Start with this question: “What can this body approve, deny, or condition today, and what issues are outside its authority?” A data-center hearing may address only one piece of a larger project—such as zoning, a site plan, or an environmental permit. Utility construction, air permits, water service, and later operating approvals may be decided elsewhere. Your most useful questions identify the decision in front of the room, demand project-specific evidence, and turn important promises into conditions that can be measured and enforced.
1. Identify exactly what is being decided
Read the hearing notice, agenda, staff report, application drawings, and any recommended conditions before you prepare questions. Write down the application number, parcel, applicant, hearing date, and the agency or board taking action. Do not assume that a meeting advertised as a “data center hearing” can approve every part of the development.

| Proceeding you may see | What it commonly addresses | Question to ask first |
|---|---|---|
| Zoning or rezoning | Whether the proposed use and dimensional standards fit the land-use code | Which use classification, setbacks, height, buffers, and conditions are before this body? |
| Site-plan or special-use review | Building placement, access, landscaping, stormwater, lighting, and construction controls | Which drawings and operating assumptions are part of the approval? |
| Environmental review | Analysis of effects and mitigation measures required by applicable law | Which impacts are studied, and where can written comments be submitted? |
| Air or emissions permit | Stationary engines, emergency generators, fuel storage, and emissions limits | What equipment and operating hours are covered by this permit? |
| Utility or transmission approval | Substations, lines, generation, or other infrastructure outside the parcel | Which separate agency approves the work, and when is its comment period? |
Ask the clerk or chair where written comments become part of the official record, the deadline for submitting them, and how to request accommodations or remote participation. Deadlines, notice rules, appeal rights, and standing vary by jurisdiction; confirm them in the current local notice and code rather than relying on a general checklist.

Its large-scale data-center regulations provide for neighborhood coordination, a public hearing, Zoning Examiner review, and final consideration by the Mayor and Council. They also call for sound-impact studies, noise barriers, and operational noise limits. Those requirements are a Tucson example, not a nationwide rule.

2. Prepare questions that require documents, not slogans
For each concern, ask for the estimate, its date, assumptions, responsible preparer, and the document in which it appears. A useful sequence is:
- Download the complete application and staff report, including appendices and revised drawings.
- Mark every number that affects neighbors: building area, electrical load, water use, generator count, hours, traffic, setbacks, and construction duration.
- Ask the applicant to distinguish an initial phase from the facility’s fully built-out condition.
- Request the standard, measuring location, reporting frequency, and remedy for every proposed limit.
- Submit concise written questions before the deadline and bring copies for the clerk and decision-makers.
Project estimates remain proposals until they are supported by filings, permits, contracts, or enforceable conditions. A job total or tax projection should not be treated as verified merely because it appears in a presentation.
3. Electricity, substations, and the grid
Demand and build-out
Ask: What is the expected peak demand in megawatts and annual electricity consumption, both at opening and at full build-out? Require the applicant to show how demand changes as additional buildings, server halls, or tenants are added. Ask whether the estimate includes cooling, battery charging, offices, pumps, security systems, and losses—not just computing equipment.
Do these 3 things before closing this tab:
1Fix the driver behind crashes, sound loss and screen glitches2Repair Windows errors before they cause bigger problems3Scan for outdated or missing drivers - takes under a minuteEnergy sources and on-site generation
Ask for the expected energy mix and whether any generation is planned on the property. Clarify whether generators are emergency-only, permitted for routine peak shaving, or intended to run during grid constraints. Request the fuel type, storage capacity, expected operating hours, emissions controls, and applicable air permits for each generator class.
Grid upgrades and cost allocation
Ask which substations, transmission lines, feeders, transformers, or other upgrades are required; who will build them; and who pays. Ask whether work outside the parcel needs a separate approval and whether construction will affect roads or nearby properties.
Fairfax County explains that residents do not directly pay for the electricity a data center consumes there, but customers may bear a portion of infrastructure improvements such as new lines and equipment. That is a local description, not a prediction for another jurisdiction. Request the project’s interconnection study, utility cost agreement, payment schedule, and any public contribution from the applicant or utility.

The Electric Reliability Council of Texas (ERCOT) identified grid dependence and on-site generation as data-center impact topics in its 2026 request for information. ERCOT stated that responses were due October 12, 2026, with a report expected by December 10, 2026. Those dates concern a Texas information-gathering process; they do not set a deadline for your hearing.

4. Water supply, cooling, and wastewater
Source and quantity
Ask for water use during peak heat, a typical month, and a full year, separated by construction and operation. Identify the source—municipal supply, reclaimed water, groundwater, surface water, or another source—and provide the quality requirements for that source. Ask whether the estimate covers future phases and whether drought restrictions change the operating plan.
Cooling design
Require a description of the cooling technology and the conditions under which it operates. Evaporative systems, closed-loop systems, air cooling, and hybrid designs can have different water and energy profiles. Ask how water use changes with outdoor temperature, humidity, equipment load, and a prolonged drought.
Wastewater and infrastructure
Ask what blowdown, treatment chemicals, sanitary wastewater, and other discharges will be produced; where each stream will go; and which discharge or sewer permits apply. Confirm whether treatment plants and water mains have capacity for the proposed flow, what upgrades are needed, and who pays.
Operating disclosure
Ask whether actual electricity and water use will be reported after opening, at what intervals, in what units, and to whom. Penn State Extension identifies water resources and infrastructure capacity as central community questions, while ERCOT’s request addresses water sources, consumption, and cooling technologies. Neither source establishes a universal water-use number; insist on a number calculated for this facility and its phased design.

5. Noise, lighting, generators, and air quality
Noise study and sensitive receptors
Ask which study models sound at nearby homes, schools, hospitals, parks, and property lines. Confirm that it includes nighttime operation, low-frequency sound, rooftop or packaged cooling equipment, transformers, fans, alarms, and generator testing. Request the modeled levels at each receptor, the weather and operating assumptions, and the baseline measurements.

Limits and verification
Ask what limits apply at the property boundary and at residences, whether they vary by time of day, and which agency can enforce them. A condition is stronger when it names the instrument, measurement method, monitoring location, reporting schedule, and remedy for an exceedance. Ask for post-opening measurements by an independent professional and a process for residents to report complaints.
Backup generation and emissions
Ask how often each generator will be tested, how long tests last, whether coordinated testing can create a neighborhood-wide event, and how residents will receive notice of material changes. Identify fuel, stack height, emissions controls, fuel deliveries, and all required air permits. Ask what happens if a generator operates beyond emergency use or if an air permit is violated.
Light, traffic, and construction hours
Request a photometric plan showing spill light at property lines and nearby homes, fixture shielding, color temperature, and automatic controls. Ask for construction hours, truck routes, idling rules, haul schedules, road repairs, and a plan for complaints. ERCOT’s impact categories include noise, light, and traffic; the specific limits and enforcement authority come from local law and the project’s approvals.
6. Land use, design, and construction impacts
Ask why this site was selected, what alternatives were evaluated, and how close the buildings, substations, cooling yards, fuel tanks, and loading areas will be to homes and other sensitive uses. Request setbacks, screening, tree removal, stormwater controls, flood-risk information, and the height and massing of every phase.
Separate temporary construction effects from permanent operations. Ask for the anticipated construction sequence, peak workforce, crane and concrete activity, blasting or pile-driving plans, dust controls, erosion protection, emergency access, and restoration obligations. If the project will be built in phases, ask what can be occupied before later infrastructure is complete and whether each phase receives a separate inspection or approval.
7. Public money, jobs, and promised benefits
Ask for every proposed incentive, tax exemption, grant, discounted utility arrangement, land contribution, road project, or other public assistance. Request the legal instrument, duration, performance milestones, clawback terms, and the public body responsible for enforcement.

For construction and permanent jobs, ask how many positions are expected, when they occur, whether the estimate is direct or indirect, the wage and qualification assumptions, and whether the figures have been independently checked. Ask which infrastructure and service costs remain public, including roads, utility extensions, emergency response, inspections, and future maintenance.
Community-benefit proposals should identify beneficiaries, eligibility, dollar amounts or services, delivery dates, and a binding agreement. A voluntary statement in a slide deck is not equivalent to a condition of approval.
Independent reader supportYour contribution helps us test, update, and keep practical guides available for everyone.8. Turn promises into enforceable conditions
For each important commitment, ask five accountability questions:
- Will it be written into the resolution, permit, development agreement, or another enforceable instrument?
- Who is the named responsible party—the owner, operator, utility, contractor, or another entity?
- What measurable standard, baseline, deadline, and reporting format apply?
- Which agency receives reports, performs inspections, and investigates complaints?
- What remedy applies after noncompliance: corrective work, a fine, suspension, withholding of occupancy, or another action authorized by law?
Ask whether ownership or operator changes transfer the obligations. Ask when monitoring begins, how records become public, and whether residents can inspect results. The Iowa Data Center Decision Tool for Counties, Cities, Communities emphasizes public timelines, zoning provisions, measurable standards, and water sources; use those prompts while confirming that the local decision-maker has legal authority to impose each condition.
9. Compare alternatives on the same scorecard
If the applicant offers multiple sites, cooling systems, building layouts, or power arrangements, ask for a side-by-side comparison using identical assumptions. The following framework prevents one option from being described with peak figures and another with average figures.
Recommended Free Tools
| Comparison axis | Evidence to request |
|---|---|
| Electricity | Peak and annual demand at opening and full build-out; energy sources; on-site generation |
| Grid work | Substations, lines, transformers, schedule, responsible builder, and cost allocation |
| Water | Source, peak and annual use, drought case, quality, and metering plan |
| Cooling | Technology, seasonal performance, chemicals, blowdown, and wastewater route |
| Noise | Modeled and measured levels at the same receptors, including nighttime and low-frequency sound |
| Generators | Type, fuel, test schedule, emissions, permits, and notice procedures |
| Land-use fit | Setbacks, height, buffers, sensitive uses, traffic, lighting, and stormwater |
| Public balance | Jobs, incentives, infrastructure costs, emergency-service demands, and enforceable benefits |
| Accountability | Monitoring, public reporting, responsible party, and remedy for exceedances |
The available guidance identifies these categories but does not establish which alternative is best for every site. Ask decision-makers to explain the trade-offs in the record instead of accepting a general claim that one design is “more efficient” or “cleaner.”

10. Speak effectively and protect the record
Open by identifying the application and the specific condition you want. Ask one factual question at a time, state the document or number you are seeking, and request that the answer be entered into the record. If an answer is deferred, ask who will provide it, by what date, and where it will be posted.
Bring a one-page list of your highest-priority questions, but submit detailed exhibits in advance if the rules require prefiling. Refer to sheet numbers, study sections, and parcel locations so the board can match your concern to the application. Do not present a project estimate as a proven fact; identify it as the applicant’s estimate and ask for its assumptions.
11. Track approvals after the hearing
Before the meeting ends, ask which permits and proceedings remain, their expected sequence, and the next public comment opportunity. Utility lines, substations, air permits, building permits, water-service agreements, and environmental approvals may proceed on separate schedules. Request notice of revised plans, appeals, inspections, occupancy, and any amendment that changes equipment, capacity, operating hours, or noise.

Keep a dated log of promised reports, construction activity, noise or lighting observations, traffic problems, and agency responses. 12. Know what this guide cannot decide
There is no universal data-center water figure, noise limit, job count, tax benefit, hearing deadline, or appeal rule. Those facts depend on the project, location, phase, governing code, and permit. Institutional and government guidance—including ERCOT, Tucson, Fairfax County, the University of Iowa Hubbell Environmental Law Initiative, and Penn State Extension—supports asking for measurable evidence; it does not determine whether a particular project should be approved. Your strongest hearing questions are therefore specific, documented, and tied to a condition the responsible authority can legally enforce.
