How to Verify Whether a Construction Project Has Actually Broken Ground

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

To verify that a construction project has actually broken ground, identify the exact project and jurisdiction, check the official permit and inspection history, and corroborate those records with dated evidence of physical work or a project progress log. An issued permit or a ceremonial groundbreaking announcement proves authorization or publicity—not that crews have started building.

There is no universal legal definition of “broken ground.” Whether excavation, demolition, utility relocation, or other enabling work qualifies depends on the project claim, governing documents, and local rules.

As an Amazon Associate I earn from qualifying purchases.

What “broken ground” should mean for your check

People use “broken ground” loosely. A developer may mean the first excavation, while a lender, buyer, public agency, or contract may require commencement of the announced structure itself. Before looking at records, write down what event you are trying to prove.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
  • Site preparation: clearing, grading, fencing, access roads, or temporary utilities.
  • Demolition: removal of an existing building or slab.
  • Enabling work: utility relocation, shoring, dewatering, or soil stabilization.
  • Main construction: excavation, foundations, structural framing, or installation of the announced facility.

If the claim says a hospital is “under construction,” a cleared lot may be insufficient. If it says “work began,” approved demolition or foundation excavation might satisfy the ordinary meaning. For a legal, financing, or contractual decision, apply the definition in the applicable agreement and local regulations rather than a general internet usage.

Also decide whether you are testing a historical statement or current activity. A foundation inspection can prove that a physical stage occurred by a particular date, but it does not prove that work is still continuing today. Conversely, heavy equipment visible now does not necessarily establish when the project first started.

Step 1: Pin down the exact project

Large developments often have separate buildings, phases, parcels, and permit numbers. Start a project record containing:

  • the official project name and any alternate name;
  • street address, parcel, lot, or block identifier;
  • project sponsor, owner, or public agency;
  • the announced phase or building;
  • the date and wording of the claim that construction started.

Compare every later record with this information. A permit for a neighboring parcel, an earlier phase, or unrelated tenant work can look like proof while referring to a different scope.

Where a project has several addresses, identify the parcel covered by the particular permit. A campus may have one public name but separate permits for a garage, utility work, temporary structure, and main building. Capture the permit description, not merely its number, because a number alone may not reveal whether it covers the announced facility.

Step 2: Find the authority that controls the site

Use the municipality’s building department, planning or construction department, or equivalent permitting authority. Search its official portal by address, parcel, permit number, or application number. Some systems separate building, grading, demolition, utility, and planning records, so check each category that could represent the claimed work.

Seattle’s public guidance illustrates the useful fields to seek: permit activity, status, inspection status, related permits, and project documents. The labels differ elsewhere, but the principle is the same—search the record tied to the site, not a general project-news page.

Record the portal’s “last updated” date and save the permit or application identifiers. Online data can be delayed, corrected, or split between current and historical systems. If a search by project name returns nothing, try the street address, parcel number, owner, architect, or contractor shown in a public announcement.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Do not assume the planning agency is the same office that records inspections. A planning approval, environmental clearance, or zoning case may sit in one system while building permits and inspection results sit in another. Follow links to the building official, public works department, or records office when the primary portal points elsewhere.

Step 3: Separate permission from physical activity

Regulatory milestones describe what the applicant has done with the authority; they do not automatically describe what workers have done at the site.

Record or event What it establishes What it does not establish by itself
Application filed The applicant submitted a request. Approval, issuance, or site work.
Plan review or approval The authority accepted plans at that stage. That construction has begun.
Issued permit Permission to perform the permitted work, subject to conditions. That a crew mobilized or work is continuing.
Inspection request or appointment An inspection was scheduled or requested. That the inspected work passed or was completed.
Passed excavation or foundation inspection An official inspection entry records that stage of work at a stated time. That every part of the project is active or on schedule.
Final approval or sign-off The authority accepted completed work for that permit. When initial ground-breaking occurred.

The Los Angeles Department of Building and Safety states: “Once your plans are approved, you may proceed to permit issuance, which is your go-ahead to begin construction.” That sentence describes authorization. You still need an inspection, progress record, or dated observation to show that work actually began.

An “active,” “issued,” or “open” status can remain in a portal while the owner waits, redesigns the work, or pauses construction. Read the status definitions and event history where available. An expiration, suspension, or closure may explain why a project that once had permission no longer appears active, but those administrative events still do not identify the original start date.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Step 4: Look for records tied to actual work

Search the inspection tab, permit chronology, and attached documents for entries that identify a physical stage and date.

Inspection milestones

Depending on the jurisdiction and permit type, useful entries may include demolition, excavation, shoring, footings, foundations, underground utilities, concrete placement, or framing. A stage-specific result is stronger than a generic “active” status because it connects the record to work in the field.

Read the result carefully. “Requested,” “scheduled,” “deferred,” “failed,” and “passed” describe different events. A scheduled inspection proves an appointment was made; a passed excavation inspection is stronger evidence that the inspector recorded that stage. Neither one proves that the entire announced project is proceeding without interruption.

Daily logs and progress reports

Ask whether the project has a daily jobsite log, superintendent report, lender inspection, or public progress report. The implementing rules associated with the Philippines’ National Building Code describe a supervising architect or civil engineer keeping a daily jobsite log of actual progress and related information for review by the Office of the Building Official. That is a jurisdiction-specific requirement, not a universal rule, but it demonstrates the kind of contemporaneous evidence that can answer the question.

What to capture

  • date and time of the entry;
  • permit or project number;
  • address or parcel;
  • described activity and phase;
  • inspector, engineer, contractor, or reporting party;
  • result, such as passed, failed, deferred, or incomplete.

Save the page or document as it appeared, including the retrieval date. If the portal changes its display, your copy should show which record supported your conclusion and whether the date was an event date or merely a last-updated date.

Step 5: Corroborate with dated site evidence

If you can view the property safely and lawfully from a public place, take a dated photograph or note a credible, dated observation. Look for excavation, foundation forms, installed reinforcement, concrete placement, active equipment, or other work that matches the permit scope. Record your vantage point and the visible address or landmark.

Do not enter a fenced or posted site, approach machinery, or rely on a photograph whose date cannot be established. Promotional renderings, recycled images, and undated drone footage are weak evidence. A site photograph can show activity, but it may not identify the project, the permit, or the precise work being performed; pair it with an official record.

Photographs should show context where possible: a street sign, parcel boundary, building number, or distinctive neighboring feature. Note whether the image shows work in progress or only completed materials. A stock photo of a crane, even if published beside the project name, does not establish that the crane was at that site on that date.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Step 6: Match the date and scope

Build a simple timeline in which every item has a date, source, and scope. Distinguish work that predates the announcement from work after it. A demolition permit may show that a former structure was removed months earlier, while a separate building permit remains unused.

Question Why it matters
Is the record for the same address or parcel? Nearby or similarly named projects can be confused.
Is it the same phase or building? One phase can start while another remains unbuilt.
What was the event date? A current permit status does not prove when work started.
What work was described? Preparation may not meet a claim about the main structure.
Was the event completed, merely scheduled, or reported? Scheduling and announcements are weaker than completed inspections.

For contractual deadlines, define the qualifying event in writing and have the responsible professional or counsel apply the governing documents.

When dates conflict, do not silently choose the earliest one. Explain whether one source records authorization, another records an inspection, and a third reports a ceremony. The conclusion may be “physical work was documented by June 12,” even if the owner announced a groundbreaking on May 1 and the permit was issued in April.

Step 7: Fill gaps in online records

A blank portal is not proof that nothing happened. Records may be historical, restricted, delayed, or held by another department. Seattle notes that some older permits and plans are not in the main online system and may require a separate library or records request.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
  1. Check the authority’s historical-record, archive, or document-request page.
  2. Search related permits for demolition, grading, utilities, public works, and temporary structures.
  3. Ask the permitting office for the exact permit number and the most recent inspection or progress entry.
  4. Ask the project representative to identify the permit, phase, and date they mean by “started.”
  5. Keep the request factual: provide the address, parcel, project name, and the date range.

Request copies of the relevant inspection card, approved scope, and dated progress record rather than asking only whether the project is “underway.” If an office cannot release a document, ask whether it can confirm the event date, record type, or procedure for a formal request.

A project representative’s answer is useful for locating records, but treat it as a statement to corroborate. Ask for the permit number, inspection type, and date instead of accepting an undated assurance.

How to weigh conflicting evidence

When sources disagree, score each item against five questions: who created it, how precisely it matches the address and phase, how recent it is, whether it records authorization or observed activity, and whether an independent source corroborates it.

Evidence Practical weight Reason
Official inspection or progress record naming the site and physical stage, plus dated site evidence Strongest practical case Combines a project-specific record with independent observation.
Inspection entry without corroborating observation Strong, subject to record quality Records a stage of work but may not show current continuation.
Dated photograph or credible report from a public vantage point Useful corroboration Shows visible activity but may not identify the exact scope.
Issued or active permit Useful but not conclusive Shows authorization, not mobilization.
Contractor mobilization update or notice filed for the project Useful but limited May show preparation or parties without proving physical work.
Rendering, investor presentation, schedule, old photograph, or ceremonial shovelful Weak Can be symbolic, aspirational, outdated, or detached from field activity.

A recent inspection tied to excavation or foundations generally answers “has work started?” more directly than an issued permit. A direct observation may be compelling, but it cannot alone prove that the activity belongs to the announced project.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Use the strongest wording the evidence supports. “Authorized,” “announced,” “site preparation observed,” and “foundation work recorded” are different conclusions. Avoid upgrading one into another merely because a press release uses the phrase “underway.”

What local systems can and cannot tell you

Los Angeles

Los Angeles describes approved plans moving to permit issuance and provides permit-status, inspection, and property-record tools. Its inspection process covers stages such as excavation and foundations. Those tools can establish a recorded inspection event, but the permit issuance itself remains authorization rather than proof of commencement.

New York City

New York City describes plan approval and work permits as prerequisites for work to begin, followed by inspections and sign-off as work proceeds and closes out. These are local requirements; do not assume another city uses the same sequence or terminology.

Seattle

Seattle’s permit timeline follows the administrative path from application intake to issuance. A timeline showing movement through that path does not itself show activity at the site. Its guidance also identifies separate access routes for some older permits and plans.

Florida

A Florida notice of commencement is a jurisdiction-specific construction and lien-related filing. It can help identify project parties and details, but its existence is not independent proof that crews have physically started work.

Philippines

The National Building Code implementing-rules material describes a daily jobsite log maintained by the supervising architect or civil engineer and available for review by the Office of the Building Official. Whether that log exists, and how it can be accessed, depends on the project and local administration.

These examples illustrate why a portal result must be read in context. A term such as “notice,” “commencement,” “inspection,” or “sign-off” can have a specific administrative or lien-related meaning in one jurisdiction and a different meaning elsewhere.

Common mistakes that produce a false “yes”

  • Treating permit issuance as commencement: the owner may hold a permit without mobilizing.
  • Counting a ceremony as construction: a staged shovelful can be symbolic.
  • Using a generic “underway” statement: it may refer to financing, design, or site preparation.
  • Mixing phases: visible work on one parcel may not be the announced building.
  • Ignoring old images: a photograph can predate a delay or represent another site.
  • Reading “active” as “occupied by workers”: portal status often means the permit remains open administratively.
  • Assuming missing data means no work: historical records may be stored elsewhere.
  • Entering the property to investigate: trespass and safety risks outweigh any evidentiary benefit.
  • Confusing a scheduled inspection with a completed one: the appointment alone does not establish that work passed inspection.
  • Ignoring the scope line: utility or demolition work may be real but may not satisfy a claim about the main structure.

A repeatable verification worksheet

Use one line for each source so another person can reproduce your conclusion.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
  1. Project identity: name, address, parcel, sponsor, phase, and claim date.
  2. Authority: department, portal, search term, and permit or application number.
  3. Administrative status: filing, approval, issuance, expiration, suspension, or closure.
  4. Physical milestone: inspection type, log entry, photograph, or report, with exact date.
  5. Scope match: explain why the recorded work belongs to the claimed project.
  6. Independent corroboration: identify a second source or state why none was available.
  7. Uncertainty: note missing records, conflicting dates, or an unresolved definition of “started.”

Conclude with a carefully bounded statement such as: “An official foundation inspection dated [date] matches the permit for [phase] at [address], and dated public-view photographs show the same work; this supports a finding that physical construction had begun by that date.” Keep variable information inside your own records rather than presenting an unsupported general claim.

For a short due-diligence memo, attach the source links or copies, identify the retrieval date, and separate facts from interpretation. State exactly what has been verified and what remains unknown, such as whether work continued after the inspection or whether enabling work qualifies under a contract.

When you need a formal or legal determination

If the answer affects a purchase, loan draw, insurance obligation, public-funding condition, tax treatment, development agreement, or deadline, ask the relevant authority or qualified professional to apply the governing rule. Provide the complete timeline and source copies. Local definitions may distinguish “commencement,” “substantial commencement,” “notice to proceed,” and “construction start,” and those terms can carry different consequences.

The general method in this guide can organize evidence, but it cannot replace the contract, ordinance, permit condition, or court-approved interpretation that controls a particular dispute.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Do not rely on an informal portal search as a legal opinion. The controlling language may be in a permit condition, development agreement, financing document, or local rule that is not displayed beside the basic permit status.

What a defensible conclusion looks like

A defensible conclusion identifies the project and jurisdiction, names the dated record showing physical work, explains how the scope matches the claim, and states any remaining uncertainty. For example, an issued permit plus a groundbreaking announcement supports authorization and intent. An excavation or foundation inspection tied to the same address, reinforced by a dated public observation, supports the stronger conclusion that work physically started. If only a permit, schedule, or ceremony exists, report that the project was authorized or announced—not that construction has been verified.

Frequently Asked Questions

Does an issued building permit prove construction has started?

No. An issued permit is permission to perform the permitted work. Look for a dated inspection, jobsite or progress log, or independent dated observation showing physical activity.

Is a groundbreaking ceremony proof that crews began work?

Not by itself. A ceremony may be symbolic or promotional. Check whether excavation, foundations, demolition, or another defined qualifying activity was recorded afterward or on the same date.

Free tools Windows power users keep installed

One-click scans. No signup required.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

What inspection records are most useful?

Entries tied to a physical stage—such as demolition, excavation, shoring, footings, foundations, underground utilities, concrete, or framing—are more informative than a generic active status. Check whether the entry was completed or merely scheduled.

What if the project does not appear in the online permit portal?

A missing result is not proof that no work occurred. Search by address and parcel, check related departments and historical systems, and ask the authority about archives or records requests. Older permits and plans may be stored separately.

Does a Florida notice of commencement prove work began?

No. It is a jurisdiction-specific construction and lien-related filing. It may identify parties and project details, but it is not independent proof of physical construction.

Can a public photograph prove a project broke ground?

It can corroborate activity if the date, location, and visible work are clear, but it may not establish the permit scope or exact project. Use it with an official inspection or progress record and observe only from a safe, lawful public place.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Does demolition or utility relocation count as breaking ground?

There is no universal answer. Whether enabling work qualifies depends on the wording of the claim, contract, permit, and local rules. State precisely what work occurred rather than assuming it proves main-building construction.

When should I obtain a formal legal opinion?

If the conclusion affects a loan draw, purchase, insurance obligation, public funding, tax treatment, development agreement, or deadline, provide the complete timeline and source copies to the responsible authority or qualified professional.

The Bottom Line

A permit proves authorization, not commencement. Match the exact project, phase, address, and jurisdiction; then seek a dated inspection or progress record describing physical work and corroborate it with lawful, dated site evidence. If the only proof is a permit, schedule, announcement, or ceremony, describe the project as authorized or announced—not verified as physically started.
