What residents should do when a council housing project is delayed

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

If a council housing project is late, first establish who is responsible and request a written, dated update. Ask what has slipped, why it changed, the next milestone, the person or organisation that owns the next action, and when residents will hear more. Then decide whether you are dealing with a landlord-service failure, a housing application, a planning decision, or a project being delivered by another body. Those routes have different complaint systems and remedies.

Keep a simple record of every enquiry, promise, reply and practical effect on you. If routine contacts do not address a service failure, make a formal complaint under the relevant organisation’s published procedure. A general construction delay is not automatically a case for the Housing Ombudsman, and a planning application deadline is not a deadline for finishing a building.

Start by identifying the project and the council’s role

“Council housing project” can describe several different arrangements. The council may be the social landlord, the project sponsor, the planning authority, or a service provider involved in homelessness or housing-register decisions. A housing association, contractor, developer or regional body may be delivering the homes while the council has a different responsibility. The correct route depends on the UK nation, the council, the site, the tenure of the homes and the decision or service that has actually failed.

Collect the basic facts

  • Project or development name and full site address.
  • The council department, housing team or named project sponsor.
  • Whether the homes are council homes, another form of social housing, temporary accommodation or private housing secured through a council scheme.
  • The role the council appears to be performing: landlord, sponsor, planning authority or another service provider.
  • The original completion date, opening date or other public milestone, and where that date was published.
  • What the delay means for you: a missed move, temporary accommodation, overcrowding, travel costs, accessibility problems, loss of facilities or another specific impact.

Look at the council’s project page, site notices, housing correspondence, committee or cabinet papers and resident newsletters. If the project is on land owned by another organisation, check who issued the public commitment and who controls construction. Do not assume that the organisation with the council’s name on a sign is responsible for every part of delivery.

Request a written update that answers the useful questions

Send one clear written request to the identified team or sponsor. Email creates a dated record, but a letter, online contact form or accessible communication channel is also suitable. Ask for an accessible format, interpreter or language support if you need it.

Questions to include

  1. What specific part of the project is delayed?
  2. What is the current expected milestone or handover date, and is it an estimate or an approved timetable?
  3. What changed from the previous schedule?
  4. What decision, approval, work or information is needed next?
  5. Who owns that next action, including the responsible team or external organisation?
  6. How does the delay affect residents, allocations, temporary accommodation or access to services?
  7. When will the next update be issued, and how will residents receive it?

Ask the council to distinguish confirmed information from a forecast. A realistic revised milestone is more useful than an unqualified promise. If the answer is verbal, send a short follow-up stating what you understood and invite corrections.

Keep an evidence log

Save the original schedule, public notices, letters, emails, meeting notes and photographs of site notices. Keep a dated list of your contacts, the response received and any missed commitment. Record practical effects such as extra rent or travel, a delayed allocation, unsuitable accommodation or an accessibility risk. This is sensible evidence-keeping, not a legal requirement, and it helps an organisation investigate a specific failure.

Council or organisation’s role Typical problem First route What you can ask for
Social landlord No promised update, poor communication, failure to manage a housing service, or another service failure affecting a resident The landlord’s published complaints procedure An explanation, correction of the service failure, a reliable update, practical remedy or compensation where the policy allows
Homelessness service Handling of a homelessness application, assessment or decision The council’s homelessness review or complaints route, as applicable The decision or service to be reviewed under the relevant homelessness process
Housing register Priority, banding or an allocation decision The council’s allocation review or complaints route A review of the housing-register decision under the published scheme
Planning authority A planning application has not been determined, or a planning decision is disputed The planning authority’s process and any statutory appeal route that applies A decision or planning appeal where the legislation permits
Project sponsor, contractor or developer Construction, procurement or handover is late The sponsor’s resident-contact or complaints route; complain to the council where it made a service commitment or controls the project A status report, reasons, revised milestones and action owner

A project delay can involve more than one route. For example, the sponsor may owe residents an update while the landlord separately mishandles a temporary move. Describe each failure separately rather than asking one body to provide a remedy it does not control.

Complain to the council or landlord when service has failed

GOV.UK’s council-housing guidance directs residents to complain to the council first and to contact the Housing Ombudsman if the issue cannot be resolved. Use the landlord’s published policy if the council is acting as your social landlord. A complaint is stronger when it identifies the service failure, its effect and the outcome you want.

What to put in the complaint

  • State that you are making a complaint, not merely requesting information.
  • Name the project, address, relevant dates and previous reference numbers.
  • Describe the missed promise, absent update, inaccurate information or other service failure.
  • Explain the effect on you or the affected resident group.
  • Attach or list the key evidence without sending unnecessary personal data.
  • Ask for a specific response: the current position, correction of records, a communication plan, an apology, practical action or consideration of loss under the policy.
  • Ask the landlord to acknowledge the complaint and confirm the expected response date.

If the issue is simply that building work has not finished, the complaints team may not be able to accelerate a contractor. It can still examine whether the landlord or council gave misleading information, failed to communicate, ignored an agreed commitment or mishandled the effect on your housing service.

Understand the Housing Ombudsman’s two-stage process

The Housing Ombudsman deals with eligible complaints about a social landlord’s housing service and complaint handling. Its resident definition is: “An expression of dissatisfaction, however made, about the standard of service, actions, or lack of action by an organisation, its own staff, or those acting on its behalf. Affecting an individual resident or group of residents.” A general delay in a council-sponsored development is not automatically within that remit.

Published response periods

Stage Landlord acknowledgement Landlord response
Stage one Within 5 working days Within 10 working days of acknowledgement
Stage two escalation Within 5 working days Within 20 working days of acknowledgement

A landlord may extend a response period, but it should give reasons and a written date for the response. Keep the acknowledgement and calculate the dates in working days. If a deadline passes, contact the landlord to point out the missed date and ask for the response. The Ombudsman’s Dispute Support team may help secure a response.

When escalation is appropriate

Ask for stage two if the stage-one answer does not resolve the complaint or fails to address the points raised. Formal Ombudsman investigation generally follows completion of both stages. The Ombudsman says it cannot investigate on a resident’s behalf, so you must present the complaint and evidence yourself. It can examine landlord service and complaint handling; it cannot order a construction programme to finish simply because a council project is late.

Check whether another ombudsman or review route applies

The Housing Ombudsman’s remit is housing-landlord activity and management. Its examples include repairs, complaint handling, antisocial behaviour and charges. The same council may be responsible for services outside that remit.

Homelessness and housing-register decisions

Handling of a homelessness application and disputes about housing-register priority may fall within the Local Government and Social Care Ombudsman’s area rather than the Housing Ombudsman’s. First use any statutory review or internal process stated in the decision letter or allocation scheme. A complaint about delay in building homes is not the same as a challenge to your legal priority or homelessness decision.

Planning decisions

If the complaint concerns a planning application, identify whether the problem is delay in deciding the application, the content of a decision or construction after permission was granted. The applicable planning process and appeal rights depend on the decision and the UK nation. A planning application determination period concerns the authority’s decision on the application; it does not establish a completion deadline for an approved development.

Third-party delivery

If a contractor, housing association or private developer controls the work, ask the council what oversight or contractual role it has. Complain to the organisation that made the resident-facing commitment as well as to the delivery body where its process permits. Do not assume that a council can disclose another organisation’s records or compel a private programme to meet an unrecorded date.

Use information requests to obtain existing records, not a guaranteed finish date

A Freedom of Information request can be useful for finding records, but it cannot guarantee an answer such as “the project will complete on this date.” Council responses illustrate why. Dover District Council said it did not hold expected or actual completion dates because those dates were not a planning requirement. Wokingham Borough Council said it held no data about the requested development delays and explained that applicants do not have to tell the local planning authority when a development starts or completes. Wigan Council likewise reported that it did not hold a specific list identifying delayed developments and noted that external factors can affect progress. Those are local responses, not proof that every council lacks control or information.

Make a precise request

Ask for existing records and a date range, for example:

  • Project-board, cabinet, committee or scrutiny reports.
  • Published plans and the latest approved timetable.
  • Risk, milestone or progress reports held by the council.
  • Resident notices and consultation communications.
  • Correspondence with a contractor or developer that the council holds.
  • Records showing changes to the target handover or occupation date.

Ask for records rather than explanations that would require officials to create a new dataset. The council may not hold every item, and exemptions or other local information procedures may apply. If you need an explanation of current progress, a direct written question to the project team is usually more suitable than an information request alone.

Separate planning deadlines from construction completion

Planning guidance from the Ministry of Housing, Communities and Local Government describes periods for deciding planning applications in England and an applicant’s right to appeal where an application is not determined. Those provisions address a planning decision. They do not mean that an approved council-housing scheme must be built or occupied within the same period.

Construction can be affected by procurement, funding, land, utilities, technical approvals, contractor performance, changes in scope and other matters. Ask which of these categories applies to your project, but treat the answer as a project-specific explanation rather than a general rule. If the council has announced a new milestone, ask whether it is approved, conditional or indicative.

Escalate safely when residents are being affected

When communication is the main failure

Send a formal complaint identifying each unanswered question and the date it was first raised. Ask for a named contact and a regular update schedule. If several residents are affected, a joint submission can show the shared impact, while each resident should still describe individual housing or accessibility consequences.

When accommodation or safety is at risk

Tell the housing team immediately if a delay leaves you without suitable accommodation, creates an accessibility problem or affects health and safety. Ask what interim arrangement or risk control is available. A construction timetable complaint should not replace urgent reporting of a repair, safeguarding concern or homelessness emergency.

When a promised date has passed repeatedly

Request the source of the latest date, the assumptions behind it and the trigger for changing it. Ask the sponsor to explain what residents should do if the next milestone is missed. Keep communications factual; do not accuse an individual of misconduct without evidence.

A practical sequence for the next 30 days

  1. Day 1–3: Identify the site, council team, tenure and council role. Save the original public commitment.
  2. Day 3–7: Send the written questions and request an accessible response if needed.
  3. After the reply: Compare the answer with the published schedule and list any unanswered point or changed commitment.
  4. If service failed: Submit a formal landlord or council complaint, state the impact and request acknowledgement and a response date.
  5. If the issue is outside landlord scope: Check the homelessness, allocation, planning or third-party route before escalating.
  6. At each deadline: Record the date, chase a missing response and ask for the next written milestone.
  7. After both landlord stages: Consider the Housing Ombudsman only if the complaint concerns an eligible social-landlord service or handling issue.

What a useful outcome looks like

Residents cannot always obtain an immediate completion date, particularly where the council does not control construction or has not recorded one. A useful outcome may instead be a verified current status, the reason for the change, a named action owner, a realistic milestone, a communication schedule and a remedy for a separate service failure. Keep those outcomes distinct: accountability for communication does not guarantee that a contractor will finish by a particular day.
