The advertised rent is only one part of an apartment’s cost and obligations. Before signing, identify every mandatory and optional charge, determine who pays each utility, and get parking and amenity promises in writing. Deposit limits, deduction rules and return deadlines depend on your state, city and whether the property is public housing or a private rental.
Use the lease, every addendum and a written cost schedule to verify the deal. Keep the signed documents, receipts, inspection photos and repair requests so you can prove what was agreed and what condition the apartment was in.

Start with a complete cost and obligation sheet
Ask the landlord or agent for a written schedule before paying an application fee or signing. Compare the schedule with the lease and addenda; a marketing page is not a substitute for a contract. Maine tenant guidance expressly calls for disclosure of total rent, recurring fees, utility service costs and other tenant charges.
Record every amount due before and after move-in
| Cost or obligation | What to verify in writing |
|---|---|
| Base rent | Monthly amount, due date, payment method, grace period and late-fee formula. |
| Mandatory recurring fees | Name, amount, frequency, what service it covers and how much notice is required for a change. |
| Optional charges | Whether you may decline the charge without losing the apartment or another essential service. |
| Utilities | Service covered, responsible payer, account-opening deadline, allocation formula or meter, billing vendor, late fees and shutoff procedure. |
| Parking | Space or permit, fee, guest rules, towing terms, maintenance duties and repricing or removal rights. |
| Pets | Pet rent, deposits, one-time fees, animal restrictions and assistance-animal process. |
| Internet and insurance | Whether either is required, approved providers, minimum coverage and proof deadlines. |
| One-time move-in costs | Application or screening fee, security deposit, administrative fees, prorated rent and key or access-device charges. |
| Potential end-of-lease costs | Cleaning standards, notice, early-termination charges, re-letting fees and move-out procedures. |
Ask which charges can change
For each variable item, ask what triggers an increase and how much advance notice you receive. A utility estimate is not a cap unless the lease says it is. Keep the answer with your lease records.

Security deposits: amount, permitted deductions and return
A security deposit generally protects the landlord against unpaid rent or damage beyond normal wear and tear. It is not a fee that can automatically be kept when you leave. Rules differ sharply by jurisdiction and property type, so never treat a figure from another state as a universal limit.
Examples of different legal rules
| Jurisdiction or property type | Rule described by the cited guidance |
|---|---|
| HUD public housing | Public-housing agency guidance from 2020 describes a ceiling of one month’s rent or a reasonable fixed amount. The guidance applies to PHAs, not every private apartment. |
| Texas | Current Texas Attorney General renter guidance describes a 30-day return example and an itemized-deduction process. Normal wear and tear cannot be charged. |
| Maine | Current Maine guidance describes a 21-day default return period, or a period stated in the lease of no more than 30 days. The landlord cannot retain the deposit for normal wear and tear. |
| California | Current California guidance describes a cap of up to one month’s rent for most residential properties. Different rules can apply to particular housing categories. |
These examples illustrate why the controlling state and local law must be checked. A city ordinance, subsidized-housing rule or property category may add requirements. Ask the relevant housing authority or a qualified local lawyer when the amount or deadline is disputed.
Document condition so deductions can be tested
- Complete a move-in checklist, including walls, flooring, appliances, fixtures, windows, doors, smoke alarms and provided furniture.
- Photograph or record video of each room and any existing damage. Keep the files with a date and location.
- Send the checklist and a short written description of defects to the landlord using the lease’s notice method.
- At move-out, clean to the written standard, photograph the same areas and retain proof of key return.
- Give the forwarding address required by the lease or local law so the landlord can send the accounting or refund.
When deductions are made, compare each line with the lease, your inspection evidence and local law. In Texas, the guidance describes itemized deductions; other jurisdictions may impose different formatting or documentation requirements.

Utilities: identify the payer, meter and billing method
The lease should name each service rather than using a blanket phrase such as “utilities included.” Check water, sewer, trash, gas, electric, heat, internet and any building-wide service.
Questions for every utility
- Does the landlord pay it, or must you open an account in your name?
- If the building is master-metered, how is your share calculated?
- Is the allocation based on a submeter, square footage, occupants, a ratio formula or another method?
- Which company sends the bill, and may it add an administrative or late fee?
- Are estimated bills reconciled to actual usage?
- Who handles outages, meter problems and billing disputes?
- Can service be shut off for nonpayment, and what notice is required?
HUD’s 2020 Public Housing Occupancy Guidebook says a public-housing lease must specify which utilities, services and equipment the PHA provides at no cost and which utilities and appliances the tenant pays for. It also explains utility allowances and reimbursements for certain income-based tenants. Those requirements concern public housing; a private lease may use a different arrangement.
Budget for usage, not just the advertised rent
Request recent bills or a realistic usage estimate when available, and ask how seasonal heating or cooling affects the total. Put any allowance, reimbursement or utility cap in an addendum. If internet is bundled, verify speed, equipment, installation and what happens if the service is unavailable.

Parking: make the space and the risk explicit
Parking rights can be lost in a vague sentence. Confirm whether parking is assigned, first-come, permit-controlled, tandem, street-based or limited to a garage. Record the space number or permit identifier and attach a map or diagram if the location matters.
Do these 3 things before closing this tab:
1Clear out junk files and repair common Windows errors2Fix the driver behind crashes, sound loss and screen glitches3Repair Windows errors before they cause bigger problemsParking terms to check
- Monthly or one-time fee and whether it is mandatory or optional.
- Guest parking hours, permits and enforcement.
- Towing authority, warning procedures and who pays removal costs.
- Snow removal, sweeping, lighting, gate, charger and surface-maintenance duties.
- Vehicle-size, storage, repair and commercial-use restrictions.
- Whether the landlord may relocate, remove or reprice the space during the lease term.
- What happens to parking when the lease renews or ends.
HUD counselor training materials state that parking location restrictions and parking fees are typically lease terms. If an agent promises a particular space, obtain that promise in the lease or a signed parking addendum rather than relying on a conversation.
California guidance also treats removal of previously enjoyed parking as a potential retaliatory service change after a good-faith complaint. Whether that protection applies depends on the facts and the governing law.

Amenities: included service, optional fee or revocable convenience?
Ask about pools, gyms, package rooms, storage, laundry, lounges, coworking areas and internet separately. For each, determine whether access is included in base rent, optional for an added fee, governed by a separate membership, or merely offered as a convenience that can close.
Get the rules and fee schedule
- Request amenity rules, hours, reservation limits and guest policies.
- Ask whether access is guaranteed throughout the lease or can be suspended for repairs, weather, staffing or rule violations.
- Confirm whether a closure creates a credit, refund or no remedy.
- Check equipment, liability, age and supervision rules.
- Verify storage dimensions, laundry pricing and package-delivery responsibility.
Massachusetts Attorney General guidance says optional parking, pool and fitness-center fees do not have to appear in the advertised price when the tenant may decline them. The practical test is whether the charge is genuinely optional and clearly disclosed; read the local rule and the lease before assuming an amenity fee can be refused.

Screening reports and adverse-action notices
The Federal Trade Commission says a landlord may use a screening report to reject an application, charge higher rent, require a cosigner or demand a larger deposit. If a report leads to a negative decision, the applicant should receive an adverse-action notice identifying the screening company and explaining the right to dispute inaccurate information and obtain a free copy of the report within 60 days.
If the report is wrong
- Keep the denial, conditional-approval or pricing notice.
- Request the screening company’s name and contact information from the adverse-action notice.
- Obtain the report within the stated 60-day period.
- Dispute inaccurate, incomplete or outdated information with the screening company and provide supporting records.
- Send the landlord a concise explanation and ask whether the decision can be reconsidered.
Keep copies and dates for every dispute. A screening error can affect both approval and the amount of the deposit or rent.
Compare apartments by total risk, not headline rent
When two apartments appear similar, score them using the same assumptions. A lower base rent can be offset by mandatory fees, volatile utilities or uncertain parking.
| Comparison factor | Evidence to collect |
|---|---|
| True monthly cost | Rent plus mandatory fees, expected utilities, parking, internet, insurance and recurring pet charges. |
| Deposit exposure | Amount, permitted deductions, inspection process, forwarding-address rule and return deadline under local law. |
| Utility predictability | Individual meters or allocation formula, recent bills, caps, allowances and billing fees. |
| Parking certainty | Assigned location, availability, fee, towing terms and change rights. |
| Amenity value | Optionality, fee, operating rules, closure rights and any credit for lost access. |
| Lease flexibility | Renewal, notice, subletting, assignment and early-termination provisions. |
| Maintenance process | Emergency number, written-request method, entry notice and escalation path. |
| Privacy and entry | Notice period, permitted reasons and contractor access. |
| Renewal and termination risk | Rent-change notice, automatic renewal language and move-out deadlines. |
What to do when the landlord or tenant does not follow the lease
Start with the contract. USAGov advises reading the lease carefully before seeking outside help. Send a written notice that identifies the clause, describes the problem, requests a specific remedy and gives the deadline required by the lease or applicable law. Keep proof of delivery.
Escalation options
- Report the issue through the landlord’s stated maintenance or management channel.
- Send a formal written notice with dates, photographs, invoices or other evidence.
- For a HUD-covered property, use HUD’s complaint line when the matter falls within its jurisdiction.
- Contact the relevant state or local housing agency or a legal-aid organization.
- Ask a local lawyer before withholding rent, paying for repairs and deducting the cost, or terminating the lease; those remedies are jurisdiction-specific and can create liability if used incorrectly.
Continue meeting undisputed obligations while the dispute is reviewed unless qualified local advice says otherwise. A clear paper trail is usually more useful than an informal argument.
