CRZ clearance

What permits are required to build or widen a road through forest land in India?

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Short answer: A road that uses land legally treated as forest for a non-forest purpose normally requires a forest-diversion approval under the current forest-conservation framework. Depending on the alignment and project category, it may also require a separate environmental clearance (EC), wildlife clearance, coastal regulation zone (CRZ) clearance and other land or infrastructure permissions. These approvals are not interchangeable. A forest approval does not by itself establish that EC or wildlife approval is unnecessary.

Screen the complete road and widening footprint—including temporary works and ancillary areas—against forest records, Protected Areas, eco-sensitive zones (ESZs), eco-sensitive areas (ESAs), wildlife corridors, wetlands and CRZ boundaries before construction planning. The exact approval set and sequence are project-specific.

Which approvals should a forest-road project be screened for?

Start with four separate regulatory questions rather than looking for one “forest-road permit.” The table below shows the issue each track addresses and when it commonly becomes relevant.

Approval or permission What triggers the question What the available official material establishes
Forest-diversion approval Use of land legally treated as forest for a non-forest road, widening or associated purpose Forest clearance is a distinct process on PARIVESH. The land classification and current forest-conservation law and rules must be checked for the actual proposal.
Environmental clearance (EC) The road or widening proposal falls within the applicable entries and thresholds of the EIA Notification framework Physical-infrastructure projects are addressed under Item 7 of the EIA Notification 2006 framework. Category A proposals are appraised centrally; Category B proposals are appraised at state or Union-territory level.
Wildlife clearance The alignment or its impacts engage a Protected Area, ESZ/ESA, habitat, corridor or another situation covered by wildlife law and applicable guidance Where prior wildlife clearance applies, project-related activity cannot begin until that clearance is obtained.
CRZ clearance Any portion of the route lies in a regulated coastal zone CRZ clearance is a separate pathway on PARIVESH and must be checked against the current CRZ notification and maps.
Other permissions Land acquisition, tree felling, railway or utility crossings, and state or local requirements These may apply to a particular route, but no universal checklist can be assumed for an unspecified state and alignment.

PARIVESH treats forest, environmental, wildlife and CRZ clearances as separate workflows. Treating one approval as a substitute for another is a common and costly planning error.

Forest-diversion approval for the road footprint

Confirm the legal status parcel by parcel

The first question is not whether a road is called a “public road” or “widening.” It is whether any part of the proposed right of way, construction area or associated facility is land legally treated as forest, and whether the proposed activity is a non-forest use. Obtain authoritative records for every affected parcel and map them to the engineering alignment. A route can contain both forest and non-forest portions; those portions cannot be treated as one legal category.

Widening can still be diversion

Widening an existing road does not automatically avoid forest regulation. New lanes, shoulders, drains, cut slopes, retaining structures, borrow areas, camps, material yards and other ancillary works can expand the area used for a non-forest purpose. Include the full construction and temporary-work footprint in the screening exercise.

Do not rely on work outside the forest boundary

A 2023 project-specific Expert Appraisal Committee record required forest clearance for diversion and expressly stated that beginning work on non-forest land did not create a right to approval for forest land. That condition is not a national exemption or a universal sequence, but it illustrates the practical rule: keep forest and non-forest portions legally distinct and do not infer forest approval from progress elsewhere.

What the application decision will determine

The competent authorities will apply the current forest-conservation legislation, rules and conditions to the project facts. The applicable requirements can vary with the area, legal classification, purpose, agency and current delegations. Do not insert a supposedly universal approval stage, exemption, compensatory-afforestation formula or net-present-value rate into the project plan without checking the current rule and the specific approval.

When environmental clearance is required

Use the current EIA framework, not an old road checklist

The Ministry of Environment, Forest and Climate Change (MoEFCC) places physical-infrastructure projects under Item 7 of the EIA Notification 2006 framework. Whether a particular new road or widening proposal needs EC depends on its scope, category, location and the notification and amendments in force when the application is made.

PARIVESH displayed a consolidated EIA Notification 2006 updated through July 2026. Check that live text and its amendments for the actual project instead of relying on an older article, tender note or consultant template.

Category A and Category B routes

Category Appraisal level identified by MoEFCC Practical implication
Category A Central level, through the Expert Appraisal Committee (EAC) The application follows the central appraisal route and any conditions issued with the EC.
Category B State or Union-territory level, through a State Expert Appraisal Committee (SEAC) The state or Union-territory appraisal route applies, subject to the current notification and institutional arrangements.

The table identifies appraisal levels, not a blanket answer that every forest road needs EC. Confirm the applicable entry, threshold and category for the precise length, width, scope and location.

Historical delinking does not waive either approval

NHAI’s 2019–20 annual report described a process then in force in which EC consideration for linear projects involving forest land was delinked from forest clearance. That is historical procedural context, not proof of today’s sequence and not a waiver of forest-diversion approval or EC. The current notification and the project’s own conditions control.

When wildlife clearance is required

Map protected and sensitive areas along the entire alignment

Wildlife review becomes a separate issue when a route is in or around a Protected Area, an ESZ or ESA, or affects habitat or a wildlife corridor under applicable law and guidance. Proximity alone does not give every road the same answer: the exact boundary, notification, legal regime and proposed impacts matter.

Understand the review bodies

In its parliamentary response posted 30 July 2026, MoEFCC described scrutiny involving the State Chief Wildlife Warden, the State Board for Wildlife, the Ministry and, for recommended cases, the Standing Committee of the National Board for Wildlife (SCNBWL). The review considers ecological sensitivity, cumulative and project-specific effects on habitats and corridors, and proposed mitigation.

“No construction or other project-related activities can be commenced by the Project Proponents unless prior Wildlife Clearance, as applicable, is obtained under the provisions of the Wildlife (Protection) Act, 1972.”

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Keep the qualification “as applicable.” It means the location and law must first establish whether prior wildlife clearance is required; where it is required, construction and other project-related activity must wait for it.

ESZ cases need current, location-specific checking

NHAI’s annual report records a 2020 communication about the applicability of wildlife requirements to road projects in an ESZ outside a Protected Area. That historical reference is a reason to verify current guidance for the actual ESZ, not a general exemption for roads outside Protected Areas.

CRZ, wetlands and other location-based controls

Coastal regulation zone

If any part of the alignment, widening footprint or associated work lies in a regulated coastal area, screen it for CRZ clearance. PARIVESH lists CRZ clearance separately from EC, forest and wildlife processes. Check the current CRZ notification, approved maps and the competent authority for the relevant coastal state or Union territory.

Wetlands and other environmentally significant features

MoEFCC describes PARIVESH’s GIS-enabled Decision Support System as a way to analyse proximity to forests, Protected Areas, ESZs, wetlands and CRZs. A route that misses a forest boundary can still intersect another regulated or ecologically significant feature, so do not stop the screening after the forest layer is clear.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Land, trees, railways and utilities

Separate permissions may be needed for acquisition or transfer of land, felling or removal of trees, railway overbridges or underbridges, and crossings of utilities. NHAI identifies land acquisition and railway crossing approvals as separate project issues. The exact state, local-body, railway and utility requirements depend on the route and are not established by the forest-clearance process.

A practical approval-screening workflow

  1. Freeze the engineering envelope. Record the centreline, full right of way, widening limits, cut-and-fill slopes, drains, retaining works, interchanges, camps, borrow areas, disposal areas and other temporary or ancillary works.
  2. Run spatial screening. Use the PARIVESH GIS-enabled Decision Support System and authoritative maps to check forests, Protected Areas, ESZs/ESAs, wildlife corridors, wetlands and CRZs. Save the map layers and dates used so later design changes can be rechecked.
  3. Verify parcel status. Obtain the legal classification for every affected parcel and mark forest and non-forest portions separately. Resolve overlaps or conflicting records with the competent land and forest authorities before finalising the alignment.
  4. Define the project scope. Confirm whether the work is a new road, lane addition, realignment, rehabilitation or another form of widening; document length, width, construction method and ancillary facilities.
  5. Open the separate tracks. Assess forest diversion, EC, wildlife and CRZ requirements independently. A “not required” conclusion for one track must not be copied into another file.
  6. Check current notification and guidance. Review the EIA Notification consolidated through July 2026, current forest-conservation rules, wildlife directions and CRZ instruments applicable on the filing date. Historical reports are context only.
  7. Obtain prior approvals where required. Do not begin project-related activity in a situation requiring prior wildlife clearance. Do not treat work on non-forest land as permission to use forest land.
  8. Build the conditions into design and contracts. Translate approval conditions into drawings, method statements, work zones, supervision duties, monitoring, restoration and reporting requirements before mobilising contractors.

Documents and facts that determine the answer

Authorities and appraisal bodies need a project definition precise enough to test legal and ecological effects. Assemble, at minimum, the following decision inputs:

  • Alignment maps and coordinates covering the entire construction and temporary-work footprint.
  • Parcel-wise forest and land records, including the status of each widening segment.
  • Road category, proposed length and width, cross-section, construction method and ancillary facilities.
  • Maps showing Protected Areas, ESZs/ESAs, corridors, wetlands and CRZ boundaries.
  • Any alternatives considered and the forest area, sensitive-area intersections and mitigation implications of each.
  • Existing permissions, land-acquisition status and proposed railway, utility or local-road crossings.

These facts are not paperwork for its own sake: they determine which current notification entries, authorities and conditions apply.

How to compare alternative alignments

If engineers can avoid a forest edge, corridor or coastal zone, compare the alternatives before committing to a detailed application. Use the same criteria for every route:

Comparison axis Question to answer
Forest land and legal status How much legally classified forest land would each route use, and are the affected parcels contiguous or fragmented?
Sensitive-area intersections Does the route enter a Protected Area, ESZ/ESA, wildlife corridor, wetland or CRZ, and for what length or footprint?
EC category and appraisal Would the project fall under a different Item 7 entry or Category A/B pathway?
Number of approval tracks Which separate forest, EC, wildlife, CRZ, land, tree, railway or utility permissions are triggered?
Mitigation and conditions What habitat protection, compensatory plantation, pollution control, monitoring or restoration obligations would each route carry?

A shorter route is not automatically the lower-risk route if it intersects more sensitive boundaries or creates additional approval tracks.

Conditions, mitigation and monitoring

Clearance is not the end of the obligation. MoEFCC states that safeguards are prescribed as applicable through appraisal and clearance conditions. Depending on the project, conditions can address wildlife protection, habitat conservation, pollution control, compensatory plantation, construction methods, monitoring and reporting. Treat each condition as a contractual and design requirement; assign responsibility, funding and evidence of compliance before work starts.

What the recent numbers do—and do not—show

MoEFCC reported that 20 projects or activities located at least partly in a Protected Area or ESZ/ESA received EC during financial years 2024–25 and 2025–26. This is a count of approvals in those two years, not a road-specific forecast, approval probability or success rate. It should not be used to estimate how long or how likely a particular road application will be.

Common mistakes and how to correct them

  • “It is only widening, so no forest approval is needed.” Corrective action: map every new lane, shoulder, slope, drain and ancillary area against legal forest records.
  • “EC covers wildlife clearance.” Corrective action: open a separate wildlife screening and obtain prior clearance where applicable.
  • “Outside the Protected Area means outside wildlife regulation.” Corrective action: check ESZ/ESA boundaries, corridors and current location-specific directions.
  • “We can start on ordinary land while the forest file is pending.” Corrective action: follow the project’s conditions and do not infer any right to forest approval from non-forest work.
  • “An old consultant checklist is still valid.” Corrective action: verify the July 2026 consolidated EIA notification and current forest, wildlife and CRZ instruments.
  • “A clear forest map means the route is cleared.” Corrective action: screen wetlands, CRZ and other environmental, land, railway, utility and local permissions separately.

Bottom line for project owners and contractors

Before treating a forest-road or widening project as construction-ready, establish the legal status of every affected parcel, screen the complete footprint in PARIVESH, and run forest-diversion, EC, wildlife and CRZ checks as separate decisions. The current requirement depends on the alignment, scope, category and sensitive-area intersections. Obtain every approval that applies and incorporate its conditions into the design and construction plan; no single “forest permit” substitutes for that project-specific review.
