That may be a city, county, state or provincial transportation department, toll-road authority, transit agency, or another road owner. A project’s location inside city limits does not by itself make the city the permitting authority. You must identify the exact road segment, describe the work, and ask the controlling authority which permit classes and related approvals apply.
The short answer: jurisdiction follows the road, not the nearest city hall
Road permits are generally issued by the public agency with legal control of the right-of-way (ROW) where the work will occur. On a local street, that is often a city or county public-works, engineering, transportation, or right-of-way office. On a state-controlled route, the state transportation department may be the issuer even when the road runs through a municipality. A county road inside a city boundary can remain a county responsibility, while a state route inside the same boundary can remain under state control.

The work itself also changes the answer. Excavating, installing a utility, building a driveway, closing a lane, placing equipment, repairing a sidewalk, or occupying a shoulder may use different applications or require more than one approval. The safest first call is to the road owner’s permit office, with the address, nearest intersection, road name and a plain-language description of what you plan to do.

Municipal boundaries and transportation jurisdiction are separate systems. A city may maintain some streets but not every route inside its boundaries. State departments commonly retain control of designated highways, and counties or special authorities may control other corridors. Virginia’s rules illustrate the point: a Virginia Department of Transportation (VDOT) land-use permit applies only on VDOT right-of-way or property; county and city permits are required for roads under those local jurisdictions.

Maps, road names and postal addresses can be misleading. A named avenue may change ownership at an intersection, a frontage road may belong to a different agency than the mainline, and a sidewalk or drainage strip may be within a separate easement. Confirm the segment rather than relying on the closest government office or on who plows the road.
How to identify the issuing authority
- Pin down the exact location. Record the street address, side of the road, nearest cross streets, parcel number if available, and whether the work is in the travel lane, shoulder, sidewalk, verge, drainage area or an adjoining private parcel.
- Determine who controls that segment. Check the road authority’s official jurisdiction map or road inventory, then confirm with its permit desk. Ask specifically whether the segment is city, county, state or provincial, federal, toll-road, transit, railroad or another authority’s ROW.
- Describe the activity, not just the project name. Say whether you will dig, install or repair a utility, construct a driveway, replace a sidewalk, place a crane or dumpster, landscape, drill a monitoring well, stage materials, or perform another activity.
- Explain duration and public impact. State dates, working hours, equipment footprint, lane or sidewalk closures, pedestrian detours, shoulder use and any expected traffic-control measures.
- Ask which approvals are linked. The office may route you to separate excavation, utility-cut, construction, driveway, parking, street-occupation or traffic-control applications. Ask whether another owner’s consent is needed.
Match the permit to the work
Excavation or breaking the pavement
Digging into a road, shoulder, sidewalk or other public surface is usually treated as excavation or a road-opening activity. Calgary, for example, requires an excavation permit to break or dig into the surface of a city road ROW. The application may require plans showing limits of disturbance, depth, utility clearances, restoration and inspection points. Excavation approval does not automatically authorize a lane closure or material storage; those impacts can trigger a separate street-use permit.
Utility installation and repair
Utility work can follow a specialized route. Toronto’s Utility Management unit reviews and issues utility-cut permits for qualifying utility work in the city ROW. The city directs non-pre-approved utilities and non-utility work to other application paths and separately identifies right-of-way construction permits. Tell the authority whether the line is water, sewer, electric, telecommunications, gas or another service, who owns it, and whether the work is a new connection, emergency repair or replacement.

A new or modified driveway crossing, sidewalk reconstruction or curb alteration may be a ROW permit even when no deep excavation is planned. Austin lists driveway and sidewalk work among its city-ROW permit types. The review can address grades, drainage, accessibility, sight distance and restoration standards in addition to the construction method.

Construction, landscaping and monitoring equipment
Construction in a public strip, installation of foundations or structures, landscaping, survey installations and monitoring wells may each be classified differently. Los Angeles requires permits for construction in property, streets or other ROW owned by, to be owned by or controlled by the city; its Bureau of Engineering describes distinct “A,” “B,” excavation and revocable permit categories. The category depends on the work and the property interest involved, so provide drawings and a precise description rather than asking for a generic road permit.
Temporary occupation or storage
Placing a crane, lift, dumpster, fencing, construction trailer, materials or vehicles in the ROW can require a temporary-use, parking or street-occupation permit even if nothing is dug. Toronto describes a street-occupation permit for temporarily occupying the public ROW. The application normally needs the footprint, dates, hours, barriers and pedestrian route. A temporary occupation approval may be required in addition to a construction or excavation permit.
Traffic control is often a second approval
A permit to perform work does not necessarily authorize you to close a lane, block a sidewalk or divert traffic. Austin states that work in or use of city ROW requires a ROW permit and identifies traffic-control obligations, including use of trained personnel or a qualified barricade company to set and maintain compliant control. Calgary likewise notes that street-use approval may be needed for lane closures, staging or traffic impacts in addition to excavation approval.
Give the permit office a traffic-impact description early. Include lane widths, closure timing, work vehicles, pedestrian access, bicycle facilities, bus stops, emergency access and proposed signs, cones, barriers or flaggers. The authority may require an engineered traffic-control plan, a certified traffic-control provider, advance public notice or coordination with transit and emergency services. Do not assume that buying traffic cones satisfies a legal requirement; the permit and approved plan control the equipment and layout.

Official examples of how the route changes
| Location and situation | Likely issuing path | What the example shows |
|---|---|---|
| Virginia state-controlled highway | VDOT land-use permit | VDOT permits apply only to VDOT ROW; county or city permits apply on roads controlled by those governments. |
| Los Angeles construction in city ROW | City Bureau of Engineering permit category, such as “A,” “B,” excavation or revocable permit | Construction, excavation and revocable use can have distinct city applications. |
| Austin work in city ROW | City ROW permit, with applicable driveway/sidewalk, excavation, parking, temporary-use or other sub-type | The city first determines whether the site is city ROW and then routes the activity to the appropriate permit. |
| Toronto utility cut | Utility Management utility-cut permit for qualifying utility work | Utility and non-utility work use different application paths; other ROW construction permits may also apply. |
| Toronto temporary occupation | Street-occupation or related public-ROW permit | Temporary use of the ROW is regulated separately from the underlying construction activity. |
| Calgary road excavation | City excavation permit; possible street-use permit | Breaking the surface and managing lane, staging or traffic impacts can be separate approvals. |
These examples demonstrate categories, not a universal form or fee schedule. A different city, county or state can use different names and combine or split the approvals.
Check for other owners and agencies
Road control is not the only approval issue. Utility owners may require locating, protection or consent before excavation. A transit agency, railroad, drainage district, toll-road operator or private access-road owner may control adjacent facilities. Toronto specifically directs applicants to check mapped Metrolinx coordination zones, where Metrolinx approval may be needed. Ask whether the site overlaps another agency’s corridor, easement or protection zone, and obtain written coordination requirements before mobilizing.
Private property work can still need a public-ROW permit when a driveway, service connection, sidewalk, staging area or traffic-control device crosses into public land. Conversely, a road permit does not replace building, environmental, grading, utility, accessibility or property-owner approvals that apply outside the ROW.
Information to prepare for the permit office
- Project address, road name, side of road and nearest intersections.
- Road-owner or jurisdiction confirmation, if already available.
- Scaled site plan showing ROW limits, lanes, sidewalks, shoulders, drainage, utilities, trees and work boundaries.
- Method, dimensions and depth of excavation or installation; materials and restoration details.
- Start date, duration, daily hours and whether work is phased or emergency.
- Equipment, vehicles, cranes, dumpsters, fencing or materials that will occupy the ROW.
- Lane, shoulder, sidewalk, bicycle-route or transit impacts and the proposed pedestrian and traffic-control arrangement.
- Contractor and utility-owner information, insurance, bonds, licenses or other credentials requested by the authority.
- Coordination letters or approvals from utilities, transit, rail, toll-road or adjacent infrastructure owners.
Ask the authority for the current application, drawing standards, insurance or bond rules, restoration specifications, inspection process, notice requirements and fee schedule. Those details vary by jurisdiction and can change; there is no universal deadline or fee established across the examples above.

A practical application workflow
- Call or submit a jurisdiction inquiry. Provide the exact segment and ask who owns or controls the ROW.
- Obtain the permit checklist. Request every form that matches the activity, including excavation, utility, driveway, temporary occupation and traffic control where relevant.
- Coordinate utilities and adjacent owners. Complete required locates and obtain approvals before finalizing the plan.
- Prepare the plans and traffic-control proposal. Show dimensions, restoration, pedestrian access, signs, barriers, flaggers and emergency access.
- Submit through the authority’s current channel. Follow its naming, file-format, insurance and payment instructions rather than using a generic construction application.
- Resolve comments and obtain written approval. Keep the issued permit, approved plans and conditions on site; note inspection and notification steps.
- Build only within the approved limits. Request a modification before extending the work area, changing dates, adding a closure or occupying more ROW.
- Restore and close out. Meet pavement, sidewalk, marking, drainage and landscaping standards, schedule required inspections and retain close-out records.
England uses a different legal framework
In England, the Department for Transport distinguishes organizations without statutory street-work rights from statutory undertakers. An organization without those rights generally needs a section 50 licence. Statutory undertakers operate under the street-works framework and obtain a permit from the relevant highway authority. This terminology and division are specific to England; do not apply the section 50 label to a project in another country or assume that an English highway authority is equivalent to a city permit office elsewhere.
Common mistakes and how to correct them
Applying to the city because the address is in the city
Problem: The application is rejected or routed late because the route is state or county controlled.
Correction: Confirm the segment in the road owner’s map and obtain a jurisdiction determination before preparing final plans.
