Before substantial repairs, obtain an independent assessment when the cause or scope is disputed and check your state’s notice rules. If the contractor will not resolve the problem, possible next steps include a licensing or consumer-protection complaint, mediation or arbitration, small claims, or a lawsuit—depending on your state, contract, and the amount at issue.
1. Make the site safe and preserve the evidence
Address immediate hazards first
If a foundation appears to be moving, a wall or fence is unstable, a driveway has created a trip or vehicle hazard, or construction has damaged gas, electric, water or drainage lines, keep people and vehicles away from the affected area. Contact an appropriate qualified professional or emergency service when there is an immediate danger. Do not enter an unstable area merely to take photographs.

Emergency steps to prevent additional damage are different from permanent repairs. Cover an opening, control water, or install temporary protection when it is safe to do so, but record what the area looked like before and after the temporary measure. Keep every receipt for tarps, temporary fencing, pumping, safety work and other reasonable protection.
Create a dated damage file
Photograph and video the entire property context as well as close details. Include property lines, the construction equipment, access routes, nearby structures, drainage paths and any markings that show scale. Record the date and time, what work was occurring, when you first noticed the condition, weather or site events that may matter, and anyone who witnessed it.

Save the construction contract, plans, change orders, permits, inspection records, invoices, text messages, emails and the names of the contractor’s employees or subcontractors. Keep a timeline of calls and site visits. Iowa Attorney General home-improvement guidance and New York Attorney General guidance both emphasize written project records, contracts and receipts as practical consumer safeguards.
Do not remove damaged materials or discard broken fence sections until you have photographed them and asked the insurer or an appropriate professional whether an inspection is needed. If removal is necessary for safety, preserve representative pieces where practical and document who removed them, when and why.
2. Notify the contractor in writing
Describe the problem precisely
Send a dated letter or email that identifies the property and project, the location and type of damage, when you observed it, and the response you want. Ask for an inspection and a written proposal for repair or payment. Attach copies—not originals—of photographs and relevant documents. Keep the message, attachments and proof of delivery.

Subject: Damage at [property address] during [project]
On [date], I observed [specific damage] at [location]. The work taking place was [brief description]. Attached are photographs and a timeline. Please confirm by [reasonable date] when you will inspect the condition and provide a written repair proposal. I am preserving the site and reserving my rights under the contract and applicable law.
Use a reasonable response date rather than announcing a legal deadline unless you have confirmed the rule for your state. New York’s Attorney General advises homeowners to keep the written contract and changes and to discuss problems with the contractor. Review your agreement for notice addresses, warranty terms, required inspections, dispute-resolution clauses, and any requirement to give the contractor an opportunity to cure.

Keep communications controlled
Use one email thread or a numbered log so the facts do not become scattered. After a phone call, send a brief confirmation stating what was discussed and what each person agreed to do. Avoid accusations you cannot prove, broad admissions about fault, or an agreement to release claims before you know the repair scope and cost. A contractor’s promise to “take care of it” is not a substitute for a written scope, schedule and responsibility for related damage.
3. Ask your insurer how coverage applies
Notify your own insurer promptly
Call the claims or advice number on your homeowners policy and explain what happened, when it happened and what work was underway. Ask:
- Whether the facts may fall within the policy’s covered causes of loss or exclusions.
- What photographs, contracts, estimates and receipts it needs.
- Whether an adjuster or engineer should inspect before materials are removed.
- Whether the insurer wants notice before permanent repairs.
- How deductibles, temporary-protection costs and subrogation may be handled.
Coverage depends on the actual policy and the circumstances. The District of Columbia Department of Buildings directs homeowners to read their own policy rather than assume construction damage is covered. A contractor’s commercial general liability policy may contain subcontractor exclusions, a designated-premises limitation or a job-site restriction. Ask the contractor for its insurer and policy information when relevant, but a certificate of insurance alone does not prove that this event is covered.

Coordinate emergency work with the claim
Take reasonable action to stop continuing damage, but tell the insurer what you did and why. Before demolishing, repaving or rebuilding, ask whether an inspection is required. If delay would create a safety or major-water risk, protect the property first and preserve photographs, samples, invoices and a written explanation of the emergency.

4. Establish the cause and the repair scope
Use an independent professional for structural questions
A foundation crack, settlement, bowing wall, drainage failure or repeated movement can have several causes. When the condition may be structural or the contractor disputes responsibility, obtain a written assessment from a qualified independent professional whose work is appropriate to the issue. Depending on the facts, that may be a structural engineer, geotechnical professional, licensed building inspector or another qualified specialist.
Ask the professional to describe observed conditions, likely contributing factors, recommended testing, urgency, repair alternatives and limitations. An assessment can clarify the condition and reasonable repair scope; it does not automatically prove who caused the damage. Keep the report, photographs, invoices and any testing data.
For a driveway or fence, obtain a written estimate from a qualified repair contractor if the proper remedy is not obvious. The estimate should identify demolition, disposal, base preparation, drainage work, materials, dimensions, finish, permits or inspections, schedule, warranty and exclusions. Compare estimates on the same scope rather than choosing solely by the lowest price.

Compare repair proposals on documented terms
| Item to compare | Questions to ask |
|---|---|
| Cause and scope | Does the proposal address the documented failure, or only its visible symptom? |
| Materials and method | What concrete mix, reinforcement, fence material, drainage solution or foundation method is specified? |
| Price and payment | What is included, what could be extra, and when are payments due? |
| Schedule | When will work begin, how long will it take, and what events permit a change? |
| Permits and inspections | Which permits or inspections are required by the local authority, and who obtains them? |
| Warranty | What workmanship and material warranties apply, for how long, and how are claims made? |
| Licensing and insurance | Is the provider properly licensed or registered locally and insured for the proposed work? |
Iowa Attorney General guidance encourages written estimates, permit checks, insurance verification and written project terms. Verify license or registration status with the relevant local or state authority. Pennsylvania’s contractor-registration FAQ explains that registration and insurance requirements do not guarantee workmanship or contractor performance.

5. Decide how to pursue a resolution
Start with a documented settlement request
After you have a reasonable repair scope, send the contractor a concise demand that identifies the damage, the requested work or payment, supporting estimates and a response date. State whether you are seeking direct repair, reimbursement for a completed emergency measure, or another specific resolution. Keep negotiations in writing and do not sign a release until you understand whether it covers known and unknown damage, related costs and future work.
Understand what each escalation route can do
| Route | Typical purpose | Important limitation |
|---|---|---|
| Contractor licensing or registration complaint | Reports unlicensed activity, code or conduct concerns to the responsible agency. | An agency process may discipline a contractor without awarding your repair costs. |
| State consumer-protection complaint | Alerts a consumer-protection office to deceptive or improper business practices and may support early intervention. | Authority and remedies vary by state. |
| Mediation | A neutral facilitator helps the parties negotiate a voluntary settlement. | It generally does not impose a result unless the parties sign an agreement. |
| Arbitration | A private decision-maker may issue a binding or nonbinding decision under the contract or applicable rules. | Check the contract, fees, appeal rights and whether the forum can award the relief you need. |
| Small claims | A simplified court process for qualifying money claims. | Claim limits, filing rules and available remedies are state-specific. |
| Attorney or civil lawsuit | Addresses larger, complex or disputed claims and may seek money or other relief. | Costs, deadlines, proof requirements and potential recovery depend on local law. |
California’s Contractors State License Board describes early intervention, mediation, arbitration and small claims as possible paths, while warning that an agency complaint does not guarantee restitution. The Maine Attorney General describes small claims for claims below $10,000 and recommends legal advice for larger claims; that figure and procedure apply to Maine, not nationwide.
Independent reader supportYour contribution helps us test, update, and keep practical guides available for everyone.6. Check state-specific notice and deadline rules
There is no single national deadline or notice form for construction damage. The property’s location, the type of work, the contract, when you discovered the condition and the applicable statute can all affect your rights. Some laws require a formal notice that gives the contractor an opportunity to inspect or offer repairs before a lawsuit.

Its Residential Construction Liability Act materials describe written notice, inspection and repair-offer procedures, and identify categories such as necessary engineering or consultation fees that may be claimed within that statutory framework. Do not allow a contractor’s delay to make you miss a limitation period. Mark the dates of discovery, written notice, inspections, promises, payments and completed repairs. A consultation with a lawyer can be especially important when the damage is structural, the cost is high, the contractor denies responsibility, or a contract contains arbitration or waiver language.
7. Damage-specific considerations
Driveway damage
Record cracking, heaving, tire tracks, broken edges, displaced base material and drainage changes from several angles. Ask whether heavy equipment, excavation, altered runoff or inadequate base preparation is implicated. A repair proposal should explain whether isolated slab replacement, full-depth replacement, grading or drainage work is needed. Repaving over an unstable base may conceal rather than solve the problem.
Fence damage
Photograph posts, rails, gates, footings and property-line conditions. Confirm ownership and boundary location before authorizing replacement. A written scope should address matching materials, gate operation, post depth, removal of concrete footings, access and any neighbor coordination. If the fence is shared, notify the neighbor and document who authorized which work.
Foundation damage
Treat widening cracks, offset walls, sticking doors, sloping floors, water intrusion or soil movement as reasons for prompt professional evaluation. Do not rely only on cosmetic patching when movement or drainage may continue. Preserve pre-repair measurements and reports, and ask whether monitoring is needed before selecting a permanent method.
8. Keep a complete claim and expense file
Organize the contract, change orders, timeline, photographs, professional reports, estimates, invoices, receipts, insurance correspondence, notices and delivery confirmations in date order. Separate temporary-protection costs, investigation costs and permanent repair costs. Record lost use, access problems or other impacts only when you can document dates and amounts. Keep copies in more than one secure location.
This record helps an insurer, mediator, agency, court or attorney understand what happened without relying on memory. It also lets you compare the contractor’s proposed repair with an independent scope and identify unresolved items before signing a settlement.
When to get legal help
Consider local legal advice when the foundation may be unsafe, the contractor threatens a lien or lawsuit, the contract requires arbitration, the insurer denies or delays a claim, multiple subcontractors are involved, or the likely cost exceeds a small-claims limit. Bring the contract, notices, photographs, reports, estimates and insurance correspondence to the consultation. A lawyer can identify the applicable deadline and notice procedure; no general article can substitute for that jurisdiction-specific analysis.
