Clean brick and masonry can serve as fill, subbase or bedding, while materials such as reclaimed asphalt shingles, glass, spent foundry sand and coal fly ash have narrower, specification-dependent uses. A material is not acceptable simply because it has been recycled: its source, processing, gradation, engineering properties, environmental condition, roadway layer and project specification all control the decision.
Material containing regulated or suspect contamination, harmful inclusions, failed test results or a prohibited constituent must be rejected from the proposed use or quarantined for assessment. The controlling requirement is always the current specification and acceptance procedure issued by the project owner or transportation agency.

Which construction debris has a legitimate road-building use?
Road projects use recycled materials in different layers for different functions. A coarse, durable aggregate suitable for a base course may not meet the requirements for an asphalt surface mixture. Conversely, a material acceptable for general fill may be unsuitable as aggregate in new concrete pavement. The following pathways are documented, but each remains subject to project-specific design and approval.

The U.S. Environmental Protection Agency (EPA) identifies non-hazardous concrete, asphalt, brick, block, wood and metals as materials that may have local recovery and recycling markets. A market for a commodity does not, by itself, establish that the material is suitable for a particular road layer. EPA’s overview of construction and demolition materials is available at Sustainable Management of Construction and Demolition Materials (page last updated March 18, 2026).

Reclaimed asphalt pavement
RAP is milled or removed asphalt pavement that is processed for reuse. Federal Highway Administration (FHWA) guidance treats RAP recycling as an established pavement-rehabilitation practice and calls for material evaluation, mixture design, plant verification and ongoing quality control. The allowable RAP content is not a universal percentage: it depends on the asphalt mixture, aggregate and binder properties, traffic and climate, plant capability, and the applicable state or project specification. Use the FHWA resource, Asphalt Pavement Recycling with Reclaimed Asphalt Pavement, together with the current contract requirements.
Recycled concrete aggregate
RCA is made by removing, crushing and processing hydraulic-cement concrete pavement. FHWA’s Technical Advisory T 5040.37, Use of Recycled Concrete Pavement as Aggregate in Hydraulic-Cement Concrete Pavement (2007), addresses RCA in new concrete pavement and says recycled aggregate used for concrete paving should meet the quality requirements applied to virgin aggregate. In the application covered by that advisory, soil, asphalt and steel are harmful components that must be excluded.
That concrete-pavement pathway is narrower than the use of crushed concrete as general fill or subbase. EPA states that brick, concrete and masonry can be recycled on site for fill, subbase material or driveway bedding. Approval for one of those uses does not prove that the same batch qualifies as aggregate in new structural concrete.

Other recovered materials
FHWA’s Tools and Resources for Using Industrial By-Product Materials in Road Construction index links to technical publications and specifications for industrial by-products, reclaimed concrete, RAP and roofing shingles. TxDOT’s Roadway Recycled Materials Summaries provide a state-level example covering materials such as asphalt shingles, glass and RCA, with summaries, case studies and specifications. These resources demonstrate possible uses, not blanket approval in every state.
EPA’s Comprehensive Procurement Guidelines for Construction Products describe recovered materials used in products and construction applications. Its flowable-fill guidance identifies road-construction backfill as an application and discusses coal fly ash and spent foundry sand in engineered fill mixtures. The required proportions and performance properties must be designed for the project rather than copied as a universal recipe.
Match the material to the roadway layer
Before accepting a load, identify the layer and function it must perform. A pavement section normally includes a wearing or surface course, one or more bound or unbound base layers, a subbase and, in some locations, structural or non-structural fill. Each layer imposes different demands for strength, stiffness, drainage, durability, particle shape, cleanliness and moisture behavior.

| Roadway layer or use | Questions the designer must answer | Examples of potentially suitable debris pathways |
|---|---|---|
| Asphalt surface or intermediate mixture | Does the processed material meet asphalt-mixture aggregate and binder requirements, and does the mix design verify performance? | RAP; selected roofing-shingle materials where the specification allows |
| Concrete pavement aggregate | Does RCA meet the project’s virgin-aggregate quality requirements, and are soil, asphalt, steel and other harmful inclusions excluded? | Processed RCA from controlled concrete sources |
| Granular base or subbase | Are gradation, bearing, durability, drainage and cleanliness adequate for the unbound layer? | Processed RCA; clean brick or masonry; approved glass or other by-products where specified |
| General fill or road-construction backfill | Will the material compact, remain stable and meet environmental and mixture requirements for the fill design? | Clean concrete, brick and masonry; flowable-fill mixtures containing approved fly ash or foundry sand |
Do not infer acceptance for a higher-performance layer from a lower-performance use. For example, a crushed masonry product approved as driveway bedding is not automatically an aggregate for a high-traffic asphalt surface, and flowable fill is a designed cementitious mixture rather than loose waste placed in a trench.

How to qualify debris before it reaches the road
A disciplined acceptance process prevents a contaminated or poorly graded load from becoming a pavement defect or an environmental liability. The exact tests and paperwork come from the owner, engineer and jurisdiction, but the sequence below is broadly applicable.
- Identify the source. Record the demolition or milling location, original material, dates, previous uses and any known coatings, treatments or spills. Keep concrete, asphalt, brick, masonry, soil, wood, metals and other streams separate during removal.
- Inspect and segregate. Reject obvious trash and foreign material at the source. Look for painted or coated surfaces, insulation, pipe or tank residues, stained soil, electrical equipment, treated wood and other suspect components. A clean-looking surface is not proof that regulated constituents are absent.
- Screen for environmental concerns. If asbestos, polychlorinated biphenyls (PCBs), lead or another regulated constituent is suspected, stop the reuse decision and follow the applicable identification, sampling, notification and handling rules. State and local requirements may add controls beyond federal examples.
- Process the accepted stream. Crush, mill, screen and remove steel or other inclusions as required. Processing should produce a consistent material rather than simply reduce the size of mixed demolition waste.
- Test engineering properties. Confirm gradation and the properties relevant to the intended layer, such as durability, cleanliness, moisture behavior, strength or mixture performance. A retail sieve set can help with field observation, but it does not replace project-required laboratory testing or an engineer’s acceptance.
- Match the current specification. Check the project drawings, special provisions and the responsible department of transportation’s current material specification. FHWA maintains a national and state resource index; the owner’s written acceptance procedure governs the job.
- Verify production and placement. For RAP, verify the plant and asphalt mixture. For RCA or other aggregate, control stockpile segregation, moisture, gradation and delivery records. Sample at the frequency required by the contract and retain traceability to the source.
- Document the decision. Keep source descriptions, test reports, approvals, quantities, rejected-load records and any environmental determinations. Documentation shows that a recycled material was accepted for a defined use, not approved without limits.
What must be rejected or held for assessment?
“Rejected” can mean barred from the proposed road use; “held” means isolated until a qualified party identifies, tests and routes it under the applicable rules. Do not send a suspect load directly to a road project.

Regulated or suspect contamination
EPA identifies asbestos, PCBs and lead as federally regulated examples in construction and demolition material management. State and local laws may regulate additional constituents or impose stricter procedures. If records, visual inspection or sampling indicate a regulated constituent, quarantine the material, prevent mixing and obtain the required environmental determination before deciding on reuse or disposal. EPA’s Best Practices for Reducing, Reusing, and Recycling Construction and Demolition Materials explains source control and management principles.
Harmful inclusions and mixed demolition waste
For the RCA concrete-pavement application addressed by FHWA, soil, asphalt and steel are specifically identified as harmful components to exclude. Other road uses can have their own exclusion lists. Mixed loads containing uncontrolled soil, waste, wood, insulation, plastics, gypsum, glass fragments or metals should not be treated as aggregate merely because concrete or asphalt is present.
Failed quality or performance tests
Material that misses the required gradation, durability, cleanliness, strength, moisture or mixture-performance criteria must be rejected from that use. It may be possible to reprocess, blend or redirect it to a lower-demand application, but only after the engineer confirms that the new use is allowed. A failed test is not cured by relabeling the stockpile.

Material outside the project specification
A contractor cannot substitute an attractive recycled product for a specified material without approval. If the owner’s specification does not list the material or the proposed use, obtain a written determination from the responsible engineer or agency before delivery and placement. The determination should identify the exact source, processing, tests, layer and controls.
Who sets the rules?
There is no single national acceptance percentage, contaminant threshold or recycled-content rule that applies to every material and road layer. FHWA’s resources point users to national and state specifications, while TxDOT’s summaries illustrate how requirements can differ by jurisdiction. A limit published for one state, pavement type or material class must not be presented as a universal rule.
For a live project, start with the owner’s latest contract documents and contact the project engineer or department of transportation materials office. Confirm whether the proposed use is covered by a standard specification, requires a special provision, needs a source approval, or must pass project-specific testing. Also verify environmental permits and waste-classification obligations before moving material across site boundaries.
Common mistakes that create pavement or compliance problems
- Assuming “recycled” means “safe.” Recycling describes a process, not an environmental clearance or engineering approval.
- Using one acceptance rule for every layer. Surface mixtures, concrete pavement, base, subbase and fill have different performance requirements.
- Mixing sources in one stockpile. Combining clean concrete with soil, asphalt, painted masonry or unknown demolition debris destroys traceability and can change test results.
- Skipping plant or field quality control. A laboratory qualification does not guarantee that every production load has the same gradation or cleanliness.
- Copying another jurisdiction’s limits. State and owner specifications may differ in allowable materials, tests and documentation.
- Sending suspect material for placement while tests are pending. Hold the load in a controlled area until identification and acceptance are complete.
- Treating fill approval as concrete-aggregate approval. The engineering demand and exclusion requirements are different.
A practical acceptance decision
Use this sequence at the stockpile or submittal review:
- What is it? Identify the original material and keep the source traceable.
- Where will it go? Name the exact roadway layer and function.
- Is it clean? Investigate regulated constituents and remove harmful inclusions.
- Can it perform? Complete the required gradation, durability, strength, environmental and mixture tests.
- Is it allowed? Obtain written confirmation against the current owner and jurisdiction specification.
- Can production stay consistent? Establish processing, stockpile, sampling and delivery controls.
- What happens if it fails? Define quarantine, reprocessing, alternate-use or lawful disposal routes before placement begins.
When those questions are answered, reuse can conserve virgin aggregate and keep valuable material in circulation without treating demolition waste as an unrestricted substitute. When any answer is unresolved—especially contamination, harmful inclusions, test failure or specification status—the material belongs in a controlled assessment process, not in the road.
