Photograph the damage, record when and where it appeared, identify the contractor or authority, check your local notice deadline immediately, and keep a complete copy of your claim. A report starts an investigation; it does not by itself prove liability or guarantee repairs or payment.
1. Make the area safe before documenting it
If the damage creates an immediate danger—such as a trip edge, unstable wall, exposed utility, blocked access, or unsafe road surface—contact the authority responsible for the road or public space and follow any emergency instructions. Keep people and vehicles away from the hazard. Do not put yourself at risk to obtain photographs.

Where it is safe, document the condition before cleaning, resurfacing, moving materials, or making permanent repairs. Temporary steps needed to prevent further harm should be recorded and supported by receipts.

1Scan for outdated or missing drivers - takes under a minute2Clear out junk files and repair common Windows errors3Fix the driver behind crashes, sound loss and screen glitches2. Build an evidence record that an investigator can use
Take dated, contextual photographs and video
Photograph the entire frontage or work area first, then take close-ups of every crack, lifted section, crater, broken edge, stain, rut, or other change. Include a ruler, tape measure, familiar object, or fixed landmark for scale. Capture nearby construction access points, equipment tracks, barriers, signs, permit notices, and any condition that helps explain how the damage may have occurred. A short video can show unevenness, movement, water flow, or the route vehicles used.

Keep the original files, including their creation dates and metadata, rather than relying only on edited or compressed copies. Make a backup in a separate location. The official guidance from Randwick Council supports photographs or video, and Calgary asks for photographs together with incident details and witness information.
Write a contemporaneous incident note
Record:
- The full property address and the exact location of each damaged area.
- When you first noticed the condition and, if known, when it was last intact.
- What construction was underway, including the project address, equipment, deliveries, excavation, demolition, utility work, or traffic changes.
- The names, logos, phone numbers, vehicle plates, permit numbers, or site-board details visible at the project.
- Weather, unusual vibration, heavy vehicle movement, or other relevant circumstances.
- The names and contact details of anyone who saw the work or the condition before and after it appeared.
Describe observations rather than conclusions. Write “a 1.5-metre crack was visible across the driveway on 18 October, while concrete trucks were entering the adjoining site,” rather than stating that the contractor definitely caused it. An investigator can assess causation; an accurate timeline protects your credibility.
Preserve financial and technical records
Keep contractor estimates, invoices, receipts for temporary protection, repair quotations, inspection reports, plans, correspondence, and a simple sketch showing measurements and locations. Number the photographs and refer to those numbers in your note. Do not discard damaged materials until the organisation handling the claim confirms that inspection is unnecessary.

3. Decide who should receive the report
Two questions determine the starting point: who controlled the work location, and who owns or manages the damaged asset?
Private contractor or developer
If a builder, excavation company, developer, or subcontractor controlled the site, send a written notice to that business using its registered or project contact details. Include the project address and identify the company that actually operated equipment, if different from the developer. Ask for the business’s claims contact and insurer details, but do not delay your notice while waiting for a verbal response.

Utility company
Utility construction may be performed by a utility itself or by a contractor. Use project signs, utility notices, permit records, and vehicle markings to identify the responsible organisation. New York City guidance for sidewalk damage caused by a utility or contractor directs owners to contact the company responsible for repair and to search Department of Transportation permits for work at the address or nearby area. That guidance concerns New York City sidewalks; use your own authority’s permit system and asset rules elsewhere.
Municipality or road authority
Send a claim through the municipality’s official claims channel when the city, county, road authority, or another public body owned the work or the damaged road, sidewalk, verge, or crossover. A driveway apron or crossover may be public infrastructure even though it serves a private property. Ask which body manages that specific section.

Ottawa explains that it may determine a contractor controlled the location and direct the claimant to that contractor, sometimes providing contact details. Parramatta guidance similarly says damage caused by a contractor, utility provider, or other organisation should be referred to that organisation where the council does not manage the third-party asset.
City vehicle or public-works incident
Use the government claims process if a city vehicle or public-works operation may have struck the property. Calgary’s instructions for City vehicle damage ask for the date, time, location, photographs, witness information, and identifying details for the vehicle where available. Its process is specific to City vehicle claims, so do not assume that form covers contractor work or ordinary road-condition damage.
4. Separate a hazard report from a compensation claim
A phone call, online service request, or hazard report may help an authority make a dangerous area safe, but it may not be formal notice of a claim. If you want repair costs or other compensation, submit the separate written claim required by the asset owner or authority. Nanaimo expressly states that a telephone call or visit to City Hall alone does not constitute written notice under its cited claims process.

In your covering message, state whether you are reporting an urgent hazard, requesting an inspection, seeking repair, making a compensation claim, or doing more than one of these. Ask the recipient to confirm the correct process if the categories are unclear. Keep the service-request number and the formal claim number as separate records.
5. Submit a complete written notice
Use the official form or written claims address published by the organisation responsible for the work or asset. If no form is available, send a dated letter or email and request written confirmation of receipt. Your notice should contain:
- Your full name, postal address, telephone number, and email address.
- The property address and the precise damaged location.
- The date and time of the incident, or the date range when the damage may have occurred.
- A factual description of the condition and the work taking place nearby.
- The project owner, contractor, utility, municipality, vehicle, or crew details you know.
- Witness names and contact information.
- A list of attached photographs, videos, diagrams, estimates, invoices, and receipts.
- The action requested, such as an inspection, temporary safety work, repair, or reimbursement of documented costs.
State that the damage is being reported based on your observations and that you will provide further information if requested. Do not sign a release, accept a settlement, or authorise permanent work on the other party’s behalf before understanding what rights the document affects.
Retain proof of delivery
Save the completed form, every attachment, the sent email or upload confirmation, postal tracking, and all replies. Record the name and job title of each contact and the date of every conversation. Ask for a claim or reference number and use it in later correspondence. If an adjuster is assigned, send additional documents through the method the adjuster specifies and keep copies.
Toronto’s claim guidance asks for claimant identity, incident date and location, and available event and contractor details. It says photographs, receipts, and estimates can be retained for submission after an adjuster is assigned. Follow the receiving organisation’s instructions rather than assuming that every attachment must accompany the first notice.

6. Check the deadline before doing anything else
Notice periods are jurisdiction- and claim-specific. Do not use another city’s deadline as a general rule. Contact the responsible authority, check its current claims page, and obtain professional legal advice promptly if the deadline is close or has passed.
| Location and source | Published guidance | How to use the example |
|---|---|---|
| Toronto | Claims involving City road or sidewalk conditions have a stated 10-day notice period. | This period applies to the described Toronto claim category; it is not a universal construction-damage deadline. |
| Nanaimo, British Columbia | Written notice is stated as due within two months under section 736 of British Columbia’s Local Government Act. | This is specific to the Nanaimo and British Columbia context described by the city; verify the current law and claim type. |
These examples show why an early written notice is safer than waiting for a repair estimate or a contractor’s promise to investigate. If you are uncertain which body must receive notice, send the notice to every plausibly responsible organisation while asking each to identify the correct channel, and retain proof of each delivery. Local law may impose different rules for public bodies, private parties, latent damage, insurance claims, or court proceedings.

Ask before permanent repair
Tell the claims contact before resurfacing, replacing concrete, rebuilding a wall, or removing a damaged footing. Ask whether an inspector must attend, whether the authority needs specific measurements or a professional report, and whether temporary protection is authorised. Keep photographs of any emergency work and retain all invoices.
Escalate possible structural damage
Cracking, lifting, or cratering of a driveway or pathway can be consequential damage associated with building work. The Queensland Building and Construction Commission defines consequential damage as “damage to a residential property at a building site or next to a building site caused by, or because of, carrying out building work at the building site, regardless of any intention, negligence or recklessness of the person carrying out the work.” Its examples include “the cracking, lifting or cratering of a driveway or pathway on the property.”
If a retaining wall, footing, slab, foundation, building wall, or other structural element appears affected, stop work in the unsafe area and ask the relevant authority whether it requires a professional report before repairs. Randwick Council specifically advises contacting Council first to determine whether a professional report is required for structural damage to buildings, walls, or footings. Do not commission an expensive report solely because another party suggested it; first ask what qualifications, scope, and format the claims process accepts.

8. What happens after you file
Investigation and responsibility assessment
The recipient may request more photographs, inspect the site, compare project records, interview witnesses, or refer the matter to a contractor or insurer. Ottawa says it assesses legal responsibility and may approve a claim where the evidence shows the City is responsible. It also explains that a contractor controlling the location may need to handle the claim.
Cooperate with reasonable information requests while keeping your own timeline and copies. A request for more evidence is not an admission that the organisation accepts responsibility.
Possible outcomes
- The responsible organisation arranges an inspection or repair.
- The contractor or utility accepts responsibility and negotiates a repair or reimbursement.
- The authority refers you to a contractor, insurer, or another asset owner.
- The claim is denied because responsibility, causation, notice, or the amount of loss is disputed.
- The organisation asks for additional evidence or a professional assessment before deciding.
Calgary’s official claims page states plainly: “Making a claim does not guarantee payment.” Filing is a request for investigation, not proof that the other party must pay.
9. Use the right route for common scenarios
Damage appeared during neighbouring building work
- Photograph the property and the construction access route.
- Record the project name, contractor, site manager, and permit information from signs or public records.
- Send written notice to the contractor or developer and to the authority that controls the affected road, sidewalk, or crossover.
- Ask whether the authority requires an inspection before repairs and whether a public-asset claim form is separate from a private-property claim.
A utility excavation damaged the driveway edge
- Photograph the excavation, reinstatement material, utility markings, and the transition between old and new surfaces.
- Identify the utility and the excavation contractor from notices, permits, or crew information.
- Request repair from the responsible company in writing and submit any required public-road or sidewalk notice separately.
- Keep invoices for temporary access or safety measures and do not permanently rebuild before the utility or authority confirms its inspection requirements.
A public vehicle or crew struck the property
- Record the date, time, location, vehicle number, plate, agency markings, and witness details.
- Photograph vehicle contact points and the property damage if safe.
- Use the public body’s vehicle-incident or claims form, not only a general service request.
- Retain delivery confirmation and all repair estimates.
10. Troubleshoot common reporting failures
“The contractor only wants to discuss it by phone.”
Have the conversation, but send a same-day email confirming what was discussed, the observed condition, and the date you first reported it. Ask for a written claims contact. A call may not satisfy a statutory written-notice rule.
“I do not know who caused the damage.”
Report the condition to the property or road authority and describe every nearby project. Search permits, inspect site boards, ask adjacent owners when the work began, and provide vehicle or crew details. The authority can often identify the permit holder or contractor even when you cannot.
“The damage was repaired before I could photograph it.”
Preserve any photographs taken earlier, messages, witness statements, dated measurements, invoices, and records showing who performed the repair and why. Explain the sequence honestly and identify which evidence is unavailable.
“The claim was rejected.”
Request the decision and reasons in writing. Check whether the rejection concerns the wrong recipient, late notice, insufficient evidence, causation, asset ownership, or repair valuation. Ask whether there is an internal review, insurer contact, or appeal route. Do not let an internal review request distract you from any court or statutory deadline that may continue running.
11. A practical submission checklist
- Area made safe and urgent hazards reported.
- Wide and close photographs or video captured before permanent repair.
- Original files backed up and photographs labelled by location.
- Address, exact damage location, discovery date, and construction timeline recorded.
- Contractor, utility, permit, vehicle, or public-authority details collected.
- Witness names and contact information recorded.
- Quotes, invoices, receipts, diagrams, and reports preserved.
- Asset owner and work-site controller identified as far as possible.
- Formal written claim submitted through the stated channel.
- Deadline checked for the specific jurisdiction and claim category.
- Delivery proof, claim number, and correspondence log retained.
- Inspection and professional-report requirements confirmed before permanent repair.
12. The decision framework in one sentence
Document first, identify the work controller and asset owner, submit a written notice through the correct claims process, verify the local deadline, preserve the site for inspection, and treat any payment or repair as contingent on the organisation’s investigation and legal responsibility assessment.
