Start by identifying the project. New York construction pay rules differ for public work, privately held projects receiving qualifying public subsidies, and ordinary private construction. That classification determines whether a prevailing-wage schedule applies, which overtime rules control, where to file, and whether a general contractor can be pursued for a subcontractor’s unpaid wages.
Construction wage theft can include unpaid hours, unpaid prevailing-wage supplements, a wrong trade classification, a sham apprentice designation, unlawful deductions, off-the-books work, misclassification as an independent contractor, or a kickback demanded after payment. The steps below show how to check your rate, preserve proof, file a claim and respond to retaliation.

1. Determine which New York construction rule covers your job
Ask who owns or funds the project, the total construction cost, and whether a public entity is the contracting party. Do not assume that a project is private merely because your direct employer is a private subcontractor.

Public work under Labor Law §220
Labor Law §220 applies when a public entity contract involves construction-like labor paid with public funds and the primary objective benefits the public. New York’s Department of Labor (NYSDOL) publishes a prevailing-wage schedule for each locality, project type and trade. Schedules change on July 1, so use the schedule covering the dates you actually worked rather than an older rate kept in a job trailer.

Your total required pay may include a cash wage plus fringe or other supplements. The schedule’s occupation must match the work you performed, not simply the title printed on a paycheck. Public-work overtime is commonly due after eight hours in a day and on weekends under prevailing-wage rules, although statutory exceptions can apply.
Privately held projects with public funding under Labor Law §224-a
A private contract can still carry prevailing-wage duties when it is a “covered project” under Labor Law §224-a: public funds are at least 30 percent of total construction cost and total project costs exceed $5 million, subject to statutory exceptions. Check the project’s funding documents and any posted prevailing-wage notice before treating it as ordinary private work.
Ordinary private construction
If neither a public-work rule nor a covered-project subsidy rule applies, New York wage, overtime, pay-frequency, recordkeeping and anti-retaliation requirements still govern. A collective-bargaining agreement or individual employment contract may promise more than the statutory minimum. Your contract, pay stubs and time records should be checked together.

| Project category | What triggers it | Pay rule to check | Likely first enforcement channel |

2. Compare your actual work and pay with the correct schedule
Use duties, not a label, to identify your trade
Write down the tasks you performed each day: demolition, concrete, carpentry, electrical work, equipment operation, laboring or another listed occupation. Compare those duties with the schedule’s classification. A worker paid under a lower classification can lose both the cash rate and the related supplements.
Check the complete prevailing-wage package
For a covered job, compare each pay period with the schedule’s hourly wage and supplements. A check that appears to match the basic hourly rate can still be short if the required supplement was omitted. Preserve the schedule for the county, project type, trade and dates at issue; schedules are revised annually on July 1.
Check overtime by day and weekend
On public work, do not use only a 40-hour weekly calculation. Prevailing-wage rules commonly require overtime after eight hours in a day and on weekends, subject to statutory exceptions. Record the start and stop time for every shift, including split shifts, travel or preparation time that your employer treated as work.

Verify apprentice status
An apprentice must be individually registered in a qualifying program. A company cannot avoid the required rate simply by calling an otherwise unregistered worker an apprentice. Keep your registration information, program documents and any message in which a supervisor assigned you apprentice work or a lower apprentice rate.
3. Recognize the most common construction wage-theft patterns
- Hours missing from payroll: You worked before the official start time, after clock-out, during meal periods or on a second location, but the time sheet shows fewer hours.
- Wrong trade classification: Your duties fit a higher-paid schedule classification than the one on your check.
- Unpaid supplements: The cash wage is paid but required fringe or other prevailing-wage supplements are missing.
- False apprentice status: You are labeled an apprentice without individual registration in a qualifying program.
- Wrong overtime method: The employer pays overtime only after 40 weekly hours even though the applicable prevailing-wage rule requires daily or weekend overtime.
- Illegal deductions: The employer subtracts costs from wages in a way not allowed by New York law or the governing agreement.
- Off-the-books work: A supervisor tells you to work in cash, outside the time system or without a pay stub.
- Independent-contractor misclassification: You are treated as a contractor even though the company controls your work as an employee.
- Kickbacks: You receive a proper check but are required to return part of it in cash or through another payment.
A single discrepancy may be an error; a repeated pattern, instructions to alter time records, or demands to return money warrants prompt documentation and advice.
4. A general contractor can be liable for a subcontractor’s wage debt
Labor Law §198-e addresses construction contracts at every tier. It states: “A contractor making or taking a construction contract shall be liable for any debt resulting from an action under section one hundred ninety-eight of this article, owed to an employee or third party on the employee’s behalf, incurred by a subcontractor at any tier acting under, by, or for the contractor or its subcontractors for the employee’s performance of labor.”

That language can reach a general contractor even when your paycheck came from a lower-tier subcontractor. Keep the names of the general contractor, construction manager, subcontractor and every company that directed your work. An employee waiver of this statutory liability is generally invalid, so signing a form that purports to release the contractor does not automatically erase the protection.
5. Build an evidence file before a dispute destroys records
Make copies in a personal, lawful location. Do not remove confidential materials unrelated to your wages, alter a time sheet, or create a record that falsely changes what happened.
- Collect pay records. Save every pay stub, check image, direct-deposit record, cash receipt, deduction notice and year-end wage statement.
- Reconstruct every shift. Keep a daily log of arrival, departure, meal breaks, travel between sites, weather delays and work performed before or after the recorded shift.
- Preserve scheduling evidence. Export texts, emails, call logs, schedule applications, time-clock screenshots and instructions about where and when to report.
- Document classification. List your actual tasks, tools, crew and supervisor for each project. Record whether anyone called you an apprentice and whether you were individually registered.
- Identify the project chain. Note the site address, owner or public entity, general contractor, every subcontractor, project number, union or collective-bargaining agreement, and dates worked.
- Keep witness information. Write down co-workers’ names and contact details while you still have them, and identify supervisors who approved hours or directed off-the-clock work.
- Preserve public-work payroll information. Request or retain the prevailing-wage schedule and any certified-payroll material you can lawfully obtain. NYSDOL says certified payroll must show hours, days, occupation, hourly wage and supplements and must be kept for at least six years.
- Record threats or pressure. Save messages demanding a kickback, telling you to change hours, threatening immigration consequences, or warning you not to complain.
6. File with the channel that matches the violation
For ordinary unpaid wages, deductions, supplements, minimum-wage or overtime claims, the standard NYSDOL Labor Standards complaint is Form LS223. Claims generally must be filed within three years after the wages became due. Public-work matters may be referred to the Bureau of Public Work and Prevailing Wage Enforcement, particularly when the dispute concerns a prevailing-wage schedule, classification or certified payroll.

| Situation | Where to start | Timing and records | What the agency may examine |
|---|---|---|---|
| Unpaid private-project wages, overtime, deductions or supplements | NYSDOL Labor Standards Complaint Form LS223 | Generally within three years of the due date; submit pay and time records | Your employer’s payroll, timekeeping, deductions and payments |
| Public-work or covered-project prevailing-wage shortage | NYSDOL Bureau of Public Work and Prevailing Wage Enforcement, or the Labor Standards route directed by NYSDOL | Preserve the applicable schedule, project identifiers and certified-payroll evidence | Classification, hourly wage, supplements, daily or weekend overtime and certified payroll |
| Retaliation after a wage complaint | Report promptly to NYSDOL and consider legal advice | Keep the complaint, dates and every adverse action | Whether the protected complaint was followed by firing, reduced hours, threats, transfer or another penalty |
NYSDOL investigations can reach three or more years and, in some matters, examine all affected workers over a three-to-six-year period. Those investigation periods do not change the ordinary filing deadline for an individual claim, so do not delay. You may also consult a private attorney or bring a court action. Avoid filing overlapping proceedings about the same wages without advice, because parallel cases can affect strategy and available remedies.
7. Respond to retaliation immediately
New York’s retaliation protection covers a good-faith wage complaint even if you are mistaken about the exact statute or calculation. A complaint can be verbal or written, but a short factual written notice creates a clearer record.
- State the dates, hours, rate, classification or deduction you believe is unpaid.
- Ask the employer to correct the records and pay the amount due.
- Send the message through a channel you can preserve and keep a copy outside the workplace.
- Log any schedule cut, firing, demotion, transfer, threat, immigration threat or other adverse action, with the date and witnesses.
- Report retaliation promptly to NYSDOL. Remedies can include reinstatement, lost pay, damages and penalties.
Do not exaggerate, threaten co-workers or destroy company records. A factual timeline and preserved documents are more useful than a confrontational exchange.

NYSDOL states that contractors and subcontractors bidding or working on covered Article 8 projects must register. Electronic certified-payroll filing began December 31, 2025. Ask whether the project is registered and how certified payroll is being filed; a missing or inconsistent filing can help identify a records problem but does not by itself prove the amount owed.
Amendments to Labor Law §220(3)(f) scheduled for June 18, 2026 are suspended by federal court order, according to NYSDOL. Because the order, registration requirements and wage schedules can change, check the current NYSDOL prevailing-wage schedule and enforcement guidance on the date you act, and note the access date in your records.
9. A worker’s action checklist
- Identify whether the project is public, a §224-a covered project or ordinary private construction.
- Obtain the current schedule for the county, project type, trade and work dates when prevailing wage may apply.
- Compare duties, classification, cash wage, supplements and overtime day by day.
- Confirm whether any apprentice designation rests on individual registration.
- List every contractor and subcontractor at the project and preserve contracts, notices and certified-payroll information.
- Keep a personal shift log and copies of all pay, schedule and message records.
- Use Form LS223 for ordinary wage claims and the public-work enforcement channel for prevailing-wage issues.
- File within the applicable period, and seek advice before pursuing overlapping agency and court cases.
- Document and report retaliation as soon as it occurs.
The decisive facts are usually simple but must be proved: what project you worked on, what you did each day, what the applicable schedule required, what you were actually paid, and who controlled the work. Building that record early protects a claim against both the subcontractor that issued the check and, where §198-e applies, the contractor above it.
