How to Report Unsafe Road Construction Zone Conditions

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

For an immediate threat to life, a crash in progress, or an injury, call local emergency services instead of waiting for an online form. For a non-emergency roadway problem, report it to the state or local transportation agency that owns the road or manages the project. If the danger is to construction workers or involves unsafe workplace practices, contact OSHA or the state workplace-safety agency.

Your report is most useful when it identifies the exact location, direction of travel, date and time, specific condition, and the risk it creates. Take photographs only from a safe, lawful place; never enter or approach an active work zone to document a problem.

Choose the reporting route before you submit anything

There is no single nationwide public intake channel for every U.S. road construction project. The right contact depends on three questions: how urgent the danger is, whether the risk affects road users or workers, and who owns or operates the road.

Situation First contact What to provide Important limitation
Immediate threat, crash in progress, serious injury, or life-threatening condition Local emergency services Exact location, direction of travel, immediate danger, injuries, and safe access information Do not wait for an online transportation or OSHA form to be reviewed
Non-emergency danger to drivers, pedestrians, cyclists, or passengers, such as missing signs, confusing lane shifts, or exposed hazards State department of transportation, city or county transportation department, public works agency, or the project contact posted at the site Road name, nearest cross street or mile marker, direction, date and time, and a factual description The responsible agency varies by road owner and jurisdiction
Unsafe work practice or hazard exposing construction workers OSHA or the state workplace-safety agency that covers the site Worksite location, employer or contractor if known, hazard description, dates and times, and whether anyone is in immediate danger Federal OSHA and state-plan procedures are not identical; a complaint does not guarantee an on-site inspection
General work-zone feedback or a question about federal work-zone management FHWA Work Zone Management Team at [email protected] Project or road details and a clear explanation of the concern This is a feedback contact, not an emergency number or a replacement for the road-owning agency

The Federal Highway Administration supports state and local governments with highway design, construction, and maintenance. Its headquarters contact information is not presented as a universal public hazard-reporting service. Start with the agency responsible for the particular road whenever you can identify it.

Step 1: Decide whether the condition is an emergency

Use the emergency route when delay could allow someone to be killed or seriously injured. Examples include a vehicle entering an unprotected excavation, a barrier or sign that has fallen into an active lane, workers or motorists trapped in a collision, live traffic being directed into an immediate hazard, or a condition already causing crashes.

What to do during an immediate danger

  1. Move yourself and passengers to a safe location if you can do so without creating another hazard. Do not stop in a travel lane, shoulder that is being used by traffic, or a closed work area merely to make a call or take a photograph.
  2. Call local emergency services and state that the problem is at a road construction zone. Give the road name, nearest cross street, mile marker or visible landmark, direction of travel, and the lane or approach affected.
  3. Describe what is happening now: for example, an open lane with no visible barrier, a person injured, debris in traffic, or vehicles colliding. Explain whether the danger is moving toward other road users.
  4. Follow the dispatcher’s instructions. Do not attempt to move cones, barriers, equipment, or injured people unless trained responders direct you and it is safe.

OSHA’s complaint guidance says its online form and email are not for emergencies. It directs a fatality or imminent life-threatening situation to immediate telephone contact at 1-800-321-OSHA, also shown as 800-321-6742. For a roadway user facing immediate danger, local emergency services should be the first call; OSHA is the workplace-safety route described below.

Step 2: Identify what kind of hazard you are reporting

Separating a roadway-control problem from a workplace-safety problem helps your report reach the people who can act.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Road-user and traffic-control hazards

Use the road owner or project agency for conditions affecting people traveling through the zone. Relevant examples include missing or obscured warning signs, cones or drums that do not guide traffic as expected, a confusing lane shift, a barrier that leaves an opening, an exposed drop-off, debris, a blocked pedestrian route, or a work-zone layout that appears to place traffic and equipment in conflict.

In a city or county, the responsible organization may be a local public works or transportation department. On a state highway, it is often the state department of transportation. A project sign may identify a contractor, resident engineer, public information officer, or agency contact. That posted contact can be a practical starting point, but it does not replace emergency services when the danger is immediate.

Worker-safety and workplace-practice hazards

Use OSHA or the relevant state workplace-safety regulator when the concern is how workers are being exposed to danger. Examples include workers operating in live traffic without adequate protection, unsafe access or egress, unprotected falls, hazardous equipment practices, or other conditions at the worksite that threaten employee safety or health.

OSHA states that anyone who knows about a workplace safety or health hazard may report unsafe conditions. A worker or representative may file a complaint and request an inspection. USAGov directs workplace-safety reports to OSHA or the agency that regulates the industry and points readers to state labor departments for state workplace matters. If the site is covered by a state plan rather than federal OSHA, the state agency’s process and confidentiality rules may differ.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Step 3: Gather precise, factual information

A useful report allows an agency to find the condition without guessing. Record facts while they are fresh, but do not put yourself in danger to collect them.

Location details

  • Road name and, if known, route number.
  • Nearest cross street, interchange, address, mile marker, or recognizable landmark.
  • Direction of travel, such as northbound, eastbound, or an entrance ramp.
  • Lane, shoulder, sidewalk, path, or ramp affected.
  • Project name, contractor name, work-zone sign, or agency name if posted.

Time and conditions

  • Date and exact or approximate time you observed the problem.
  • Whether it was present continuously or appeared during a particular operation.
  • Weather, darkness, visibility, congestion, or other conditions that made the hazard harder to see, when those facts are relevant.
  • Whether you saw a near miss, collision, blocked route, injury, or other immediate consequence. Report what you personally observed rather than assigning blame.

A clear description

Describe the physical condition and the risk in separate sentences. “At 6:40 p.m. on westbound Route 18, approximately 200 feet east of Pine Street, the right lane shifted left but the advance warning sign was facing away from traffic” is more actionable than “the construction is unsafe.” Add what a driver, pedestrian, cyclist, or worker would encounter and why it could lead to a conflict, confusion, or exposure.

Do not exaggerate, speculate about the contractor’s intentions, or identify a person as responsible unless you have reliable information. Agencies can investigate a factual observation more effectively than a conclusion.

Step 4: Document the condition without entering the work zone

The Federal Highway Administration recommends a written record of deficiencies and says photographs may help document them. A phone photograph can show a missing sign, blocked route, debris, or lane alignment, but only if you can take it safely and lawfully.

  • Remain outside barricades, fencing, excavation limits, equipment paths, and other closed areas.
  • Do not walk along a shoulder or lane that is open to traffic for a better angle.
  • Do not stop suddenly, reverse, use a median crossing, or ask another person to stand in traffic for a picture.
  • If you are driving, wait until you are legally parked in a safe location before writing notes or handling a phone.
  • Keep the original file when possible so its date and time information remain available, but do not rely on an automatically recorded location as your only evidence.

If a photograph cannot be taken safely, a careful written description is better than risking an additional crash or exposing yourself to construction equipment. Tell the agency that no photograph was taken because the location was unsafe to approach.

Step 5: Submit a roadway report to the responsible agency

For a non-emergency road-user concern, contact the organization responsible for the road or project. The exact submission method differs by jurisdiction; it may be a telephone line, online service request, email address, or contact printed on a project sign. The supplied federal guidance does not establish one universal directory or form, so verify the agency for the specific road.

  1. Identify the road owner. Look for the route number, city or county boundary, project sign, or agency logo. If you are unsure, describe the location and ask which department handles that segment.
  2. Use the agency’s public reporting channel or the project contact posted at the site. State that you are reporting a work-zone safety condition, not requesting general construction information.
  3. Provide the location, direction, date and time, hazard description, and any safe photographs.
  4. Explain the immediate consequence you are concerned about, such as traffic being guided toward an excavation or pedestrians being forced into moving vehicles.
  5. Ask for a reference number or the name of the person or unit receiving the report. Note the submission date and time.

When a city street is involved, a city transportation or public works department may be the practical first contact. On a state highway, use the state transportation agency. County roads, toll facilities, bridges, and privately operated roads may have different owners. Do not assume that a federal agency can dispatch a local crew simply because federal standards or funding are involved.

Step 6: Report a worker-safety hazard to OSHA or a state regulator

OSHA accepts reports from anyone who knows about a workplace safety or health hazard. A worker or representative can file a complaint and request an inspection. The listed OSHA contact number is 800-321-6742 (1-800-321-OSHA).

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Information to include in an OSHA complaint

  • The worksite address or the most precise location available, including the road, direction, mile marker, and nearby intersection.
  • The employer, contractor, or project name if known.
  • A specific description of the unsafe practice or exposure.
  • When the hazard occurs, how often you observed it, and whether it is happening now.
  • The number or types of workers exposed, if you can state that safely and accurately.
  • Whether anyone has been injured or faces an imminent life-threatening danger.

OSHA’s process may screen a complaint, handle it off site, or conduct an inspection. Filing does not guarantee that an inspector will visit in person. State-plan agencies can use different forms, timelines, and procedures, so a state workplace-safety complaint may not be handled exactly like a federal OSHA complaint.

Confidentiality and identity requests

OSHA says a worker may ask that their name not be revealed to the employer. Its federal handling guidance describes withholding the complainant’s name in that process. Do not promise complete anonymity for a report made to a transportation department or state agency; those systems can have different public-records and confidentiality policies. If protecting your identity matters, ask the receiving agency how it handles complainant information before submitting details that identify you.

It is not an emergency line, and it should not be used instead of contacting the state or local road agency about an active hazard that agency can correct. FHWA supports state and local highway programs, but the agency responsible for signs, barriers, lane control, maintenance, and field response is usually determined by the road owner and project arrangements.

Follow up when the hazard remains

Keep a copy of what you submitted, the date and time, the method used, the receiving office, and any reference number. If the condition remains, submit a follow-up through the same agency’s process and explain that the earlier report did not resolve the hazard. Include a new observation time and note whether the condition changed, worsened, or caused a near miss.

In project-inspection guidance, FHWA emphasizes documenting deficiencies, agreeing on correction timing, and following up to confirm correction. As a reporter, you may not control the agency’s schedule, but you can make follow-up more useful by referring to the original report and describing the current condition rather than sending an identical unexplained message.

If you cannot identify the right agency

  1. Use the project sign or the road owner’s public contact channel and ask for the office responsible for work-zone safety.
  2. Provide the location in full even if you do not know the agency; the receiving office can often route a request internally.
  3. If the concern is specifically about worker exposure, contact OSHA or the state workplace-safety regulator rather than relying only on a transportation service request.
  4. If the situation becomes immediately dangerous, stop pursuing administrative follow-up and call local emergency services.

Common reporting mistakes and how to avoid them

Using a non-emergency form during an emergency

Online queues and email are not designed for a life-threatening event. Call local emergency services for immediate roadway danger. OSHA specifically says not to use its online complaint form or email for an emergency.

Sending a vague location

“Near downtown” is rarely enough for a field crew. Add the road, direction, nearest cross street or mile marker, lane or path, and the time observed.

Entering a closed area for evidence

A photograph is optional; personal safety is not. Stay outside the active work zone and use a written account when a safe image is impossible.

Sending a worker complaint only to the transportation agency

A transportation department may manage the project, but OSHA or the state workplace-safety agency handles workplace-safety complaints. If workers are the people exposed, use the workplace regulator as well as any appropriate project contact.

Assuming confidentiality is automatic

OSHA describes a process for requesting that a worker’s name not be revealed. Other agencies may have different rules. Ask about identity handling instead of promising anonymity to another reporter.

Expecting every complaint to produce an inspection

OSHA may screen a complaint, respond off site, or inspect; a complaint does not guarantee an on-site inspection. Transportation agencies also set their own response priorities and correction schedules.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

A concise report template

You can adapt the following wording for a transportation agency, project contact, or workplace-safety regulator:

“I am reporting a safety condition at [road and exact location], affecting [direction, lane, sidewalk, or work area]. I observed it on [date] at approximately [time]. The condition is [factual description]. It creates a risk because [specific conflict or exposure]. [State whether anyone was injured, whether crashes or near misses occurred, and whether the condition is still present.] I observed this from [safe location]. My contact details are [details you choose to provide]. Please provide a reference number or direct this report to the office responsible for the site.”

Remove bracketed prompts before sending. Do not include information you cannot verify, and do not claim to have entered the work zone or taken a photograph if you did not.

What a well-routed report accomplishes

The fastest path is determined by the danger, not by the agency that is easiest to find online. Emergency services handle immediate threats. The road-owning state or local agency handles non-emergency traffic-control and roadway conditions. OSHA or a state workplace-safety regulator handles hazards exposing construction workers. FHWA’s Work Zone Management Team can receive general feedback, but it is not a substitute for the responsible field agency.
