The core path is environmental licensing through Licença Prévia (LP), Licença de Instalação (LI) and Licença de Operação (LO). Waterfront and in-water works also require prior consultation with the competent Brazilian Navy maritime authority under NORMAM-303. A private terminal or use of port areas can add a Ministry of Ports and Airports (MPOR) and ANTAQ authorization or adequacy process, while dredging, water withdrawals, discharges, land tenure and municipal construction rules create separate checks.
There is no single Bahia shipyard permit. The exact package depends on whether the site is inside an organized port, whether the project occupies or alters jurisdictional waters, whether a new channel or dredging is needed, the environmental authority with competence over the impacts, the water source and use, and the legal status of the land or seabed.

Start by defining the project that will be licensed
Before requesting any approval, map the complete project rather than describing only the buildings. Record the land parcel, any water-area polygon, berths, ramps, floating structures, breakwaters, access channel, maneuvering basin, anchorage, dredging footprint, utilities, repair activities, cargo or passenger operations, storage areas and expected operating profile. Identify whether the facility is a land-only shipyard, a marina, a small or medium terminal, a new port, an expansion of an existing terminal, or a mixed repair-and-logistics complex.
Do these 3 things before closing this tab:
1Clear out junk files and repair common Windows errors2Fix the driver behind crashes, sound loss and screen glitches3Repair Windows errors before they cause bigger problemsThis definition determines which authority acts first and which studies are proportionate. A workshop set back from the shoreline may avoid some maritime-works filings, while a pier, launch ramp, mooring buoy, dredged basin or floating dock places the project under the Brazilian Navy’s in-water review as well as environmental licensing. A private terminal outside an organized port has a different port-sector path from a facility using an existing organized-port area.

Environmental licensing: LP, LI and LO
Brazil’s port-sector guidance treats environmental licensing as a legal obligation that must precede installation of planned port infrastructure. The licensing authority establishes the required procedure through a Termo de Referência, so the developer should obtain that document before commissioning technical studies.
| License | Purpose | Typical project material |
|---|---|---|
| Licença Prévia (LP) | Evaluates environmental feasibility and approves the location and basic concept, subject to conditions. | Impact studies defined by the Termo de Referência. An EIA/RIMA may be required when the expected impacts meet the applicable thresholds. |
| Licença de Instalação (LI) | Authorizes construction and physical implementation after the conditions of the LP are addressed. | Implementation-level studies and plans, commonly including an RCA or PBA and an environmental-management, mitigation and monitoring program where required. |
| Licença de Operação (LO) | Authorizes operation after the authority verifies compliance with installation conditions and operating controls. | Evidence that mitigation, monitoring, pollution controls and other LP/LI conditions have been implemented. |
The sequence is not a substitute for the Navy, port-sector, water-use or municipal approvals. It is the construction-to-operation environmental track. Do not begin earthworks, dredging, pile driving or installation on the assumption that an LP alone authorizes construction; the LI is the installation authorization, and the LO is needed before the licensed operation begins.
Choosing the environmental authority
Competence can be federal, state or municipal depending on the project’s location, scale and impact profile. Bahia’s environmental portal provides consultation for state and municipal licensing acts and is a practical starting point for confirming the level of action. Ask the competent authority to issue or confirm the Termo de Referência and identify whether the project requires an EIA/RIMA, a less extensive assessment, or specific programs for dredging, sediment, water quality, waste, noise, habitat and community impacts.
Plan for conditions, not just the license certificate
Each license can carry conditions controlling construction timing, monitoring, mitigation, reporting, emergency response, waste handling, dredged material and community measures. Build those obligations into the design, procurement package and operating budget. A change to the berth layout, dredging volume, cargo, discharge point or production process can require a license amendment or a new review rather than a simple administrative update.

Brazilian Navy approval for works in jurisdictional waters
Under the Brazilian Navy’s maritime-works guidance, execution of a public or private work located under, over or alongside Brazilian jurisdictional waters requires prior consultation with the applicable Capitania dos Portos, Delegacia or Agência. The guidance states a non-navigable-river exception; a project team should document why that exception applies instead of assuming it.
NORMAM-303 categories expressly cover marinas, small and medium terminals, new ports, ports associated with dredging, terminal expansions, breakwaters, floating structures, mooring buoys and other works. A shipyard with a launch ramp, quay, dolphins, floating dock or dredged turning area should therefore be screened even when its principal buildings are on land.
What to submit
Use the documentation specified for the work category in the current NORMAM-303 procedure and submit it to the correct local maritime authority. The guidance calls for two original copies and payment of the applicable GRU. Prepare a consistent drawing set showing coordinates and dimensions of the proposed structures, relationship to navigation, access and maneuvering areas, construction method, and any dredging or obstruction. Keep the Navy submission synchronized with the environmental design; conflicting coordinates or dimensions can force resubmission.
Check the local rule before filing
Local procedures can change. The Capitania dos Portos da Bahia page records Portaria 22 of 17 October 2025, amending NPCP-BA/2024. Confirm the current local navigation and submission requirements immediately before filing, even if an earlier concept received informal feedback.

Port-sector authorization for private terminals and port areas
If the project is a private port or terminal, or uses an area not assigned to port operations, check the MPOR procedure for an authorization or an adequacy declaration and the related ANTAQ track. The adequacy review examines consistency with port-sector policy and the applicable Plano de Desenvolvimento e Zoneamento (PDZ).
Core technical package
The MPOR service expects an EVTEA and a coherent technical file. Assemble:
- Georeferenced plans of the land and water areas;
- Berth locations and dimensions;
- The access channel, maneuvering basin and anchorage;
- A descriptive memorial explaining construction and operation;
- Capacity projections, cargo or passenger assumptions and operating profile; and
- An investment estimate.
The adequacy-declaration service states an estimated stage duration of up to 100 business days. That is an administrative estimate for the service stage, not a promise that the entire project will be authorized within that period; environmental studies, Navy consultation, land permissions and corrections run on their own schedules.
Organized-port versus outside-port decisions
Confirm whether the parcel and water area are inside an organized port and whether the proposed use is compatible with its PDZ and port authority arrangements. A site outside an organized port may require a private-terminal authorization path, while a project inside one can require coordination with the port authority and proof that the proposed occupation and operations fit the port’s planning instruments. Do not infer current authorization from an older operator license. For context, CODEBA lists License of Operation No. 1,622/2022 for the Organized Port of Salvador, valid through 5 August 2032; its listings also show an Aratu-Candeias operating-license validity through 26 July 2025 and an Ilhéus renewal through 30 September 2028. The Aratu date has passed, so its current status must be confirmed directly before relying on it.

Water-use outorga and discharge controls
A project may need a water-use outorga for withdrawals, discharges or other regulated uses. The granting body depends on the source and the use: determine whether the case belongs with the National Water and Basic Sanitation Agency (ANA) or Bahia’s water authority, INEMA, and check any basin-committee coordination.
ANA’s Bahia-specific rule for the Tremedal system illustrates the type of conditions that can accompany an outorga: allocation limits, measurement and monitoring, annual declarations and coordination with INEMA and the basin committee. That rule is an example, not a universal condition for every Bahia facility. A project team should quantify intake, process water, cooling, sanitary demand, stormwater interaction and every planned discharge, then obtain a written determination of the applicable authority and filing.
Municipal, land and coastal approvals
Environmental and maritime approvals do not replace local building and operating permissions. Depending on the municipality and parcel, the project may need:
Quick wins for a faster PC:

- Fire-safety approval for buildings, fuel areas, workshops and storage;
- A municipal operating authorization;
- Proof of ownership, lease, concession or other legal right to occupy the land;
- Permission for occupation of coastal or other Union property where the shoreline or seabed is federally owned; and
- Additional site-specific approvals identified by the municipality, environmental authority or land administrator.
Verify the legal boundary between private land, tidal or coastal Union property and the water area. A lease or purchase contract alone may not authorize a pier or seabed occupation. Put the tenure documents and georeferenced boundaries into the same base map used for the environmental, Navy and MPOR filings.

A practical permitting sequence
- Define the footprint and operation. Fix land and water polygons, facility type, berths, channels, dredging, breakwaters, repair activities, cargo, utilities and operating hours.
- Confirm environmental competence. Consult Bahia’s environmental portal and the relevant authority; obtain the Termo de Referência before ordering impact studies.
- Screen study requirements. Determine whether an EIA/RIMA, RCA, PBA or other impact, mitigation and monitoring package is required. Include dredging, sediment management, water quality, waste and habitat issues in the scope where applicable.
- Prepare the LP application. Submit the location and basic concept with the studies and documents required by the Termo de Referência. Track every condition because it will govern the LI.
- File the Navy consultation early. Select the NORMAM-303 category, prepare the work-specific drawings and technical documents, provide two original copies, pay the GRU and submit to the applicable Bahia Capitania, Delegacia or Agência before any in-water or waterfront work starts.
- Develop the port-sector file. If the project is a private terminal or involves unassigned port areas, prepare the PDZ-consistency explanation, EVTEA, georeferenced plans, descriptive memorial, capacity forecast and investment estimate for the MPOR/ANTAQ process.
- Resolve water uses. Apply for an outorga or obtain a written no-outorga determination for each withdrawal, discharge or regulated use through ANA or INEMA, as applicable.
- Obtain the LI and site approvals. Complete the implementation plans, environmental-management programs, municipal building and zoning approvals, fire review, land or lease permissions and any coastal or Union-property authorization before construction.
- Construct under the conditions. Keep the approved coordinates, dimensions, methods, monitoring and reporting unchanged unless the authorities approve a modification.
- Close out for operation. Demonstrate implementation of LI conditions, controls and monitoring, obtain the LO, and secure the municipal operating authorization and any port-sector operating clearances before commencing the planned activity.
How the project concept changes the permit burden
| Project concept | Additional issue to resolve | Why it matters |
|---|---|---|
| Land-only shipyard | Environmental licensing, municipal zoning/building and fire approvals, land tenure, plus water-use review if applicable. | Keeping all work on land can avoid some maritime-works categories, but shoreline access or a launch structure changes the analysis. |
| Shipyard with quay, ramp or floating dock | Prior Navy consultation under NORMAM-303 and environmental review of the waterfront structures. | The work is under, over or alongside jurisdictional waters and must be reviewed before execution. |
| Marina or small/medium terminal | NORMAM-303 submission, environmental LP/LI/LO and municipal/site permissions. | Marinas and small or medium terminals are expressly listed maritime-works categories. |
| New channel, turning basin or dredged port | Dredging-related Navy category, environmental studies and water-area mapping; port-sector review if it is a terminal or port. | Dredging changes the footprint, navigation geometry and environmental study burden. |
| Private terminal outside an organized port | MPOR/ANTAQ authorization or adequacy process, PDZ analysis where applicable, EVTEA and georeferenced port plans. | Private use and port-sector policy must be assessed separately from the environmental license. |
| Expansion inside an organized port | Compatibility with the port’s planning and occupation arrangements, plus all environmental and maritime approvals triggered by the expansion. | An existing port license does not automatically authorize a new berth, dredging area or changed operation. |
Common failure points and how to avoid them
Starting design without a fixed water boundary
Unclear coordinates lead to inconsistent environmental, Navy and MPOR drawings. Freeze a single georeferenced base plan and issue controlled revisions to every authority.
Treating the LP as permission to build
The LP addresses feasibility and conditions; the LI is the installation authorization. Mobilizing construction before the LI and other required approvals can invalidate the project schedule and expose the developer to enforcement.
Leaving dredging until the end
Dredging affects channel geometry, sediment handling, navigation and impact studies. Decide early whether the site uses an existing channel or needs a new or enlarged one, then include that footprint in the Termo de Referência, Navy category and port-sector file.

An operator’s license, such as the licenses listed by CODEBA, is evidence about that operator and facility at a stated date. It is not a transferable authorization for a different developer, footprint or activity. Confirm current validity and obtain project-specific approvals.
Filing only with the environmental authority
The Navy consultation, port-sector authorization, outorga, municipal approvals and land or coastal permissions are separate tracks. Create a responsibility matrix naming the authority, document set, submission date, conditions and renewal or reporting obligation for each track.
Documents to assemble before formal submissions
- Corporate and representative identification documents;
- Proof of land ownership, lease, concession or other occupation right;
- Georeferenced land and water polygons and a unified site plan;
- Facility layout showing berths, ramps, floating structures, breakwaters, channels, basins and anchorage;
- Descriptive memorial, construction method and operating profile;
- Capacity projections, cargo or passenger assumptions and investment estimate for the EVTEA;
- Environmental baseline information and studies required by the Termo de Referência;
- Water-demand, withdrawal and discharge calculations;
- Municipal zoning, building and fire documentation; and
- NORMAM-303 work-category documents, two original copies and GRU payment evidence for the Navy submission.
Use the same project name, coordinates, dimensions and capacity figures in every file. Record each authority’s conditions and update the matrix when a local rule changes, including amendments such as Bahia’s Portaria 22 of 17 October 2025.
