Before you exchange contracts or pay a non-refundable deposit, obtain the complete, issued completion and occupancy documents, identify the authority that issued each one, and authenticate them through that authority’s own records or verification process. Then compare the certificate address, building and unit scope, permitted use, status and approved plans with the flat you intend to buy. A seller’s copy, application receipt or assurance is not proof that a final certificate exists.
Certificate names and legal effects vary by country, state, city and project type. Some authorities issue separate completion and occupancy certificates; others issue one document covering both functions. The procedure below is a disciplined framework to adapt to the property’s jurisdiction, not a universal legal checklist.

What completion and occupancy certificates establish
A completion certificate generally records that construction or development was completed in accordance with an approved plan, permit, layout and specifications. An occupancy certificate generally concerns whether the building, or a defined part of it, may be occupied for a stated use and whether required civic or safety conditions have been met. Those descriptions are not universal legal definitions, so the issuing authority’s rules control.
For example, an India Ministry of Housing and Urban Affairs FAQ search excerpt describes an occupancy certificate in terms of occupation and civic infrastructure such as water, sanitation and electricity, while describing a completion certificate as confirmation of development according to the sanctioned plan, layout and specifications. The same excerpt says that a state or union territory using one certificate for both functions may satisfy both requirements under the applicable Act. Verify the current state law rather than assuming two documents are always required.

New York City’s Department of Buildings gives a narrower local definition: its Certificate of Occupancy states the legal use and/or permitted occupancy type of a building. That definition applies to New York City, not automatically to another US city or any other country.
In England, the Building Safety Regulator’s completion-certificate guidance cited for higher-risk buildings describes submission and review of completion information, comparison with earlier and updated documents, review of change records and inspection. The guidance, updated 1 October 2026, is specifically for higher-risk buildings and should not be presented as the process for every flat in the UK.
Separate documents or one combined certificate
| Question | What to establish locally |
|---|---|
| What does the document certify? | Construction completion, legal use or occupancy, or both. |
| Who issued it? | The municipal building department, development authority, regulator or other legally designated body. |
| What does it cover? | The whole development, a building, a phase, a floor or a particular unit. |
| What is its status? | Final, temporary, provisional, partial, conditional, expired or merely an application. |
| Is a second document required? | Only if the local rules require separate completion and occupancy approvals. |
Do not reject a transaction solely because you see one document instead of two, and do not accept one document as sufficient without checking what functions and scope it legally covers.

“Occupancy certificate” and “completion certificate” can mean different things even in neighbouring jurisdictions. Before reviewing paperwork, record the flat’s country, state or province, city or municipality, development name, building or tower, unit number, floor and postal address. Ask which authority approved the building plan and which authority issued the certificate.
- Identify the competent authority. It may be a municipal building department, planning or development authority, fire or safety regulator, or another body named in local law.
- Find the authority’s current verification method. Look for an official property, permit or building-record search. If there is no public search, use contact details published by the authority itself and ask how a buyer can authenticate a certificate.
- Record official identifiers. Keep the permit number, application number, building or parcel identifier, certificate number, issue date and any electronic verification code.
- Check whether the project is subject to a special regime. High-rise, phased, mixed-use and higher-risk buildings can have additional approvals or separate completion procedures.
A property agent, developer or seller may help you locate records, but the issuing authority—not the seller—is the source that can confirm issuance and scope.

Request the complete issued documents
Ask for a legible copy of every page of the final certificate, including schedules, annexes, seals, signatures, QR codes, electronic seals, conditions and limitations. Request both sides when a document is printed double-sided. A first page without its schedule may omit the units, floors or uses actually covered.
Information to capture from each certificate
- Exact legal name of the issuing authority and its office or department.
- Certificate type and certificate number.
- Issue date, effective date and any expiry or renewal date.
- Full address, parcel or lot reference and official building identifier.
- Development, tower, phase, floor and unit scope.
- Approved use, occupancy type, maximum occupancy or other restrictions.
- Whether the certificate is final, temporary, partial, provisional, conditional or superseded.
- Referenced permit, approved plan, completion plan, inspection record or change approval.
- Any exclusions, outstanding works, conditions, safety measures or areas not approved for occupation.
Ask the seller to state in writing whether the document is the final authority-issued certificate for the flat’s building and whether any later certificate, amendment or revocation exists. Treat an application receipt, inspection booking, draft, unsigned form or “certificate soon” letter as evidence of a process—not as the final approval.
Authenticate the certificate with the authority
Use the authority’s own database or written confirmation. Do not rely on a web address, phone number or email supplied only by the seller; independently locate the authority’s official contact channel.
- Search the official portal by the property address, building identifier or certificate number. Save the result as a PDF or screenshot showing the date of access.
- Check that the portal record identifies the same development, building and permitted use shown on the certificate.
- Compare the record’s status and issue date with the paper or electronic copy. Note amendments, withdrawals, superseded certificates and conditions.
- If no public search exists, ask the authority how a prospective purchaser can verify the record. Provide the certificate number, address and seller’s copy, and request confirmation of authenticity, scope and current status.
- Keep the authority’s reply, the name or reference of the officer or service request, and the date of confirmation in your conveyancing file.
New York City example
New York City’s Department of Buildings directs users to the Buildings Information System for older requests and to DOB NOW for requests on or after 1 March 2021, searching by property address. This illustrates the principle of using the issuing department’s own systems; it is not a procedure for another city. Ask the local authority which portal and filing-date rules apply to your property.
Compare the certificate with the approved plans
A certificate can be genuine yet still fail to cover the flat being sold. Compare it with the approved building plan and the completion or as-built plan, using the same identifiers on every document.

| Item to compare | Questions to answer | Why it matters |
|---|---|---|
| Address and parcel | Do the street address, lot, parcel or survey references match? | A similar address can refer to another phase or building. |
| Building and phase | Does the certificate name the correct tower, block, wing and construction phase? | Large projects often receive approvals in stages. |
| Floor and unit | Is the flat, floor or unit schedule expressly included? | A whole-site document may not approve every unit or later phase. |
| Use | Is the approved use residential, and does it permit the advertised layout or mixed-use arrangement? | A commercial or serviced-apartment approval may not equal ordinary residential occupation. |
| Configuration | Do the number of floors, rooms, extensions, balconies, parking areas and common facilities match the approved and completed plans? | Unapproved alterations can fall outside the certificate. |
| Dates and references | Do permit, inspection, completion-plan and certificate dates follow a plausible sequence? | Inconsistent references require an explanation from the authority. |
Mark every difference rather than assuming it is harmless. A changed internal wall may be minor in one jurisdiction and material in another; an extra floor, enclosed balcony, changed use or relocated fire exit can be significant.

The certificate is one part of the file. Local rules may require supporting documents before occupancy can be certified, and those documents can reveal a mismatch earlier than the certificate itself.
A West Bengal government checklist, for example, includes an approved building plan, building permit, plinth-level completion certificate, completion plan, and current property-tax and ownership records. Its risk-tiered requirements include a structural stability certificate for medium-risk buildings. These are West Bengal examples, not universal requirements, but they show the categories to ask about.
Request the locally relevant file
- Approved building, layout and site plans.
- Building permit and any revised or regularised permit.
- Plinth-level or stage-completion certificate where the local system uses one.
- Completion or as-built plan submitted to the authority.
- Fire, structural, accessibility, environmental, utility or lift approvals where applicable.
- Property-tax, land-title and ownership records, matched to the seller and development.
- Records of approved changes, deviations, conditions or enforcement notices.
Do not demand documents that the local authority does not issue. Instead, ask the authority or a locally qualified conveyancer which substitutes are legally accepted.
Interpret common certificate statuses
Final certificate
A final certificate should identify the approved work or use and show that the authority issued it, but still verify the unit scope and any conditions. “Final” on a seller’s cover letter is not enough if the authority’s record says provisional or superseded.

Temporary or provisional approval
Find out its end date, conditions, permitted use and consequences after expiry. Ask whether occupation is lawful during the temporary period and what inspection or works are outstanding. Obtain written advice before making the approval a condition of purchase.
Partial or phased certificate
Confirm that the phase, building, floor and common services serving the flat are included. A certificate for one tower or completed section may not cover the entrance, car park, amenities or utilities used by the flat.
Application or inspection receipt
This proves that someone submitted material or requested an inspection. It does not prove that the authority approved completion or occupation. Require the issued decision or an authority confirmation that no separate certificate is legally required.
Certificate with conditions or exclusions
Read every condition. A restriction on sleeping accommodation, a ban on using an unfinished floor, a required fire measure or an excluded extension can directly affect the flat’s value and lawful use.

Deal with discrepancies before signing
Pause the transaction when the authority record and seller’s document differ, the address or unit is missing, the plan shows an unapproved alteration, or the certificate is limited to another phase. Ask the seller for a written explanation and supporting approval, then ask the issuing authority to confirm the position independently.

- Wrong address or building: request correction or proof that the authority uses a different official identifier; do not assume it is a clerical error.
- Unit not listed: ask whether the certificate covers the whole building or only listed units, and obtain the rule or schedule that answers the question.
- Plan differs from the flat: identify each change and ask whether it was approved, regularised or excluded.
- Certificate missing from the authority record: treat the document as unverified until the authority authenticates it through an official channel.
- Outstanding works or conditions: obtain a completion timetable, responsibility for costs and written legal advice on whether occupation and transfer are permitted.
- Seller refuses authority verification: make verification a written condition of the transaction or reconsider proceeding.
There is no single worldwide consequence for a missing or mismatched certificate. Depending on local law, issues can affect lawful occupation, utility connections, enforcement exposure, financing, insurance, resale or the ability to register the transfer. A locally qualified property conveyancer or real-estate lawyer should assess the actual consequence.
Jurisdiction-specific illustrations
India: state and local rules control
The Ministry of Housing and Urban Affairs FAQ search result distinguishes completion and occupancy functions and recognises that one combined certificate may be used where a state or union territory provides for it. Because the underlying PDF was not available in the cited result, confirm the current statute, state rules and authority practice before relying on that summary. The West Bengal checklist demonstrates why approved plans, completion plans, permits, tax and ownership records may matter alongside the certificate.
New York City: certificate of occupancy records
The Department of Buildings states that a new building needs a Certificate of Occupancy subject to the city’s rules and exceptions, and defines the certificate by legal use or permitted occupancy type. Verify the address record in the appropriate Department of Buildings system and read the recorded occupancy description rather than assuming every residential-looking unit has the same approval.

England: higher-risk building completion process
The Building Safety Regulator guidance cited for higher-risk buildings involves submission and review of completion information, comparison with earlier and updated documents, change records and inspection. It should not be applied to every flat or every part of the UK. Confirm whether the building falls within the higher-risk regime and which local completion, building-control and occupation documents apply.
Questions to put to the seller, developer and authority
- What is the certificate number, issue date and issuing office?
- Is this the final certificate, and has it ever been amended, replaced, suspended or revoked?
- Does it cover this exact tower, phase, floor and flat?
- What residential use and occupancy limits does it permit?
- Which approved building and completion plans does it reference?
- Were any changes, extensions, conversions or regularisations approved after the original permit?
- Are any works, inspections, conditions or safety measures outstanding?
- Does the authority provide an online search or written authentication service?
- If the jurisdiction issues one combined certificate, what law or authority rule explains that arrangement?
- Which documents must be supplied to a buyer, lender, insurer or land registry before completion?
Protect the purchase contract
Give your conveyancer the certificate, authority search results, approved plans and every written explanation before signing. Ask for the contract to identify the exact documents and approvals that must be delivered by completion, not merely a promise to apply for them. Where the certificate is conditional or absent, obtain jurisdiction-specific advice on whether to delay, retain money, require remedial work, obtain an indemnity or withdraw. An indemnity does not create lawful occupancy or cure an unapproved building change, so it should never replace authority verification.
Keep a dated file containing the original downloads, screenshots, emails, call references, plan versions and notes of who confirmed each point. Authorities can update portals and records; preserving what you checked and when helps your legal and lending teams evaluate the transaction.
