Repair common Windows errors and clear accumulated junk for a smoother, more stable PC - no reinstall needed.Free scan · no reinstallYes—a builder can sometimes move a new-condo occupancy or closing date, but only within the rights and notice procedure in your signed agreement and local law. The practical questions are whether the revised date is still inside the permitted extension period, whether you agreed to change it, and what happens when the contractual outside date passes. Change orders are separate: a layout or finish revision may be allowed, refused, priced as an extra, or accepted only if it does not disrupt construction. Treat every date and specification as a written contract term, not a sales estimate.
The detailed rules below use Ontario examples because Ontario’s official condominium forms and guidance spell out these issues. In another province, territory, state or country, the signed agreement and local legislation control. The Canada Mortgage and Housing Corporation (CMHC) advises buyers to check local homeowner-protection rules and to “Consult with your lawyer before signing any documents.” Read CMHC’s new-condominium buying guidance.

Start with the documents that actually control your purchase
A brochure, price sheet or agent’s email is not a substitute for the executed agreement. Assemble the complete package before you assess risk:
- the agreement of purchase and sale;
- the disclosure statement;
- the buyer information or condominium information sheet;
- the occupancy or delay addendum;
- all schedules, specifications, colour and finish forms, drawings and amendments; and
- every notice that changes a date, price, plan or specification.
In Ontario, the Condominium Home Addendum prevails over the purchase agreement and other attachments if they conflict. Check that every required field, signature and date is complete. Have a lawyer who regularly handles condominium transactions review the package before you waive conditions or sign a change.

Know the two dates that govern an Ontario occupancy delay
Firm occupancy date
The Statement of Critical Dates in Ontario’s Condominium Home Addendum identifies the expected firm occupancy date. It is the date on which the unit is intended to be ready for occupancy under the agreement, subject to the addendum’s extension rules. A missed firm date can create eligibility for delayed-occupancy coverage under Ontario’s new-home warranty system, but coverage depends on the applicable addendum, notices, reason for the delay and other facts. It is not automatic.
Outside occupancy date
The same statement identifies the outside occupancy date—the latest date permitted after extensions that comply with the addendum. If that date is missed, an Ontario buyer may have a 30-day period in which to terminate. The right depends on the signed addendum, valid notices and the circumstances, so do not treat the 30 days as a universal cancellation rule.
Ontario’s Home Construction Regulatory Authority (HCRA) addendum guidance explains that notice form and timing are governed by the applicable addendum. Confirm the version that applies to your agreement rather than relying on a form found online.
What to do when the builder announces a delay
1. Match the notice to your signed schedule
Record the original firm date, every permitted extension, the outside date and the date on which the builder delivered notice. Compare the notice’s method, content and lead time with the addendum. Keep the envelope, email headers and attachments; a date dispute can turn on when notice was actually received.

- One-Handed Loading - Keep one hand free with a 1/4 in. hex chuck that accepts 1 in. bit tips
2. Ask what event caused the change
Request a written explanation, the new proposed date and whether the builder is invoking a specific extension clause. Do not infer that a vague construction update validly extends the contract. Ask whether the change affects interim occupancy, mortgage timing, closing appointments, inspections or your warranty rights.
3. Protect your claim while you investigate
HCRA notes that delay-related compensation may arise under Ontario’s New Home Warranties Plan Act, but not every delay qualifies. A buyer who agrees to change the occupancy or closing date may affect their entitlement to compensation. Before signing an amendment, obtain legal advice on whether it preserves, reduces or waives any claim. The warning is set out in HCRA’s addendum directive.
4. Rebuild your household plan around the contractual dates
Do not schedule a non-refundable move, terminate a rental, sell an existing home or lock a mortgage solely on the builder’s estimated date. Maintain a contingency for storage, temporary accommodation, rate-lock expiry and employment or school changes. Ask your lender how a delayed closing affects approval validity and required documents.
5. Claim only through the specified process
If the addendum or warranty program provides a form, deadline or evidence requirement, follow it exactly. Keep receipts and a chronological log of notices, calls and costs. A lawyer can determine whether a particular expense, period or notice supports a claim.
Interim occupancy is not the same as owning the unit
Ontario often permits interim occupancy before the condominium corporation is registered and title transfers. You may receive keys and live in the unit, but you do not yet own it. The buyer generally cannot make mortgage payments that build ownership during this period, yet an interim occupancy fee is payable even if the unit is unoccupied.

- estimated municipal property taxes; and
- projected common expenses.
Check the agreement for the exact calculation, payment date, adjustment rights and what happens if registration is delayed. Ask when the builder expects registration and whether utilities, parking, lockers and common-element access have separate rules. The CAO’s explanation of pre-construction condos describes the distinction between occupancy and title; verify current figures and terms with your lawyer.
When a project or phase is cancelled
Pre-construction agreements commonly contain conditions tied to minimum sales, financing, approvals or other project milestones. Ontario buyer materials say these cancellation conditions should be disclosed in the purchase documents. Read who may cancel, by what deadline, and whether the condition applies to the entire project or a phase.
Check what happens to your deposit
Identify where deposits are held, when they must be returned after a permitted cancellation and what deductions, if any, are authorized. The CAO explains that deposits are generally held in trust and that limited deposit protection may apply, subject to the transaction and current law. Do not assume every deposit is protected in the same way or for the same amount.
Review the condominium information sheet
HCRA’s directive says the Condominium Information Sheet must be the first page of an agreement for a new or pre-construction condominium and highlights status, early-termination conditions and expected occupancy. The directive describes an initial 10-day cancellation period; the statutory trigger and applicable dates must be confirmed from your documents and current legal advice. See the HCRA Condominium Information Sheet directive.

Change orders: what you can change, what it can cost and why timing matters
A change order is a written alteration to the agreed design, materials, fixtures, price or work scope. Builders may offer a menu of selections, but an advertised option is not necessarily an entitlement. Ask for the deadline, approval process and price before treating any option as available.
Changes to layout and openings
Ask specifically whether you may move or remove walls, alter windows or doorways, change door swings, relocate plumbing or electrical points, or modify ceiling and bulkhead details. Structural, fire-separation, accessibility and building-code constraints can make a requested change impossible. A change that appears cosmetic may require engineering, revised permits or a different construction sequence.
Finishes, fixtures and appliances
Confirm the included manufacturer, model, colour, grade, dimensions and installation allowance for flooring, cabinets, counters, plumbing fixtures, lighting, appliances, doors and hardware. “Upgrade” can mean the retail difference, a builder administration fee, labour, tax, redesign or all of these. Request a line-item price and ask whether a credit is available if you choose a less expensive item.
Timing, selections and builder approval
Get the selection deadline in writing. Missing it may let the builder choose a standard item, charge a late fee or refuse the change because materials have been ordered. Ask whether the builder, architect, engineer or condominium corporation must approve the revision, how long approval takes and whether the work is completed before interim occupancy or later under a deficiency process.
Use a written change-order record
Each approved revision should identify the drawing or specification being replaced, exact dimensions and products, additional or reduced price, taxes, payment schedule, effect on the occupancy date and signatures. Do not rely on an agent’s verbal assurance that “it will be taken care of.” CMHC recommends asking what alterations are permitted and what they cost; its checklist for buying a new condominium is a useful starting point, while the contract controls the result.

|---|---|---|
| Is the change allowed? | Structure, code, permits and construction stage may restrict it. | Written approval, revised plan and responsible professional’s sign-off. |
| What is the full price? | Labour, design, administration, tax and installation can exceed the item’s retail difference. | Itemized quote stating inclusions, exclusions and tax. |
| When must I decide? | Late selections can be refused or can disrupt procurement and schedule. | Selection calendar and acknowledgement of the deadline. |
| Does it change the schedule? | A revision can affect occupancy, inspection or registration timing. | Clause or amendment stating any schedule impact. |
| What replaces the original? | Conflicting drawings create disputes over what is to be built. | Signed amendment naming the superseded specification. |
Compare two condo offers on risk, not just price
When evaluating competing projects, place the relevant terms side by side. A lower purchase price can be outweighed by a less certain schedule, restrictive selections or a long interim-occupancy period.
| Comparison point | Record for each project |
|---|---|
| Occupancy schedule | Firm occupancy date, permitted extensions, notice method and outside date. |
| Delay remedies | Coverage conditions, claim procedure, compensation limits and termination rights. |
| Cancellation | Sales, financing and approval conditions; who can terminate and by when. |
| Deposits | Trust arrangement, return process and applicable protection under current law. |
| Change flexibility | Available layouts and finishes, selection deadlines, approval requirements and itemized costs. |
| Interim occupancy | Fee formula, expected registration timing and responsibilities before title transfer. |
Ontario rules support these as sensible comparison axes, but the legal effect of each term varies by agreement and circumstances. Have counsel review both packages before choosing.
A practical pre-signing and construction checklist
- Collect the complete contract. Include the agreement, disclosure statement, buyer or condominium information sheet, addendum, schedules, specifications and all amendments.
- Mark the critical dates. Write down the firm occupancy date, every extension date, the outside date, notice requirements and the process for claiming coverage.
- Test your finances against delay. Ask your lender about rate-lock expiry, appraisal validity and re-approval; budget interim occupancy, rent, storage and moving changes.
- Identify cancellation triggers. Note minimum-sales, financing, approval and other conditions, plus deposit-return provisions.
- Inventory what is included. Record brands or models where stated, dimensions, allowances, parking, locker, appliances, utilities and common expenses.
- Price every proposed change. Obtain written approval, deadline, itemized cost, tax treatment, payment timing and schedule impact.
- Control document versions. Keep originals and revised drawings, specifications, selection forms, notices and signed amendments in a dated folder.
- Pause before accepting a new date. Ask a condominium lawyer whether the amendment changes delay compensation, termination rights or other remedies.
- Verify the current form. HCRA’s materials describe 2020 addenda, while the current regulation listing indicates new forms scheduled for agreements entered on or after January 1, 2027. Confirm the form and law applicable to your agreement’s date and type.
Common mistakes and how to avoid them
Treating the sales estimate as the contract date
Fix: use the Statement of Critical Dates and addendum, not a brochure or verbal prediction, when arranging financing and housing.

Pick the symptom - the matching free tool is one click away.
Signing a date extension without advice
Fix: ask what rights are preserved and obtain written legal advice before agreeing; HCRA specifically warns that a mutually agreed date change can affect compensation.
Assuming occupancy means title
Fix: budget the interim occupancy fee and confirm registration and closing mechanics separately.
Approving a change from an email or showroom conversation
Fix: require a signed, itemized change order tied to a revised plan or specification.
Ignoring project-cancellation language
Fix: understand the sales and financing conditions and the deposit-return process before signing.
Using an old Ontario form
Fix: check the agreement date, transaction type and current HCRA or regulatory requirements; do not copy a downloaded addendum into a new deal.
