Repair common Windows errors and clear accumulated junk for a smoother, more stable PC - no reinstall needed.Free scan · no reinstallBefore buying a parcel or starting design, obtain written confirmation of four things: the governing planning and building authorities, the zoning rules that apply to the specific site, the approvals and permits your proposal triggers, and the school district’s capacity and mitigation requirements. A zoning-map label is only a starting point. Overlays, conditions, easements, site standards, land-use entitlements and school-capacity rules can change whether a project is feasible, how long approval takes and what it costs.
Use the workflow below to turn those questions into documented decisions before you close on land, sign a construction contract or spend heavily on final plans.

Why this due diligence must happen before design or closing
Real-estate listings and informal statements rarely establish development rights. The controlling information is found in adopted zoning maps, zoning codes, general plans, recorded conditions, permit checklists, school-district plans and written decisions from the authorities with jurisdiction.
A parcel can appear suitable for housing yet require a conditional-use permit, subdivision approval, variance, environmental review, historic review or a school-capacity certification before construction can proceed. A building department may also reject plans that satisfy the basic use but fail setbacks, access, parking, drainage, landscaping, loading, height or lot-coverage standards.

School review is often a separate track. In some jurisdictions, school concurrency or a capacity certification must be completed before a building permit is issued or a subdivision is recorded. Treating school capacity as a question for the nearest principal or a sales agent is not sufficient; the formal analysis uses enrollment, projected demand, facility capacity and adopted capital-facilities plans.
Step 1: Identify every authority with jurisdiction
Start with the parcel’s legal address and assessor or tax identification number. Confirm whether it lies inside a city, in an unincorporated county, or within a special planning area. Then identify the authorities listed below and record the staff contact, application portal, applicable code edition and date of the latest fee schedule.
| Question | Authority to confirm | What to obtain |
|---|---|---|
| What land-use rules apply? | City or county planning department | Official zoning map, zoning code, general-plan designation, overlays and written zoning verification |
| Who issues construction permits? | Municipal or county building department, or a delegated building official | Permit checklist, submittal portal, plan-review sequence, fees, expiration and inspection requirements |
| Who controls roads, drainage and utilities? | Public works, transportation, utility and stormwater agencies | Access standards, right-of-way and easement information, frontage improvements and utility conditions |
| Which schools serve the parcel? | School district or other designated education authority | Attendance boundaries, current enrollment, capacity figures, projections, capital-facilities plan and impact-fee or concurrency rules |
| Are special reviews required? | Environmental, historic, fire, floodplain, coastal, airport or special-district agencies | Overlay regulations, required studies, approvals and appeal or hearing procedures |
Ask each office to confirm the answer in writing. A phone conversation can help you find the right reviewer, but it is not a dependable record of development rights or a condition you can enforce later.

Step 2: Verify zoning from primary records
Read the official map, then the code
Use the jurisdiction’s official zoning map, not a third-party map, to identify the district and any split-zoned portions of the parcel. Santa Clara’s published sequence begins: Verify the Zoning District of the property using the City’s Zoning Map.
Save a dated copy or screenshot showing the parcel boundaries and map legend.
Next, read the complete zoning-code section for that district and the corresponding general-plan designation. Check permitted, accessory, conditional and prohibited uses. A residential label does not by itself establish the number of units or the type of housing allowed.
Check overlays, conditions and history
Search for every overlay and combining district, including historic, design, hillside, flood, coastal, airport, fire, environmental, affordable-housing and infrastructure areas. Review recorded development agreements, planned-unit-development conditions, prior entitlements, deed restrictions and code-enforcement records. A zoning-verification letter, where available, should identify the district, overlays, zoning history and conditions affecting the parcel.
Ask public works to identify public and private easements, rights-of-way, future road reservations, utility corridors and access limitations. An easement can reduce the buildable envelope even when the zoning map shows adequate area.

Test the actual proposal against measurable standards
Prepare a preliminary site plan that reflects the project you actually intend to build. Compare it with the code before paying for construction documents.
| Control | What to test | Evidence to keep |
|---|---|---|
| Use and density | Use category, unit count, floor-area ratio, lot area per unit and maximum density | Code sections and a planner’s written interpretation |
| Building envelope | Height, front/side/rear setbacks, lot coverage, step-backs and daylight rules | Dimensioned concept plan and zoning calculations |
| Parking and loading | Vehicle and bicycle spaces, accessible spaces, loading bays, driveway width and maneuvering | Parking table, circulation plan and transportation comments |
| Site access | Driveway location, sight distance, frontage, fire access and emergency turning | Public-works and fire-department requirements |
| Landscape and open space | Landscaping, tree protection, common open space, private yards and stormwater areas | Landscape calculations and arborist or drainage requirements |
| Signs and exterior work | Sign area, lighting, fences, walls, mechanical equipment and screening | Applicable sign and design standards |
| Constraints | Flooding, wetlands, steep slopes, contamination, habitat, historic resources and utilities | Maps, site studies and agency determinations |
Los Angeles County’s checklist illustrates the level of detail often expected: property lines, easements, setbacks, proposed structures, access, parking and other site features must appear on the plan set. Use the local checklist as the controlling list rather than assuming a plan acceptable in another city will be accepted here.
Step 3: Request an early planning review
Before preparing a full permit package, ask whether the jurisdiction offers a pre-application conference, pre-permit zoning plan check or development-services meeting. Portland describes its optional review for large or complex projects as a check of the proposal for compliance with the Zoning Code before you apply for a building permit.
The reviewer can identify land-use applications that would otherwise appear late in building-plan review.
Approvals that an early review may reveal
- Conditional-use or special-use permit.
- Variance or adjustment for a dimensional standard.
- Subdivision, lot-line adjustment or parcel-merger approval.
- Site-plan, design-review or planned-development approval.
- Environmental, historic, tree, floodplain, coastal or traffic review.
- Affordable-housing, inclusionary or development-agreement requirements.
- Public hearings, noticing, appeal periods or development-impact conditions.
Bring the parcel number, survey or boundary information, concept site plan, preliminary unit or floor-area count, parking calculation, access concept and known constraints. Ask the planner to state which approvals are prerequisites, which may run concurrently and which agency controls each decision.
Step 4: Assemble the correct permit package
A zoning determination is not a building permit. Building permits address construction-code compliance, structural safety, fire and life safety, energy, accessibility, grading, plumbing, mechanical and electrical work, while land-use approvals establish whether the proposal is allowed at that location.
Pasadena explains that applications and fees go through its Permit Center and that plan review checks federal, state and city laws and ordinances. Depending on the project, reviewers may require site or plot plans, floor plans, elevations, structural plans and supporting documents. Comparable jurisdictions commonly request some combination of the following:
- Completed application forms and ownership or authorization evidence.
- Boundary, topographic and civil surveys.
- Site, grading, drainage, utility and stormwater plans.
- Floor plans, roof plans, elevations, building sections and schedules.
- Structural calculations, soils or geotechnical reports and energy documents.
- Accessibility, fire-protection, landscape, tree and hazardous-material documents.
- Transportation, environmental, historic or noise studies when triggered.
- Evidence of prior land-use approvals and school-capacity or concurrency clearance.
Confirm the current forms, fee schedule, accepted file format, naming rules, plan scales, signatures, payment methods, review sequence and permit-expiration rules. Ask whether separate grading, demolition, right-of-way, utility, fire, sign or trade permits are required. Record the date on which an application is deemed complete; many jurisdictions measure review periods from completeness rather than initial upload.

Step 5: Analyze school capacity independently of building permits
Request the district’s underlying data
Contact the school district serving the parcel and request its current capital-facilities plan, enrollment projections, facility capacities, attendance boundaries, planned school projects and school-impact-fee schedule. Ask for the adoption date and the projection year used in the current plan.

King County describes capital-facilities plans as documents that identify projected enrollment, facility-capacity needs and funding strategies; they can also support capacity analysis and impact-fee calculations.
Request the district’s written methodology. Clarify whether capacity is measured by permanent building capacity, program capacity, portables, utilization targets, classroom loading, grade level or another formula. Ask how the district assigns students when attendance boundaries change and whether a new development is evaluated by dwelling type, bedroom count, unit count or an adopted student-generation rate.
Do not substitute proximity for capacity
The nearest school may not be the assigned school, and a school with a favorable reputation may have no available capacity under the district’s adopted formula. Capacity analysis normally combines current enrollment, projected students from the proposal, other approved development and the capacity of affected facilities. Obtain the district’s written attendance assignment and capacity result instead of relying on a real-estate listing or informal statement.
Step 6: Determine whether concurrency or a capacity certificate is required
Ask the planning department and school district whether the parcel lies in a school-concurrency area and exactly what event triggers review. The trigger may be a rezoning, land-use application, subdivision approval, site-plan approval, building permit or recording of a final plat.

Repair Windows errors before they cause bigger problemsFix Now →Fix the driver behind crashes, sound loss and screen glitchesFind Drivers →Miami example: concurrency before permits
Miami states that a housing-increasing project must apply for school concurrency and that the process must occur before building permits can be issued. If capacity is inadequate, mitigation may involve land or fees. This is a local rule, not a nationwide sequence; another jurisdiction may use a different trigger or no concurrency program at all.
Delaware example: certification for covered subdivisions
Delaware law requires covered residential subdivisions in New Castle County to obtain a school-capacity certification. The certification considers current enrollment, previously certified demand and demand from the proposed development. Delaware regulations define school capacity as the number of students a school building can serve under the state Department of Education school-construction formula. Confirm whether your project falls within the covered geography and subdivision definition before assuming an ordinary building permit is enough.

Questions to put in the written determination
- Is the parcel inside the applicable concurrency or certification area?
- What project types and unit counts trigger review?
- Which agency issues the determination and how long is it valid?
- What enrollment year, capacity formula and attendance boundaries are used?
- Does an approval reserve capacity, and for how many units or lots?
- What happens if boundaries, projections or available capacity change before permits issue?
- What appeal, hearing or reconsideration rights apply?
Step 7: Document mitigation, fees and payment timing
If the analysis finds insufficient capacity, obtain the written finding and the complete mitigation terms before treating the site as financially feasible. Possible measures include school-impact fees, voluntary assessments, land dedication, facility construction, phased occupancy, deed restrictions or another agreement authorized by local law.
Do not assume that paying a fee guarantees a seat at a particular school or that a fee in one county follows the same formula elsewhere. Confirm the amount per unit or other basis, annual indexing, exemptions, credits for existing development, refund rules, expiration, appeal rights and the agency receiving payment.

Payment timing is equally important. Snohomish County reports that school-impact fees in its current program are collected during permitting, are due at building-permit issuance and are subject to a ten-year expenditure period. That schedule is specific to the program described; verify your jurisdiction’s point of collection, allowable expenditure period and whether fees are due again for later phases or permit renewals.

Create one schedule that shows dependencies rather than treating each review as an isolated task.
- Before acquisition: obtain the zoning map, code sections, general-plan designation, overlays, easements, prior conditions, school boundaries and current capital-facilities documents.
- Concept stage: prepare a scaled site plan and preliminary unit, floor-area, parking, access and height calculations.
- Early review: meet with planning, public works, fire, building and the school district. Request a written list of required entitlements, studies, capacity reviews and mitigation.
- Feasibility decision: price design, studies, fees, land dedication, frontage work, utility upgrades, contingencies and schedule risk.
- Entitlement stage: file conditional-use, variance, subdivision, site-plan, environmental or concurrency applications in the sequence the authorities specify.
- Permit stage: submit the complete building and trade packages, pay required fees and track completeness comments and expiration dates.
- Preconstruction gate: verify that every prerequisite approval is final, every mitigation agreement is signed, capacity clearance remains valid and permit conditions are incorporated into the construction documents.
Compare a prospective site or jurisdiction using the same questions
| Comparison axis | Questions to answer |
|---|---|
| Permitted use and density | What use, unit count, floor area and density are allowed by right? |
| Overlays and site controls | What conditions, setbacks, easements, access limits and environmental or historic rules reduce the buildable area? |
| Entitlement and permit sequence | Which approvals are required, which can run concurrently and which must be final before a permit or plat? |
| School methodology | Which district serves the parcel, what capacity formula is used and how are students assigned? |
| Concurrency or certification trigger | Is review triggered by rezoning, subdivision, site plan, building permit or another event? |
| Mitigation and fees | What options exist, how are amounts calculated and when is payment due? |
| Appeals and public process | Are hearings, notice, appeal deadlines or judicial-review windows involved? |
| Validity and expiration | How long do zoning letters, capacity findings, entitlements and permits remain valid? |
Common failure points and how to correct them
The map says residential, so the project is assumed feasible
Problem: The map is read without overlays, conditions, density rules, easements or site standards.
Correction: Obtain the zoning code and general-plan sections, map every constraint on a concept plan and request written zoning verification.
School review is left until permit submission
Problem: A capacity or concurrency requirement appears after design costs are committed.

Correction: Ask at the concept stage whether the project is subject to school review, what event triggers it and whether a written clearance is required before permit issuance or subdivision recording.
An informal staff answer is treated as approval
Problem: Staff turnover, code amendments or a different reviewing agency produces a different result.
Correction: Send a concise written description of the parcel and proposal, ask specific questions and retain the response with the date, code edition and assumptions.
A fee is budgeted without confirming its basis
Problem: The budget uses a neighboring jurisdiction’s rate or ignores indexing, credits and phase timing.
Correction: Request the adopted fee schedule and a project-specific calculation, including exemptions, payment point, refund terms and mitigation alternatives.
Permit drawings omit land-use conditions
Problem: The building set conflicts with an approved site plan, frontage condition, landscape plan or school agreement.
Correction: Maintain a conditions matrix and check every condition against the architectural, civil, structural and landscape sheets before submission.
Documents to have before you commit
- Dated official zoning-map extract and applicable code sections.
- Written zoning-verification letter identifying district, overlays, history and conditions, when available.
- General-plan designation and any adopted area, corridor or neighborhood plan.
- Title report, survey and mapped easements or rights-of-way.
- Planner’s written list of required entitlements, studies, hearings and expiration dates.
- Current permit checklist, fee schedule, forms, submission requirements and review sequence.
- Concept site plan showing boundaries, access, setbacks, buildings, parking, loading, landscaping and constraints.
- School-district capacity analysis, attendance assignment, capital-facilities plan reference and written concurrency or certification determination.
- Project-specific mitigation agreement or fee calculation, including payment timing and validity.
- Approval schedule and conditions matrix signed off by the project team.
The decision gate before buying or building
Proceed only when the written record answers four practical questions: Is the intended use and intensity allowed or realistically approvable? Which entitlements and permits are required, in what order and at what cost? Can the school system accommodate the projected students under its adopted methodology, or is mitigation available on acceptable terms? And will every approval remain valid long enough to complete design, financing and construction?
If any answer is unresolved, make the issue a closing condition, obtain an option or extension, redesign the proposal, or treat the parcel as an unverified risk. The safest construction schedule begins with documented land-use and school-capacity decisions, not with permit drawings.
