If a road project may take part of your land, house, shop, crops or trees in Bangladesh, first identify the authority named in the document, the plot and measured area, the project purpose and the notice stage. A statutory acquisition normally proceeds through the Deputy Commissioner under the Acquisition and Requisition of Immovable Property Act, 2017 (ARIPA), while a road agency’s internal project approval and any project-specific resettlement assistance are separate matters. Do not assume that every setback, road reservation or construction impact is automatically an acquisition under ARIPA. Read the notice actually served, meet its deadline and preserve evidence before anything changes on the ground.
Start by identifying what document you received
The same road project can generate several kinds of paperwork. A letter from a road agency about a proposed alignment is not necessarily a statutory acquisition notice. A survey or measurement exercise is not the same as an award. The document should tell you, or allow you to determine, which office is acting, what legal authority is cited, which plot is affected and how much land or property is involved.

| Document or stage | What it means for an owner | What to check |
|---|---|---|
| Project proposal or agency communication | An administrative or technical step in planning a road. It may describe a corridor, reservation or construction need without being the statutory acquisition notice. | Issuing agency, project reference, alignment drawing, survey date and whether it asks for a response. |
| Preliminary notice under section 4 | The Deputy Commissioner has begun the statutory acquisition process. Before issuing it, the property’s actual state and nature, including structures, crops and trees, are to be recorded by video, photographs or another technology. | Notice date and service method, plot and area, stated purpose, recorded assets and response instructions. |
| Later public claims notice under section 7 | After the acquisition decision, interested people are asked to appear personally or through an authorised representative and state their interest and compensation claim. | The exact working-day deadline: ordinarily 15 working days after notice, or 7 working days for a nationally important project. |
| Assessment and award | The compensation assessment and formal award for the affected interest and assets. | Written calculation, recorded ownership shares, affected area, structures, crops and trees, and payment status. |
| Possession or handover communication | A later implementation step. Section 13 links possession to payment, or deemed payment, of the compensation awarded under section 11, subject to the facts of the case. | Whether an award exists, whether payment was made or deemed made, and any dispute recorded by the office. |
The governing statute identified here is ARIPA, Act 21 of 2017, enacted on 21 September 2017. It replaced the Acquisition and Requisition of Immovable Property Ordinance, 1982. Read the current official text at Laws of Bangladesh and ask the issuing office whether any later amendment or implementation instruction applies to your case.
What to do immediately after receiving a notice
- Keep the original and record service details. Scan or photograph every page, envelope and attachment. Write down when and how it was served, the office address, reference number, plot number, stated area, project name and the date by which you must respond. Keep a calendar entry for the deadline rather than relying on memory.
- Map the affected property. Compare the notice with your deed, khatian or other land and revenue records. Mark the portion described in the notice on a sketch or survey plan. If the document uses a local measurement, ask the office to explain the unit and the conversion to the area shown in your records.
- Check the condition record. Section 4 requires a pre-notice record of the property’s actual state and nature, including buildings, other structures, crops and trees, using video, still photographs or another technology. Ask to see or inspect the record if the notice or office does not provide it. Note any omission or incorrect description promptly in writing.
- Prepare proof of your interest. Assemble the documents that explain why you are an interested person and what share you claim: land and revenue records, registered instruments, inheritance or authority papers where applicable, and documents showing co-owners or heirs. There is no single document that is universally sufficient for every claim, so organise the papers around your particular title and interest.
- Preserve dated evidence of assets. Keep clear, dated photographs and video of each affected structure, shop fitting, boundary, crop, tree and other item. Photograph from several angles and retain original files with their metadata. A simple inventory should identify the location, dimensions, condition and person who owns or uses each item.
- Respond through the correct channel. Use the address and method in the notice, submit a signed claim or statement, and retain a stamped copy, receipt, postal proof or other evidence of delivery. If you appoint a representative, use written authority and keep a copy with your file.
- Ask for the next procedural step in writing. If the notice is unclear, ask the Deputy Commissioner’s office which stage it represents, what the applicable deadline is and where to inspect the assessment or property record. An oral assurance should not replace a written submission before the deadline.
How to make a useful compensation claim
The section 7 notice is not merely an invitation to say that you object. It asks each interested person, personally or through an authorised representative, to state the nature of the interest and the amount and details of the compensation claim. A clear submission lets the office match your claim to the correct plot, share and recorded assets.

Describe the interest and the share
State whether you claim as the recorded owner, an heir, co-owner or another interested person recognised in your documents. Give the claimed percentage or fractional share where relevant, name other known claimants and attach the records that support the relationship. If an inheritance, power of attorney or other authority is involved, identify it and explain who is authorised to act.
Describe what is affected
List the plot and the area proposed for acquisition, then list each affected asset separately. For a building or shop, describe its type, floor area, materials and condition. For crops and trees, identify the species or crop, approximate area or number and stage of growth. Explain any damage that the notice or measurement does not capture, and attach the dated evidence that supports the description.
State the amount without inventing a rate
You may state the amount you claim and explain how you reached it, but do not treat an internet rate, a neighbour’s settlement or a contractor’s estimate as a universal legal formula. ARIPA provides a statutory process for determining compensation and lists matters to be considered and matters not to be considered. The sources available for this guide do not establish one per-unit price or multiplier that applies to every Bangladeshi road project.

How compensation is assessed under ARIPA
The Act governs the statutory compensation process, but the payable amount depends on the assessment and facts recorded for the particular acquisition. The safest way to review a figure is to obtain the Deputy Commissioner’s written assessment and award and test each line against your records and evidence.
| Review point | Question to ask |
|---|---|
| Identity and title | Does the award name the correct owner, heir, co-owner or other interested person, and does each recorded share match the supporting documents? |
| Land area | Does the measured area in the award match the notice, survey record and land documents? If only part of a plot is taken, is the affected portion clearly identified? |
| Land and improvements | Are the land, structures, crops and trees that were present and recorded before the notice reflected in the assessment? |
| Legal basis | Does the document identify the statutory provision and explain the calculation rather than presenting an unexplained lump sum? |
| Payment status | Does it show whether payment has been made, is available for collection, or is treated as deemed payment under the applicable procedure? |
Do not promise yourself a market-price uplift, a fixed percentage or a particular payment date unless the current statute, the written assessment and the project record support it. If the amount, ownership or asset record is wrong, put the specific error and supporting document before the Deputy Commissioner’s office and obtain proof that it was received.

Payment, possession and disputes
Section 13 connects possession with payment, or deemed payment, of the compensation awarded under section 11. That rule should be read with the actual award and payment record; it does not, by itself, answer every question about a disputed title, an uncollected amount, a co-owner’s objection or a person whose documents are incomplete.
When title or inheritance is disputed
Gather the documents that show the chain of title, succession and authority to act. Notify the acquisition office of competing claims instead of allowing one claimant’s submission to stand as the only account. A property lawyer who can examine the notice, records and award can advise on the appropriate objection, representation or court process for the specific dispute.
When payment is delayed or cannot be collected
Ask the issuing office for a written statement of the award, the amount deposited or made available, the payee names and any reason payment is withheld. Keep copies of bank, treasury or receipt records. Do not sign a full settlement or possession document until you understand what it covers and whether it affects an unresolved claim.

When the recorded assets are incomplete
Use the pre-notice photographs, video, inventory and witness information to identify the omission. Submit a concise correction request listing each missing or misdescribed item and attach the evidence. The earlier the correction is documented, the easier it is to link the request to the relevant notice and assessment.

A road project may have a safeguard, resettlement or livelihood document that offers assistance beyond the statutory acquisition award. Such assistance can have its own eligibility rules, forms, grievance channel and payment schedule. Treat those promises as project-specific and obtain the written policy for the named project.

That is context for that project, not a universal entitlement rule for every road-widening scheme. Read the project’s eligibility definitions and grievance procedures separately from the Deputy Commissioner’s acquisition notice. A person who does not hold formal title should not assume either that no assistance is available or that statutory compensation is guaranteed; the answer depends on the project documents and the facts of occupation and interest.

Keep two folders: one for the ARIPA notice, claim, assessment and award; another for any resettlement, relocation, livelihood or vulnerable-person assistance offered by the project. Do not allow a project-assistance form to substitute for the statutory claim unless the document clearly explains that relationship.
Do not confuse agency approval time with your deadline
The Road Transport and Highways Division’s citizen charter lists a 10-working-day service period for a described administrative land-acquisition approval service for agencies under it. That is an internal proposal-approval standard for the specified service. It is not an owner’s compensation deadline, a promise that acquisition will finish in ten working days, or a prediction of when possession or payment will occur. The charter is available at the Road Transport and Highways Division. Your operative deadline remains the one in the notice served on you.
A practical comparison before you sign or accept anything
Use this review table with the documents in your file. Mark the source of each answer and list any mismatch as a separate written question to the issuing office.

When to obtain case-specific advice
Get qualified Bangladesh property-law advice promptly if the notice uses a name or plot you do not recognise, family members disagree about inheritance, a co-owner is missing, the measured area conflicts with your records, the award omits a structure or crop, payment is disputed, or an officer asks you to surrender possession before you understand the payment record. Bring the complete file, not only the latest letter. The adviser will need the notice, service date, land records, condition evidence, claim, assessment, award and any project-assistance policy to identify the available response.
For every case, the disciplined approach is the same: identify the statutory stage, meet the notice deadline, state your interest and claim precisely, preserve the condition of the property in dated evidence, and compare the written award with what is actually affected. That process protects your position without assuming that a road plan, an internal approval or a project promise has the same legal effect as an ARIPA acquisition notice.
