If the damage is an immediate hazard, use your local emergency or hazard-reporting channel before making a routine service request. Photograph the condition, record the exact location and date, identify the project, and keep every estimate, invoice, receipt, and message. A city service request asks for inspection or correction; it does not automatically reimburse private repair costs.
Start with safety and evidence
Make an immediate hazard safe
If a broken curb, driveway apron, sidewalk edge, or mailbox creates an immediate danger to pedestrians, cyclists, vehicles, or mail delivery, keep people away from it and use the local emergency or hazard-reporting channel. Do not enter a work zone or move heavy concrete while a crew is operating. A routine 311 request is appropriate for a non-emergency condition; it is not a substitute for an emergency response.

Photograph before cleanup or repair
When it is safe, take wide photographs showing the street, address, project area, and relationship to the damage, then take close photographs of cracks, broken sections, tire marks, debris, or displaced parts. Keep the original files so their dates and metadata remain available. Record:
Do these 3 things before closing this tab:
1Scan for outdated or missing drivers - takes under a minute2Clear out junk files and repair common Windows errors3Fix the driver behind crashes, sound loss and screen glitches- the exact street address or nearest address and which side of the street is affected;
- the date you noticed the damage and, if known, when construction occurred;
- the project sign, permit number, utility name, contractor name, phone number, vehicle or license identifier, and any witness contact details;
- what was present before the work, if you have earlier photographs, inspection records, or messages; and
- every report number, email, text, estimate, invoice, and receipt created afterward.
These details are practical evidence, not a universal list of items every agency requires. Do not delay an urgent safety response merely to collect perfect documentation.

Determine what was damaged and who controls it
The same-looking strip of concrete can be governed by different rules. Before assuming that the city, contractor, or homeowner must repair it, ask the local public works or transportation department who owns or maintains the specific feature and whether it lies in the public right-of-way.
| Feature or situation | Control question | Why the answer changes your report |
|---|---|---|
| Curb along a public street | Is it part of the roadway under local rules? | A transportation or public-works agency may inspect and repair it, while a separate claim may address who caused the damage. |
| Driveway apron (the section crossing the sidewalk or verge) | Is the apron in the public right-of-way, and which agency inspects it? | Some cities accept dedicated apron inspection requests; ownership and repair funding can vary by cause and location. |
| Sidewalk beside the property | Does local law place maintenance on the adjacent owner? | The owner may face a sidewalk violation or repair duty even when another party caused the break, so report the condition and document the construction cause. |
| Driveway on private land | Is the damaged pavement entirely inside the parcel? | The property owner generally needs the contractor or project owner to inspect and address a private-property loss; the city may have no repair program for it. |
| Curbside mailbox | Who installed and maintains it, and was the event accidental or vandalism? | Accidental construction damage belongs with the project contractor or owner; vandalism is a police and postal-service matter. |
New York City illustrates why geography matters. NYC311 states, “Curbs are considered a part of the roadway and are owned by the City.” That statement applies to New York City, not to every jurisdiction. The same NYC guidance explains that adjacent sidewalk maintenance is generally the property owner’s responsibility, and an owner can remain liable for sidewalk violations even when someone else caused the damage. Check your own city and state rules before relying on the New York example.
Report damage in the public right-of-way
Use the agency’s specific category
Look for your city’s 311 or public-works portal and choose the category that matches the feature and cause: street damage caused by street work, curb damage, driveway-apron inspection, sidewalk damage, or a similar label. Include the exact address, photographs, project identification, and a concise description. Ask for the service-request number and save the confirmation.
Do not assume that one general complaint covers every issue. NYC311 lists separate routes for street damage caused by street work and for curb or driveway complaints in its Report Problems directory. Its Curb or Driveway Complaint guidance says a curb report requires the exact street address and that the Department of Transportation inspects the reported curb or sidewalk condition.
Describe the condition, not just the suspected fault
State what a field inspector can verify: “A 1.5-metre section of curb is broken beside the construction entrance at [address]; fragments are in the travel lane,” rather than only “the contractor damaged it.” Explain whether vehicles, pedestrians, drainage, or mail delivery are obstructed. You can identify the suspected project separately and attach photographs.

Ask what the agency will and will not do
Confirm whether the request is for inspection, temporary hazard control, or permanent repair; whether the agency will contact the contractor; and whether a separate property-damage claim is required. A service request may close after an inspection even if your private repair costs remain unresolved.
Notify the construction company, utility, or project owner in writing
Send a dated email or letter to the contractor’s site contact, the project owner, or the utility whose work is taking place. Include:
Recommended Free Tools
- the property address and the exact damaged feature;
- when you noticed the condition and what construction activity was occurring;
- clear photographs and any service-request number;
- a request for an on-site inspection, a written repair plan, and the correct claims contact; and
- a statement that you are preserving estimates and receipts while responsibility is evaluated.
Keep the sent message, attachments, delivery confirmation, and every response. Avoid signing a release, accepting a cash settlement, or authorizing permanent work that could destroy evidence until you understand what the agreement covers. If temporary work is necessary for safety, document it first and retain the invoice.
Find the responsible contractor when the project is unidentified
Look for a construction notice, permit board, utility marking, traffic-control sign, or crew vehicle. If the name is missing or illegible, ask the city for active permit or project information. In its NYC Sidewalks: A Property Owner’s Guide, the New York City Department of Transportation says a resident can call 311 and request the status of active street or sidewalk construction permits to learn which company is doing the work.
Outside New York City, the equivalent may be a public-works permit desk, transportation department, utility-construction office, or open-records request. Ask for the permit or project number, permit holder, sponsoring agency, and contractor of record. If the agency cannot disclose a private contractor’s details, ask it to forward your notice or explain the correct claims channel.

Separate a service complaint from a reimbursement claim
These processes have different purposes and can proceed at the same time.
| What you are seeking | Where to start | What to provide | What to expect |
|---|---|---|---|
| Inspection or correction of a dangerous public condition | Local 311, public works, or transportation department | Exact location, condition, hazard description, photos, and project details | An inspection, work order, referral, or explanation of agency responsibility |
| Repair by the party performing the work | Contractor, utility, or project owner in writing | Address, date, photographs, description, and requested inspection | A site visit, repair proposal, insurer or claims contact, or a denial that you can evaluate |
| Repayment for private repair costs | The responsible contractor or utility, or the city’s claims office when a city worker or city contractor is involved | Proof of cause, dated photographs, estimates, invoices, receipts, and communications | A claim review under local procedures; payment is not guaranteed |
There is no nationwide form, deadline, or reimbursement guarantee established for construction damage. Filing deadlines, notice rules, required repairs before filing, and limits on recoverable costs depend on the jurisdiction, contract, insurance, and facts. Ask the agency or claims contact for the applicable deadline in writing and calendar it.
Preserve repair costs and avoid losing leverage
Get estimates before authorizing non-emergency work
For a driveway, curb, apron, or mailbox, obtain an itemized estimate describing demolition, disposal, materials, labor, permits, drainage or grading work, and restoration. If the defect is unsafe, take the photographs first and make only the work needed to protect people and property. Ask whether the responsible party wants to inspect before repairs begin.
Keep a complete cost file
- original and updated photographs;
- contractor estimates and written scopes of work;
- paid invoices, receipts, cancelled checks, and proof of insurance payments;
- temporary protection or emergency-service costs; and
- copies of permits, service requests, correspondence, and inspection results.
NYC311’s Broken Sidewalk guidance advises documenting the damage and its source, retaining repair receipts, and seeking repayment from the utility or private contractor when that party caused the damage. When a City worker or contractor caused the condition, NYC guidance points to a City claim route. Those are New York procedures, not a promise that every city will reimburse the same expenses.
Handle a construction-damaged mailbox as a separate case
Classify the event correctly
If a truck, excavator, paving crew, or other construction activity accidentally struck the mailbox, photograph the damage and contact the project contractor or owner. Ask the local government or project owner which claims route applies. Do not describe accidental construction damage as vandalism simply because the box is broken.

The United States Postal Service page How to Report Mail/Package Theft or Personal Mailbox Vandalism addresses personal mailbox vandalism: it directs people to notify local police, place mail on hold if needed until repair or replacement, and contact the local Post Office for assistance. That guidance does not establish a reimbursement procedure for accidental damage by a construction contractor.
Protect mail service while responsibility is decided
If the box cannot securely receive mail, ask the local Post Office about a temporary hold or another delivery arrangement, and tell the project contact that delivery is interrupted. Keep records of any temporary measure and its cost. Do not buy a replacement before asking whether the contractor or agency will repair or reimburse it, unless an urgent delivery or safety need requires immediate action.
Check USPS standards before replacing a curbside box
USPS Postal Explorer’s 508 Recipient Services describes approved curbside mailbox categories. It says custom-built boxes require local postmaster approval and generally must meet standards for the flag, size, strength, and construction quality. Confirm the current requirements and local placement rules before installation. A product purchase is relevant only if repair is not being handled by the responsible party and replacement is actually necessary.

New York City
For a curb or driveway complaint, use NYC311 and provide the exact street address; the Department of Transportation inspects the reported condition. NYC’s curb guidance says a missing or damaged curb may be repaired or replaced by the City at no cost to the property owner. Sidewalk obligations differ: the adjacent owner may be responsible for maintenance and violations, even where construction caused the break.

Atlanta
Atlanta’s ATL311 accepts certain requests for inspection of right-of-way sidewalks, curbs, and driveway aprons through its Concrete (Sidewalk, Curb, Driveway Apron) Inspection page. The page says the Department of Transportation inspects damage caused by tree roots or damage that creates imminent danger to the traveling public, and that inspection funding differs by cause and location. This is an example of local variation, not a general construction-damage claims rule. Ask ATL311 whether your construction-related condition fits its current inspection criteria and how a private-cost claim must be filed.
Use this reporting sequence
- Stabilize the hazard. Keep people and vehicles away, and use the emergency or hazard channel if there is imminent danger.
- Document the scene. Photograph wide and close views, record the address and date, and identify signs, permits, vehicles, witnesses, and the affected feature.
- Confirm control. Ask public works or transportation whether the curb, apron, sidewalk, driveway, or mailbox is public, private, or maintained under a special rule.
- File the correct service request. Use the local 311 or agency category for street-work damage, curb, driveway apron, sidewalk, or another precise condition; save the report number.
- Notify the project party. Send the contractor, utility, or owner a written notice with photographs and a request for inspection, repair plan, and claims contact.
- Identify an unknown contractor. Request active permit or project information from the city or transportation agency.
- Obtain and preserve costs. Get itemized estimates, ask whether inspection must precede repair, and retain all invoices and receipts.
- Open the right claim. Submit a reimbursement claim to the responsible contractor or utility, or to the city’s claims office when local guidance directs you there. Ask for deadlines and required forms.
- Maintain mail service. For a damaged mailbox, contact the project party, ask the Post Office about a hold if necessary, and verify USPS and local installation standards before replacing it.
Common failure points and how to correct them
You report only to 311
A service request can produce an inspection without compensating you for private repairs. Keep the 311 number, then separately notify the suspected contractor, utility, or project owner and ask for its claims procedure.
You report only to the contractor
A private company cannot close a public hazard report or determine every right-of-way obligation. Notify the local agency when the curb, apron, sidewalk, roadway, or traffic area is affected.
You assume the nearest concrete belongs to the homeowner
Ownership may change at the curb line, sidewalk, driveway apron, or parcel boundary. Ask the controlling agency before paying for work or accepting a denial based on an incorrect assumption.
You repair before documenting or allowing inspection
Emergency safety work may be necessary, but unrecorded repairs can make causation and reasonable cost harder to prove. Photograph first, notify the responsible party, and preserve removed materials or invoices when practical.
You call mailbox damage vandalism
USPS vandalism instructions are aimed at intentional acts. An accidental strike by construction equipment should be documented and pursued with the project contractor or owner, while the Post Office is contacted for temporary delivery assistance if needed.
You buy a replacement box without checking approval
Verify USPS curbside standards and local postmaster approval requirements, particularly for custom-built boxes. Also ask whether the party responsible for the damage will supply or approve the replacement.
