Puerto Rico Building Permits: A Homeowner’s Step-by-Step Guide

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Most new construction and remodeling in Puerto Rico requires a Permiso de Construcción Consolidado (PCOC) before work starts. The Puerto Rico Office of Permits Management (OGPe) handles permits, licenses, inspections and certifications through its electronic Single Business Portal (SBP). A Puerto Rico-licensed architect or engineer generally prepares and files a PCOC for a homeowner. A separate Permiso de Uso Residencial (PUS) is used to authorize residential use. Work that may be exempt must be checked against the current Joint Regulation; an assumption that a project is “minor” is not a safe substitute for verification.

This guide explains how to identify the right authorization, prepare the property and technical information, file in SBP, pay the application-generated charges, monitor review and comply with inspections. Do not begin regulated construction while an application is pending.

Which Puerto Rico authorization does your project need?

The first decision is not which form to complete, but what legal activity you are undertaking. Construction authorization and authorization to occupy or use a residence are related but separate processes.

New construction or remodeling: the PCOC

OGPe’s homeowner guidance directs new construction and remodeling through a licensed architect or engineer using the Permiso de Construcción Consolidado (PCOC). The PCOC is written authorization for construction works or structures and consolidates applicable urbanization, construction and demolition work into one application path. A remodel can therefore require a PCOC even when no new building is being created.

The professional evaluates the scope, prepares or coordinates the plans and identifies the project contacts required by SBP. Whether an owner may personally enter information in SBP does not remove the professional requirement that applies to the project.

Residential use: the PUS

A Permiso de Uso Residencial (PUS) is a separate OGPe process for residential use. OGPe describes its sequence as reviewing the requirements, creating or accessing an SBP account, creating a project profile and filing the PUS. A PUS is not a substitute for a construction permit when physical work itself requires a PCOC.

Work that may be exempt

Some work may qualify for an exemption under Puerto Rico’s Joint Regulation. The exemption is determined by the regulation’s actual conditions, not by the owner’s description of a job as cosmetic, small or routine. Verify the current exemption rules for the municipality and exact scope before ordering materials or mobilizing a crew. If the work does not meet every applicable condition, use the required permit path.

Demolition, site and urbanization work

The consolidated PCOC application can incorporate urbanization, construction and demolition works. Depending on the project, SBP may request earthwork quantities, plot or site plans, structures, demolition information and the proposed use. A project that combines a remodel with site work should be described as a complete project rather than filed as an incomplete “interior” job.

Situation Likely OGPe path Important qualification
New home or addition PCOC Usually prepared and handled through a Puerto Rico-licensed architect or engineer.
Structural or substantial remodel PCOC Confirm the exact scope and technical attachments with the licensed professional.
Work meeting every Joint Regulation exemption condition Possible exemption Verify eligibility before work; “minor” is not itself an exemption.
Authorization to use a residence PUS Separate SBP application; it does not replace a construction authorization.
Project including demolition, urbanization or earthwork PCOC with applicable components SBP requirements depend on the project’s actual elements.

What to gather before filing

Prepare the information that SBP and your architect or engineer will use to define the project. Missing or inconsistent data can prevent submission or create review requests.

  • Lot-owner information and tenant information when the application asks for it.

Environmental and technical material

The PCOC requirements include the applicable environmental document or a categorical-exclusion certification. Other attachments depend on the project and can include plans, structural information, site or plot plans, demolition details, earthwork quantities and information about the proposed use. Your professional should establish the project-specific list; do not upload a generic set of drawings and assume it is complete.

How to file a PCOC in the Single Business Portal

OGPe’s applicant manual describes the filing process as 100% electronic. The following sequence follows the manual’s workflow, while recognizing that labels and screens can change.

  1. Create or access your SBP account. Register with a working email address, confirm the email and create a profile. The profile can be used by an individual or a company. Keep the login available to the owner and the authorized professionals who need to work on the case.
  2. Create the project before associating the permit. SBP uses a project profile as the container for the permit application. Choose a name that distinguishes the property and scope from other projects in the account.
  3. Enter project classification and location. Provide the rural or urban classification, project type, description, owner, address and location. Add the lot owner, tenant and associated or adjoining cadastral information when applicable. Check that cadastral and street information agree with the ownership evidence.
  4. Upload evidence of ownership. Add the ownership document required for the property. Make sure the owner named in the document corresponds to the owner entered in SBP, or explain the authorized relationship through the professional handling the case.
  5. Select the permit application. For new construction or remodeling, choose the Permiso de Construcción Consolidado (PCOC). The consolidated option is intended to bring applicable urbanization, construction and demolition works into the authorization.
  6. Complete the project-specific technical sections. Answer the questions that apply to the scope, including proposed use, structures, plot plans, demolition and earthwork quantities. Do not mark a section “not applicable” without confirming that conclusion with the responsible professional.
  7. Enter the professional and project contacts. Identify the architect or engineer and, as applicable, inspector, contractor and specialists. Use the exact names and information that will appear on plans, certifications and seals.
  8. Attach environmental and other required documents. Upload the applicable environmental document or categorical-exclusion certification and all required plans, certifications and supporting material. SBP will not allow the applicant to proceed to payment until required attachments have been uploaded.
  9. Run a completeness review. Compare the owner, cadastral data, project description, drawings, environmental material and professional contacts. Correct inconsistent addresses, names, lot numbers or project scopes before submission; an inconsistency can cause a clarification request or delay.
  10. Submit and pay the generated charges. SBP calculates the charges for the application. The first payment can cover filing, while later stages may include CIAPR and CAAPPR seals and other tariffs. Pay by credit card in SBP and save the receipt and case number.

Filing a residential-use authorization

If the question is whether a home may be used as a residence, follow the PUS path rather than adding a use request informally to a construction application. Review OGPe’s current PUS requirements, create or access the SBP account, create the project profile and file the PUS. Keep the PUS case distinct from a PCOC case so that construction authorization and use authorization are not confused.

A completed remodel may still need a PUS even after construction authorization, depending on the property’s status and the use being requested. Confirm the relationship between the two applications with OGPe or the licensed professional handling the project.

What happens after submission?

Electronic review and requests

SBP records the submission and routes it through the applicable review. The type of review depends on the application and project. A validation or ministerial step may be available for some filings, while projects requiring fuller technical or agency review can involve additional examination. If OGPe or a reviewing agency requests clarification, respond through the case using the requested format and keep the project description, drawings and attachments synchronized.

Case tracking

OGPe provides a case-status service that can be checked with the case number without logging into SBP. Record the number immediately after filing and use it when communicating with OGPe, your architect or engineer, contractors and inspectors. A status check is not an approval; work remains prohibited until the required permit has been issued.

Inspections and access

The Puerto Rico Building Code 2016 states that construction or work for which a permit was granted may be inspected by the Building Official or government agencies with jurisdiction. The applicant must keep permitted work accessible for inspection. Coordinate access, preserve the approved plans and permit records at the site when required, and do not cover work that an inspection must verify.

Can you start construction while the permit is pending?

No—not for regulated work. Section 109.4 of the Puerto Rico Building Code 2016 states: “Any person who commences any work on a building, structure, electrical, gas, mechanical or plumbing system before obtaining the necessary permits shall be in violation subject to penalties and a fee established by the Building Official that shall be in addition to the required permit fees.”

This rule reaches more than the visible building shell. It expressly includes building, structural, electrical, gas, mechanical and plumbing systems. A pending application, payment receipt, professional’s assurance or scheduled inspection is not the same as an issued permit. If an exemption is being evaluated, pause the regulated portion until the exemption is confirmed under the applicable Joint Regulation provisions.

Fees and processing time

There is no single reliable Puerto Rico-wide fee or guaranteed turnaround that applies to every homeowner project. The official material used for this guide does not state a universal amount or processing-time promise. Charges depend on the application and project information entered in SBP.

Cost or timing question What can be stated safely
Permit fee SBP generates the amount for the specific application; do not rely on a fixed online figure.
First payment May cover filing according to the PCOC manual.
Later charges Can include CIAPR and CAAPPR seals and other tariffs, depending on the case.
Payment method Credit-card payment is made in SBP.
Processing time No universal guaranteed turnaround is established; completeness, project type and review requirements affect the case.

Budget for professional design and coordination separately from OGPe charges. Ask the architect or engineer for a written scope that distinguishes design, filing, responses to review comments, inspections and any agency or professional seals.

Common homeowner mistakes and how to avoid them

Calling a remodel cosmetic without checking the regulation

Paint and finish work may be treated differently from work affecting structure or regulated systems, but the label “cosmetic” is not a legal determination. Compare the actual work with the Joint Regulation and obtain confirmation before proceeding.

Opening a PUS when construction authorization is required

A PUS addresses residential use. It does not authorize physical construction that requires a PCOC. Define both the work and the intended use before selecting the SBP application.

Using the wrong cadastral or owner information

Check the cadastral number, address, owner name and any adjoining lots against the ownership evidence. Correct errors before payment, and disclose associated cadasters when the project uses them.

Uploading only drawings

The PCOC may require environmental documentation or a categorical-exclusion certification, ownership evidence, professional information and project-specific technical material. SBP can block payment until required attachments are present, and a later reviewer can request more.

Starting site work while waiting

Mobilizing equipment, beginning excavation or installing regulated systems can be treated as commencement of work. Wait for issuance and follow the approved scope.

Letting the application and field work diverge

If the owner changes the layout, use, lot limits, structural approach or systems after filing, ask the responsible professional whether the application must be amended. Building something different from the authorized scope creates a separate compliance problem even if a permit number exists.

A practical homeowner checklist

  • Define whether the project is new construction, remodeling, demolition, urbanization, site work, residential use or a combination.
  • Ask a Puerto Rico-licensed architect or engineer to confirm the PCOC path and any possible Joint Regulation exemption.
  • Collect owner identity, address, cadastral data, associated cadasters and ownership evidence.
  • Write a complete project description and identify the proposed use.
  • Confirm rural or urban classification and the project type in SBP.
  • Prepare plans, environmental material or categorical-exclusion certification, earthwork and demolition information as applicable.
  • Identify the architect or engineer, inspector, contractor and specialists required for the scope.
  • Create and verify the SBP account, confirm the email and create the project profile.
  • Upload every required attachment before attempting payment.
  • Review names, lot numbers, addresses, scope and drawings for consistency.
  • Pay the amount generated in SBP by credit card and save the receipt and case number.
  • File a separate PUS when residential-use authorization is required.
  • Check case status with the case number and answer review requests promptly.
  • Do not start regulated work until the permit is issued; keep permitted work accessible for inspection.

When professional help is especially important

Owner involvement is useful for confirming property facts, intended use, budget and design decisions. A licensed architect or engineer is especially important when the project changes structure, adds area, affects electrical, plumbing, gas or mechanical systems, includes demolition or earthwork, involves several lots, or requires environmental documentation. The professional can also determine whether a purported exemption actually fits the Joint Regulation and can coordinate responses when OGPe requests corrections.

Before filing, verify the current OGPe requirements, SBP labels and municipality-specific conditions. Rules, forms, fees and screens can change. The safest sequence is to define the scope, confirm the authorization, file a complete electronic application, wait for issuance and then build exactly what was approved.
