There is no single Maryland “shipyard construction permit.” The approvals for a shipyard depend on the parcel, wetlands and waterways, floodplain and shoreline impacts, acreage disturbed, dredging or filling, utility arrangements, wastewater and stormwater discharges, air-emitting equipment, and local land-use rules. Before fixing a site plan, screen those constraints and coordinate with the Maryland Department of the Environment (MDE), applicable federal reviewers, and the county or municipality.
The practical question is not whether every shipyard needs every permit. It is which permit families are triggered by this site and this process plan. The sections below show how to make that determination before land purchase, design, or earthwork.

Is there a single Maryland permit for building a shipyard?
No. MDE’s permit categories address separate environmental activities rather than a shipyard as one project type. A facility might need approvals for regulated wetlands or waterways, erosion and sediment control, construction stormwater, industrial stormwater, wastewater, water supply or appropriation, and air emissions. Local zoning, site-plan, building, fire, utility, and special-area approvals may apply at the same time. Federal review can also be required when the work affects federally regulated waters or another federal interest.

Applicability cannot be decided from the word “shipyard.” A repair yard with no shoreline work and existing utilities presents a different review from a new yard that dredges a basin, builds piers, installs coating equipment, and discharges process water. Treat the project as a set of site and operational triggers.

Begin with a parcel constraints review
Before selecting a preferred layout, map the physical features and proposed work that can change the approval path. The map should cover:
- Tidal and nontidal wetlands and the waterways connected to them.
- Floodplains, shoreline limits, and nearby receiving waters.
- Existing ditches, streams, drainage outfalls, and submerged lands.
- Any proposed dredging, filling, bulkheads, piers, docks, launch ramps, dry docks, basins, or utility crossings.
- Buildings, roads, parking, laydown areas, cranes, fuel or material storage, and all areas of temporary or permanent earth disturbance.
- Existing public water and sewer, wells, septic systems, discharge points, and known contamination or cleanup areas.
- County or municipal boundaries and any local overlay or special-area requirements.
A concept map that omits a future pier, access road, drainage outlet, or utility trench can produce a misleading permit screen. Show the largest reasonably foreseeable construction footprint, then identify which elements are optional and which are essential to operations.
Wetlands, waterways, tidal waters, and floodplains
Use the joint federal/state application when regulated resources may be affected
MDE’s Wetlands and Waterways Protection Program provides a Joint Federal/State Application for alterations involving floodplains, waterways, and tidal or nontidal wetlands. The application process is the logical starting point when grading, road construction, shoreline stabilization, dredging, filling, a pier, a basin, a culvert, a utility crossing, or a stormwater outfall could alter a regulated resource.

The applicant must identify the resources and describe the proposed work. MDE and the relevant federal reviewers then determine which authorizations, conditions, avoidance measures, mitigation, and construction limits apply. A project that avoids wetlands but affects a waterway may follow a different path from one that fills tidal wetland; a project with no resource impact may not need this authorization at all.
Request water-quality certification when applicable
MDE also lists a separate water-quality certification request process. Certification questions generally arise when a federally reviewed activity could affect state water quality. Whether certification is required, and what conditions it contains, depends on the actual work and the federal review pathway. Include certification in the early agency discussion rather than assuming the joint application resolves every water-quality issue.
Design around resources before mitigation is priced
Moving a building or access road away from a wetland can be less costly than redesigning after an application identifies impacts. Have the engineer distinguish permanent impacts, temporary construction access, dewatering, cofferdams, pile work, dredged material, and stormwater outlets. Preserve a documented avoidance-and-minimization option even if the preferred concept includes shoreline construction.
Erosion, sediment control, and construction stormwater
Obtain plan approval and coverage before earth disturbance
MDE treats erosion and sediment control and stormwater-management plan approval as separate permit topics from the general permit for stormwater associated with construction activity. Maryland’s e-Permits guidance requires coverage before earth disturbance for a project that will disturb one or more acres. The same requirement applies when an initial phase is smaller but the planned project will ultimately disturb at least one acre: coverage must be secured before the first disturbance, not when the later phase begins.

“Disturbance” can include clearing, grading, excavation, fill placement, access roads, utility trenches, staging, and other work that exposes or relocates soil. Confirm the disturbed-acre calculation with the design engineer and the local approving authority, especially where construction is phased or contractors will work under separate contracts.
Coordinate the erosion and stormwater documents
The erosion and sediment control plan addresses how soil will be stabilized and kept out of waterways during construction. The stormwater-management plan addresses permanent drainage, runoff treatment, conveyance, and, where relevant, water-quality volume and peak-flow control. A shipyard’s large paved areas, roof areas, crane pads, launch facilities, and shoreline grades can make the permanent design more complex than a typical building site.
Do not authorize clearing or mass grading based only on a submitted plan. Verify that the required plan approvals, permit coverage, notices, inspection arrangements, and contractor responsibilities are in place. Incorporate stabilization milestones, inlet protection, sediment basins, dewatering controls, and inspection records into the construction contract.
Separate construction runoff from operating discharges
Industrial stormwater during operations
MDE lists a general permit for stormwater discharges associated with industrial activities and identifies marinas, boat yards, and yacht basins among its water-management categories. That listing makes industrial stormwater an important operational screening item for a shipyard or boatyard, but it does not establish that every facility, every construction phase, or every activity is covered by one identical authorization.
Map where rain can contact vessels, abrasive-blasting residue, paint or coating materials, metals, fuels, scrap, waste containers, loading areas, and maintenance work. Decide which areas can be enclosed, covered, isolated, or drained to treatment. The permit determination should be based on the actual industrial classifications and discharge points, not simply on the facility’s name.
Process wastewater and other wastewater streams
Maryland regulations require discharge authorization for specified discharges of waste or wastewater and for certain construction or modifications of systems serving industrial or commercial establishments when the work increases or alters discharges to state waters. A shipyard’s screening inventory should consider, as applicable:
- Vessel, equipment, or parts washing water.
- Wastewater from surface preparation, abrasive blasting, painting, or coating operations.
- Cooling water, boiler blowdown, or other process water.
- Sanitary wastewater from employees and visitors.
- Stormwater that contacts industrial materials or process areas.
- Dewatering water generated during excavation, basin work, or shoreline construction.
These examples are prompts for an inventory, not a finding that every stream will exist or require a separate permit. For each stream, document its source, expected volume, contaminants, treatment, storage, proposed discharge point, and whether it will enter a sanitary sewer, a private treatment system, or state waters. Ask MDE for a written applicability determination where the routing or treatment is unusual.

Water supply, wells, sewer, and water use
A new or altered water system can trigger approvals beyond the building connection. MDE identifies Water and Sewerage Construction Permit applications and Water Appropriation or Use Permits among its water-permit categories. A well, a high-capacity withdrawal, a new public-water extension, a force main, a wastewater collection system, or an on-site treatment system may each require review depending on the design and source.

At concept stage, establish the water balance: potable and sanitary demand, firefighting demand, vessel and equipment washing, process use, cooling, dust suppression, and seasonal peaks. Identify whether water will come from a public utility, a new or existing well, surface water, a hauled supply, or a combination. Match the water balance to sewer capacity and pretreatment requirements before finalizing the number of berths or production bays.
MDE guidance for new water supply also places water appropriation or use, water and sewerage construction, construction stormwater, wetlands and waterways, and discharge permits in the same early-screening universe. Treat utility design as part of environmental permitting, not as a late civil-engineering detail.
Air-quality review for shipyard equipment
MDE’s permit-topic index includes Air Quality General Permits to Construct. That establishes an air-permit category to screen; it does not prove that a particular shipyard needs an air permit or identify the applicable threshold.
Prepare an equipment and emissions inventory before purchasing or specifying major equipment. Include coating and paint booths, abrasive blasting, welding and cutting, boilers, emergency generators, material-handling engines, fuel tanks, solvent use, and any thermal or combustion process. Record fuel type, rated capacity, operating hours, controls, stack information, and the materials used. Submit that inventory to MDE’s air program for an applicability determination. Do not assume that a portable contractor unit, a temporary blasting enclosure, or a vendor-supplied control system is exempt without confirmation.

Local government approvals
County or municipal authorities may require zoning confirmation, a site plan, subdivision or parcel approvals, grading approval, building permits, fire-code review, utility permits, access permits, and floodplain or shoreline authorizations administered locally. The responsible jurisdiction depends on the parcel. Ask the planning, public works, building, and fire offices for a consolidated list and an application sequence before signing a construction contract.
Federal review
Federal involvement depends on the resource affected, the type of discharge or water work, federal funding or property, and the agency with jurisdiction. The Maryland joint application can provide a coordinated starting point for certain wetlands and waterways alterations, but it does not establish the outcome of every federal review. The available facts are not enough to promise a specific federal permit, a National Environmental Policy Act document, or a categorical exclusion. Determine those issues during agency coordination for the actual parcel and design.

Recommended permitting sequence
- Select candidate parcels and map constraints. Show wetlands, waterways, floodplains, shoreline, receiving waters, utilities, access, and known contamination.
- Create a concept plan. Include buildings, dry docks, launch facilities, piers, dredging and filling, roads, drainage, outfalls, staging, and utility connections.
- Hold a pre-application meeting. Bring the concept plan, resource map, acreage estimate, process summary, water balance, and preliminary discharge points to MDE. Include federal reviewers and local planning or building officials where appropriate.
- Resolve wetlands and waterway questions. Use the Joint Federal/State Application when the proposed work may alter regulated resources, and ask whether a water-quality certification request is also needed.
- Develop erosion, sediment, and permanent stormwater plans. Reconcile grading, shoreline protection, drainage, and construction sequencing across the civil, marine, and architectural drawings.
- Secure construction stormwater coverage before disturbance when the threshold applies. Confirm the approved plans, permit coverage, notices, inspection duties, fees, and contractor obligations.
- Inventory operating discharges and emissions. Obtain MDE determinations for industrial stormwater, process and sanitary wastewater, water supply or appropriation, sewer construction, and air-emitting equipment.
- Integrate conditions into final design and contracts. Carry mitigation, buffers, seasonal restrictions, treatment systems, monitoring, reporting, inspections, and stop-work procedures into bid documents and the schedule.
How to compare candidate Maryland parcels
| Decision factor | Questions to answer | Why it changes the approval path |
|---|---|---|
| Wetlands and waterways | Are tidal or nontidal wetlands, streams, floodplains, or submerged resources on or next to the site? | Resource alterations may require the joint federal/state application, avoidance, minimization, mitigation, and conditions. |
| Shoreline and marine work | Will the project dredge, fill, build a pier, create a basin, install a launch ramp, or place an outfall? | In-water and shoreline work can add state and federal review beyond ordinary upland construction. |
| Earth disturbance | How many acres will be disturbed, including later phases, roads, staging, and utilities? | The acreage and phasing determine when construction stormwater coverage and erosion controls must be in place. |
| Water and sewer | Is public capacity available, or are wells, treatment systems, extensions, or new collection facilities needed? | Water appropriation or use and water/sewer construction approvals may be added. |
| Discharge profile | What process, sanitary, cooling, washing, dewatering, and stormwater streams will leave the property? | Different streams can require different discharge authorizations, treatment, monitoring, and receiving-water controls. |
| Air emissions | What coating, blasting, welding, combustion, storage, and engine equipment will operate? | MDE air-permit applicability depends on the equipment and emissions, not the shipyard label. |
| Local jurisdiction | Which county or municipality controls zoning, site plan, building, fire, utilities, and access? | Local approvals and sequencing vary by parcel and can control when state permits are usable. |
Schedule, fees, and what can be estimated
MDE’s online wetlands permit entry gives an estimated processing range of 30 to 365 days. That is a portal estimate for that permit entry, not a forecast for a particular shipyard or for the complete approval program. It does not include time to survey resources, redesign a project, obtain local approvals, answer agency comments, secure mitigation, or coordinate federal reviews.
There is no defensible universal shipyard-permitting schedule or fee total without a parcel and process plan. Build a schedule with separate activities for surveys and engineering, agency pre-application, plan preparation, application review, responses and revisions, utility approvals, local hearings or permits, and construction-stormwater authorization. Treat any date as conditional until the agencies confirm the applicable pathway.
Common mistakes and how to correct them
Buying a shoreline parcel before mapping resources
Problem: A preferred layout assumes a basin, pier, or outfall that later conflicts with wetlands or floodplain constraints.
Fix: Complete the resource and floodplain map and a marine-work concept before closing on the site or committing to a fixed footprint.
Phasing earthwork to avoid the stormwater threshold
Problem: A first phase is described as less than one acre even though the approved development will ultimately disturb at least one acre.
Fix: Calculate the complete planned disturbance and secure coverage before the first disturbance when the threshold applies.
Do these 3 things before closing this tab:
1Scan for outdated or missing drivers - takes under a minute2Repair Windows errors before they cause bigger problems3Fix the driver behind crashes, sound loss and screen glitchesTreating construction runoff as the only water issue
Problem: The project obtains construction coverage but has no plan for vessel washing, coating wastewater, sanitary flow, or industrial stormwater after opening.

Leaving utilities until the end
Problem: Public sewer or water capacity is unavailable, forcing a redesign after civil plans are complete.

Assuming air permits are automatic or irrelevant
Problem: Coating, blasting, boilers, generators, or engines are installed before MDE reviews emissions.
Fix: Submit a process and equipment inventory and obtain an air-program applicability determination before purchase or installation.
What to bring to the first agency meeting
- A parcel map with wetlands, waterways, floodplains, shoreline, utilities, and receiving waters identified.
- A concept site plan with disturbance limits, phases, buildings, roads, docks, piers, basins, dredging, filling, outfalls, and staging.
- A preliminary acreage calculation that includes future phases and temporary work areas.
- A water and sewer narrative covering source, demand, storage, treatment, discharge points, and utility capacity.
- An operating-process list covering vessel repair, washing, coating, blasting, welding, fueling, waste handling, and material storage.
- An equipment and emissions inventory for boilers, generators, engines, booths, and other air sources.
- A list of local jurisdictions, property owners, easements, and known contamination or remediation constraints.
With those materials, MDE and the local and federal agencies can identify the actual permit families, data gaps, sequencing, and design changes. Without them, a promise that a shipyard needs a fixed checklist or a single approval is unreliable.
