Report suspected roadworks damage promptly to the organisation that manages the road or to the project contact, then ask which body handles the property-damage claim. Create a dated record, photograph the damage and its safe-to-photograph surroundings, obtain repair estimates, and keep every reference number and message. The road authority may retain the claim, pass it to a contractor or utility, or identify another responsible organisation during its investigation.
There is no universal deadline, form or automatic right to compensation. The correct route depends on the country, the road manager, the organisation that carried out the work, and whether you are claiming physical repair costs or a reduction in property value. Confirm the current local procedure before submitting.

1. Make the area safe before collecting evidence
Keep people and vehicles away from a dangerous surface, unstable wall, exposed service, open excavation, obstruction or other hazard. If the condition presents an immediate risk, use your local emergency service or road-hazard reporting channel rather than waiting for a property claim process.
Take photographs of the road defect, traffic arrangement or worksite only from a safe, lawful position. Do not enter a live work zone, stand in traffic, cross barriers or put yourself at risk to obtain a better image. A photograph is useful only if obtaining it is safe.

2. Create a dated damage record
Start a written file as soon as you notice the problem. Record:
- the date and approximate time you first saw the damage;
- when the roadworks took place, if you know it;
- the full property address and the nearest road, junction, bridge or project location;
- what is damaged, such as a driveway surface, kerb, wall, fence, gate, drainage channel, paving, landscaping or another structure;
- what you observed about the work, access route, plant, excavation or temporary traffic arrangement;
- the name on any project sign and any contractor, utility or authority contact visible from a safe place; and
- the names, dates and reference numbers for every call, email, online report and visit.
Photograph each affected item from close range and from farther away. Close-ups show cracks, displacement, impact marks, broken edges and other detail; wider views show the relationship to the road, boundary, drainage feature, sign or other identifiable landmark. Keep the original files with their date and time information and make a backup. Do not edit the originals in a way that removes metadata.
3. Work out who manages the road and who performed the work
The organisation responsible for a road is not always the organisation that caused the damage or will investigate it. A local council may manage a local street, while a national or devolved road authority manages a major route. A contractor may have been hired for resurfacing or construction, and a utility company may have excavated the road under a separate permit.
| What you can establish | Likely first contact | What to ask |
|---|---|---|
| Local street, footway or council project | The local road authority or its published roadworks contact | Is this your project, and what is the property-damage claim route? |
| Major or strategic road | The national, devolved or metropolitan road manager for that route | Who is the scheme owner and which claims team handles physical property damage? |
| Utility excavation or service installation | The road authority and the utility or project contact shown on signs or notices | Which organisation is investigating, and can each confirm that in writing? |
| Private access affected by a public project | The project owner or road authority, with the contractor copied where possible | Is the access arrangement part of the works and what evidence is required? |
Use the authority’s current website, project sign, permit notice or telephone service to verify the contact. Do not assume that the company whose vehicles were on site is legally responsible. The investigation may identify a contractor, utility or another organisation, and some authorities forward claims rather than deciding them themselves.

4. Report the underlying problem and obtain a reference
Some procedures require you to report the road or footpath problem before you submit a compensation claim. When you contact the authority or project team, describe the suspected cause without presenting an unproved conclusion. State what you observed, when you noticed the damage, where the work occurred and why the timing or physical relationship makes you believe the two are connected.
- Use the current road-defect, incident or project-contact channel for the location.
- Ask whether a separate incident report is required before a property-damage claim.
- Request the report or incident reference and write it in your records.
- Ask for the correct property-claim form, email address or portal and the name of the organisation that will assess it.
- If another body is mentioned, ask the first contact to identify the transfer and ask the second body to confirm receipt.
For example, Northern Ireland’s published process asks a claimant to report the problem believed to have caused the damage and retain the reference number before pursuing the claim. Gloucestershire County Council gives similar instructions for a road or pavement problem. Read the current instructions at nidirect.gov.uk’s road or street problem claim guidance and Gloucestershire County Council’s claim page if those jurisdictions apply.
5. Assemble a claim that shows damage, cause and loss
A complete submission normally has three parts: what happened, why the roadworks or road condition probably caused it, and the financial loss needed to put the property back into its prior condition. The exact form and required documents vary by authority.
Describe the incident precisely
- Give the property address, exact location and the roadworks project or route.
- Set out the dates in order: when work was visible, when access or conditions changed and when damage was first noticed.
- Describe the physical damage, dimensions where useful, and any change in safety, drainage or use.
- Explain the observed connection to the work while distinguishing observation from assumption.
- List witnesses, photographs, videos, messages, reports and reference numbers.
Document the repair loss
- Obtain a written estimate or quotation describing the proposed work and materials.
- Keep invoices and receipts for completed repairs, temporary protection, inspection or other directly related costs requested by the claims process.
- Photograph the condition before urgent work, if safe, and retain photographs during and after the repair.
- Preserve damaged items or removed materials where practical until the authority has had a reasonable opportunity to inspect them.
Do not discard a broken gate component, displaced paving or other evidence simply because a contractor has offered to look at the site. If an item must be removed for safety, photograph it in place first and store it if practical.

6. Repair urgent damage without destroying evidence
A dangerous defect or failed drainage feature may need immediate work to prevent injury or further property damage. Before repair, photograph the condition and notify the claims contact that urgent action is required. Keep the contractor’s description, dated invoice, measurements and any replaced material that can reasonably be retained.
Some road authorities advise repairing quickly and limiting compensation to the original loss rather than later consequential losses. That is authority-specific, so follow the local instruction and ask whether an inspection can occur first. An urgent repair does not remove the need to prove what the condition was before it changed.
7. Cooperate with inspection, but do not treat it as an admission
The authority, contractor or a loss adjuster may inspect the driveway or property, request additional photographs, measure the damage or ask for access records. Provide reasonable access and answer factual questions consistently with your written record.

8. Understand what you must establish
Submitting a form is not the same as proving a claim. Depending on the jurisdiction and legal route, you may need to show:
- that the roadworks, road condition or authority action was connected to the event;
- that the organisation receiving the claim had responsibility for the relevant road, work or maintenance activity;
- that the event caused the particular physical damage rather than a pre-existing defect or unrelated failure; and
- the reasonable cost of restoring the property, supported by estimates, invoices or receipts.
Local legal tests differ. An authority may investigate whether it knew or should have known about a hazard, whether the work was controlled properly, or whether a contractor had contractual responsibility. Do not state that a body is liable merely because its logo appeared on a vehicle or because the work happened outside your home.
9. Examples of how local procedures differ
These examples illustrate routing differences; they are not a universal deadline or guarantee of compensation.
Do these 3 things before closing this tab:

|---|---|---|
| England and the wider UK | The correct road manager depends on the route. Local roads are generally handled by councils; many major roads in England are handled by the national road authority, while other routes may belong to metropolitan or devolved bodies. | A road-manager locator is not automatically a property-damage claim form. Confirm the route and current claims channel. |
| Northern Ireland | The infrastructure department offers a property-damage process for road or street problems for which it may be responsible. | It asks for clear photographs and repair receipts or estimates, may inspect, and may identify a contractor, utility or other organisation. There is no automatic entitlement; each case is investigated. |
| Queensland | The state transport department includes roadworks on a state-controlled road among possible property-damage circumstances. | Photos and repair receipts are requested, and the claimant must establish causation and loss. The process is limited to infrastructure or works managed by that department. |
| Tasmania | A claim relating to road or bridge maintenance, resurfacing or construction may be referred to the responsible contractor. | Evidence such as a written quote or tax invoice may be requested. |
| Victoria | The transport department has a notice and claim process for certain road-related incidents. | Its responsibility is not automatic for every incident; check whether the event falls within its process. |
| British Columbia | A claim involving damage to a home or land arising from provincial highway construction or maintenance may be forwarded to the responsible contractor. | Confirm the provincial route, project and contractor handling before sending duplicate submissions. |
10. Keep physical damage separate from a property-value claim
A cracked driveway, damaged fence, failed wall or broken drainage feature is a physical-damage claim. A belief that a new, widened or altered road has reduced the market value of your home is a different type of claim, with different eligibility rules and evidence.

In the UK, Part I compensation guidance concerns the effect of a road on property value and directs the claim to the authority responsible for the road. Do not use that process as a substitute for a repair-cost claim. Ask the relevant authority which procedure applies to your loss and whether the claim is for physical reinstatement, value impact or both.
11. Common mistakes that weaken a claim
- Waiting until repairs are complete to report the damage: the original condition may be impossible to inspect.
- Photographing only a close-up: without a wider location view, an investigator may not be able to connect the damage with the worksite.
- Entering a dangerous work area: an unsafe photograph is not worth an injury or a trespass issue.
- Assuming the visible contractor is the decision-maker: the road authority, utility, project owner and contractor can have different roles.
- Submitting estimates without a causal explanation: a price alone does not show why the damage occurred.
- Throwing away damaged material: preserve it where practical or document its condition before disposal.
- Starting with a property-value form: value-impact compensation is not the same as physical repair compensation.
- Claiming more than the evidence supports: distinguish observed facts, likely connections and costs that are still estimates.
12. A practical submission checklist
- Make the location safe and report any immediate hazard through the local emergency or road-hazard channel.
- Record when the damage was noticed and when the roadworks occurred, if known.
- Photograph every damaged item close up and from a safe wider viewpoint.
- Note the exact address, road, project sign, contractor or utility details visible from a lawful position.
- Identify the road manager and ask who commissioned and performed the work.
- File the underlying road or incident report if the local process requires it.
- Save the incident reference and ask for the property-claim route.
- Collect written estimates, invoices, receipts, witness details and correspondence.
- Notify the claims contact before urgent repairs and preserve before-and-after evidence.
- Submit through the current official channel and keep a complete copy.
- Attend any inspection, answer requests promptly and record what was discussed.
- Check the local acknowledgement, information and appeal instructions if the claim is rejected or passed to another organisation.
13. If the claim is rejected or redirected
Read the written reason rather than assuming that a referral is a final refusal. A referral may mean that the authority believes a contractor, utility or another road manager must investigate. Ask for the correct contact, the transfer date and any new reference.
If the decision says causation or loss was not established, compare it with your photographs, chronology, repair description and invoices. Supply factual clarification that addresses the stated gap. If the authority provides a review, complaint or appeal route, use the current instructions and observe any stated time limit. Where the financial loss is significant or the facts are disputed, obtain advice from a qualified adviser familiar with the law of the location; do not assume that a procedure from another country applies.

14. Verify the process for the exact location
Government and contractor procedures can change. Before sending a claim, confirm the current contact details, form, notification requirements, evidence list and any deadline for the country, road name and project involved. Ask specifically whether the route handles physical property damage, whether an incident report must precede the claim, and whether the authority or contractor will inspect before repair.
