacity against the delivery programme
Compare the proposed start and completion dates with current contracts, committed staff, plant maintenance and supplier capacity. Confirm that named project managers, engineers, quantity surveyors, health-and-safety personnel and foremen can be released when promised. Check professional registrations and replacement rules for key staff.
For equipment, distinguish owned, leased and subcontractor-supplied plant. Confirm availability dates, mobilisation cost, maintenance, fuel consumption and transport permits. A tender can be legally compliant yet commercially unwise if it would overextend working capital or force unsafe parallel delivery.
8. Understand what happens after award
NCA’s project-registration guidance places responsibility on the owner or developer and says the application should be made within 30 days after award. The listed supporting material includes current contractor and subcontractor licences, consultant registrations, approvals, the signed contract or tender documentation and a quantity-surveyor-signed BOQ summary. The guidance states that project registration is free.
Before bidding, ask who will assemble those documents, obtain approvals and submit the project-registration application. Agree the contractor’s contribution, the consultant’s role, document ownership and the consequences if an approval is delayed. This prevents a post-award scramble over information that was available only to the employer or design team.

9. Preserve evidence if the process appears unfair
Keep the complete procurement record: notice, every tender version and addendum, questions and answers, site-visit evidence, the submitted bid, delivery receipt, opening information where available, award notice and evaluation communications. PPRA identifies bidders and contractors among interested parties and describes complaint channels.
Do not rely on an old review deadline or a summary article. If you may challenge a decision, seek prompt professional advice and consult the current revised PPADA and regulations for the applicable forum, standing, documents and filing period. Preserve the record while the facts are fresh.
10. Use a disciplined bid/no-bid decision
When several opportunities are open, compare them on the same axes. Make legal eligibility a gate rather than allowing a high commercial score to compensate for a disqualifying defect.
Recommended Free Tools
| Decision axis | Questions | Go/no-go test |
|---|---|---|
| Eligibility fit | NCA class, specialist licences, reserved status, experience and mandatory evidence | Go only if every pass/fail item is demonstrably satisfied. |
| Scope clarity | Consistency of drawings, specifications, BOQ, site data and amendments | Go when material unknowns are clarified or deliberately priced with accepted risk. |
| Delivery capacity | Staff, equipment, partners, workload and programme realism | Go only with named resources and a credible mobilisation plan. |
| Financial exposure | Working capital, securities, insurance, payment structure, taxes and volatility | Go when the cash-flow model remains financeable under a conservative case. |
| Risk allocation | Design, ground, variation, delay, defects and termination provisions | Escalate unacceptable or unpriceable risks before submission. |
| Bid cost and probability | Estimator hours, site travel, security cost and realistic award prospects | Proceed when the opportunity justifies the cost without weakening other bids. |
| Strategic value | Location, references, capability development and portfolio fit | Use as a tie-breaker, never as a reason to ignore a mandatory failure. |
You can assign internal scores if management finds that useful, but there is no universal Kenyan numerical threshold. Write your own minimums for margin, cash cover, capacity and risk, and record the director or bid committee’s decision.
