How to Report Construction Contractor Fraud and Recover Your Money

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

If a contractor took your money and did not perform, stop further payments, preserve every record, send a factual written demand, report the conduct to the appropriate regulators, and use a recovery route that fits your state and loss. A complaint can trigger an investigation or discipline, but it is not automatically a money judgment. Recovery usually requires negotiation, a bond claim, a court case, or a state recovery fund.

What counts as contractor fraud?

Construction disputes range from ordinary breach of contract to intentional deception. A missed deadline, defective work, or abandoned project may support a contract claim even when fraud cannot be proved. Fraud generally requires evidence that the contractor knowingly misrepresented a material fact or accepted money through deceptive conduct; the legal test and available remedies vary by state. Describe what happened factually and let the regulator, court, or attorney apply the legal standard.

Examples that warrant prompt review include taking a deposit and never starting, using a false license number, misrepresenting insurance or permits, billing for work not performed, fabricating inspection results, repeatedly demanding payment for the same work, or abandoning a project after collecting substantial funds. Do not accuse someone of a crime in public posts when the facts are disputed. Preserve evidence and use formal reporting channels.

Take these steps before reporting anyone

Stop additional loss

  • Pause further payments until the contract, completed work, and required inspections are reconciled.
  • Do not sign a new change order, waiver, release, or settlement without understanding whether it gives up claims.
  • Secure the property and prevent avoidable damage, but photograph conditions before emergency work changes the evidence.
  • If a payment is scheduled automatically, cancel the authorization and keep confirmation of the cancellation.

Preserve the complete record

Save the signed contract, estimates, specifications, change orders, invoices, payment confirmations, canceled checks, card or bank records, texts, emails, voicemail files, photographs, videos, permit records, inspection results, advertisements, and witness names. Keep the original files with their dates and make a working copy for submissions. Do not delete messages, edit photographs, or alter documents. The Federal Trade Commission recommends following phone conversations with a letter sent by certified mail and retaining notes and copies.

Create a chronology while events are fresh. Record the contract date, promised start date, each payment, scheduled milestones, missed visits, explanations given, discovery of defects, inspection dates, and every demand for performance or refund. Write down who was present and what each person personally observed. Separate facts you witnessed from statements you heard from others.

Send a written demand that creates a clear record

Before filing a complaint, the FTC advises consumers to “First try to resolve it with the contractor.” A concise demand can produce a refund or cure and gives an agency or court a dated account of what you requested.

State the contract date and project address, the work promised, the amount and dates paid, the specific work that was not performed or is defective, and the remedy you want. Request either completion according to the contract or a stated refund, and provide a reasonable deadline. Attach copies, not irreplaceable originals, of the relevant contract pages, payment proof, photographs, and inspection reports. Explain how you calculated the amount needed to repair or complete the work.

Send the demand by a trackable method; certified mail provides the delivery record the FTC recommends for following telephone conversations. Keep the signed receipt, the letter, all attachments, and any response. If the contractor proposes a settlement, put the terms in writing, identify payment dates, and do not sign a release until the promised funds clear.

Where to report a contractor

Federal Trade Commission

File a consumer complaint with the FTC when the conduct involves deceptive advertising, payment practices, impersonation, or a broader pattern of consumer harm. Include a factual chronology and identify the contractor’s business names and known aliases. The FTC uses complaints for enforcement and intelligence; it does not act as your private lawyer or guarantee an individual refund.

State or local consumer-protection office

Your state attorney general’s consumer-protection division, a local consumer-affairs office, or another designated state agency may accept complaints, facilitate mediation, publish warnings, or refer matters for enforcement. Procedures and authority differ. Follow that office’s instructions on electronic forms, document size, privacy, and whether the contractor receives a copy.

Contractor licensing board or registrar

Report the contractor to the agency that licenses or registers the trade, even if you are unsure whether a license was required. Provide the license number if known and explain if the person advertised, contracted, or performed regulated work without one. Arizona’s attorney general directs scam victims to report to both the FTC and the Registrar of Contractors.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

A licensing complaint can support a warning, citation, administrative discipline, or referral for prosecution. It is not a substitute for a claim seeking your money. Ask the agency what relief it can legally order before assuming a complaint will produce repayment.

Reporting route Primary purpose What it may do What it normally does not guarantee
FTC Federal consumer-protection enforcement and pattern detection Collect a complaint, investigate broader deception, or refer enforcement An individual refund or a private judgment
State or local consumer office Consumer complaints, mediation, and state enforcement Request a response, mediate, warn, or refer the matter Payment of your repair or completion costs
Licensing board or registrar License compliance and professional discipline Investigate, cite, suspend, revoke, or refer a license matter Full restitution, especially where the agency lacks civil collection authority

Understand what a licensing investigation can and cannot do

California’s Contractors State License Board (CSLB) states: “While CSLB makes every attempt to get restitution for consumers financially harmed by a licensed contractor, we cannot guarantee that you will get any money back.” That qualification applies broadly to the practical distinction between regulation and collection: an agency may discipline a contractor without obtaining the funds needed to finish your project.

For an unlicensed contractor, CSLB states that it has limited jurisdiction and “cannot require an unlicensed person to make repairs to your project or pay restitution.” Other states may have different powers, but you should verify them rather than assume a board can order compensation. Ask whether the agency can compel a refund, whether it can accept a bond claim, and whether filing affects a separate court deadline.

Remedy Can it produce money? Typical speed and cost Dollar ceiling or eligibility Evidence and legal help
Mediation Yes, if both sides agree to a settlement Often less expensive and faster than court; local program rules vary Not stated; depends on agreement and program Contract, payment proof, chronology, and repair estimates; an attorney is optional but useful for complex releases
Small-claims case Yes, through a court judgment Lower filing cost and simpler procedure than a full civil action, subject to court schedules State-specific maximum; verify with the court Written contract, payment records, photographs, inspection evidence, and witness testimony; attorney rules differ by state
Civil lawsuit Yes, potentially including contract damages and other relief allowed by state law Usually slower and more expensive; discovery and expert evidence may be required Not stated; governed by damages proven and procedural rules Detailed project file and proof of causation and loss; prompt advice from a construction or consumer-law attorney is advisable for large or disputed claims
Contractor license-bond claim Yes, up to the bond’s applicable terms and limits Administrative procedure; timing and paperwork vary Bond amount, claim deadline, and covered conduct are state-specific License information, contract, payment proof, and proof of qualifying damage; follow the licensing agency or surety’s instructions
State recovery fund Yes, if statutory conditions are met and funds are available Usually a last-resort administrative process State-specific limits and eligibility Proof of a final judgment or exhausted collection sources may be required; Florida describes its homeowners’ construction recovery fund as a last resort after other payment sources are exhausted

Mediation

Mediation is useful when the contractor is reachable and both sides might accept a documented resolution. Bring the contract, payment ledger, chronology, photographs, inspection findings, and an itemized completion or repair estimate. Any agreement should specify the amount, due dates, method of payment, work to be performed, access arrangements, and when (if ever) claims are released. Mediation cannot force a party to participate or pay unless a binding agreement results.

Small claims

Small claims can be practical for a deposit or repair bill within your state’s limit. Confirm the correct defendant’s legal name, registered address, filing fee, service method, hearing location, and limitation period with the court. Organize exhibits in date order and bring originals or properly authenticated copies. A judgment is not the same as immediate payment; collection may require additional procedures if the contractor does not voluntarily satisfy it.

Civil litigation

A larger loss, complicated defects, multiple parties, or a disputed lien may require a regular civil action. A lawyer can assess contract language, expert evidence, damages, insurance, corporate ownership, and whether to name the contractor, company, or other responsible parties. Do not delay while negotiating if a limitation period, bond deadline, or lien issue may expire.

Bond claims

Many licensing systems require a contractor bond, but a bond is not an unlimited insurance policy. Eligibility, notice, filing forms, covered losses, and claim limits vary by state and by the bond in effect when the work occurred. Obtain the contractor’s exact legal name and license number, identify the surety if available, and follow the regulator’s deadline and service rules.

Recovery funds

Some states maintain a recovery fund for qualifying homeowners harmed by licensed contractors. These programs commonly require that other collection sources be exhausted and may require a court judgment, proof of an unsatisfied judgment, or evidence that the contractor is unavailable. Check residency, project type, licensing status, filing deadline, maximum award, and documentation requirements before relying on the fund.

Handle liens, bankruptcy, and large losses urgently

A contractor’s unpaid subcontractors or suppliers may create lien exposure even when you paid the general contractor. Texas guidance warns that unpaid subcontractors and suppliers may file a lien and recommends legal advice when lien language or ownership rights are involved. Preserve every notice, sworn statement, waiver, invoice, and recorded document. Do not sign a lien release or pay a claimant without confirming what rights the document affects.

If the contractor files bankruptcy, collection efforts may be restricted and deadlines can be short. Send your records to a licensed attorney promptly to determine whether and how to file a claim, challenge a discharge, or protect your property rights. Large losses, threatened foreclosure, an active lien, or a notice from a bankruptcy court justify immediate legal advice rather than waiting for an agency response.

Know the deadlines and state-specific rules

Small-claims ceilings, statutes of limitation, bond procedures, lien deadlines, licensing rules, and recovery-fund eligibility differ by state. Verify each requirement with the relevant court, licensing regulator, recovery-fund administrator, or a licensed attorney. A regulator’s acknowledgment of your complaint does not extend a court deadline unless the law expressly says it does. Calendar every date from the contract, last payment, discovery of the defect, notice of abandonment, lien notice, and agency correspondence.

What to do if the contractor responds

If the contractor offers to return money

Get the offer in writing. Confirm the amount, payment date, payment method, and whether any release is conditioned on cleared funds. Do not withdraw a complaint or dismiss a claim before the agreed payment is irrevocably received unless your attorney advises otherwise.

If the contractor promises to finish

Use a written completion schedule identifying labor, materials, inspections, correction of defects, and the consequences of missed milestones. Do not make an additional advance payment merely because work is promised; tie any payment to objectively verified progress and the contract’s terms.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

If the contractor stops communicating

Document each contact attempt, send the demand by certified mail, and proceed with the licensing and consumer-protection complaints. Obtain an independent inspection and written completion estimate so that your damages can be measured without relying on the contractor’s statements.

Preventive practices that also strengthen a claim

U.S. government consumer guidance recommends checking licenses and bonds, getting several written bids, requiring a contract with clear payment terms, avoiding cash and large advance payments, and withholding final payment until the work and required inspections are satisfactory. FTC guidance likewise recommends checking licensing and insurance, obtaining multiple estimates, and keeping contract terms in writing.

  • Verify the license directly with the state regulator and confirm that the legal entity on the contract matches the license.
  • Ask for proof of insurance and bond information, then record the policy or bond details.
  • Require a written scope, materials list, start and completion dates, payment milestones, permit responsibilities, warranty, and change-order process.
  • Pay through traceable methods and keep receipts; avoid handing over cash or funding a large unexplained deposit.
  • Photograph progress before each milestone payment and retain inspection approvals.
  • Do not release the final payment until contracted work and required inspections are satisfactorily complete.

When to get professional help

A construction-fraud attorney or consumer-law legal-aid service is especially important when a lien, bankruptcy, large loss, unlicensed work, multiple property owners, or an approaching deadline is involved. Bring the complaint packet, contract, payment ledger, photographs, inspection reports, and every notice you received. Ask specifically about the best recovery forum, limitation periods, bond or fund eligibility, lien exposure, and whether an agency complaint could affect settlement strategy.
