A declaration can give a contractor or concessionaire a negative performance record and make it ineligible to bid for new projects for two years. At least two affected parties have challenged the action in court, so the final legal position remains unsettled.
What the catastrophic-event clause does
The provision moves severe highway failures beyond an individual defect or compensation dispute and into the Ministry’s contractor-performance system. The Ministry’s circular of 2 March 2026 assigns minus 30 marks in performance evaluation when a failure is declared a catastrophic event. A poor performance record can affect eligibility for later National Highway tenders, while the provision also allows a two-year bar on bidding for new projects.

The rule is not triggered by every crash, pothole or construction defect. It defines specific structural, pavement and tunnel failures, and excludes incidents that resulted from a force-majeure event.

These cases cover three different failure patterns: a fatal construction accident, major pavement and retaining-wall settlement, and a retaining-wall collapse. The reported actions therefore illustrate the breadth of the new framework, while the court challenges mean that responsibility and sanctions could still change.

Which failures count as catastrophic?
The 2 March 2026 Ministry circular lists five categories. The thresholds below apply to the situations described in the circular, not to ordinary maintenance defects.
- Structural collapse: collapse of a bridge, flyover, underpass or retaining structure during the concession, contract or design period.
- Serviceability-ending embankment or pavement failure: the failure must remove serviceability and require at least one carriageway to be closed or diverted. It qualifies when the continuously affected length is at least 50 metres, or the cumulative discontinuous length exceeds 1% of the project length, whichever threshold is lower. The timing window is the defect-liability period or five years, whichever is less.
- Launching-girder or staging collapse: the collapse must cause loss of life during construction.
- Pavement-quality-concrete failure: full-depth panel replacement must be required over more than 2% of the carriageway area within five years of completion.
- Tunnel or portal collapse: a tunnel or tunnel portal collapses during operation, or people remain trapped for more than 72 hours during construction.
The circular says the Ministry’s competent authority notifies an incident as a catastrophic event unless the cause was force majeure. That exception is likely to be central in any dispute over extraordinary natural or other uncontrollable events, although the reported cases do not establish how the Ministry will apply it in practice.

How a highway failure reaches a Ministry decision
- Occurrence and local assessment: the implementing agency records the failure, its effect on traffic and structures, casualties, and the relevant contract or concession obligations.
- Mandatory reporting: the responsible regional or competent officer of the National Highways Authority of India, the Ministry, the National Highways and Infrastructure Development Corporation, or the Border Roads Organisation must report a qualifying event for a decision.
- One-month deadline: the circular requires reporting within one month of the occurrence. It warns that failure by the responsible officer to report on time can itself invite disciplinary action.
- Notice or notification: the Ministry may issue a show-cause notice, allowing the developer to respond, or notify a catastrophic event. The NH-12 matter was reported at the show-cause stage, whereas the other two were described as notifications challenged in court.
- Performance consequences: a declared event carries minus 30 marks in the performance evaluation. The framework can also result in a two-year prohibition on bidding for new projects, subject to the applicable decision and any court order.
The circular’s signed warning states: “Failure of the Regional Officer of NHAI/MORT&H/NHIDCL or the competent officer of BRO to report any such event within ‘one month of its occurrence for declaration as Catastrophic Event shall invite disciplinary action.”

Previously, a serious failure could be handled mainly through defect notices, repair directions, damages, or a project-specific dispute. The new system creates a formal performance record that follows the responsible contractor or concessionaire into future procurement. Minus 30 marks can make later qualification more difficult even where a two-year bidding bar is not imposed.

The policy also gives agencies a measurable test for escalation. Closure or diversion of a carriageway, affected-length thresholds, the five-year limits, and the 2% panel-replacement threshold provide more objective criteria than a general finding that a project performed badly. Developers will therefore need contemporaneous records on design assumptions, construction quality, inspections, traffic controls, geotechnical conditions and any alleged force-majeure cause.
What happens after a catastrophic highway failure?
Declaring an event does not by itself rebuild the road. The damaged work must be made safe, traffic restored where possible, and permanent repairs or replacement procured. An NHAI e-procurement listing sought four-lane construction at damaged locations near Tharad on the Udhampur–Ramban section of NH44, expressly describing the work as following a recent catastrophic event. The listing demonstrates the remedial procurement that can follow a major failure, but it does not establish that the Tharad work was one of the three developer cases reported in October.

For a developer facing action, the immediate issues are the factual cause of the failure, whether the circular’s thresholds are met, whether force majeure applies, the distinction between a show-cause notice and a final notification, and the effect of any interim or final court order. The reported litigation means the practical consequences for the Uttar Pradesh and Tamil Nadu parties may evolve.

Why the first reported use matters
The October 2026 cases are described as the Ministry’s first reported use of the newly introduced clause. They signal a shift toward ministry-level accountability for failures that cause deaths, threaten structural integrity, or make a highway unusable. For bidders, safety and quality performance is no longer only a project close-out concern: a single qualifying event can affect the contractor’s rating and access to National Highway work for years.
