What Happens to a Modular Home Order If the Manufacturer Closes?

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

If a modular-home manufacturer closes before completing your order, the home may be delayed or never delivered, and your deposit is not automatically refunded. Your options depend on the purchase or construction contract, the company that took your money, state law, the order’s status, and whether the company has filed bankruptcy.

Start by separating the factory from the contracting seller. A dealer, retailer, builder, or general contractor may have promised delivery and accepted your payment even though a different company manufactured the modules. That distinction determines whom you can demand performance or repayment from.

Why a factory closure does not automatically cancel your contract

“Manufacturer” is often only one participant in a modular-home transaction. The factory may fabricate modules, while a dealer or builder sells the home, arranges site work, installs it, and signs the customer agreement. Your legal claim normally follows the entity that made the promise in your contract and the entity that received each payment.

Identify every business involved

List the manufacturer, dealer or retailer, builder, installer, lender and any separate site-work contractor. Read the signature blocks, definitions and payment instructions in every agreement. A manufacturer’s shutdown does not prove that a dealer’s contract is impossible to perform; the dealer might be able to source another factory, negotiate completion, or offer a contract remedy. Conversely, a dealer that has your deposit may remain responsible even when the factory is insolvent.

Match each payment to an obligation

Create a payment ledger showing the date, amount, recipient and stated purpose of every deposit, progress payment, loan draw and change-order payment. A card charge to a dealer, a check payable to a manufacturer and a lender disbursement may be treated differently in a dispute. Keep the original receipts and bank or card statements, not just a typed summary.

What to do as soon as the company stops responding

  1. Secure the file. Gather the signed purchase and construction contracts, specifications, change orders, delivery and installation schedules, invoices, receipts, financing documents, warranty papers, emails, text messages and photographs. Save them in more than one location.
  2. Confirm the shutdown. Ask the manufacturer and the contracting seller in writing whether operations have stopped, whether your order is in production, and where any completed modules, plans or materials are located. Do not rely on a telephone promise; preserve the written response or evidence that no response arrived.
  3. Request a written resolution. Ask the contracting seller for a specific status, an accounting of money received and work completed, and a proposed delivery, completion or refund plan. Set a reasonable response deadline stated in the letter. Send the request by a method that records delivery.
  4. Contact the payment provider promptly. If you paid by credit card or financed the purchase, call the card issuer or lender and ask what dispute, cancellation or holder-related protections may apply and what deadlines control. The Minnesota Attorney General identifies credit-card and financing disputes as possible avenues in appropriate cases, not universal remedies. A chargeback is not guaranteed, and waiting can reduce available options.
  5. Check for an actual bankruptcy case. A closure announcement is not the same as a bankruptcy filing. If a petition was filed, identify the exact debtor name, court, case number and chapter from official notices or the court docket. Read the claims instructions and deadlines; bankruptcy procedures can replace ordinary collection efforts.
  6. Contact state regulators. Ask the state attorney general and the agency that licenses manufactured-home dealers, builders or installers whether your transaction is covered by a surety bond, escrow requirement, guaranty fund, statutory trust or complaint process. Coverage is state-specific and may depend on the seller’s license and the type of home.
  7. Get advice before signing a substitute deal. For a substantial deposit, unfinished site or approaching deadline, consult a lawyer experienced in bankruptcy and construction disputes in your state. Before paying a replacement contractor, obtain a written accounting of what you already paid and who owns any plans, modules or materials.

Potential ways to recover money or obtain completion

Route What determines availability Important limitation
Contract claim against the seller or builder The signed agreement, its performance terms, and which entity accepted the payment A judgment may be difficult to collect if the company is insolvent or has no assets
State bond, escrow or consumer-protection process The state’s licensing law and whether the responsible business was covered Limits, eligibility and payment priority vary; a recovery can be partial
Credit-card or financing dispute How the transaction was paid, the finance documents and applicable deadlines Availability is fact-specific; the Minnesota Attorney General describes these only as possible avenues
Bankruptcy claim A filed case, the correct debtor and the court’s claims procedure Filing a claim does not guarantee payment, and the amount may depend on available assets and creditor priority
Replacement construction or delivery Whether another manufacturer or builder can lawfully take over and what the original contract permits Do not pay twice without a written credit for prior payments and a clear ownership and warranty arrangement

These routes are not interchangeable. A demand for delivery, a refund request, a card dispute and a bankruptcy claim seek different outcomes and can have different deadlines. Decide which result you want first, then preserve the evidence for that route.

State examples that show how outcomes differ

State and source Documented fact What it does—and does not—establish
Colorado, 2021 Registered manufactured-housing sellers were required to provide a $50,000 bond. The attorney general enforced the bond for two couples after Riverwood Cabins filed bankruptcy without building their homes. The couples received partial relief and did not receive the expected homes. It is a Colorado example, not a nationwide refund guarantee.
North Carolina Covered purchase agreements must identify the home and accessories, price, deposit or payment, date and signatures. The statute provides a three-business-day written cancellation right. Later cancellation rules address actual damages; they are not a special refund rule triggered by a manufacturer’s closure.
Maine For covered home-construction or improvement projects over $3,000, written contracts must include specified terms, including a deposit limit of one-third of the total contract price, estimated start and substantial-completion dates, and signed written change orders. Maine guidance warns that even a successful case may not be collectible from a bankrupt, judgment-proof or departed builder.
Minnesota, 2025 The attorney general reported that Minnesota Rusco stopped operating on October 29, 2025, and filed Chapter 7 on November 3, leaving contracts, deposits and unfinished work. The alert illustrates the uncertainty after an abrupt closure. Check the current docket and later state updates for deadlines and case developments.
Maryland, 2024 A court affirmed an order finding more than 800 violations by two modular-home businesses that had taken over $1 million in deposits and progress payments without finishing homes. Enforcement can follow widespread nonperformance, but the announcement does not establish an individual buyer’s recovery or predict another state’s result.

Colorado: a bond can provide only partial relief

In its July 22, 2021 announcement, the Colorado Attorney General said two couples paid down payments to Riverwood Cabins, which filed bankruptcy in February 2020 without building either home. Colorado’s registration requirement included a $50,000 bond for manufactured-home sellers, and the state enforced that bond for the purchasers. The bond was shared by the two couples, and the attorney general described the result as “partial relief”; the buyers would not receive the homes they expected. The state also reported a separate $100,000 recovery for 14 other families in 2020. Those figures show why a bond is worth investigating, while also showing that it may not replace the home or cover the entire loss. Read the Colorado Attorney General announcement.

North Carolina: cancellation rules are not a closure refund

North Carolina’s G.S. 143-143.21A requires covered manufactured-home purchase agreements to identify the home and accessories, price, deposit or payment, date and signatures, and gives a buyer a three-business-day written cancellation right. If a buyer cancels after that period but before completion, a dealer may retain actual damages up to 10% of the purchase price for a home in dealer inventory. For a specially ordered home, the statute permits actual damages up to the full amount of the buyer’s deposit or other payment. These provisions concern buyer-initiated cancellation and damages; they do not create an automatic refund merely because a manufacturer closes. Confirm that the current statute covers your transaction and read the specific agreement. Read G.S. 143-143.21A.

Maine: contract requirements may improve documentation, not collectability

The Maine Attorney General says covered home-construction or improvement contracts above $3,000 must contain specified terms. The guidance includes a deposit limit of one-third of the total contract price, estimated start and substantial-completion dates, and written, signed change orders. It also cautions that a successful civil or criminal proceeding may not produce collection when a builder is bankrupt, judgment-proof or has left the state. Check the current law and whether your project falls within the covered category before relying on these requirements. Read Maine’s home-construction guidance.

Minnesota: a bankruptcy filing changes the timetable

The Minnesota Attorney General’s November 21, 2025 alert described Minnesota Rusco’s abrupt closing on October 29 and Chapter 7 filing on November 3. Consumers were left with contracts, deposits and unfinished work. The alert discusses possible credit-card or financing disputes and the federal Holder Rule when it applies. Because those possibilities depend on the documents and the case, verify the bankruptcy docket, trustee notices and claim deadline rather than assuming a refund or relying on an old announcement. Maryland: enforcement does not equal immediate payment

In December 2024, the Maryland Attorney General announced that a court affirmed a final order finding more than 800 violations by two modular-home businesses. The businesses had taken over $1 million in deposits and progress payments and failed to finish homes. The figure describes money taken in the matter, not a per-customer loss or a confirmed amount recovered by every buyer. It demonstrates that regulators can pursue widespread nonperformance, while leaving individual collection dependent on the order, assets and applicable procedure. How bankruptcy affects your next move

Once a company files bankruptcy, ordinary collection activity may be stayed and the case controls how creditors submit claims. Determine whether the debtor is the manufacturer, the dealer, the builder or more than one related company. A claim against the wrong legal entity can fail even when the businesses used similar names.

Use the official notice to confirm the claims bar date, required forms, mailing or electronic filing method and any instructions for disputed amounts. Describe the contract, payments, promised delivery, work completed and the amount you seek. Keep copies of everything filed. A bankruptcy claim is a request to share in whatever distributable assets exist; it is not an order requiring a new factory to finish your home.

Before accepting completion by another company

A replacement offer can solve a construction problem, but it can also create a second dispute if the first contract is never resolved. Ask for a written inventory of completed modules, stored materials, engineering drawings, permits, site work and inspections. Establish who owns each item and whether liens or unpaid suppliers affect it.

The new agreement should state the credit for every prior payment, the remaining balance, delivery and installation milestones, responsibility for defects, warranty coverage, change-order procedure and treatment of the original contract. Do not surrender original documents or sign a release until you understand whether it waives a claim against the failed company, its seller or a bond.

Modular and manufactured homes may be treated differently

Every state defines “modular” and “manufactured” differently for licensing, construction standards, sales contracts and consumer remedies. The Colorado and North Carolina examples cited above concern manufactured homes. They illustrate possible protections but do not establish that those statutes cover every modular-home order. Ask the relevant state agency which classification applies to your home, who must be licensed and whether a bond, escrow or guaranty fund covers the seller or builder.

Questions to answer before asserting a claim

  • Which entity signed the agreement with you?
  • Which entity received each deposit or progress payment?
  • Was the payment made by card, lender draw, check or another method?
  • Was the home a standard inventory unit or specially ordered?
  • What work, modules or materials actually exist, and who possesses them?
  • Has a bankruptcy petition been filed, and what is the claim deadline?
  • Does your state require a bond, escrow, guaranty fund or licensed seller?
  • Are you seeking delivery, completion, a refund, a payment dispute or damages?

Common mistakes that reduce recovery options

  • Assuming the factory and the seller are the same legal company.
  • Waiting for a promised refund without sending a written demand or checking deadlines.
  • Assuming a chargeback, Holder Rule defense or bond payment is automatic.
  • Filing a bankruptcy claim against a trade name instead of the debtor named in the case.
  • Paying a replacement builder without documenting credits, ownership and warranties.
  • Describing a state rule for manufactured homes as a nationwide modular-home guarantee.

Bottom line

A manufacturer’s closure can leave a modular-home order delayed, transferred, or undelivered; it does not by itself cancel the contract or refund the deposit. Build the payment and contract map first, contact the seller, payment provider and state regulators quickly, verify any bankruptcy case and deadlines, and obtain state-specific advice before accepting a replacement deal or abandoning a claim. Bonds and enforcement programs can help in some states, but the documented Colorado example shows that relief may be partial and may not produce the home itself.
