What Domestic Building Insurance Covers in Australia—and What It Doesn’t

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

“Domestic building insurance” can mean two different things in Australia. Ordinary home building insurance covers the physical house and fixtures when an insured event in the policy causes damage. Builder-related cover—called domestic building insurance (DBI), home warranty insurance, Home Building Compensation or residential building work insurance, depending on the jurisdiction—is a conditional statutory scheme linked to particular building work and builder failures. It is not a universal promise to pay for every defect.

The state or territory, contract and certificate dates, work type and value, builder’s circumstances, claim deadlines, limits and exclusions determine whether builder-related cover responds. The examples below are current official guidance for Victoria, New South Wales and the Australian Capital Territory; they are not national rules for every jurisdiction.

Start by identifying which insurance you mean

Using the wrong meaning of “domestic building insurance” is the fastest way to misunderstand a policy or scheme. The following products address different risks.

Term What it generally addresses What you must check
Home building insurance Damage to the building and fixtures from insured events named or described in a policy. The building definition, insured events, exclusions, caps, excess, sum insured and liability cover.
Contents insurance Household goods and personal belongings inside the home. Whether it is purchased separately or bundled, and item limits.
Domestic building insurance, home warranty, Home Building Compensation or equivalent Limited protection connected with qualifying residential building work when the local scheme’s trigger and eligibility conditions are met. Jurisdiction, contract and certificate dates, builder, work type and value, qualifying event or failure, cap, deadlines and exclusions.
Statutory warranty or consumer guarantee The builder’s legal obligations about quality, compliance, completion, materials and fitness for purpose. The relevant state or territory law, warranty period, evidence and regulator, tribunal or court process.

These categories are not interchangeable. A builder may owe you a statutory warranty without an insurer owing you money. Conversely, a scheme certificate may provide a claim route only after a specified builder event or failure. Always read the actual policy, certificate and legislation for the work involved.

What ordinary home building insurance usually covers

Home building insurance protects the structure and fixtures that form part of the home. Moneysmart gives plumbing and built-in cabinetry as examples of fixtures. Depending on the policy, insured events commonly include flood, storm, theft, fire, lightning, earthquake and malicious damage. Those are examples, not an automatic package: the product disclosure statement defines the events, conditions and level of cover.

Building and fixtures

Check how the policy defines “building”. It may include the main dwelling and permanently attached structures, services and fixtures, but the exact boundary can affect garages, retaining walls, fences, pools, external structures and improvements. A claim can fail or be reduced if an item is outside that definition, under a separate limit or subject to a special condition.

Additional benefits that may be included

Some policies provide debris removal after an insured loss, temporary accommodation while the home is uninhabitable, or storage for household items during repairs. These benefits often have time, dollar or approval limits. Optional extensions can include accidental damage or motor burnout. Treat each benefit as conditional until you have checked the wording, sub-limits and claim procedures.

What it normally does not cover

Standard building cover generally does not insure loose household items and personal belongings; contents insurance addresses those risks. Policies may also exclude or restrict certain damage caused by the sea, smoke, landslides or power failures. Flood cover can have limits for particular parts of the home. The same event can therefore produce both covered and excluded damage, depending on the policy wording and cause.

Do not assume an example is a universal exclusion. Insurers define flood, storm, gradual damage, maintenance, wear and tear, defects and other terms differently. The policy and product disclosure statement, rather than a generic list, control the claim.

Builder-related insurance is conditional, not a blanket defects policy

It is inaccurate to say that domestic building insurance covers defects throughout Australia. Each scheme limits the eligible work, builder, trigger, amount and time for a claim. Some schemes are traditionally “last resort”, responding only when the builder dies, becomes insolvent or disappears. Others provide broader assistance when an eligible builder cannot or will not complete or rectify work.

Builder obligations also exist separately. The National Construction Code sets minimum construction standards, but it does not decide every workmanship, contract, maintenance or product-warranty dispute. Depending on the issue, the appropriate route may be the builder, product manufacturer, state or territory regulator, consumer agency, tribunal or court.

Victoria: legacy DBI and Home Warranty from 1 July 2026

Work covered by legacy DBI

For relevant Victorian work insured before 1 July 2026, legacy domestic building insurance is generally a last-resort scheme. The usual qualifying builder events are the builder’s death, insolvency or disappearance. Specified policies issued after 2015 can also respond when the builder fails to comply with a final VCAT or court order. The existing policy continues under its own terms, so the certificate date and wording matter for a project that crosses the transition date.

The Home Warranty scheme for eligible new work

From 1 July 2026, Home Warranty applies to eligible new work under eligible contracts over $20,000. The Building and Plumbing Commission states maximum assistance of $400,000 per home, subject to eligibility, limits and exclusions. The scheme is described as potentially covering incomplete, faulty or non-compliant work when the builder cannot or will not complete or fix it.

“Home Warranty insurance covers work that is: incomplete, faulty, non-compliant.”

That sentence describes the Victorian scheme, not a national standard. It does not remove the need to prove that the contract and work qualify, follow required steps, meet the relevant trigger and fall within the cap and time limits.

Victorian statutory warranties are separate

Consumer Affairs Victoria says implied warranties apply to all domestic building work regardless of cost or whether there is a written contract, and transfer to a new owner for up to 10 years from completion. Those legal rights do not establish that an insurer will pay for every defect or loss. A warranty dispute and an insurance claim can involve different evidence, deadlines and decision-makers.

New South Wales: Home Building Compensation

In NSW, Home Building Compensation insurance is required for specified work over $20,000, including new homes, renovations and swimming pools. State Insurance Regulatory Authority guidance describes cover of up to $340,000, subject to limits, when the responsible business cannot meet its obligations.

Potential losses listed by SIRA

  • Incomplete building work.
  • Breaches of statutory warranties.
  • Faulty design.
  • Deposits or progress payments in specified circumstances.
  • Rectification costs and certain related expenses.

Eligibility depends on listed events such as the builder’s death, insolvency, disappearance or a specified licence suspension. The deadline depends on the type of claim. A $340,000 maximum is therefore not an automatic entitlement: the certificate, event, loss assessment, limits and time rule all have to align.

Australian Capital Territory: insurance and statutory warranties operate separately

The ACT government describes residential building work insurance for houses and apartment buildings up to three storeys. It is intended to protect current and future owners if the builder dies, becomes insolvent or disappears. Confirm the certificate and scheme conditions for the particular project rather than assuming every residential structure qualifies.

ACT statutory warranty periods

Separately, ACT statutory warranties apply to qualifying residential work that requires approval and costs at least $12,000. The ACT Planning Directorate describes a six-year warranty for structural elements and a two-year warranty for non-structural elements. Its description excludes certain structures, including pools, driveways and fences. These periods concern legal warranty rights, not an assurance that an insurer will pay every repair bill.

How to check whether your project or loss is covered

  1. Name the product. Decide whether you are checking ordinary home building insurance, Victorian DBI or Home Warranty, NSW Home Building Compensation, ACT residential building work insurance or a statutory warranty.
  2. Confirm the jurisdiction. Use the rules for the state or territory where the property is located. Do not apply Victoria’s $20,000 threshold, NSW’s $340,000 maximum or ACT’s $12,000 warranty threshold elsewhere.
  3. Match the documents. Check the property address, builder’s legal name and licence, contract, certificate or policy number, work description and issue date. In Victoria, pay particular attention to whether the relevant work was insured before or after 1 July 2026.
  4. Check eligibility. Verify that the work type and contract value meet the local threshold and that the builder and contract are within the scheme. Look for exclusions covering owner-builder work, particular structures or non-qualifying contracts.
  5. Read the trigger and deadline. Identify whether the scheme requires death, insolvency, disappearance, licence suspension, a final order, or evidence that the builder cannot or will not complete or rectify work. Record the applicable claim deadline immediately.
  6. Check the financial limit. Find the maximum assistance, sub-limits, excess, deductions and treatment of deposits, progress payments, temporary accommodation, debris, investigation and professional fees.
  7. Follow the required first step. Some schemes expect you to ask the builder to finish or repair the work, obtain reports, notify the insurer or regulator, or pursue an order before claiming. Keep copies of every notice, response and inspection report.
  8. Verify the certificate. Contact the named insurer or use an official state or territory checker where available. If you cannot identify the applicable scheme, ask the relevant regulator before paying for major rectification work.

Comparing ordinary home building policies

For ordinary home insurance, compare the policy rather than the headline premium. Moneysmart recommends checking the building definition and insured events; exclusions and caps; the excess; premium; legal liability; and whether extended cover exceeds the sum insured.

Comparison point Questions to ask
Scope Which structures, fixtures and services count as the building?
Events Are flood, storm, fire, theft, earthquake and malicious damage included, optional or excluded?
Limits Are there sub-limits for temporary accommodation, debris, external structures or particular materials?
Excess What excess applies to each event, and are additional excesses triggered by location or risk?
Sum insured Would the amount cover demolition, professional fees, materials and current rebuilding costs?
Liability What legal-liability cover is included, and what exclusions apply?
Claims process When must you notify the insurer, what evidence is required and who approves emergency work?

Comparison websites can be a starting point, but promoted links may not show every option and displayed policies may not be equivalent. Obtain the product disclosure statement and compare definitions and limits line by line.

What to do when work is incomplete or defective

Document before altering the work

Photograph and date each problem, retain plans, variations, invoices, progress records and payment evidence, and obtain an appropriately qualified report when the issue is technical or safety-related. Avoid demolishing or covering work until the builder, insurer or regulator has had a reasonable opportunity to inspect, except where urgent action is needed to prevent injury or further damage.

Notify the right party in writing

Tell the builder what is incomplete, faulty or non-compliant and request a response within a reasonable stated period. At the same time, check the scheme’s notification rule and contact the insurer or regulator if a qualifying builder event has occurred or the builder will not act. A statutory warranty complaint, an insurance notification and a building-approval issue may need separate notices.

Separate emergency damage from workmanship

A burst pipe caused by a covered insured event may belong under ordinary home building insurance, while an underlying construction defect may be a builder-warranty or scheme matter. Notify the relevant insurer before permanent repairs where practicable, prevent further damage, keep receipts and do not assume one policy will fund the other.

Key limits readers commonly miss

  • Transition dates: Victorian work insured under legacy DBI remains governed by that policy even after the 1 July 2026 change.
  • Builder status: Scheme cover can depend on death, insolvency, disappearance, licence suspension or another specified failure, not merely the existence of a defect.
  • Thresholds: The Victorian and NSW $20,000 figures concern specified eligible work; the ACT $12,000 figure concerns qualifying approved work for statutory warranties.
  • Caps: Victoria’s $400,000 and NSW’s $340,000 figures are stated maximums subject to eligibility, limits and exclusions, not guaranteed payouts.
  • Transfer: A warranty or policy may transfer to a subsequent owner only under the applicable law or certificate conditions; obtain the documents when buying a recently built home.
  • Maintenance: Ordinary home insurance is not a maintenance contract. Gradual deterioration, poor maintenance or excluded causes can be treated differently from sudden insured damage.

Bottom line for Australian homeowners

Ordinary home building insurance is for insured damage to the house and fixtures; contents insurance is for belongings. Builder-related domestic building insurance is a state or territory scheme with a defined contract, qualifying work, builder trigger, cap, deadline and exclusion list. Victoria’s Home Warranty scheme broadens the stated protection for eligible new work from 1 July 2026, while legacy policies continue on their own terms. NSW and ACT demonstrate different thresholds, triggers and warranty arrangements.
