On a covered federal or federally assisted construction project, laborers and mechanics must receive at least the wage and fringe-benefit package in the contract’s applicable Davis-Bacon wage determination for the work they actually perform. Compliance is more than paying a rate: you must confirm coverage, use the correct determination and classification, calculate cash wages and qualifying fringe benefits, submit accurate certified payrolls each week, post required notices, flow the rules into subcontracts, and retain supporting records. The contract, solicitation, incorporated determination, funding statute and agency instructions control the details.
What the Davis-Bacon requirement actually is
The Davis-Bacon Act generally applies to qualifying federal or District of Columbia construction contracts in excess of $2,000. Related Acts impose similar prevailing-wage conditions on certain federally assisted construction. Those categories are not interchangeable, and a project’s name or funding label is not enough to decide coverage.

The contracting agency makes the initial coverage determination and incorporates the labor standards clauses and wage determination into the solicitation and award. For a particular job, start with the signed contract, every incorporated amendment, the funding agency’s instructions and the scope of work. If coverage or the proper determination is unclear, ask the contracting officer or funding recipient; questions requiring an official interpretation can be referred to the Department of Labor’s Wage and Hour Division (WHD).

Coverage questions to answer before mobilization
- Is this a direct federal or District of Columbia contract, or federally assisted construction subject to a Related Act?
- What construction type does the determination identify: building, heavy, highway or residential?
- Which state, county or other geographic area applies?
- Which wage determination and revision are incorporated, and what effective-date rules or exceptions apply?
- Which agency receives payrolls, and what submission portal, form or workflow does it require?
Find the applicable wage determination
A Davis-Bacon wage determination is not a national pay scale. It lists minimum rates by geographic area, construction type and labor classification. General determinations are available through SAM.gov for agencies to incorporate, but the determination attached to your solicitation and award is the controlling project document unless an applicable rule changes it.
Compare the determination against the actual job. A county boundary, construction category or revision date that is wrong for the project can produce the wrong minimum. Do not substitute a nearby county’s rate or a different construction category because it appears more convenient.
Determination checklist
- Read the solicitation and award for the determination number, construction type, locality and incorporated revision.
- Check amendments, wage-determination updates and any contract language governing revisions during performance.
- Map the project site to the stated county or locality, including work performed at off-site project locations when the contract treats that work as covered.
- Check every classification needed for the scope, not merely the titles used by your company.
- Send an apparent mismatch to the contracting agency before pricing, hiring or paying on the assumption that your preferred rate applies.
The Department of Labor’s wage-determination guidance describes a general rule for the determination in effect when the contract is awarded, but exceptions can apply. Never treat the base determination as permanently immutable; review the contract and current WHD guidance for the project’s revision rules.

Pay the rate for the work actually performed
For each covered hour, pay at least the basic hourly rate plus the applicable fringe-benefit amount for the classification in the determination. Classification follows the duties performed, not an employee’s internal job title, billing code or the rate that happens to fit your estimate.

The required total can generally be met in either of two ways:
- Pay the full prevailing wage package as cash wages.
- Pay part in cash and satisfy the remainder with qualifying contributions to, or incurred costs for, bona fide fringe benefits.
In Fact Sheet #66E (October 2023), WHD states: “The contractor’s obligation to pay at least the prevailing wage listed in the contract wage determination can be met by (1) paying each laborer and mechanic the applicable prevailing wage (including the amount of fringe benefits) entirely as cash wages or (2) providing a combination of cash wages and contributions to or incurred costs for bona fide fringe benefits.”
What counts as a fringe benefit
A benefit must meet the applicable DOL requirements before you claim credit for it. Document the plan, the employer contribution or allowable cost, the covered employees and the calculation period. Do not assume that every benefit, reimbursement or legally required payment is a creditable fringe contribution. If the claimed benefit costs less than the determination’s fringe amount, pay the difference in cash.
When the determination has no needed classification
If the listed classifications do not cover work in your scope, do not choose an arbitrary title or rate. Use the conformance process described in WHD materials and coordinate the request with the contracting agency. The additional classification and rate require approval; they are not self-selected by the contractor.

Build a weekly certified-payroll process
Certified payroll is a recurring obligation for each week in which covered work occurs. Maintain underlying time, wage and benefit records even when a week has no unusual event. The person signing the certification must be authorized and sufficiently familiar with the records to attest that they are complete and accurate.
Records to capture
- Worker identifying information required by the applicable rules.
- Classification tied to the duties performed.
- Daily and weekly hours, including the covered project and work dates.
- Basic hourly wage, fringe rate, fringe credits and total rate paid.
- Gross wages, deductions and net wages.
- Actual payment date and method.
- Supporting benefit-plan and contribution records.
Submission deadline and certification
WHD’s Davis-Bacon Compliance Principles describes delivery within seven days after the regular payment date for the payroll period. The project agency or funding recipient may prescribe a portal, naming convention, transmission method or additional cover sheet, so follow the contract’s process as well as the seven-day timing described by WHD.
Form WH-347 is available for optional use. It is not the only permissible format when an equivalent payroll contains the required information and the prescribed statement of compliance. A legally valid electronic signature may be used under WHD guidance. Keep the signed certification with the payroll and be able to connect every reported line to timecards, wage calculations and payment records.

Do not confuse payroll submission with record retention
Submitting a certified payroll does not replace the duty to retain the underlying records. Keep time, wage, deduction, classification and benefit documentation available for review under the governing regulation, contract and agency schedule. WHD’s compliance resource describes the agency’s preservation of reviewed payrolls for three years after completion of all work on the prime contract; that statement about agency preservation is not a blanket contractor-retention rule. Confirm the retention period that applies to your records.
Post the required information at the worksite
Post the required worker-rights poster and the applicable wage determination prominently and accessibly at the jobsite. Post approved conformances when they apply. Make sure workers can read the material without having to request special access, and replace superseded determinations or notices when the contract requires an update.
Workers may complain, cooperate with an investigation or testify in a Davis-Bacon and Related Acts proceeding without retaliation. Train supervisors not to threaten, discipline or disadvantage a worker for exercising those rights.

Flow the obligations into every subcontract
The prime contractor remains responsible for managing the labor-standards chain. Put the applicable clauses, wage determination and any approved conformance into each covered subcontract. Give subcontractors enough project information to classify work and calculate wages before they submit a price.

Prime-contractor controls
- Collect a subcontractor’s classification plan and fringe-benefit approach before work starts.
- Require weekly certified payrolls on the same schedule used for the prime contract, unless the agency gives different written instructions.
- Compare reported classifications and rates with observed work, time records and the incorporated determination.
- Check that fringe credits are supported by actual plan documents and contribution records.
- Resolve apparent underpayments immediately and notify the agency when the contract or law requires disclosure.
- Do not make final payment decisions solely from a subcontractor’s certification; monitor the work and retain your review trail.
Subcontract language should identify who submits payrolls, who answers agency questions, how corrections are documented and how records will be made available. A lower-tier subcontract does not erase the labor-standards obligations that flowed from the prime award.
Common mistakes and how to correct them
| Problem | Why it fails | Corrective action |
|---|---|---|
| Using a statewide or national rate | Davis-Bacon rates vary by locality, construction type and classification. | Use the determination incorporated for the project and locality. |
| Classifying by job title | The required rate follows actual duties. | Review the work performed and obtain a conformance when no listed classification fits. |
| Crediting every benefit | Only qualifying bona fide fringe benefits and allowable costs can satisfy the fringe amount. | Document the plan and contribution; pay any shortfall in cash. |
| Submitting payroll late | Covered payrolls are recurring and have a prescribed schedule. | Set a weekly close, approval and transmission calendar tied to the regular pay date. |
| Relying on an omitted clause | For covered post-October 23, 2023 contracts, clauses and determinations may apply by operation of law. | Ask the agency to resolve the omission and preserve a written record of the resolution. |
| Accepting a subcontractor’s form without review | Certification does not prove that observed work, rates and benefits are correct. | Reconcile payroll to timecards, site observations, classifications and payment records. |
| Posting only a general labor poster | The project determination and approved conformances must also be accessible. | Post the current project documents at the site and replace outdated versions. |
What happens when the rules are violated
WHD identifies possible consequences that can include withholding contract amounts, contract termination or liability for resulting government costs, and debarment for up to three years, subject to the governing rules and the facts of the case. These are potential remedies, not an automatic outcome for every error.
When a discrepancy appears, preserve payroll and time records, stop repeating the incorrect calculation, determine affected workers and weeks, and coordinate promptly with the contracting agency. Corrective payments should be traceable to each worker and covered hour. Do not alter an earlier certification without maintaining an audit trail of the correction.

Contractor’s operating checklist
- Obtain the complete solicitation, award, amendments and incorporated wage determination.
- Confirm coverage, locality and construction type with the contracting or funding agency when any fact is uncertain.
- Map actual scopes of work to classifications and request conformances before affected work is paid.
- Set base-wage and fringe calculations in payroll before the first covered pay period.
- Post the worker notice, wage determination and approved conformances at the site.
- Flow labor standards into every covered subcontract and lower-tier agreement.
- Collect, review and certify payroll every covered week.
- Transmit payroll within the agency’s required process and the WHD-described seven-day window after the regular payment date.
- Retain time, wage, deduction and benefit support under the applicable recordkeeping rules.
- Escalate classification, revision, coverage or underpayment questions to the agency and, where appropriate, WHD.
Bottom line for federal contractors
There is no single Davis-Bacon wage. Your obligation is the project-specific package in the applicable determination: the correct classification’s basic rate plus fringe benefits, paid for the duties and hours actually worked. Successful compliance depends on treating the award documents, payroll data, jobsite postings and subcontract oversight as one system. Verify the contract before pricing, document every calculation, submit an accurate certified payroll each week, and involve the contracting agency when coverage, classification or revision rules are uncertain.
