Compensation values the land and the assets taken. R&R addresses the affected family’s housing, subsistence and livelihood after displacement or loss of its main income source.
A family can qualify for both. The amount is not a single national tariff: the Collector’s valuation, the land and assets involved, the acquisition route, state rules or amendments, and any project-specific package determine the final awards.

What compensation pays for
Compensation is the authority’s award for the property acquired. The Collector determines the market value of the land using the Act’s valuation provisions, then accounts for attached assets and the statutory additions required by the acquisition law, including solatium and other applicable amounts.
For a construction project, attached assets can include buildings and other structures, wells, trees, standing crops and similar property identified during the valuation and survey. A title deed alone does not describe the whole claim: a house, workshop, irrigation well or productive tree may need its own assessment in the compensation award.

Land value and statutory additions
The relevant market-value evidence and statutory factors are recorded by the Collector. The final figure can therefore differ between parcels in the same project because location, land characteristics, permitted use, comparable evidence and the notified acquisition route differ. The Act’s additions, such as solatium, are applied according to the statutory rules in force for that acquisition.
Assets must be checked separately
Read the valuation schedule line by line. Confirm that every structure, tree, well, crop and other attached asset appears, that its measurement or description is correct, and that ownership or use evidence has been matched to the right claimant. If an asset is omitted, raise that omission through the objection, hearing, reference or appeal route identified in the notice and applicable state rules rather than assuming it is included in the land rate.
What R&R pays for
R&R is a family-level package for the consequences of displacement or loss of a home or livelihood. Section 31 of the RFCTLARR Act requires the Collector to set out an R&R award where applicable. It is not an invisible increase to the land price; it should appear as identified benefits or assistance in the R&R documentation.

Housing and homestead support
The award may identify a house site or a house, depending on the applicable scheme and the family’s eligibility. This addresses the loss of a residence or homestead and is distinct from payment for the market value of the acquired plot and structures.
Land allotment
Where the law, state rules or project package provides it, the R&R award can include an allotment of land. The size, location, tenure and conditions are controlled by the approved scheme; do not infer them from the compensation rate.
Subsistence and transport assistance
Section 31 lists one-time subsistence and transport allowances among the items that may be recorded. These are intended to help a family through the move and the initial period after displacement. The award should state the amount, the eligible family members and the payment or delivery condition.
Cattle-shed and petty-shop payments
A family that loses a cattle shed or petty shop may have a separately identified payment. Check whether the survey recorded the structure and whether the R&R schedule uses a different eligibility test from the land-ownership record.
Assistance for artisans and small traders
One-time assistance can be available to affected artisans and small traders. This category matters when the project removes a workshop, roadside stall or other small commercial livelihood even if the claimant is not the recorded owner of the land.

Employment or annuity
The R&R package may provide employment, an annuity or another livelihood measure specified by the statute, rules or project scheme. These are not interchangeable with a cash land award. An employment offer should be read for its conditions, eligibility, location and start date; an annuity should be read for its frequency, duration and beneficiary.
Fishing rights
Where a project affects fishing-based livelihoods, the R&R award can identify fishing rights or related assistance. The survey must connect the affected livelihood to the project area, and the project’s rules may define the water body, period and operational conditions.
Scheduled Caste and Scheduled Tribe protections
The Act contains special provisions for Scheduled Caste and Scheduled Tribe families. The award and the approved R&R scheme should show which additional safeguards apply, including any relocation or land-related conditions required by the statute and state rules.
Compensation and R&R compared
| Question | Compensation | Rehabilitation and resettlement |
|---|---|---|
| What triggers it? | Acquisition of land and attached property. | Displacement, loss of a house or property, loss of a main livelihood, or another qualifying project impact. |
| Who may qualify? | People whose land or compensable assets are acquired, subject to the title, interest and valuation findings. | A project-affected family identified through the statutory survey and verification; this can include non-title holders whose home, property, forest rights or main livelihood is affected. |
| What form can it take? | Money for market value, attached assets, solatium and other statutory additions. | Money, a house site or house, land, subsistence or transport assistance, livelihood support, employment, annuity, fishing rights and special-category benefits. |
| How often is it paid? | The award states the compensation amount and applicable payment arrangements. | Some items are expressly one-time; employment, annuity or other benefits can have continuing conditions set by the scheme. |
| Where is it recorded? | The Collector’s compensation award and its valuation statements. | The rehabilitation-and-resettlement scheme and the R&R award under Section 31. |
| What can change the baseline? | Location, land characteristics, evidence, acquisition route, state rules and amendments. | State rules or amendments, the approved project package, the survey findings and the family’s category and livelihood. |
The same household can therefore receive a compensation award for acquired land and structures and a separate R&R award for its move, subsistence or livelihood. One does not automatically cancel or replace the other.
Who can receive an R&R benefit?
The protected group is broader than the name on the land record. The Press Information Bureau describes a project-affected family as a family whose land, house, property, forest rights or main source of livelihood is affected by the project. Eligibility is established through the statutory survey and verification process and the applicable rules.
Recorded owners and co-owners
Owners and co-owners are normally central to the compensation valuation, but they should also check whether the family is listed in the R&R survey. A compensation entry does not prove that every eligible household member or livelihood loss has been captured.
Tenants, occupiers and livelihood-dependent families
A tenant, lawful occupier, share-based cultivator, worker or other livelihood-dependent person may be recognized for an R&R benefit even without title to the acquired parcel, if the survey and rules establish the qualifying connection. Keep rent records, cultivation evidence, business registrations, utility bills, wage or supplier records and statements from local authorities where available.

People holding recognized forest rights can fall within the affected-family definition. The same is true of families whose property or main livelihood is affected even when the acquired land is recorded in someone else’s name. The decisive document is the verified survey and the resulting award, not an assumption that only registered owners count.

How the Collector determines compensation
1. Identify the acquisition and the parcel
Start with the preliminary notification and the parcel details: survey or plot number, area, village, stated public purpose and the authority conducting the acquisition. Confirm that the notification covers the land and structures you occupy or own.
2. Examine the market-value evidence
Ask what market-value evidence and statutory factors the Collector used. Depending on the location and rules, the record may refer to comparable transactions, officially recorded values or other prescribed measures. Compare the description in the valuation statement with the parcel’s actual access, use, irrigation, buildings and restrictions.
3. Verify attached assets
Make a separate inventory of every structure, tree, well, crop and fixture affected. Photograph each item with a date, retain plans, tax records, electricity or water connections, cultivation records and invoices, and mark the item on a sketch or site plan. The purpose is to give the Collector evidence for the asset assessment, not to substitute a private estimate for the statutory valuation.

Read the calculation for solatium and every other statutory addition. Confirm the acquisition date, the legal route and the state provisions used, because those details determine which version of the rules applies.
5. Separate compensation from R&R
Do not treat a single quoted total as proof that all entitlements are included. Match the land and asset figures to the compensation award, then match housing, subsistence, transport and livelihood items to the R&R award. If the documents combine figures in a summary sheet, request the underlying schedules.
Why two families may receive different totals
The central Act is a baseline, not a universal price list. The final award depends on the Collector’s valuation, the location and nature of the land, the structures and other assets, the notified acquisition route, state rules or amendments and any project-specific package.
A state can prescribe a more favorable method or a project can adopt an approved package with its own housing, plot or livelihood options. Conversely, a benefit may depend on a survey category, a recognized livelihood, an urban or rural classification, or a choice made by the family. A figure quoted at a meeting is not reliable for another village, another state or another project until the notification, rules and award confirm it.

The Madhya Pradesh package reported by the Press Information Bureau in 2023 shows why national generalizations are unsafe. For that project, land compensation was paid at the statutory rate or ₹12.50 lakh per hectare, whichever was higher. Eligible families could receive one of the following plot-related options:

Documents to obtain before accepting an amount
- The preliminary acquisition notification and any later declaration or corrigendum.
- The survey and verification record identifying affected families and livelihood categories.
- The Collector’s compensation award, valuation statements and asset inventory.
- The approved R&R scheme and the individual R&R award under Section 31.
- The state rules, amendments and government orders cited in the award.
- Any project-specific package, option form or plot-allotment terms.
- The notice explaining payment, possession, objections, reference or appeal routes and the applicable deadlines.
Request certified copies or use the official inspection procedure stated by the acquiring authority. Keep the notification, award, maps, receipts and correspondence together; a later challenge is difficult if the claimant cannot show which document contained the disputed figure or omission.

- Confirm your status. Decide whether you are a recorded owner, co-owner, tenant, occupier, livelihood-dependent family, forest-rights holder or another category recognized in the survey. Note every family member and each affected source of income.
- Build an evidence file. Collect title and mutation records, leases, possession evidence, tax receipts, utility bills, building plans, business or cultivation records, photographs and identity documents. Label evidence by parcel and asset.
- Attend the survey or inspection. Walk the site with the survey team if the procedure allows. Point out buildings, wells, trees, crops, shops, cattle sheds and access routes, and ask that omissions be recorded in writing.
- Read the compensation calculation. Check the area, land category, market-value basis, asset measurements, solatium and other additions. Compare the schedule with your evidence and obtain clarification for every unexplained line.
- Read the R&R list separately. Verify the house or house-site decision, land allotment, subsistence and transport assistance, cattle-shed or petty-shop payment, artisan or small-trader assistance, employment or annuity, fishing rights and any Scheduled Caste or Scheduled Tribe safeguard that applies.
- Use the stated objection or hearing process. Submit a concise written list of errors with copies of supporting evidence. Obtain an acknowledgement and keep the receipt, diary number or online submission record.
- Check options before choosing. A plot grant, a plot allotment, a house and a lump-sum alternative can have different conditions. Read whether choosing one item affects another and whether the choice is reversible.
- Track payment and delivery. Record the date and reference for each payment, allotment letter, house-site handover, employment offer or annuity instruction. A compensation payment does not by itself prove that every R&R item has been delivered.
- Escalate within the stated route. If the authority rejects an asset, livelihood or eligibility claim, follow the reference, appeal or grievance route and deadline printed in the notice and applicable state rules. Obtain advice from a qualified land-acquisition lawyer or legal-aid service when the amount, title or displacement consequences are substantial.
Common mistakes and how to correct them
Assuming the title holder is the only claimant
Problem: A tenant, occupier, forest-rights holder or livelihood-dependent family is left out of the R&R survey.

Accepting a land rate that hides missing assets
Problem: A per-hectare figure is treated as payment for the house, well, trees or crops.
Correction: Demand the asset schedule and compare each item with the site inventory. Land value and attached-asset valuation should be traceable in the compensation documents.
Counting an R&R promise as compensation
Problem: A proposed plot, job or annuity is treated as if it increases the market value of the land.
Correction: Keep the compensation calculation and R&R award as separate checklists, with a status for each promised benefit.

Worked example: why one family can have two awards
Imagine a road project acquires a family’s agricultural parcel, a house and a small roadside workshop. The compensation award would address the land, house, workshop and other assessed assets, together with the statutory additions. The R&R survey could separately recognize the family’s displacement, the loss of its workshop livelihood and any qualifying housing, subsistence, transport, artisan or small-trader assistance. If a tenant operated the workshop, that person might need a separate livelihood-based R&R determination even though the land compensation is paid to the owner.
This example does not set an amount. It shows why comparing only the cheque for the parcel can understate the benefits or obligations recorded in the R&R award.
Questions to resolve before signing or choosing an option
- Which exact parcel, structure and asset does each line of the compensation award cover?
- Which family members and livelihood categories did the R&R survey verify?
- Is the benefit cash, land, a house, a service, employment or an annuity, and what conditions attach to it?
- Does a plot or housing choice replace a lump sum or another benefit?
- Which state rule, amendment or project package is cited, and is the quoted figure current for this acquisition?
- What reference or appeal route applies if an asset, person or benefit is missing, and what deadline is printed in the notice?
Use the compensation award to audit payment for property taken and the R&R award to audit the family’s move and livelihood recovery. Reading both documents together is the safest way to see what the project owes and which steps remain.
