The result depends on your location, contract date and value, the builder’s legal status, and the exact home-warranty or building-compensation policy attached to the job. You may need to notify an insurer, deal with an administrator or liquidator, formally end the contract, and appoint another builder. Insurance may cover some completion costs, deposits or defects, but limits, exclusions and deadlines vary sharply between jurisdictions.
What insolvency means for a house under construction
Insolvency means the builder cannot pay debts as they fall due. A company entering external administration is not necessarily in final liquidation: in Victoria, an administrator may recommend that the business continue trading, restructure or close. Do not treat missed deadlines or a quiet site as proof of insolvency. Confirm the legal status through the appropriate insolvency register and obtain the administrator’s or liquidator’s contact details when an appointment is announced.

Until the status and contract position are clear, avoid signing a replacement contract, paying subcontractors directly, removing materials or terminating the original agreement on impulse. Those actions can affect insurance eligibility, ownership of materials, debt claims and your right to recover losses.
Your first 48 hours: a practical response
- Confirm what has happened. Look for a formal notice from the builder, administrator, liquidator, regulator or licensing authority. Check the Australian Securities and Investments Commission register for a company, or the Australian Financial Security Authority records for a sole trader or partnership. In Queensland, the building regulator also recommends checking the relevant register. A builder’s financial trouble without a formal appointment may require a different contractual response.
- Secure the project information. Download or copy the signed building contract, specifications, variations, plans, permits, inspection reports, progress claims, invoices, receipts, bank records, emails, text messages and photographs. Photograph every room, elevation, service installation and unfinished area, including water damage or exposed wiring. Keep dated copies in more than one location.
- Find the insurance certificate. Search the contract pack, deposit paperwork and local building-survey records for the home-building compensation or warranty certificate. If it is missing, ask the builder, building surveyor or council which insurer issued it. In New South Wales, the government’s HBC Check service is used to verify cover. Do not assume that a policy exists merely because a deposit was requested.
- Notify the insurer and regulator. Ask for the claim form, trigger requirements, valuation method, evidence list and deadline in writing. Some schemes require insolvency, licence cancellation, formal contract termination or a fixed-price contract before a non-completion claim can be accepted.
- Ask who controls the site. The administrator or liquidator may want access to records, plant and materials. Ask how keys, temporary fencing, utilities, alarms and dangerous areas will be managed while responsibility is transferred.
How insurance usually fits in
Home-building compensation and warranty schemes are statutory products with defined triggers, not unrestricted guarantees to finish a house. Read the certificate and policy rather than relying on the builder’s description. Check all of the following:

- Whether the policy covers non-completion, defects, deposits, or only some of those losses.
- Whether insolvency, death, disappearance, licence cancellation or another event must be proved.
- Whether a fixed-price contract, minimum contract value or building-height limit applies.
- Whether advance payments, owner-supplied materials, variations or work after practical completion are excluded.
- The maximum amount, any percentage sub-limit and whether accommodation, storage or removal costs are included.
- The notice and claim deadline, and whether the contract must first be ended in a particular way.
An insurer may pay the reasonable cost of eligible work up to a scheme limit, not the full difference between your original price and a more expensive replacement quote. Obtain a detailed scope and independent assessment of completed, defective and incomplete work before accepting a settlement.
State and country rules are different
The following examples illustrate why advice from one jurisdiction cannot safely be applied in another. Amounts and dates are those published by the named authorities and should be checked against the current policy and contract.
| Jurisdiction and scheme | Trigger or eligibility example | Published limits and deadlines | Important qualification |
|---|---|---|---|
| New South Wales home building compensation | Last-resort cover for qualifying loss when a builder cannot complete or rectify work because of insolvency, death, disappearance or licence suspension. For work valued at $20,000 or more, the builder must provide a certificate before taking payment. | Maximum deposit described by the NSW Government: 10% of the total contract price. Defect action periods listed: six years for major defects and two years for other defects. | Only authorised progress payments should be made. The defect periods do not promise payment of every unfinished-build loss. |
| Victoria Home Warranty insurance | For eligible domestic building contracts signed from 1 July 2026, a first-resort scheme applies to work over $20,000 on homes of three storeys or less, subject to the policy. Earlier work was generally under last-resort Domestic Building Insurance (DBI). | New scheme: repairs listed up to $400,000, including six years for structural faults and two years for non-structural faults, plus 5% of the deposit and certain accommodation, removal and storage costs. Claim deadline stated: 180 days after learning of insolvency. | Administration may continue trading and is not automatically insolvency. Under the earlier DBI description, unfinished-work claims may be limited to 20% of contract price, advance payments are not covered, and repair costs are listed up to $300,000. |
| Queensland Home Warranty Scheme | For the described non-completion route: fixed-price contract; contractor bankruptcy or liquidation; licence cancellation; contract ending within two years of work starting; and a claim lodged within three months after contract end. | Compulsory premiums apply to residential construction work above $3,300. Cover is listed up to $200,000, or $300,000 when additional cover was chosen. | The non-completion route does not cover individual items left unfinished after practical completion; a defective-work process may apply instead. |
| United Kingdom new-build warranties | A September 2025 parliamentary answer said most new homes receive a 10-year new-build warranty that may protect against insolvency-related failure to complete. Some warranties cover off-plan deposits. | Ten-year warranty period stated by the housing minister. | The statement is general. Your warranty wording determines whether a deposit, incomplete work or remedial cost is covered. |
New South Wales: certificate, payments and claims
NSW home building compensation is described by the NSW Government as a last resort. For qualifying work of $20,000 or more, the builder must supply a certificate of cover and must not request payment before the cover is in place. The published maximum deposit is 10% of the contract price.

After work starts, make only progress payments authorised by the contract’s stage schedule, or payments supported by evidence that the relevant labour and materials have been performed or supplied. An early or extra payment can affect the amount recoverable. If the builder asks for a payment for a stage that is not complete, ask for an inspection and written justification rather than paying to keep the relationship alive.
NSW guidance lists six years to take action for major defects and two years for other defects from completion. Those are defect time limits, not a blanket promise that the compensation scheme will fund every cost of an unfinished home. Ask the insurer how it classifies your loss and what evidence is required.
Victoria: administration, DBI and the 2026 scheme change
Consumer Affairs Victoria distinguishes administration from insolvency. Administrators may recommend continued trading, so contact them and ask whether the builder intends to complete contracts, seek a sale or close. Customers do not have to accept a revised price or vote for a deed of company arrangement. Obtain legal and financial advice before deciding whether a proposed restructure is better than ending the contract and claiming.

Queensland: strict non-completion conditions
The Queensland Building and Construction Commission (QBCC) says its Home Warranty Scheme may respond to failure to complete or rectify residential work. The fact sheet identifies compulsory premiums for work above $3,300 and cover up to $200,000, increased to $300,000 if additional cover was selected.
For the stated non-completion claim, the contract must be fixed-price, the contractor must be bankrupt or in liquidation, the licence must be cancelled, the contract must end within two years of work starting, and the claim must be lodged within three months after the contract ends. A single item left unfinished after practical completion follows a defective-work pathway rather than this non-completion route. Confirm the current QBCC criteria and your own notice of cover before ending the contract.
QBCC warning signs include unexplained stoppages, removal of site infrastructure, workers downing tools, complaints about non-payment, constantly changing tradespeople, poor communication and repeated delays. They justify checking the builder’s status and seeking advice; they do not prove insolvency.

What happens to the contract and progress payments?
An insolvency event does not automatically cancel your building contract. The contract may give the builder, administrator or homeowner rights to suspend, terminate, take possession of materials or demand payment. Read the insolvency, suspension, termination and dispute clauses with a construction lawyer before serving a notice.
Prepare a payment reconciliation showing the original price, approved variations, deposits, each progress payment, the value of work actually completed and amounts claimed but unpaid. Do not pay a new builder twice for the same stage until ownership of materials, warranties and defective work has been clarified. Keep disputed amounts separate and document every request for payment.
How to appoint a replacement builder safely
- Obtain a condition report. Use an independent building consultant or engineer to record percentage completion, defects, code issues, incomplete approvals and work that must be opened up.
- Clarify insurance instructions. The insurer may require its own assessor, competitive quotations or approval before repair work begins. Starting without consent can reduce or complicate a claim.
- Secure permits and records. Confirm who holds the building permit, inspection certificates, engineering designs, warranties and certificates for waterproofing, electrical, plumbing and fire systems.
- Tender on a defined scope. Ask prospective builders to price completion, rectification, testing, authority fees, temporary protection and likely variations separately. A low headline quote may omit compliance work discovered after opening up.
- Use a new written contract. Set out the existing work, exclusions, completion date, payment stages, responsibility for defects and treatment of insurer payments. Check the replacement builder’s licence and insurance.
Common mistakes that reduce recovery
- Assuming a delayed project proves insolvency instead of verifying a formal status.
- Paying an overdue or unearned progress claim to prevent a stoppage.
- Discarding damaged materials or clearing the site before an assessor records the evidence.
- Missing a short claim deadline, such as Victoria’s stated 180 days or Queensland’s three months after contract end for the described claim.
- Confusing defect cover with non-completion cover, or treating a scheme maximum as an automatic entitlement.
- Terminating without following the contract’s notice procedure.
- Paying subcontractors directly without advice on lien, security-of-payment and insurance consequences.
- Comparing scheme figures from different states as though they were equivalent products.
A decision checklist for homeowners
- Have you confirmed whether the builder is in administration, liquidation, bankruptcy or merely delayed?
- Do you have the signed contract, variations, payment ledger, permits and dated photographs?
- Have you verified the insurer, certificate number, trigger event, exclusions, limits and deadline?
- Has the regulator confirmed the builder’s licence status and any required contract-ending step?
- Has an independent professional documented the work before another contractor enters?
- Have you obtained legal advice before termination, direct subcontractor payments or a deed vote?
- Does the replacement contract allocate responsibility for existing defects and recovered insurance money?
The governing rules are local and can change. A homeowner in NSW, Victoria, Queensland or the UK must rely on the actual certificate and contract, not a figure quoted for another scheme. Contact the relevant regulator, insurer, administrator or liquidator promptly, and use a qualified local construction lawyer or building professional for decisions that change your contractual rights.
