How to Verify Property Titles, Permits, and Condo Rules Before Buying in Mexico

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Do not make a deposit non-refundable or sign a deed until an independent Mexican professional has verified the recorded title, the seller’s authority, current liens, taxes and utilities, construction approvals, and—if applicable—the condominium regime and its debts. A seller’s deed copy is only a starting point. Registry, cadastral, municipal and condominium records answer different questions, and procedures differ by state and municipality.

Use a notary for the formal conveyance, but also consider buyer-side advice from a Mexican real-estate lawyer familiar with the property’s location. A building inspector or engineer is useful when plans, structural condition or the built area are uncertain. This guide explains what to request, what each document establishes, and which issues must be resolved before you commit your money.

What a complete pre-purchase check must establish

Before closing, you should be able to answer six questions with current documents rather than assurances:

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
  1. Who owns the property? The person or entity selling must match the owner recorded in the local Public Registry, and every co-owner, spouse or representative who must consent or sign must be identified.
  2. What exactly is being sold? The deed, cadastral record, sale contract and physical property should agree on address, boundaries, dimensions, unit number, floor area, parking, storage and the acquisition regime.
  3. Is anything attached to the title? A current registry search should reveal mortgages, liens, attachments, litigation notices and other recorded limitations, together with a documented release process.
  4. Are taxes, water and services current? Receipts and account records should identify the same property and show how arrears will be paid.
  5. Was the building legally authorized? Applicable land-use, construction, safety, service and occupancy approvals and the approved plans should be available and consistent with what was built.
  6. What rights and obligations come with a condominium unit? The registered condominium regime, bylaws, amendments, undivided share, common-area rights, rules, fees and debt status must be understood before you buy.

There is no single nationwide document list or online search procedure that applies identically everywhere. State registries and municipal authorities use different forms, names and access rules. Treat the items below as a disciplined framework, then have a local professional confirm the current requirements for the municipality and state where the property sits.

Build a document file before you negotiate final terms

Ask the seller or developer for legible, complete copies, not selected pages or screenshots. Keep the version and date of every document, and ask who issued it and how its authenticity can be checked. The following file gives your lawyer or notary material to compare.

Document or evidence What it helps establish Questions to resolve
Current deed or notarial instrument and Public Registry registration details Recorded owner, legal description, acquisition regime and registration history Does the name match identification and the contract? Are all pages, annexes and registration data present?
Government identification and authority documents Identity and signing authority of each seller, attorney-in-fact, company representative or estate representative Are co-owners, spouses, heirs, corporate approvals or powers of attorney required?
Current registry certificate or search obtained for the buyer Mortgages, liens, attachments, litigation notices and other recorded restrictions When was it issued? How will each item be cancelled before or at deed execution?
Property-tax and water or service statements Account status and the municipal or utility identifier associated with the property Do the account number, address and cadastral data match the deed? Who pays any balance?
Cadastral record, survey or official property description Location, boundaries, dimensions and sometimes construction area Does it match the physical lot, unit, parking and storage being delivered?
Construction, land-use, safety and service permits Whether the competent authority authorized the relevant work and use Are permits issued for this address and project, and are conditions or expirations outstanding?
Approved architectural, structural and installation plans, or a documented structural report What was authorized and, where applicable, evidence of structural condition Do plans match the building? If a plan or report is unavailable, is the reason and replacement obligation written?
Condominium regime deed, bylaws and amendments Legal creation of the condominium, unit boundaries, undivided share and common-area rights Is the unit constituted and registered? Which spaces are deeded, assigned, limited common elements or merely advertised?
Administrator’s no-debt certificate and current maintenance information Whether the unit owes condominium charges and what recurring or extraordinary costs exist Are assessments, reserve contributions, interest, disputes or planned works pending?

PROFECO’s consumer guidance identifies the registered deed, owner, property characteristics, common areas, undivided share and tax or service status as matters buyers should review. Its used-home checklist also calls for the condominium-regime copy and an administrator’s no-debt certificate for the notarial process. These are practical checks, not a substitute for a location-specific legal opinion.

Verify the seller and the recorded title

Obtain the complete deed and registration information

Request the entire current deed or notarial instrument, including annexes, and the entry or folio details showing registration in the local Public Registry. A photocopy supplied by the seller can reveal the claimed chain of title, but it does not prove that the record is current. Have the notary or your own Mexican lawyer obtain current registry evidence for the exact property.

Compare the registered owner’s full name with government identification and the proposed sale contract. Ask whether the person is married, whether a spouse has rights that require consent, and whether the property is co-owned. For a company, estate, trust or attorney-in-fact, verify the entity’s existence, representative authority, corporate approvals, probate documents or power of attorney. A person who can show a deed is not automatically the person authorized to sell today.

Match the legal description to the property you will receive

Read the deed’s address, lot or unit number, boundaries, dimensions, surface area and acquisition regime. Walk the property with the documents in hand. Check the building, floor and unit number, entrances, parking spaces, storage rooms, terraces, roof areas and other features promised in advertising. Record discrepancies with photographs and a written question to the seller.

Keep the records distinct. A cadastral or tax description supports identification for municipal purposes; a utility bill demonstrates an account and payment status; neither document by itself proves ownership. If the physical area is larger than the deed or a parking space is absent from the registered documents, stop and obtain professional advice about regularization, title and contract wording.

Investigate the current registry position and release of liens

Ask for a current certificate or search covering mortgages, liens, attachments, litigation notices, easements and other recorded limitations. The search should be ordered for the exact folio, parcel or unit, not a similar address. Do not rely on an old certificate or a verbal statement that the property is debt-free.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

When a mortgage or other encumbrance appears, require a written closing procedure: the creditor’s payoff amount and validity date, the funds that will be applied, the release or cancellation instrument, and who will submit and track its registration. The purchase contract should make the seller responsible for clearing agreed obligations and should not make your deposit irretrievably non-refundable while title defects remain unresolved.

NOM-247-SE-2021, section 5.4, states: “El proveedor debe informar al consumidor que al momento de la escrituración, el inmueble estará libre de todo gravamen.” In English: the provider must inform the consumer that, when the deed is executed, the property will be free of all liens. That statement does not eliminate the need to check the registry and document how a lien will actually be cancelled.

Reconcile taxes, utilities and the physical property

Check property tax and water or service accounts

Request the most recent property-tax statement, payment receipt and water or other service receipts that apply to the property. Verify the account numbers, cadastral key, address and meter or unit identifiers. Ask the issuing authority or utility how a buyer can confirm the balance and whether a certificate of no arrears is available.

Specify in the contract who pays balances, penalties, consumption through the handover date and any certificate or transfer fees. Preserve proof of payment. A receipt can show that an account was paid; it cannot cure an ownership, boundary or permit problem.

  • balconies, terraces, roof areas and exclusive-use spaces;
  • fixtures, appliances and improvements included in the price; and
  • the condominium’s undivided percentage and listed common areas.

Have a surveyor, architect or engineer measure material discrepancies. A marketing plan may show furniture or an amenity that is not part of the deed. Decide in writing whether an unregistered feature will be removed, regularized, transferred through a valid instrument or excluded from the transaction.

Verify construction, land-use and occupancy approvals

New construction and pre-sale projects

For a new or pre-sale condominium, request the construction authorizations, licenses and permits issued by the competent authorities. Depending on the location and project, the file may include land-use compatibility, building or construction authorization, safety approvals, technical specifications, service connections and documentation needed for completion or occupancy. The exact names and issuing offices vary.

Ask for architectural, structural and installation plans and for the project’s approved specifications. If a structural-condition report is required or plans are unavailable, obtain the explanation and the promised replacement document in writing, with a date and responsible party. Confirm permits directly with the municipality or state authority rather than accepting a developer’s summary.

Your contract should identify the unit and project, delivery standard, completion date, consequences of delay, procedure for approved changes, refund or cancellation rights where applicable, and the documents that must be delivered before closing. Separate construction progress from legal completion: a nearly finished building can still lack an approval needed for lawful occupation or registration.

Resale homes and completed buildings

Ask for the original approved plans and completion or occupancy documentation where the locality uses such records. Compare the approved drawings with extensions, enclosed terraces, removed walls, added rooms, roof structures, pools and other alterations. An engineer should assess safety when the construction differs from the plans or when records are missing.

There is no universally exhaustive Mexican permit checklist. State and municipal rules, building age, protected-zone status and the type of work all matter. If the seller cannot produce a permit, ask the local authority what record exists, whether regularization is possible and who bears the cost and risk. Do not treat a utility connection, tax payment or long occupancy as proof that every alteration was authorized.

Understand a condominium as private and shared rights

Read the regime deed before the purchase contract becomes final

Obtain the deed establishing the condominium regime, its registered plans, bylaws and every amendment. Confirm that the unit is legally constituted and identify its undivided percentage in the common elements. The regime should explain which areas are common, which are exclusive-use or limited common elements, and how expenses and voting are allocated.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

For each parking space, storage room, terrace, roof, garden or amenity, determine whether it is:

  • separately deeded and registered;
  • part of the unit’s private area;
  • a limited common element assigned to the unit;
  • an area subject to a use right under the regime; or
  • only a feature shown in marketing material.

Do not pay for a feature until its legal status and transfer mechanism are clear in the deed and sale documents.

Check rules, amendments and day-to-day restrictions

Read the current rules for pets, noise, renovations, leasing or short stays, use of amenities, parking, guests and enforcement—but only rely on rules contained in the actual regime, bylaws, duly adopted resolutions or other enforceable documents. Ask for amendments and recent meeting minutes so you can identify changed restrictions, approved works and unresolved disputes.

Request the current budget, reserve-fund information, ordinary fees, extraordinary assessments, insurance and planned repairs. Ask the administrator for a no-debt certificate and a current maintenance ledger. These are prudent buyer requests; the documents reviewed do not establish that every item is a uniform statutory disclosure in every state. If the administrator refuses to provide records, make that refusal a written condition for further legal review rather than assuming the account is current.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Confirm who can sign for the condominium

Verify the administrator’s appointment and authority to issue a debt certificate or represent the condominium. Check whether a developer still controls the association, whether handover has occurred and whether there are active claims involving construction, common areas or unpaid assessments. A unit purchase can transfer obligations or expose you to a special assessment even when the seller’s personal taxes are paid.

Special rules for foreign buyers

Determine whether the property is in the restricted zone

The Secretaría de Relaciones Exteriores describes Mexico’s constitutional restricted zone as extending 100 kilometres along international borders and 50 kilometres along coastlines. A foreigner cannot directly own land in that zone. For residential use and enjoyment, an SRE-permitted bank trust, or fideicomiso, can be used for a maximum term of 50 years.

Have Mexican counsel confirm the exact location—not merely the resort or city name—and the intended use. Ask who will be the trust beneficiary, how successor beneficiaries are named, what annual bank fees apply, how renewals or transfers work, and which SRE permits and deed filings are required. A fideicomiso provides contractual use and enjoyment through the trust structure; it is not direct title ownership.

Properties outside the restricted zone

Outside the restricted zone, the ownership structure may differ, but foreign buyers still need the same title, lien, permit, tax and condominium checks. Nationality does not replace registry verification. Confirm immigration, tax and currency-transfer implications with professionals who handle the transaction; do not assume that a structure used for one location applies to another.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Resale versus pre-sale: compare the risks, not the marketing

Issue Resale property Pre-sale or new construction
Registered deed Usually a completed deed exists and can be checked against the current registry. The individual unit deed or condominium regime may not yet be registered; confirm the developer’s title and the path to unit registration.
Physical condition You can inspect the completed unit and measure discrepancies before signing. You are evaluating plans, specifications and progress; define delivery standards and an independent inspection or acceptance process.
Permits and occupancy Review original approvals and completion or occupancy records, plus alterations. Verify construction, land-use, safety, service and completion approvals and who must obtain each one.
Condominium rights Check the registered regime, unit share, rules, amendments and existing debts. Confirm when the regime will be established and registered, how the promised unit and common areas will be defined, and what interim rules apply.
Liens and payment release Obtain a current registry search and a documented payoff and cancellation plan for any seller debt. Investigate project-level financing, the developer’s release process and the documents required before your unit can be conveyed free of liens.
Foreign-buyer structure Confirm whether the existing title or trust matches your intended ownership and use. Confirm that the planned deed or fideicomiso structure will be available at delivery and that the location triggers the applicable SRE process.

Neither route is automatically safer. The safer choice is the one whose title, permits, delivery obligations, lien releases and condominium rights can be independently documented for the particular project.

Use a staged process so your deposit remains protected

  1. Before signing an offer: identify the exact unit or parcel, request the deed or developer title evidence, and disclose that the offer is subject to satisfactory legal, registry, permit, physical and condominium review.
  2. Before paying a non-refundable deposit: have buyer-side counsel review the seller’s identity and authority, current registry evidence, contract, refund terms, foreign-buyer structure and the documents still outstanding.
  3. During technical review: inspect the property, compare plans and measurements, check taxes and services, and obtain an engineer’s opinion where construction differs from records.
  4. For a condominium: read the regime and rules, verify the undivided share and common-area rights, obtain the administrator’s no-debt certificate, and ask about assessments, insurance, reserves and disputes.
  5. Before scheduling the deed: require updated registry evidence, payoff and cancellation instructions for liens, current tax and service status, required permits and completion documents, and the final list of items included.
  6. At deed execution: confirm that the deed describes the same property, parties, rights and encumbrances reviewed; ensure the agreed lien-free treatment and payment instructions are reflected in the closing documents.
  7. After signing: keep the executed deed, proof of payment, registry submission or entry, tax receipts, condominium certificate and handover record. Confirm when registration and utility or administrator changes are complete.

Red flags that require a pause

  • The seller will provide only a partial deed, refuses a current registry search or insists that an old certificate is sufficient.
  • The name on the deed does not match the seller, or a co-owner, spouse, heir, company or attorney-in-fact is absent.
  • Address, dimensions, unit number, parking, storage or floor area differ between the deed, cadastral record, contract and physical property.
  • A mortgage, attachment, lawsuit notice or other limitation appears without a written release and registration plan.
  • Taxes, water or maintenance charges are described as someone else’s problem without account-specific receipts or a closing allocation.
  • A pre-sale seller cannot identify the authority that issued permits, the planned condominium regime or the documents required before delivery.
  • Promised amenities or exclusive spaces appear only in advertising and not in the regime, deed, plans or enforceable contract.
  • A foreign buyer is told that a restricted-zone trust is unnecessary without a location-specific legal analysis.
  • You are pressured to waive inspection, legal review or refund rights because another buyer is waiting.

A red flag is not proof that the transaction is impossible, but it is a reason to stop payment and obtain an independent written opinion. If a defect can be cured, make the cure, deadline, responsible party and refund consequence contractual.

Who should review what

Professional Best use What the role does not replace
Buyer-side Mexican real-estate lawyer Interprets title, authority, contracts, liens, condominium documents and foreign-buyer structure; coordinates evidence. Official registry action, municipal verification or a physical engineering inspection.
Notary Handles the formal deed process, required certificates, taxes and registration steps under local practice. Independent advocacy for every commercial term or a substitute for your own due diligence.
Architect, engineer or building inspector Checks measurements, plans, construction quality, structural condition and material alterations. Proof of ownership, lien cancellation or legal authority to sell.
Condominium administrator or association Provides debt status, budgets, rules, assessments and operational information. Confirmation that the regime and rules are validly registered and enforceable.

Choose professionals who regularly work in the property’s state and municipality. Ask them to identify which conclusions are based on an official record, which depend on a seller’s statement and which require a separate technical inspection.

Questions to put in writing before you proceed

  • What is the exact registry folio, parcel or unit identifier, and when was the latest search issued?
  • Who is recorded as owner, and what evidence authorizes every person who will sign?
  • Are there liens, attachments, litigation notices, easements or restrictions, and what document will cancel each one?
  • Do the deed, cadastral record, contract, plans and physical inspection agree on the property and included spaces?
  • Which taxes, utilities, maintenance charges and assessments are outstanding, and who pays each balance?
  • Which permits and completion or occupancy documents apply, who issued them and how were they verified?
  • For a condominium, where are the regime deed, undivided percentage, bylaws, amendments, rules and no-debt certificate?
  • For a foreign buyer, is the property in the restricted zone, and what trust or ownership documents will be executed and registered?
  • What specific conditions must be satisfied before the deposit becomes non-refundable and before the deed is signed?

The practical standard is simple: every material promise should be tied to an identifiable document, an issuing authority or a qualified inspection, with responsibility and timing written into the contract. If the evidence cannot establish title, authority, lawful construction, debt status or the rights attached to a condominium unit, delay the purchase rather than treating uncertainty as a formality.
