Transit-oriented development (TOD) zoning is not a single national rule. It is a local framework that generally allows more homes, mixed-use buildings and walkable streets near frequent, reliable transit. Depending on the jurisdiction and station-area plan, a site may receive higher height or floor-area limits, fewer parking obligations, and an affordable-housing requirement. A train or bus stop by itself does not guarantee TOD rights: you must verify the qualifying transit service, distance band, parcel zoning, overlay and development standards in force for that address.
What TOD zoning changes
TOD zoning aligns land-use permissions with public transportation. The Urban Institute defines TOD as creating “dense, mixed-use, and walkable communities close to stations served by frequent and reliable public transportation,” with potential benefits including lower transportation costs, less pollution and congestion, higher transit ridership and more capacity for growth (Urban Institute, 2025).

- Use: apartments, condominiums, small multifamily buildings, shops, services and other mixed-use combinations may become permitted or easier to approve.
- Capacity: the maximum number of homes or the floor-area ratio (FAR), also called floor-space index (FSI), may increase.
- Form: height, setbacks, lot coverage, frontage and public-realm design standards may change by distance from the station.
- Parking: minimum vehicle-space requirements may be reduced or removed, although accessible spaces and other transportation conditions can remain.
- Affordability: added capacity may be paired with inclusionary-zoning contributions, incentives or priority for affordable homes.
These changes are made through a city zoning code, station-area plan, overlay, provincial or state law, or a combination. There is no universal TOD entitlement that applies to every rail platform or bus stop.

How a property qualifies for TOD treatment
Distance is only one test
Policies commonly draw a radius around a station, but the measurement differs. The Bay Area Metropolitan Transportation Commission’s Transit-Oriented Communities Policy applies within one-half mile of specified BART, Caltrain, SMART, Capitol Corridor, ACE, light-rail, bus rapid transit and ferry stops or stations. Toronto’s current station-area standards use bands of 200 metres and 500 metres. Another jurisdiction may measure walking distance, use a mapped station-area boundary or require a particular service frequency.
Do not assume that a parcel is eligible because it looks close on a map. Confirm whether the code measures the lot line, building entrance, parcel centroid or walking route, and whether the stop is on the qualifying list.
Frequent service matters
Physical proximity does not necessarily mean useful transit. In the Urban Institute’s analysis of 2022 housing data, 45 percent of housing units nationally were within one-half mile of bus or rail transit, but only 10 percent were within one-half mile of frequent service arriving at least every 15 minutes in the middle of the day. Housing near frequent transit increased 20 percent from 2000 to 2022, compared with 23 percent growth in the total housing stock.
For a proposed bus-station apartment project, check the route’s scheduled headways, the hours that count under the local ordinance and whether the route is fixed, frequent or designated as bus rapid transit. A stop with infrequent service may fall outside the TOD overlay even when it is physically adjacent.
What you can commonly build
Multifamily and missing-middle housing
Typical TOD permissions include apartment buildings, condominiums, townhouses, courtyard housing and small apartment buildings on lots that previously allowed only detached homes. The Puget Sound work examined three reform patterns: “Multiply,” which places high-density housing near transit; “Missing Middle,” which permits small-scale apartments on small lots; and “Plexify,” which allows two- to four-unit buildings.

- Both tools are designed to fit into difficult to reach spaces
- Complete a wide range of applications with a high-performance motor that delivers up to 300 UWO, and an impact driver delivering up to 1,400 in-lbs of torque

- One-Handed Loading - Keep one hand free with a 1/4 in. hex chuck that accepts 1 in. bit tips
The exact result depends on the base zone and overlay. A TOD designation may make multifamily use permitted, but it does not automatically waive building-code, fire-access, environmental, stormwater, design-review or subdivision requirements.
Mixed-use buildings
Station-area codes often pair homes with shops, restaurants, offices, childcare, personal services or community uses. Ground-floor commercial requirements, active-frontage rules and loading standards can affect the first-floor plan even when the residential density is favorable. Read the use table and frontage provisions together rather than relying on a general statement that “mixed use is allowed.”
Toronto’s station-area example
Toronto illustrates how sharply standards can change by distance. On qualifying large sites in Mixed Use, Apartment Neighbourhoods or Regeneration Areas, the city says zoning must allow:
| Distance from station | Maximum building height required by the standard | Minimum FSI required by the standard |
|---|---|---|
| Within 200 metres | Up to 30 storeys | 8.0 FSI |
| More than 200 and up to 500 metres | Up to 20 storeys | 6.0 FSI |
FSI is total building floor area divided by lot area. On a 1,000-square-metre lot, 6.0 FSI represents 6,000 square metres of floor area before other applicable controls and exemptions are considered. The figures are standards for qualifying sites and designations, not a promise that every parcel can reach the stated envelope.
On sites designated Neighbourhoods, Toronto describes up to six storeys on major streets within 200 metres and up to four storeys elsewhere in the station area. The designation, street classification and parcel-specific provisions therefore matter as much as the radius.

How to translate TOD standards into a buildable envelope
Start with the mapped controls
Obtain the current parcel zoning map, station-area overlay, official or comprehensive plan and development-code text. Check the effective date: a council-approved proposal, an adopted amendment and an in-force regulation can produce different answers.

Use the stated FAR or FSI to estimate gross floor area, then test height, setbacks, step-backs, lot coverage, tower separation, frontage, open space, daylight, loading and access requirements. A high FSI may be difficult to realize if the same code imposes deep setbacks or a low lot-coverage limit. Conversely, a height allowance is not useful if the site cannot satisfy fire access, servicing or public-realm rules.
Separate permission from approval
“Allowed” can mean permitted as of right, eligible for a streamlined approval, or merely possible after a rezoning or variance. Identify every discretionary step, including design review, transportation studies, environmental review, heritage review and agreements for streetscape or station access.
Does TOD zoning remove parking requirements?
Sometimes, but only under the local rule. Reducing or eliminating minimum parking is a common TOD tool because parking consumes land and can increase construction cost. The Puget Sound study found that almost half of station-adjacent land required at least one parking space per housing unit, a rule that can materially limit housing yield.
Toronto states that, as of August 15, 2025, minimum parking requirements in protected Major Transit Station Areas are no longer in effect. Developers may still provide parking voluntarily, and accessible parking remains required. That Toronto rule should not be generalized to other station areas. A different jurisdiction may set a lower minimum, impose a maximum, require shared parking, or retain full requirements for commercial, visitor, loading or accessible spaces.

Before fixing the site plan, verify:
- whether the parcel is inside the precise parking-reform boundary;
- the number and dimensions of accessible spaces;
- bicycle parking, loading and pickup/drop-off requirements;
- vehicle-access, curb-management and emergency-access standards; and
- whether a financing agreement or tenant market requires parking even when zoning does not.
Are affordable homes required near transit?
There is no single answer. TOD policies frequently combine added development capacity with affordability measures, but the obligation may be a set-aside, a fee, a density bonus, a public-land condition or a voluntary incentive. Read the applicable ordinance rather than assuming that every transit project has the same requirement.
MTC says its Bay Area policy is intended to increase housing supply and prioritize affordable housing in transit-rich areas, while also prioritizing bus transit, walking, cycling and shared mobility in Equity Priority Communities.
Toronto describes inclusionary zoning in applicable protected Major Transit Station Areas: developers provide up to 5 percent of units or floor area as affordable housing, with affordability maintained for 25 years. The city page also notes a provincial pause on implementation until July 1, 2027 while zoning work continues. Because that status can change, confirm the effective provincial and municipal provisions when underwriting a project.

The effect is not simply a taller building. The Urban Institute’s Puget Sound report found about one-third of station-adjacent land was zoned only for single-family homes, and almost half was subject to a one-space-per-unit parking rule. It estimated that a package of reforms could increase housing production by almost 70 percent over the following decade compared with the status quo. That is a regional model, not a guarantee for an individual rezoning.

A due-diligence workflow for a TOD project
- Identify the transit eligibility. Record the station or stop name, mode, route, service frequency, operating hours and the policy’s qualifying-transit list.
- Measure the distance correctly. Map the parcel against each applicable radius or station-area boundary, including the 200-metre, 500-metre or one-half-mile band used by the relevant policy.
- Confirm the controlling documents. Download the current zoning map, overlay, station-area plan, official or comprehensive plan and development-code text from the responsible authority.
- Read the use table. Determine whether apartments, small multifamily, commercial and mixed-use components are permitted, conditional or prohibited.
- Build a dimensional envelope. Calculate FAR or FSI and test height, setbacks, lot coverage, step-backs, open space, frontage, loading and access.
- Price transportation and public-realm obligations. Include parking or parking-lot alternatives, bicycle facilities, sidewalks, curb work, station connections and transportation-demand measures.
- Check affordability provisions. Identify set-asides, term of affordability, fees, incentives and any implementation pause or transition rule.
- List approvals and risks. Separate by-right work from rezoning, variance, design review, environmental, heritage, subdivision and infrastructure approvals.
- Recheck effective dates. Use the version of each ordinance in force when the application will be filed, not an older map or a proposed amendment.
How to compare two TOD proposals
Use the same five-axis test for every site or policy:
| Axis | Questions to answer |
|---|---|
| Transit eligibility | Is the service frequent enough, and is this mode and stop named in the policy? |
| Distance and boundary | Which radius, walking-distance rule or station-area map applies? |
| Use and capacity | Are homes and ground-floor uses permitted, and what unit count or FAR/FSI can the lot support? |
| Form and design | What height, setbacks, step-backs, lot coverage, frontage and public-realm standards control? |
| Conditions | What parking, accessible-space, bicycle, loading, affordable-housing and approval obligations remain? |
This comparison prevents a common error: treating a generous height limit as superior when another site has fewer discretionary approvals, no parking minimum and a more workable affordability structure.
Common mistakes and how to avoid them
Assuming every bus stop qualifies
Many policies require frequent service or name eligible bus rapid transit routes. Verify the schedule and policy list before relying on TOD capacity.

A parcel can fall inside a half-mile or 500-metre band but remain subject to a different designation, historic district, environmental constraint or neighborhood-specific height rule. Read the parcel layer and the written code together.
Treating “no minimum parking” as “no parking rules”
Accessible parking, bicycle parking, loading, curb access, fire lanes and voluntary parking commitments can still affect the plan.
Quoting a maximum as a guaranteed project size
Toronto’s 30-storey and 8.0 FSI figures apply to qualifying large sites and specified designations within 200 metres. Similar qualifications appear in other jurisdictions. Test the complete dimensional envelope and approval path.
Ignoring the effective date
Transit-area reforms can be adopted in stages or paused. Confirm which provisions are legally operative on the filing date, especially where affordability implementation is subject to a transition.

Bottom line for builders and landowners
TOD zoning can make apartments, small multifamily projects and mixed-use buildings feasible near train and bus stations by increasing capacity and reducing parking barriers. Eligibility depends on the transit service, mapped distance or station-area boundary and the parcel’s exact designation. The reliable way to answer “what can I build?” is to assemble the current zoning and transit documents, calculate the full buildable envelope, and then account for parking, affordability, public-realm and approval conditions before treating the site as developable.
