What Permits and Environmental Reviews Are Needed to Build a Resort on an Island?

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

There is no universal island-resort permit list. The approvals depend on the island’s country and local government, land tenure, zoning, resort size, shoreline location, protected habitats, and the infrastructure you propose. Before buying land or fixing a design, take a parcel map and a preliminary site plan to the local planning authority. Ask for a written list of the application route, referring agencies, studies, and approvals for land use, environmental effects, coastal works, marine structures, water, wastewater, earthworks, access, and utilities.

A lease, development agreement, or tourism concession does not automatically authorize construction. The U.S. Virgin Islands states this explicitly for its proposed Water Island project: lease approval would not replace the separate permits required for construction and related activities.

Start with jurisdiction, land status and the planning authority

An island may have national rules, territorial or state coastal laws, and municipal planning controls operating at the same time. The first task is to establish which government owns or administers the land and seabed, which authority controls development, and whether the parcel lies inside a special coastal or protected-area boundary.

  • Confirm tenure: obtain the registered title, lease, concession, easements, public-access conditions and any restrictions on submerged land.
  • Check planning designation: verify whether tourism is an allowed use and identify density, height, lot-coverage, shoreline-setback, access and subdivision requirements.
  • Map the full project: include buildings, roads, staff housing, power and water systems, wastewater facilities, drainage, construction staging, docks, jetties, breakwaters, dredging and beach works.
  • Request referrals in writing: ask planning staff to identify every agency that must review the proposal and the order in which applications should be filed.

Dominica’s Physical Planning Division illustrates why an early meeting matters. Its tourism guidance directs applicants to consult the division and referral agencies, and distinguishes final planning permission for hotels with 12 rooms or more from outline permission for hotels with fewer than 12 rooms. Those room categories apply to Dominica only; they are not a general island rule.

The approval map for an island resort

Use the following as a screening map, not as a substitute for the island’s formal checklist. One project can require several approvals in the same category.

Approval area Typical trigger Questions and evidence to prepare
Land-use and planning New hotel, villas, staff facilities, roads or a change of use Is tourism permitted? What density, height, setbacks, public access, parking, subdivision or site-development approval applies?
Building and construction Structural work, demolition, occupancy and major site works Which building, fire, health, accessibility and inspection requirements govern the buildings and their intended occupancy?
Environmental review Large footprint, sensitive location, protected habitat, or potentially significant effects Does the authority require an EIA, IEE, environmental assessment report or another screening? What alternatives, mitigation and monitoring must be assessed?
Coastal-zone or shoreline approval Development within a mapped coastal-management or shoreline zone Are buildings, roads, drainage outlets, seawalls or beach changes inside the controlled area? Is a separate coastal assessment required?
Protected areas and species Overlap or effects on parks, wetlands, mangroves, reefs, seagrass, wildlife habitat or water-protection areas What maps, habitat surveys, species safeguards, buffers or conservation measures does the authority require?
Submerged land and marine works Jetty, marina, moorings, dredging, fill, seawall or other in-water construction Who controls the seabed and navigation? What drawings, sediment studies, navigation clearances and public-access conditions apply?
Water supply New demand where freshwater is limited or utility networks are absent Can the island provide potable water year-round? Is a well, desalination plant, storage reservoir or connection approval needed?
Wastewater and drainage Guest rooms, kitchens, laundry, staff housing and paved areas What treatment standard, disposal method, discharge consent, stormwater controls and flood protection are required?
Earthworks, access and utilities Clearing, grading, excavation, roads, power lines, generators or shoreline protection Are earth-change, tree-clearing, road-opening, utility, erosion-control or construction-management permits required?
Sector referrals Projects affecting fisheries, navigation, heritage, transport, health, fire or public infrastructure Which specialist agencies must issue comments, consents or licenses before planning permission can be granted?

When an environmental review is required

Only the competent authority can determine whether the project needs an Environmental Impact Assessment, Initial Environmental Examination, environmental assessment report or another instrument. Screening commonly considers both where the resort is located and what scale and effects it creates. A smaller project in a protected wetland may face more scrutiny than a larger project on a previously disturbed site.

Location and ecological sensitivity

Screen the parcel and the project’s effects area against current maps for national parks, marine parks, nature reserves, wetlands, mangroves, coral reefs, seagrass beds, wildlife habitat and water-protection zones. Seychelles Planning Authority guidance, tied to its 2023 physical-planning regulations, says tourism facilities are restricted or heavily regulated in sensitive areas such as protected marine parks, wetlands and nature reserves. Additional assessment or conservation measures may be required.

Scale, proximity and cumulative development

Taiwan’s environmental-impact rules for hotels demonstrate that triggers can combine ecological designation, proximity to sensitive locations and development area. The numeric thresholds are not stated here and must be checked in the current local regulation before relying on them. Ask the authority whether nearby resorts, roads, marinas or other approved projects must be assessed cumulatively.

What the study should cover

Agree the scope with the authority and qualified local practitioners before fieldwork begins. A useful island-resort study normally addresses:

  • construction and operating effects, including clearing, noise, traffic, lighting, water use and waste;
  • direct, indirect and cumulative impacts;
  • reasonable site, layout, access, technology and no-project alternatives;
  • coastal processes, erosion, flooding, storm exposure and sediment movement;
  • marine and terrestrial habitat, protected species and ecosystem services;
  • community use, including traditional fishing and public beach access;
  • mitigation, an environmental management plan, monitoring responsibilities and residual impacts.

Sri Lanka’s Coastal Zone and Coastal Resource Management Plan 2024 identifies low environmental capacity and limited carrying capacity of coastal ecosystems as core concerns. It notes that vegetation removal can change erosion and accretion patterns, while solid and liquid waste can pollute island environments. It also highlights gaps in historical information about coastal processes and island dynamics. Where baseline information is weak, plan for seasonal ecological and coastal surveys rather than assuming a short desktop review will be sufficient.

Coastal, shoreline and marine approvals

Coastal permission is often separate from ordinary planning permission. Hawaii’s Special Management Area system is an example: development inside the defined area must be reviewed against coastal-zone objectives and policies. The exact boundary, application and appeal process vary by jurisdiction.

Marine works create another approval layer. Identify permissions for submerged lands, docks, jetties, berthing facilities, marinas, dredging, fill, seawalls, moorings and navigation. The Water Island proposal in the U.S. Virgin Islands lists coastal-zone management, submerged lands and marine facilities among the relevant approval categories, alongside environmental and earth-change controls.

Do not treat a jetty or marina as a minor accessory. Sri Lanka’s coastal plan warns that jetties and dredging can alter sand movement and currents, increase sedimentation over coral and seagrass, and damage marine ecosystems. Require alternatives analysis for the location and design, construction sediment controls, navigation review and a plan for operation and maintenance.

Water, wastewater, drainage and solid waste

Island capacity can determine whether a resort is approvable even when the buildings meet planning rules. Demonstrate a reliable potable-water source for guests, staff, kitchens, laundry, fire protection and peak demand. If the proposal depends on wells, desalination, rainwater storage or imported water, identify the applicable abstraction, discharge, health and energy approvals.

Prepare a wastewater design showing collection, treatment, sludge handling, reuse or disposal, emergency storage and protection of groundwater and coastal waters. Stormwater plans should cover roofs, roads, steep slopes, flood routes, retention, erosion control and discharge points. Provide a solid-waste plan for storage, segregation, collection, transport and final disposal. The Water Island proposal specifically identifies water, wastewater and drainage as project infrastructure, while Sri Lanka’s plan treats solid and liquid waste pollution as a major island-tourism issue.

Official examples and what they do—and do not—prove

Jurisdiction or document Useful lesson Limit
U.S. Virgin Islands, Water Island Hotel Development Proposal A complex concept involving a hotel, marina, residences, roads, utilities, water, wastewater and drainage may touch coastal-zone, submerged-land, marine-facility, earth-change and environmental approvals. The proposal is not final, and a lease or project agreement does not itself grant every construction permit.
Sri Lanka, Coastal Zone and Coastal Resource Management Plan 2024 Island and waterfront tourism may be permitted case by case on EIA or IEE findings, with an Environmental Management Plan prepared and implemented. Its instruments and standards describe Sri Lanka’s framework, not another country’s legal requirements.
Dominica, Physical Planning Division tourism guidance Tourism applicants are directed to consult planning and referral agencies early; hotel room count affects the outline-versus-final planning pathway there. The 12-room distinction is Dominica-specific.
Seychelles Planning Authority Tourism Development Guidelines Protected marine parks, wetlands and nature reserves can restrict or intensify regulation of tourism facilities. Apply the current local maps and 2023 regulations to the actual parcel.
Hawaii Special Management Area permits A coastal-zone overlay can require a dedicated permit in addition to ordinary development approvals. Other islands may define coastal zones and decision standards differently.
Taiwan environmental-impact regulations for development activities Hotel EIA screening can use ecological designation, proximity and development area together. Do not borrow a threshold without checking the current Taiwanese rule and its definitions.

A practical approval sequence

  1. Define the project envelope. Record room count, villas, height, floor area, staff facilities, roads, utilities, beach works, jetty or marina dimensions, dredging and construction access.
  2. Secure authoritative site information. Obtain a survey, parcel and seabed boundaries, tenure documents, zoning map, coastal boundary, protected-area overlays and known easements.
  3. Hold a pre-application meeting. Give the planning authority the same concept plan you intend to use and request a written referral and approval checklist.
  4. Run an environmental and coastal screen. Commission qualified local advisers to identify protected habitats, species, wetlands, reefs, seagrass, mangroves, water resources, coastal hazards and cumulative projects.
  5. Test infrastructure feasibility. Document potable-water yield, wastewater treatment and disposal, drainage, solid-waste logistics, electricity, telecommunications, transport and emergency access.
  6. Choose alternatives before detailed design. Compare layouts and sites that reduce clearing, shoreline armoring, dredging, habitat loss, water demand and conflicts with fishing or public access.
  7. Complete required studies and management plans. Follow the authority’s terms of reference for an EIA, IEE or other assessment, and include mitigation, monitoring, responsibilities and funding.
  8. File coordinated applications. Submit planning, building, environmental, coastal, marine, water, wastewater, earthworks and utility applications in the sequence the agencies confirm.
  9. Track conditions through construction and operation. Convert every permit condition into a design note, contract requirement, inspection check and operating procedure.

How to compare sites or resort designs

Use one evidence base for every alternative. A visually attractive beach parcel may be the least feasible once marine works, water supply and habitat constraints are included.

Common approval failures and how to prevent them

Assuming the lease is the permit

Why it fails: tenure establishes a right to occupy or develop subject to conditions; it does not satisfy planning, environmental, coastal or building laws.

Prevention: make closing or investment conditional on the written permit pathway and a feasibility review by local land-use and environmental advisers.

Designing the marina before studying the coast

Why it fails: dredging, fill and hard shoreline structures can redirect currents, trap sediment or damage coral and seagrass.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Prevention: compare no-marina, low-impact landing and alternative-location options during environmental scoping.

Using another island’s threshold

Why it fails: room counts, EIA triggers, coastal boundaries and decision-makers are jurisdiction-specific.

Prevention: cite the current regulation for the actual island and ask the authority to confirm definitions in writing.

Leaving utilities until the building application

Why it fails: inadequate water, wastewater, drainage or waste capacity can make an otherwise compliant hotel unacceptable.

Prevention: commission infrastructure capacity checks at concept stage and show them on the same plan as the buildings.

Ignoring cumulative and community effects

Why it fails: several individually modest projects can exceed the carrying capacity of a beach, reef, water source or waste system and can conflict with fishing or public access.

Prevention: disclose neighboring projects, traditional uses and shared infrastructure in the assessment and alternatives analysis.

Bottom-line decision rule

Do not treat an island resort as a single hotel-building application. Treat it as a coordinated land, coastal, environmental, marine and infrastructure program. The next defensible step is to give the island’s planning authority a parcel map and a complete project envelope—rooms, footprint, marine works and utility approach—and obtain its written referral and approval checklist before committing to acquisition or detailed design.
