Fix the driver behind crashes, sound loss and screen glitchesFind Drivers →Repair Windows errors before they cause bigger problemsFix Now →A GST show-cause notice alleging wrongly availed or utilised input tax credit (ITC) requires a point-by-point, evidence-backed reply. Start by preserving the complete notice and annexures, identify the statutory section and tax period, reconcile every disputed invoice and amount, and file the reply through the current portal process—generally in FORM GST DRC-06 where the applicable rule covers a notice whose summary was uploaded in FORM GST DRC-01.
Do not rely on an old section, deadline, penalty formula or payment option without checking the notice’s service date, financial year, cited provision and current amended law. The procedure and consequences can change with the tax period and legislative amendments.

What to do immediately after receiving the notice
Download the notice, every annexure, the electronic service record and any demand summary. Save the files in an unaltered folder and note when and how they were served. The service date can affect the time available and the applicable statutory route, so do not work only from an email alert or a summary screen.
Create a one-page control sheet before drafting. Record each item exactly as shown in the notice:

- Date and method of service.
- GSTIN and registered person’s legal name.
- Financial year and tax period.
- Section and sub-section cited.
- Name and designation of the proper officer or authority.
- Each alleged supplier, invoice, debit note, return period or transaction.
- Amount of disputed ITC and the calculation of tax, interest, penalty and any other dues.
- Reply deadline, hearing date or portal instruction printed in the notice.
The CBIC DRC-01 summary format is built around the notice reference, period, section, facts, grounds and dues. Those same fields should control your reply. If an annexure, calculation or page referred to in the notice is missing, request it promptly and state in the reply that the record supplied was incomplete.
Do not delete, alter or replace accounting records after receiving the notice. Preserve the books, purchase registers, return data, e-way bills, contracts, payment records and communications in the form in which they existed for the relevant period.
Understand what the allegation actually says
An ITC notice can use broad language while relying on a narrow set of transactions. Separate the allegation into individual grounds instead of answering with a general statement that the credit was valid.
Build an allegation map
Prepare a working table with one row for every notice paragraph, invoice group or calculation line. Use the notice’s own numbering so the officer can follow the response.
| Notice item | Information to record | Response to prepare |
|---|---|---|
| Paragraph or ground | Exact allegation and cited provision | Short answer addressing that allegation only |
| Transaction | Supplier, invoice or debit note, date and tax period | Whether the entry is genuine, recorded and included in the relevant returns |
| Amount | Tax component and the notice’s calculation | Your reconciliation to books, returns and supporting records |
| Evidence | Documents the notice relies on or says are absent | Annexure number and explanation of what the document proves |
| Relief | Demand proposed for that item | Request to drop or reduce the amount, with any reversal or payment identified |
Classify each row only according to the issue actually raised. A mismatch in a statement is not automatically the same as ineligibility; a timing objection is not automatically a supplier-default allegation. Use the notice’s wording and the records for the relevant period rather than introducing unrelated ITC conditions.
Check the statutory route before relying on a deadline
The retrieved CBIC Act text describes section 73 as covering tax not paid or short paid, erroneous refunds, or ITC wrongly availed or utilised for reasons other than fraud, wilful misstatement or suppression to evade tax. It also says that the proper officer considers the person’s representation before determining tax, interest and penalty. That text may be an older version and cannot, by itself, settle the procedure for a notice issued now.

- One-Handed Loading - Keep one hand free with a 1/4 in. hex chuck that accepts 1 in. bit tips
The same retrieved text contains a 30-day payment route associated with that older section 73 wording. Treat that as a historical statutory reference, not as a universal current deadline or settlement rule. Before choosing payment, verify the current provision, amendments, transitional treatment, tax period and the exact wording of the notice. A notice under a different section or for a different financial year may have different consequences.
Recommended Free Tools
Do not assume that a notice mentioning “wrong ITC” follows the same route as every other ITC notice. Confirm:
- Which section and sub-section the officer has cited.
- Whether the allegation is framed as a non-fraud case or invokes fraud, wilful misstatement or suppression.
- Which financial year and tax period are covered.
- Whether the notice is a demand notice, an intimation, a scrutiny communication or another proceeding.
- Whether the current law has changed the form, limitation, interest, penalty or payment effect for that period.
If the notice appears to rely on an outdated section number, calculation method or form instruction, identify the discrepancy in writing and obtain advice on the current provision before filing.
Reconcile every disputed ITC entry
Your reply is strongest when the disputed amount can be traced from the notice to the invoice, books, return and payment evidence without unexplained differences.
Start with the notice’s calculation
- Copy the notice’s transaction list into a spreadsheet without changing supplier names, invoice numbers or dates.
- Match each line to the purchase ledger and general ledger for the same tax period.
- Match the ledger entry to the tax invoice or debit note and record the taxable value and tax component.
- Compare the entry with the relevant GST return and your ITC reconciliation for that period.
- Record credits already reversed, reclaimed or paid, with the date and accounting or return reference.
- Investigate every difference in supplier GSTIN, invoice number, date, tax amount, period or classification.
The applicable ITC conditions depend on the claim and period. The CBIC ITC rules materials describe statutory conditions, including a payment-to-supplier rule in specified circumstances. Do not treat a single document as conclusive proof of every condition; explain how the complete record addresses the specific ground raised.
Separate factual mismatches from legal disputes
For a factual mismatch, show the corrected or matching record and explain the source of the discrepancy. For a legal objection, identify the relevant statutory condition and apply it to the facts. If the notice alleges that a document is missing, identify the document and its annexure number. If it alleges that the transaction is not genuine, address receipt, commercial purpose, accounting treatment and payment records to the extent those matters are relevant and available.

Do not concede an amount merely because a reconciliation is time-consuming. Conversely, do not deny an amount that your own records cannot support. If part of the credit is indefensible, identify the exact portion and explain any voluntary reversal or payment without calling it an admission unless that is your intended legal position.
Draft the reply in the order the officer needs
Use a clear heading identifying the GSTIN, notice reference, issue date, financial year, tax period and cited section. Then organize the response so every ground can be checked against an annexure.
1. Preliminary statement
State that the reply responds to the identified notice and list the documents considered. If the notice or annexures were incomplete, record what was missing and explain any request for additional time or information. Do not make a broad denial before addressing the factual record.
Do these 3 things before closing this tab:
1Scan for outdated or missing drivers - takes under a minute2Clear out junk files and repair common Windows errors3Fix the driver behind crashes, sound loss and screen glitches2. Ground-by-ground response
Repeat the notice paragraph or ground in a short quotation or paraphrase, followed by:
- The factual position, including the affected supplier, invoice or transaction and period.
- The reconciliation to books, returns and the notice calculation.
- The statutory reason the credit should be allowed, or the precise reason the proposed amount should be reduced.
- Cross-references to numbered annexures and page numbers.
Keep one issue per subsection. If the notice contains ten invoice groups, answer all ten separately rather than placing one conclusion at the end.
3. Amount already reversed or paid
Identify the amount, date, return or payment reference and supporting record. Explain whether the action was a precautionary reversal, correction of an admitted error or another measure. Payment or reversal should not be described as an admission unless that is the legal position you intend to take.

Use FORM GST DRC-06 when the rule applies
Where the applicable rule covers a notice whose summary was uploaded in FORM GST DRC-01, the reply is furnished in FORM GST DRC-06. The official DRC-06 is headed “Reply to the Show Cause Notice.” Its fields include the GSTIN and name, notice reference and issue date, financial year, reply text, a list of uploaded documents, an option for personal hearing and verification by an authorised signatory.
Use the current form and portal labels shown for your proceeding. A historic form image or an old instruction page is not a substitute for the workflow attached to the live notice.
- Open the notice from the GST portal using the registered credentials and select the response action associated with that proceeding.
- Confirm that the displayed notice reference, issue date, financial year and tax period match your control sheet.
- Enter or upload the signed reply in the permitted format, preserving headings and annexure references.
- Upload the indexed evidence set and describe each file in the document list.
- Select the personal-hearing option deliberately; do not leave it to an automatic default.
- Complete verification through the authorised signatory and submit only after checking every attachment.
- Download the acknowledgement, submitted form, payment or reversal references and the complete uploaded set.
If the portal rejects a file, record the error, reduce file size or split the indexed annexures as permitted, and retain screenshots or support-ticket details. Do not replace a required document with an unlabelled collection of screenshots.
Independent reader supportYour contribution helps us test, update, and keep practical guides available for everyone.Assemble an indexed evidence set
There is no single universal attachment checklist for every ITC notice. Include records that answer the grounds actually raised and omit irrelevant material that obscures the reconciliation.
Useful categories of evidence
- Tax invoices and debit notes for the disputed entries.
- Purchase ledger and general-ledger extracts covering the relevant period.
- Return extracts and an ITC reconciliation linking the ledger to the claimed credit.
- Payment records where payment to the supplier is relevant to the allegation or applicable condition.
- Delivery, receipt or other transaction records when the notice questions whether supplies were received.
- Contracts, purchase orders, goods-receipt records and correspondence where they bear on the transaction.
- Records of reversals, reclaims, payments or corrections already made.
Number each annexure and add a contents page. A practical index can contain the annexure number, description, invoice or period covered and page range. Use consistent file names, such as “Annexure 3 – Purchase ledger – April to June 2024,” and cite that name in the body of the reply.

Protect confidential information
Upload only what is relevant and permitted. Redact personal information that is not needed for the allegation, but do not remove invoice, tax, supplier or payment details needed to verify the claim. Keep the unredacted originals securely in case the officer requests inspection.
Decide whether to request a personal hearing
DRC-06 includes a yes/no “Option for personal hearing.” Request a hearing when oral explanation, examination of disputed records or clarification of a complex reconciliation would materially assist the decision. Examples include a large invoice population, multiple periods, disputed data matching, or a calculation that cannot be explained adequately in the upload field.
The checkbox alone does not determine the legal entitlement in every proceeding. Follow the notice and the current statute for hearing rights, and state briefly why a hearing is useful. Prepare a two-page hearing brief listing each ground, amount, annexure and answer. Bring the submitted reply and acknowledgement, but do not introduce a new factual case without giving the officer the supporting records.

- Using a generic denial: It leaves the officer unable to connect the answer to the quantified demand. Mirror the notice’s paragraph and transaction numbering.
- Relying on an old deadline: Section 73 wording and payment consequences can change. Verify the current law for the tax period and service date.
- Submitting only invoices: An invoice may not answer a receipt, payment, return-matching or reconciliation allegation. Attach the records relevant to the stated ground.
- Ignoring arithmetic: Recalculate tax, interest, penalty and totals; identify duplicate invoices or credits already reversed.
- Uploading unindexed files: An officer should not have to guess which file supports which paragraph. Use an annexure index and page references.
- Missing the hearing choice: Decide expressly whether oral explanation would help and select the option in the form.
- Admitting more than intended: Distinguish a factual correction or precautionary reversal from a legal admission.
- Failing to preserve proof: Keep the final reply, acknowledgement, uploaded documents, portal messages and subsequent communications.
Use a decision framework before filing
The response strategy should reflect the notice’s statutory basis, period, evidence and amount at stake.
| Decision factor | Questions to answer | Practical response |
|---|---|---|
| Statutory basis | Which section and sub-section are cited, and do the facts fit that route? | Address the cited provision and verify the current amended text before relying on consequences. |
| Tax period | Which financial year and return periods are included? | Use records and law applicable to those periods; do not import a later rule automatically. |
| Evidence quality | Can each disputed line be traced to books, returns and source records? | Build a line-by-line reconciliation and identify missing documents. |
| Amount at stake | Is the demand material compared with the cost of a detailed review? | Consider qualified professional review for a high-value or technically complex notice. |
| Need for oral explanation | Would a hearing clarify records or calculations better than documents alone? | Use the DRC-06 hearing option and prepare a concise hearing brief. |
When to obtain professional review
Consider an experienced GST practitioner or chartered accountant when the notice covers several years, a substantial amount, allegations involving fraud or suppression, disputed supplier data, limitation issues, or a calculation that cannot be reconstructed from the annexures. Verify the person’s qualifications, written scope, confidentiality arrangements, deliverables, filing authority and fee terms before engagement.
Professional review does not replace your records. Give the adviser the complete notice, service proof, books, returns, reconciliations and prior correspondence. Ask for a written issue list identifying the amount accepted, disputed and unsupported, together with the proposed filing and hearing strategy.
What to preserve after submission
Retain the submitted DRC-06 or applicable response form, acknowledgement number, timestamp, final reply, annexure index, every uploaded file and any portal error record. Keep proof of any payment or reversal separately. Monitor the portal and registered contact details for hearing notices, deficiency communications, orders or requests for additional information.
