A new-build townhome normally comes with a builder warranty that covers specified defects in permanent construction for set periods. A common pattern is about one year for workmanship and materials, about two years for heating, cooling, plumbing and electrical systems, and up to ten years for qualifying major structural defects. Those periods are not universal law: the controlling terms are your warranty certificate or booklet, the administrator named in it, the closing or commencement date, and the law where the townhome is located.
To protect your rights, identify the correct warranty program, check the deadline before doing anything else, document the condition, and send a written claim exactly as the warranty requires. A builder warranty included with construction is different from a home-warranty service contract purchased separately after closing.

What a new-build townhome warranty is
A builder warranty is a promise connected to the construction and sale of a new home. The Federal Trade Commission describes it as something that comes with new home construction or a remodel. It usually covers defects in materials, workmanship, specified systems, or structural components for different periods. The builder may administer the warranty directly, or a third-party warranty provider, insurer, provincial program, or state program may handle claims.
Your warranty documents—not a general “one-two-ten” rule—define the legal promise. Before assuming that a problem is covered, find the certificate, booklet, commencement date, definitions, exclusions, notice method, repair standards, and dispute procedure. A townhome may also have a condominium, homeowners-association, or strata agreement that assigns responsibility for roofs, exterior walls, foundations, shared utilities, and other common elements. Those documents can affect who must report a defect and who may authorize access.

A separately purchased home-warranty service contract is a different product. It is generally a renewable service agreement for repairing or replacing listed appliances and systems, subject to its own service fees and limits. Do not use that contract’s claim process for a builder-warranty defect unless your documents specifically direct you to do so.
How long coverage lasts
Coverage is component-based. The same townhome can have several running deadlines, often starting at closing, possession, or another commencement date stated in the certificate. The periods below are examples from official guidance, not a universal entitlement.
| Component or defect | Common period in cited guidance | Examples | Important qualification |
|---|---|---|---|
| Workmanship and materials | About one year | Siding and stucco, doors and trim, drywall, paint, finishes and similar construction work | The exact list, tolerances and start date come from the applicable warranty. |
| Mechanical, electrical and plumbing systems | About two years | Heating, air conditioning, plumbing and electrical installation | Some programs separate system components or use different durations. |
| Major structural defects | As long as ten years in some programs | A structural condition serious enough to threaten the home’s integrity; the FTC gives a roof that could collapse as an example | “Major structural defect” is a defined term. A cosmetic crack or ordinary settlement is not automatically structural. |
| British Columbia mandatory model | 2-5-10 | Provincial home-warranty insurance for eligible homes, including strata and townhome claims | The provincial framework uses its own categories and rules rather than the New Jersey pattern. |
New Jersey’s program expressly includes townhouses and describes one year for defects in materials and workmanship, two years for defects in the design and installation of heating, air-conditioning, plumbing and electrical systems, and ten years for major structural defects. The New Jersey periods apply only within that program and its definitions. British Columbia’s mandatory 2-5-10 framework demonstrates why a townhome in another jurisdiction may have different periods, claim routes and covered components.

What is usually covered in the first year
First-year coverage commonly addresses construction workmanship and materials that fail to meet the warranty’s standard. Examples can include improperly installed siding or stucco, defective doors or trim, drywall and paint defects, flooring, cabinets, fixtures, roofing work, insulation, waterproofing, masonry, concrete, grading that prevents proper drainage, and other listed finishes. New Jersey’s consumer guidance gives a broad first-year list that includes grading for drainage, concrete, masonry, stucco, carpentry, waterproofing, insulation, siding, roofing, doors, windows, finishes, flooring, painting, cabinets, fixtures and appliances.

- One-Handed Loading - Keep one hand free with a 1/4 in. hex chuck that accepts 1 in. bit tips
Coverage does not mean every imperfection must be replaced. Many documents set tolerances for minor variations, settlement, color differences, nail pops, or seasonal movement. Read the performance standard and maintenance obligations. A defect that was visible and accepted at closing may be treated differently from a concealed failure, depending on the warranty and local law.
Systems coverage in the second year
Heating, ventilation and air-conditioning, plumbing, and electrical systems are commonly assigned a longer period—about two years in FTC examples and in New Jersey’s stated program. A claim should identify the system, the affected room or fixture, symptoms, dates, and any safety or habitability consequence. A system failure caused by an owner’s alteration, lack of required maintenance, misuse, frozen pipes, power surge, or component manufacturer’s defect may fall outside builder coverage.
Keep manufacturer warranties for furnaces, heat pumps, water heaters, panels, pumps and other equipment. The builder warranty may cover installation while the manufacturer covers the equipment itself. Your documents may require you to pursue the manufacturer first or may exclude a component that has its own manufacturer’s warranty.

What counts as a major structural defect
Structural coverage is narrower than ordinary workmanship coverage. A qualifying defect generally must be severe enough to affect the load-bearing or essential structural performance of the home, and the warranty will define the threshold. The FTC’s example is a roof that could collapse. A program may require evidence that the condition materially impairs structural integrity, stability, safety or use.

In a townhome, the analysis can involve party walls, foundations, footings, floor and roof framing, load-bearing walls, and structural connections shared with adjacent units. A leak through a shared roof may begin as a roofing or waterproofing claim rather than a structural claim; repeated moisture that damages framing could raise additional issues. Do not label a problem “structural” merely to obtain a longer deadline. Describe the observable condition and obtain a qualified inspection when the cause is uncertain.
Common exclusions and costs you may have to pay
| Potential exclusion | How it affects a claim |
|---|---|
| Household appliances or equipment covered by a manufacturer | The builder warranty may exclude the appliance itself or limit coverage to installation. Use the manufacturer’s warranty when the documents direct you there. |
| Small or ordinary cracks | Minor cracks in brick, tile, cement or drywall are specifically identified by the FTC as commonly excluded or subject to tolerances. |
| Owner-caused damage or poor maintenance | Alterations, misuse, neglect, failure to maintain drainage or mechanical equipment, and damage after closing can defeat coverage. |
| Detached or site features | New Jersey guidance lists outbuildings, swimming pools, driveways, walkways, unattached patios, fences and landscaping among exclusions. |
| Consequential expenses | Temporary housing, moving costs, storage, meals, lost rent and other indirect expenses are often excluded. The FTC specifically warns that moving out and alternative-accommodation costs may not be covered. |
| Expired or late claims | Notice after the applicable period, or failure to meet a special filing deadline, can result in denial even when the condition began earlier. |
Mitigate damage without destroying evidence. For example, shut off water, place a temporary covering over an active leak, or obtain emergency electrical service when safety requires it. Keep receipts and photographs, and tell the warranty provider what emergency work was done. Do not authorize permanent reconstruction or demolition before the required inspection unless delay would cause greater damage.
Documents to gather before filing
- Warranty certificate, booklet, registration confirmation and all amendments.
- Closing or possession statement showing the commencement date.
- Builder, developer, warranty administrator and insurer contact details.
- Homeowners-association, condominium or strata rules assigning responsibility for common elements.
- Manufacturer warranties and model or serial numbers for affected equipment.
- Inspection reports, photos, videos, repair invoices, maintenance records and contractor opinions.
- Every email, letter, portal submission, phone note and text message about the defect.
Miami-Dade consumer guidance advises buyers to obtain warranties from the developer, contractors, subcontractors and appliance manufacturers and to return certificates within the required time. If you never received the booklet, request it in writing from the seller, builder, closing agent and the named administrator. Record when and how each request was made.

- Confirm the responsible program. Read the certificate to determine whether the builder, an insurer, a provincial or state program, or a third-party administrator receives the first notice. For a shared roof, wall or utility, ask the association or strata manager whether it must submit the claim or coordinate access.
- Calculate every deadline. Start with the commencement date and classify the condition as workmanship, a system, or a possible structural defect. Alberta’s guidance tells homeowners to check coverage dates before filing. Note any separate deadline for submitting a formal demand, requesting dispute resolution, or challenging a denial.
- Document the condition. Take dated, wide and close photographs; record videos of intermittent sounds, leaks or equipment displays; and write when the symptom began, whether it is worsening, and how it affects use or safety. Preserve damaged parts when practical.
- Send written notice through the required channel. Use the portal, form, email address or mailing address in the warranty. Even if a hotline exists, the FTC recommends putting the repair request in writing. State the unit address, room or exterior location, dates, symptoms, suspected component, emergency measures and requested remedy. Keep a copy and proof of delivery.
- Cooperate with inspection. The provider may inspect, request records, and coordinate with the builder. Alberta states that the warranty provider assesses claims and works with the builder to resolve warrantable defects. Offer reasonable access, secure pets, and keep the area available until the inspection is complete.
- Review the proposed repair. Ask which warranty provision applies, what work will be performed, who will perform it, when it will start, and whether the repair carries a completion or workmanship warranty. Confirm in writing whether accepting the work releases any other part of the claim.
- Escalate before the clock runs out. If the claim is denied, ignored or only partly repaired, follow the administrator’s reconsideration, mediation, arbitration, government-program or court procedure. Do not wait for an informal promise if a formal notice deadline is approaching.

Send one notice for multiple defects only if the warranty permits it; otherwise use the required form for each category. Avoid guessing at the cause. “Water appears at the ceiling below the roof valley after rain” is more useful than an unsupported conclusion that the foundation failed.
Independent reader supportYour contribution helps us test, update, and keep practical guides available for everyone.Inspection, repairs and access in a shared townhome
Townhomes often combine individually owned interiors with common or limited common elements. A roof membrane, exterior cladding, party wall, foundation, drainage system or shared mechanical line may require association authorization and access to neighboring units. Notify the association promptly, but do not assume that its involvement replaces your individual written notice. Send the claim to every party the documents identify and ask who is responsible for the common element.
Keep the home reasonably accessible during the inspection window. If a contractor misses an appointment, record the date, time and result and request a new appointment in writing. If an inspection finds no covered defect, ask for the written findings, photographs and the warranty provision relied upon. You may obtain an independent inspection, but check whether the warranty requires preapproval for reimbursable testing and whether invasive testing could affect coverage.

Use the administrator’s dispute procedure
Many builder warranties provide internal review, mediation or arbitration. The FTC notes that mediation or arbitration may apply. Follow the specified form, fee rule, waiting period and evidence requirements. A missed precondition can bar later relief.
New Jersey
New Jersey’s program has formal state or private-plan procedures. Its process uses written notice and, after applicable prerequisites, formal Notice of Claim and Demand steps. The consumer guidance warns that late filing can result in denial. Confirm the exact deadline and forum in your certificate before choosing mediation, arbitration or another remedy.
Alberta
In Alberta, the homeowner contacts the warranty provider, which assesses the claim and works with the builder. Check the coverage dates first, submit the provider’s required information, and use its review or dispute route if the builder does not correct a warrantable defect.
British Columbia
British Columbia uses a mandatory 2-5-10 home-warranty insurance framework for eligible homes, including strata and townhome claims. The policy’s category definitions, insurer notice rules and dispute process control. Coordinate with the strata corporation when the defect concerns a common property element, while preserving your own notice and records.
Other U.S. locations
There is no single nationwide builder-warranty schedule. Review state law, the contract of sale, the warranty certificate and any association documents. A written demand, mediation, arbitration or a government construction-defect program may be required before litigation. A local construction attorney or consumer agency can explain deadlines when a substantial structural, safety or habitability issue is disputed.
How to avoid losing a valid claim
- Do not rely on a verbal promise that “someone will come out.” Submit the formal written notice.
- Do not wait for a convenient repair date if the workmanship or system period is close to expiring.
- Do not discard damaged materials, conceal the area, or perform a permanent repair before inspection unless necessary to prevent harm.
- Do not describe several unrelated symptoms as one defect; separate them so each can be matched to the correct coverage period.
- Do not assume the builder, association and manufacturer will forward notice to one another.
- Do not sign a broad release or completion acknowledgment until you understand which defects and future rights it covers.
- Do not stop paying for required maintenance or ignore emergency mitigation because a claim is pending.
Quick claim checklist
- Find the certificate, booklet, commencement date and administrator.
- Map each symptom to its workmanship, systems or structural period.
- Read exclusions, tolerances, maintenance duties and consequential-cost provisions.
- Photograph, film and log the condition before altering it.
- Notify the builder, administrator, association or strata as the documents require.
- Keep delivery receipts, claim numbers, inspection reports and every conversation note.
- Meet all reconsideration, mediation, arbitration or government-program deadlines.
The practical verdict is straightforward: a new-build townhome warranty can pay for qualifying construction defects, but only within the categories, periods and procedures written into the applicable program. Early written notice, precise evidence and deadline control give you the best chance of obtaining a repair or other remedy.
