Massachusetts has a statewide prohibition on unnecessary noise, but it does not set one construction start time for every town. Regulation 310 CMR 7.10 covers construction and demolition equipment; local bylaws, permits, and enforcement procedures determine when work may occur and what remedy is available. In most communities, the local Board of Health is the first agency for construction-noise complaints. A useful complaint identifies the exact site and equipment, records a reliable chronology, checks permits, preserves recordings and witness information, and follows up in writing.

Boston illustrates why location matters: the city lists regular building-construction hours of 7 a.m. to 6 p.m. on weekdays, publishes separate decibel limits, and uses different reporting routes during and after those hours. Those figures are Boston rules, not statewide defaults.

What Massachusetts law says about construction noise

The statewide rule is Massachusetts Department of Environmental Protection (MassDEP) regulation 310 CMR 7.10, titled “Noise.” Its general prohibition states:

“No person owning, leasing, or controlling a source of sound shall willfully, negligently, or through failure to provide necessary equipment, service, or maintenance or to take necessary precautions cause, suffer, allow, or permit unnecessary emissions from said source of sound that may cause noise.”

The regulation expressly says that 310 CMR 7.10(1) applies to, but is not limited to, “construction and demolition equipment.” That makes the rule relevant to equipment such as compressors, generators, saws, demolition tools, trucks, and other machinery when their emissions are unnecessary under the regulation. Enforcement is tied to 310 CMR 7.52.

The wording is not a simple statewide curfew. It focuses on unnecessary emissions and on whether the person controlling the sound failed to take necessary precautions or maintain equipment. A town can also regulate construction through its own noise bylaw, permit conditions, zoning rules, or special restrictions. Those local requirements may be stricter or may use different hours, measurement points, exemptions, and forms.

What the statewide rule does not provide

  • It does not establish one Massachusetts-wide construction start time that applies in every municipality.
  • It does not make every sound during daytime hours automatically lawful.
  • It does not replace local permits, bylaws, or emergency-work provisions.
  • It does not require a resident to own a sound-level meter before making a complaint.

MassDEP identifies the local Board of Health as the primary responder for most community noise disturbances, including construction and heavy-equipment noise. Police are the route for disturbing-the-peace complaints, while MassDEP handles specified regulated facilities and sources. Choosing the right agency at the outset prevents a complaint from being sent to an office that cannot investigate it.

Are there statewide construction hours?

Not in the material governing this guide. Massachusetts relies heavily on municipal rules and permits for operating hours. Two neighboring towns can therefore have different weekday, weekend, holiday, or emergency provisions. A project that is allowed during ordinary hours in one town may need a variance, after-hours permit, or special authorization in another.

Before treating a start time as illegal, identify:

  • the municipality where the work is occurring;
  • the type of work (building construction, demolition, roadwork, utility work, or another source);
  • the ordinary hours in the local bylaw or permit;
  • whether the contractor has an after-hours, emergency, or public-utility authorization; and
  • which office receives complaints for that time and source.

Do not assume that “construction noise” means the same legal category as a business, party, vehicle, or public-works disturbance. The source and the time can change both the standard and the agency.

Who to contact: a decision guide

Situation First route What to provide or ask
Building construction or demolition, routine nuisance Local Board of Health Address, equipment, dates and times, recordings, witnesses, permit information, and the local bylaw or permit condition you believe applies.
Roadwork or utility work Municipal department or Board of Health; check for emergency authorization Project name, agency or contractor if known, location, lane or utility work details, and whether work is claimed to be emergency-related.
Disturbing-the-peace situation Police non-emergency line Describe the active disturbance and its location. Ask for the incident or call number.
Immediate danger, threats, or an active safety emergency 911 State the hazard first. Noise documentation can wait until people are safe.
Specified regulated facility or source within MassDEP jurisdiction MassDEP or the agency identified by the applicable permit Give the facility identity, permit information, dates, and the nature of the regulated emission.
Boston building construction during regular hours Inspectional Services Email [email protected] and search the approved-permit information for the site.
Boston work outside regular hours Boston after-hours permit database, then 311 or Inspectional Services if no permit appears Check the database first, save the result, and report apparent unpermitted work.

These routes are starting points, not a promise that every office will make a final legal determination. Ask the receiving agency which local rule, permit condition, or measurement procedure it is applying.

  • 【Digital LCD Display 】 The digital display is a 4-digit LCD display with a resolution of 0.1 dB. Backlit LCD digital display, the reading effect is clearer in dark places. When the battery is low, the LCD display will display a low voltage icon, indicating that the power is low at this point and the battery needs to be replaced.
  • 【Convenient and Lightweight 】Tadeto sound level meter is lightweight and easy to carry. It's widely used in factories, transportation, car, baby room and audio system offices, sound quality control in homes, schools, and construction sites.

How to document a possible violation

A complaint is strongest when an investigator can reconstruct one event without guessing. Start documenting as soon as the noise begins, but do not enter a site, confront workers, or put yourself in danger to collect evidence.

1. Identify the source precisely

Write the complete street address, unit or lot if relevant, project name or contractor name shown on signs, and the equipment making the sound. “Loud construction nearby” is less useful than “tracked excavator idling and reversing at the east side of 18 Oak Street.” Note whether the sound is continuous, intermittent, tonal, impulsive, or associated with backup alarms, impact tools, engines, or deliveries.

2. Keep a contemporaneous noise log

Use one line for each episode. Record the calendar date, start and stop times, duration, where you were located, what you heard, and how it affected you. Include sleep interruption, inability to work, interrupted calls, vibration, or repeated episodes. A neutral description is more useful than labels such as “illegal” or “intentional.”

For recurring work, continue the log across days. Mark quiet intervals and days with no activity; a complete record is more credible than a list containing only the worst moments. Have each witness keep an independent log rather than copying yours.

3. Capture short recordings and photographs

Short video clips can show the site, equipment, time context, and surrounding conditions. Photograph posted permits, project signs, equipment, and the position from which you recorded. Preserve the original files, including their metadata when available, and make a backup in a second location. Do not edit the originals; if you make a shorter clip for emailing, keep the unaltered file as well.

Recordings rarely establish a legal decibel violation by themselves because phones compress audio and do not prove the precise level at a required measurement point. They are still valuable corroboration of timing, source, and character of the noise.

4. Check permits and local databases

Search the municipality’s building, inspectional, or after-hours permit system when one is available. Save a screenshot showing the search date and result, and write down the permit number, approved hours, conditions, expiration date, and any emergency or nighttime authorization. If no record appears, say exactly what you searched and when; absence from a database is a lead for an investigator, not proof that no authorization exists.

5. Gather witnesses safely

Ask neighbors or other affected people whether they independently observed the same episode. Record names and a reliable contact method only with their permission. A witness statement should identify where the person was, what was heard, the start and stop times as best they can recall, and the effect. Never pressure a witness to adopt your legal conclusion.

6. Track every communication

Create a contact table with the date, agency or person, phone number or email used, complaint or incident number, documents sent, promised response, and actual response. Save confirmation emails and copies of attachments. If an officer or inspector visits, note the visit time and what was explained. In a follow-up, ask which bylaw, regulation, or permit condition is being investigated and what additional information is needed.

Using a sound-level meter without overstating the result

A phone app or handheld meter can add useful context, especially when a local ordinance calls for sound-level measurements. It is not a substitute for the municipality’s official measurement or for the legal standard in your town.

For every reading, record:

  • the device make and model or app name and version, if shown;
  • whether the reading is A-weighted (dBA) or uses another weighting;
  • the exact location and approximate distance to the source;
  • the date and clock time;
  • whether the device was indoors or outdoors and whether windows were open;
  • weather or unusual conditions that could affect propagation; and
  • the displayed level, duration, and any calibration or verification performed.

Keep the raw screenshots or exported data. Avoid placing the microphone where it could be damaged or trespassing to reach a preferred measurement point. In your complaint, describe the reading as “a supporting observation,” not as a certified compliance result. Ask the enforcing agency where and how it measures under the applicable bylaw.

Boston: a local example, not a statewide schedule

Boston’s official noise guidance says regular building-construction hours are 7 a.m. to 6 p.m. on weekdays. During those hours, the city directs residents to Inspectional Services at [email protected] and advises searching approved permits. For work outside those hours, Boston provides an after-hours permit database. If no permit appears, the city directs residents to report unpermitted work through 311 or Inspectional Services.

Boston’s published numeric standards

Boston provision Published value and period Qualification
City guidance 50 dB from 11 p.m. to 7 a.m. City of Boston 2026 guidance; applies within Boston’s framework.
City guidance 70 dB at other times, except permitted construction City of Boston 2026 guidance; permitted construction is treated as an exception in the guidance.
Municipal Code §16-26.5 50 dBa at a residential lot line from 6 p.m. to 7 a.m. for construction devices Current 2026 S-2 code page. Construction-device noise above this level is unlawful during that period, except emergencies by public utility companies.

Boston’s public guidance says police verify qualifying complaints with a sound-level meter. The measurement location, timing, weighting, and local definitions therefore matter. A reading taken at your window may not match a required residential-lot-line measurement.

Do not transplant Boston’s 7 a.m.–6 p.m. schedule or its 50/70-decibel figures into another municipality. A different town may use different hours, thresholds, exemptions, permit systems, or complaint forms.

How to file with a local Board of Health

After assembling your records, submit a concise packet through the Board of Health’s stated channel. If the office accepts email, put the address and date range in the subject line; if it requires a form or portal, attach the same packet there.

  1. Write the location and source. Give the exact construction address, your observation address, project or contractor name if visible, and the equipment involved.
  2. State the pattern. List each episode in a compact chronology with dates, start and stop times, duration, and effect.
  3. Identify the rule you want checked. Cite 310 CMR 7.10 as the statewide noise rule and identify any municipal bylaw, permit condition, or posted hour you found. Ask the Board of Health to determine which provision applies.
  4. Attach evidence. Include the log, a representative set of original recordings or clearly named copies, photographs, witness contacts, permit screenshots, and meter observations with their limitations.
  5. Request a practical response. Ask for confirmation of receipt, the complaint number, the assigned investigator, whether an inspection or official measurement will occur, and the next step if the noise recurs.
  6. Keep the submission trail. Save the sent email, portal receipt, attachments, and all later communications in one folder.

Remain factual and specific. A Board of Health can act more readily on “impact hammer from 6:42 a.m. to 7:18 a.m. on three dates” than on a general allegation that a contractor is “always violating the law.”

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

What to do if the noise is happening now

For a routine disturbance, use the local Board of Health process and, when appropriate, the police non-emergency route. If the situation involves an immediate threat to life, fire, structural collapse, dangerous traffic conditions, or another urgent safety hazard, call 911. Explain the hazard and location first; evidence collection is secondary.

If police respond to a disturbing-the-peace complaint, obtain the incident or call number and add it to your chronology. A police response does not itself decide whether 310 CMR 7.10 or a municipal construction rule was violated, so send the documented construction information to the Board of Health as well when that is the proper local route.

Common mistakes that weaken a complaint

  • Assuming a statewide curfew. Verify municipal hours and permit conditions before asserting that a start time is unlawful.
  • Reporting without an address. Agencies need the exact source location, not only the neighborhood.
  • Sending only a decibel number. A number without device, distance, weighting, time, and location cannot be evaluated reliably.
  • Editing away context. Preserve original recordings and explain any copy or excerpt you send.
  • Ignoring permits. Emergency, utility, roadwork, or after-hours authorizations can change the analysis.
  • Confronting workers or entering the site. Trespass, retaliation, and safety risks can create a more serious problem than the original nuisance.
  • Using inflammatory conclusions. Describe what happened and ask the agency to determine the violation.
  • Failing to follow up. Without a complaint number and written trail, later staff may not be able to connect repeated episodes.

A ready-to-send evidence checklist

  • Exact construction address and your observation location
  • Project, contractor, permit, or sign information
  • Equipment and type of sound
  • Dated start and stop times for each episode
  • Duration, frequency, and effects on sleep, work, or daily activities
  • Original photographs and short videos with a backup copy
  • Permit or after-hours database screenshots and search dates
  • Independent witness names and contact details, with permission
  • Sound-level observations with device, dBA setting, distance, location, and time
  • Agency contacts, complaint numbers, responses, and requested follow-up

What outcome to expect

The likely outcome depends on the municipality, the source, the permit, and the quality of the evidence. An agency may verify hours, inspect equipment, take an official sound measurement, review a permit condition, contact the contractor, or determine that an exception applies. It may also refer a source to another department. Your role is to provide a verifiable record and make it easy to identify the rule and location being investigated.

The most defensible approach is therefore jurisdiction-specific: use 310 CMR 7.10 to understand the statewide prohibition, confirm the local rule and authorization, document each episode carefully, and send the packet to the local Board of Health or the appropriate emergency or police channel.

Frequently Asked Questions

What time can construction start in Massachusetts?

There is no single statewide start time established in the material for every municipality. Check the town or city bylaw and the project’s permit; Boston, for example, lists regular building-construction hours of 7 a.m. to 6 p.m. on weekdays, a local rule rather than a statewide default.

Who should I call about construction noise?

For most community construction or heavy-equipment noise, start with the local Board of Health. Use the police non-emergency route for a disturbing-the-peace situation, 911 for an immediate safety emergency, and MassDEP for specified regulated facilities or sources.

Do I need a sound meter to prove a violation?

No. A dated log, recordings, photographs, permit information, and witnesses can make a complaint usable. A phone app or handheld meter may add context, but official measurements and the applicable local standard control enforcement.

Can nighttime roadwork be legal in Boston?

Yes. Boston notes that some nighttime roadwork may be authorized for emergencies. Check the after-hours permit information and the project’s authorization rather than assuming that all nighttime work is unlawful.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

What should I do if the contractor has a permit?

Save the permit and read its approved hours and conditions. A permit may authorize work during periods that would otherwise be restricted, but it does not eliminate every requirement; ask the enforcing agency to review the permit against the observed activity.
