If a road-widening plan may touch your property, first identify exactly what the public agency wants: the entire parcel, a strip of land, or a temporary or permanent easement. Ask for the current parcel plan, a written description of the property interest, the valuation materials, the proposed offer, the expected schedule, and the name of the agency’s relocation contact. Do not rely on a general project map or a verbal explanation.
Federal Uniform Relocation Assistance and Real Property Acquisition Policies Act (Uniform Act) requirements generally apply when a project receives federal financial assistance and acquires real property or displaces people or businesses. State and local laws, agency manuals, funding arrangements, and the documents for your parcel can change the practical rules. This guide explains the federal baseline and how to get the project-specific answers you need.

Start by finding out what the agency needs from your property
“Road widening” does not necessarily mean the government will buy your house. An acquiring agency may need a full purchase, a partial acquisition, or only a right to use part of the land. The legal description and plan—not the project name—determine what is actually proposed.

| Proposal | What it usually means | Questions to ask |
|---|---|---|
| Full purchase | The agency acquires the entire parcel and you convey ownership. | What is the legal description, closing process, possession date, and treatment of buildings, fixtures, and personal property? |
| Partial acquisition | The agency buys a defined portion of the parcel while you retain the remainder. | How many square feet or acres are affected? What happens to driveways, parking, fences, landscaping, drainage, utilities, and the remaining lot? |
| Permanent easement | You retain title, but the agency receives specified continuing rights, such as a roadway, slope, drainage, or utility right. | What activities are permitted, who maintains the area, and what uses by you are restricted? |
| Temporary easement | The agency receives rights for a stated construction period and must return or restore the area as the agreement requires. | What is the exact duration, start and end condition, access route, restoration standard, and compensation? |
Request a plan that shows the proposed right-of-way line, easement limits, construction limits, and the remaining parcel. Ask whether the drawing is preliminary or approved and which revision is current. Keep every version you receive.

Use a written property-interest checklist
- Area affected, with dimensions and units.
- Permanent or temporary status and, for a temporary easement, the duration.
- Permitted agency uses, including construction access, staging, grading, drainage, slope work, utilities, and maintenance.
- Restrictions on your use of the affected area.
- Changes shown for driveways, gates, parking, sidewalks, fences, landscaping, wells, septic systems, and utility lines.
- Effects on access during construction and after the project opens.
- Plans for the remainder of the parcel, including setbacks, drainage patterns, and buildable area.
These are questions to verify against the project documents. General federal guidance cannot establish what will happen at your address.
Identify the acquiring agency and the project’s funding
The city, county, state department of transportation, transit authority, or another public body may be the acquiring agency. A consultant or a local public works employee may contact you, but ask which legal entity will take the property interest and who has authority to make the offer.
Ask whether the project uses federal financial assistance. The Uniform Act’s federal acquisition and relocation requirements generally attach when federal financial assistance is involved and the project acquires real property or displaces people or businesses. A project funded entirely from state or local sources may still be governed by state statutes or agency policies that provide similar or additional protections. Do not assume that a project is outside the rules—or covered by every federal procedure—without confirming the funding and acquisition documents.

Send an email or letter to the acquiring agency and keep proof of delivery. Request:
- The current parcel plan and legal description.
- A plain-language description of the interest sought.
- The project schedule, anticipated construction start, and any possession or closing date.
- The appraisal or other valuation materials used for the offer.
- The written offer and an explanation of how it was calculated.
- The name, phone number, and email address of the negotiator.
- The relocation office contact and written information about eligibility if anyone may have to move.
- The state or local rules and agency procedures the agency is applying.
Ask the agency to identify any information it considers confidential or unavailable and to explain the legal basis for withholding it. Written answers make it easier to compare the proposal with the plan and to spot changes.

Understand the federal acquisition sequence
For a federally assisted acquisition, FHWA describes a sequence of determining value, making an offer of just compensation, and negotiating with the owner. The agency may proceed to condemnation under state eminent-domain procedures if negotiations fail. Refusing an offer does not automatically stop the project, and accepting an offer is not the only way to ask questions or seek a better-supported valuation.
1. Valuation
The agency determines the value of the specific property interest it proposes to acquire. That may involve an appraisal, a review of an appraisal, or an appraisal waiver valuation when the applicable conditions are met. The valuation should match the interest shown on the plan and should address the effect of the acquisition on the remaining property when that issue is relevant.

2. Written offer
The agency presents an offer of just compensation. FHWA’s acquisition guidance describes just compensation as a constitutional principle for private property taken for public purposes. The amount is not automatically correct merely because it appears on an official letter. Check what rights, area, improvements, and damages to the remainder the offer includes or excludes.
3. Negotiation
You may ask the negotiator to explain assumptions, measurements, comparable properties, the treatment of temporary use, and the proposed possession date. Put questions and counterproposals in writing. Preserve the original offer, revised offers, plans, photographs, inspection notes, and your own calendar of contacts.
4. Condemnation if negotiations fail
Each state sets its own condemnation process, notices, court filings, valuation rules, and deadlines. An agency may use eminent domain after unsuccessful negotiations, subject to those procedures. Because the consequences and time limits vary by jurisdiction, obtain advice from a lawyer familiar with your state’s eminent-domain law before signing a conveyance, settlement, or possession agreement when the stakes are significant.

How valuation and appraisal-waiver numbers work
Ask directly: “Was this offer based on an appraisal, an appraisal review, or a waiver valuation?” Then ask who performed the work, what property interest was analyzed, the valuation date, the comparable sales or other evidence considered, and whether the remainder of the property was evaluated.

Clear out junk files and repair common Windows errorsFree Scan →Fix the driver behind crashes, sound loss and screen glitchesFind Drivers →Repair Windows errors before they cause bigger problemsFix Now →Appraisal
An appraisal is a professional opinion of value for the defined acquisition. It should identify the property, the rights being acquired, relevant physical characteristics, and the reasoning behind the conclusion. If the acquisition changes access, utility service, parking, or the usefulness of the remainder, ask how those effects were treated.
Waiver valuation
FHWA describes waiver valuation as an optional method for an acquiring agency, not a mandatory method for every small acquisition. Its right-of-way FAQ describes a federal $10,000 threshold and says the federal funding agency may approve an increase up to $25,000 in specified circumstances when the agency offers the owner the option of having the agency obtain an appraisal. These figures are procedural thresholds in the FHWA FAQ; they are not an estimate of your home’s value, a recommended offer limit, or an automatic right that applies to every state or acquisition. Confirm the current federal regulation, state transportation-department manual, and project procedure.
If the agency used a waiver valuation and you are uncomfortable with the basis, ask whether an appraisal is available, whether you may obtain an independent appraisal, and how the agency will consider documented effects on the remainder. There is no guarantee that an independent appraisal will be reimbursed or change the offer.

| Item | What to compare | Follow-up question |
|---|---|---|
| Property interest | Full purchase, partial fee acquisition, permanent easement, or temporary easement. | Does the offer describe the same rights and boundaries shown on the current plan? |
| Area and improvements | Square footage or acreage, structures, trees, pavement, fencing, signs, and other improvements. | Which items are included in the valuation and which will be removed, replaced, or handled separately? |
| Remainder effects | Access, parking, setbacks, drainage, utilities, visibility, privacy, and usable yard or building area. | Does the valuation explain documented effects on the property you keep? |
| Timing | Offer date, acceptance deadline, closing, possession, and construction access. | What happens if the schedule changes or the agency needs early entry? |
| Relocation | Whether an owner, tenant, or business must move. | Has the agency issued a written eligibility determination and benefit information? |
Photograph existing conditions and keep permits, surveys, repair records, landscape invoices, and utility information that help establish what is on the parcel. Do not alter or remove improvements after the agency’s inspection without first asking how that may affect the valuation or construction plan.
Independent reader supportYour contribution helps us test, update, and keep practical guides available for everyone.Separate a land sale from displacement
Selling a small strip of land does not by itself mean that you are displaced. Relocation assistance concerns people or businesses that must move because of the project. A homeowner could lose part of a yard without moving, while another owner or tenant could be required to leave a residence or business.
If someone may have to move
Promptly ask the agency’s relocation office for a written notice, eligibility determination, benefit explanation, and schedule. Ask whether the determination covers every occupant, tenant, business, or personal-property issue involved. Do not move solely because a negotiator says that relocation is likely; obtain the agency’s written requirements and protect your rights under the applicable program.
Eligibility is fact-specific. It can depend on the person’s occupancy, the date and type of notice, the project’s funding, and the relationship between the move and the acquisition. FHWA materials describe relocation assistance for eligible displaced people on federally assisted projects, but the agency must apply the facts and current rules to your situation.
Check construction and access consequences before signing
A plan can show the permanent right-of-way while omitting details that matter during construction. Ask for the traffic-control, staging, access, drainage, and utility plans that affect your parcel, if available. Confirm:

- What restoration standard applies to a temporary easement.
- How emergency, delivery, mail, school-bus, and accessibility access will work.
Do not infer these answers from the project’s name or a typical road design. Require the agency or its contractor to identify the controlling plan and the person responsible for resolving field conflicts.
Know when to obtain professional help
You can ask questions and organize records without hiring anyone. Consider state-specific legal advice when the acquisition affects your residence, a substantial portion of the parcel, business operations, access, financing, title, or a condemnation threat. An eminent-domain lawyer can explain procedure and deadlines that cannot be stated reliably without knowing the state.
An independent real-estate appraiser may help evaluate whether the agency’s valuation reflects the defined interest and the remainder’s documented effects. Ask about the appraiser’s experience with partial acquisitions and whether any fee is your responsibility. Neither an attorney nor an appraiser can guarantee a higher payment, and the agency may have rules about access to its appraisal or reimbursement.
If the matter involves a tenant, business, or required move, contact the agency’s relocation office first and request written eligibility information. Relocation assistance is not automatic for every property owner and should not be assumed to cover every expense.
Keep control of the record and the schedule
- Create a project folder with every letter, email, plan revision, photograph, valuation, offer, and appointment.
- Write down the date, participants, and substance of every call or site visit.
- Mark the proposed acquisition and easements on a copy of your survey or parcel map, using the agency’s measurements.
- Send a written list of unanswered questions and ask for a response by a stated date.
- Before signing, read the legal description, possession terms, access rights, restoration promises, releases, and any statement that the payment resolves other claims.
- Confirm which state or local deadline applies before allowing an offer to expire or ignoring a formal notice.
If the agency changes the boundary, duration, access arrangement, or construction limits, request a revised plan and valuation explanation. Treat a changed proposal as a new document to review, not as a minor verbal adjustment.
Quick Recap
Questions that need a project-specific answer
- Can the city or state take part of my yard? The agency may seek a partial acquisition or easement, but the authority, procedure, and compensation depend on state law and the project documents.
- Can refusing the offer stop the road? Not necessarily. Failed negotiations may lead to condemnation under the state’s eminent-domain process.
- Will I receive relocation money? Only if the facts make you an eligible displaced person under the applicable federal, state, or local program. Request a written determination.
- Is the $10,000 or $25,000 figure what my property is worth? No. FHWA describes those as federal waiver-valuation procedure thresholds in specified circumstances, not property-value estimates.
