Make the area safe, notify the site’s designated reporting contact, preserve the facts, and investigate the conditions that allowed the close call. A near miss is not “nothing happened.” It is an event in which a person could have been injured, killed, or exposed to significant damage, but a timing difference, escape route, or remaining barrier prevented harm. Reporting it promptly gives the project a chance to fix the hazard before the outcome changes.
Internal near-miss reporting and statutory notification are separate decisions. Your site procedure may require every near miss to be logged, while a regulator may require notification only for specified severe injuries or dangerous occurrences. Apply the law of the country and project location, and use the sequence below for the internal response.

What counts as a construction near miss?
A near miss is an unplanned event that caused no injury or damage, or less harm than it could reasonably have caused. Examples include a suspended load that swings past a worker, a person stepping back before a reversing vehicle reaches them, a tool falling into an exclusion zone, a trench edge slumping without trapping anyone, or a scaffold component failing while the platform is unoccupied.
The useful question is not whether somebody was lucky. Ask what hazard was present, which control was expected to protect people, and how the event came close to defeating that control. A report can reveal a failed guard, an ineffective exclusion zone, a defective component, a confusing instruction, or production pressure that made the safe method impractical.

OSHA’s December 2015 employer guide says employers should investigate both harmful incidents and “close calls” that could have caused harm under slightly different circumstances. HSE likewise says near misses can show how well health and safety is being managed. Treat the report as prevention data, not as a search for a person to punish.
First response: control danger before collecting evidence
Do not begin an interview, take a photograph, or enter the area while people remain exposed. Emergency response and immediate risk control come first.
- Raise the alarm and get help. Use the project emergency process and call emergency services when the situation requires them. Give first aid or arrange medical assessment for anyone who may have been affected, even if the person initially reports no injury.
- Stop the hazardous activity. Isolate energy, stop plant, lower or secure loads, suspend lifting, evacuate an unstable area, or establish a physical exclusion zone as appropriate. Keep non-essential people away.
- Do not create a second incident. Never enter an unsafe excavation, approach unstable temporary works, walk under a suspended load, or handle damaged equipment merely to obtain a better photograph. Wait for a competent person to make the scene safe.
- Preserve the scene once it is safe. Prevent unnecessary movement of materials, controls, tools, vehicles, or components. If an item must be moved to eliminate danger, note who moved it, why, and its original position.
- Tell the responsible person promptly. Notify the immediate supervisor, site manager, control-room contact, or other person named in the project procedure. A prompt verbal warning can protect the next crew; complete the written record as soon as practicable.
OSHA’s investigation guidance places emergency response and scene safety before investigation. That sequence is a safety control, not an administrative preference.
How to make the initial near-miss report
Use the site’s designated route
Follow the project induction, noticeboard, permit system, or reporting application for the named contact and escalation path. OSHA’s sample policy directs workers to report incidents, hazards, and near misses to an immediate supervisor as soon as possible. HSE recommends a clear, simple system that gets reports to managers and supports worker involvement.
If the supervisor is involved in the event, unavailable, or dismisses the concern, use the alternate contact in the site procedure—such as the project manager, safety adviser, principal contractor, or client escalation route. Do not let uncertainty about the form delay an urgent warning.
Write observations, not accusations
Use neutral, time-stamped facts. “At 10:15, the telehandler reversed from the laydown area while a banksman was not visible to the operator; a worker moved behind the barrier before the machine reached it” is more useful than “the operator was careless.” Record what you saw, heard, did, and measured. Mark assumptions as assumptions.
Minimum information to capture
- Date, time, precise location, work area, level, grid reference, or chainage.
- Task underway and the sequence of events, including what happened immediately before and after the near miss.
- People present, their employers, roles, and whether anyone was exposed or potentially exposed.
- Plant, vehicles, tools, materials, temporary works, substances, and permits involved.
- The hazard and the credible potential consequence: fall, crush, struck-by, electrocution, collapse, fire, exposure, or another outcome.
- Controls that were expected—guarding, isolation, lifting plan, exclusion zone, inspection, permit, PPE, supervision—and what actually occurred.
- Immediate actions: stop-work instruction, isolation, repair, barricade, evacuation, or change in method.
- Names and contact details of witnesses, plus photographs, sketches, measurements, CCTV references, or attached records where safe and permitted.
Have the person who observed the event make the first account in their own words where possible. A supervisor can add verified facts without rewriting the witness’s recollection into a conclusion.
Keep the system non-punitive and usable
HSE warns that using accident reports to blame people may discourage employees from reporting. A form that takes too long, requires a conclusion before facts are known, or threatens automatic discipline will suppress the information the project needs. Provide a short immediate-report option, then allow a fuller investigation record.
Workers and contractors should know how to report anonymously or confidentially where the project offers that option, how urgent hazards are escalated, and how they will hear about actions taken. A report is not useful if it disappears into an inbox without an owner.

Internal reporting is not regulator notification
Log every near miss required by the project’s process, but do not label every internal report legally reportable. Statutory duties depend on jurisdiction, event type, employer status, and sometimes the equipment or work arrangement involved. Check current regulator guidance and the responsible person for the actual project.
United States: federal OSHA severe-event reporting
Under the cited federal OSHA rule, an employer must report a work-related employee fatality within 8 hours. A work-related inpatient hospitalization, amputation, or loss of an eye must be reported within 24 hours. These are severe-event notification triggers; they are not a universal 8-hour or 24-hour deadline for an internal near-miss form.

OSHA’s recordkeeping material treats recordkeeping, severe-event reporting, and electronic submission as related but distinct duties. Whether an event is recordable, reportable, or subject to a state-plan requirement depends on the facts and the employer’s circumstances. A close call with no qualifying injury may still require immediate internal escalation even when it does not meet the federal severe-event triggers.
Great Britain: RIDDOR dangerous occurrences
HSE’s RIDDOR guidance lists specific dangerous occurrences, including specified construction events. Its example says a scaffold collapse is reportable only when the scaffold was more than 5 metres high, while all failures of falsework are reportable. Those examples do not constitute a complete list, and the responsible person must check the applicable Schedule 2 provisions for the actual event.
A collapsed scaffold can therefore require an internal report in every case, while RIDDOR notification depends on the statutory conditions. Do not infer from “nobody was hurt” that notification is impossible, and do not infer from “near miss” that notification is automatic.
Other locations and projects
For work outside the United States or Great Britain, identify the regulator and law that apply to the site, the employer, and the contract. Client rules, building or engineering regulators, environmental authorities, and state or provincial regimes may add duties. Keep a written record of who made the notification decision, the facts available at the time, and any reference number.
Investigate after the scene is safe
OSHA’s Incident (Accident) Investigations: A Guide for Employers, published in December 2015, sets out a four-step systems approach: preserve and document the scene, collect information, determine root causes, and implement corrective actions. The guide is advisory; it does not create or alter a legal obligation. Its method is nevertheless practical for near misses because it focuses on conditions and barriers rather than hindsight blame.
1. Preserve and document the scene
Once the area is controlled, document its condition before normal work changes it. Photograph from wide, medium, and close perspectives; include access routes, line of sight, lighting, housekeeping, barriers, controls, and the position of relevant equipment. Add a sketch when relationships or distances are difficult to understand in a photograph. Record measurements, weather, lighting, ground conditions, equipment settings, and the status of switches, guards, alarms, permits, and isolations.
Identify what changed between the event and the investigation. A vehicle may have been moved for emergency access; a damaged component may have been removed; a worker may have reset a control. Record those facts rather than treating the reconstructed scene as original. Do not put anyone at further risk to obtain evidence.

2. Gather accounts and records promptly
Interview witnesses as soon as the scene is safe and memories are available. Begin with an open invitation such as, “Please describe what you saw from the start.” Let the person use familiar terms, then clarify times, positions, sequence, and sight lines. Use a translator when needed. Explain that the purpose is fact-finding and prevention, not fault-finding.
Do these 3 things before closing this tab:
1Clear out junk files and repair common Windows errors2Fix the driver behind crashes, sound loss and screen glitches3Repair Windows errors before they cause bigger problemsCompare more than one account without forcing them into agreement. Differences may reveal changing conditions or an unobserved part of the sequence. Preserve original notes and identify who supplied each fact.
Useful documentary sources include:
- Risk assessments, method statements, lift plans, permits, drawings, temporary-works designs, and pre-task briefings.
- Plant and equipment manuals, inspection certificates, maintenance and defect logs, calibration records, and isolation records.
- Training, competency, induction, supervision, fatigue, shift, and staffing records.
- Weather data, delivery schedules, traffic plans, radio or communication logs, CCTV, access-control records, and photographs.
- Previous near-miss reports, audits, toolbox talks, outstanding corrective actions, and change-management records.
- Contractor information and interfaces showing who controlled the task, plant, area, and handover.
Secure electronic evidence according to the project’s privacy and retention rules. Record the source and time of any downloaded file so later reviewers can distinguish the original from an edited copy.
3. Identify immediate, contributing, and underlying causes
Separate the event’s physical mechanism from the conditions that made it possible. For example, “the load entered the pedestrian route” describes the immediate event. Contributing questions include why the route was open, why the spotter could not see the operator, and why the lift plan did not control the interface. Underlying questions include how the traffic plan was approved, inspected, supervised, and changed.
Ask “why” until the answer reaches a controllable system condition, not merely a person’s name. Examine:

- Procedures, permits, drawings, change control, and whether the method was workable in the real sequence.
- Training, competence, language, communication, handover, supervision, and staffing.
- PPE selection and availability, while remembering that PPE is the last line of defence.
- Production deadlines, delivery pressure, overtime, conflicting instructions, and incentives that rewarded speed over control.
- Coordination between the principal contractor, subcontractors, designers, suppliers, and other employers.
“Worker was careless” or “the procedure was not followed” is incomplete unless the investigation explains why the action occurred and why the system did not detect or prevent it. The question may expose an unrealistic sequence, missing supervision, poor design, a blocked access route, or a control that existed on paper but not at the workface.
4. Build a defensible causal analysis
Use a simple timeline and barrier analysis before choosing a formal technique. Mark each point at which a hazard could have been eliminated, isolated, detected, or stopped. For complex events, a fault tree, bow-tie, or “five whys” worksheet can help, but the tool is less important than testing each conclusion against evidence.
Distinguish facts, supported inferences, and unresolved questions. If accounts conflict, state the conflict and what additional evidence would resolve it. Avoid claiming a single root cause when several conditions combined.
Corrective actions that prevent recurrence
An investigation is unfinished until actions addressing root causes are implemented. A reminder to “be careful” rarely changes a defective layout, missing guard, inadequate design, or impossible schedule.

Choose stronger controls first
- Eliminate the exposure: redesign the sequence, remove the need to enter the zone, or prefabricate at ground level.
- Substitute or engineer: use a safer material or automated handling; install guarding, interlocks, edge protection, barriers, separation, extraction, or designed temporary works.
- Administrate: revise the method, permit, traffic plan, inspection, handover, staffing, supervision, or coordination process.
- Use PPE: select, fit, maintain, and enforce PPE as a supplementary barrier, not the sole fix for a foreseeable high-energy hazard.
Assign, communicate, and verify
For every action, record the causal condition it addresses, the named owner, target date, required resources, and acceptance criteria. “Install a barrier” is weaker than “Principal contractor to install a lockable pedestrian barrier at the east loading route before the next delivery; supervisor to verify separation during the pre-start inspection.”
Closeout requires evidence: a photograph, revised drawing or method statement, inspection record, training attendance, test result, or observation that the control works under normal production conditions. Check for unintended consequences. A barrier that blocks an emergency exit or a new route that creates a reversing conflict is not a successful closeout.
Share useful findings with workers and contractors who could face the same exposure. Explain the changed control, when it applies, and how to report a failure. OSHA’s sample policy describes review and communication, but it is a template rather than a universal requirement to copy word for word.

Contract terms and local law may assign additional duties; verify them for the project.
Records, forms, and reporting systems
A paper form can be effective if it is available at the workface, has a clear escalation route, and supports action tracking. HSE’s Near-miss Book, published in February 2021 (ISBN 9780717667420), is a UK-oriented record book intended to help employers and employees record near misses and identify patterns. It does not replace the project’s reporting process or local legal guidance.
Whether the project uses paper, a shared form, or software, assess the process against these practical tests:
- Can workers, agency staff, visitors, and every contractor access it during the shift?
- Does an urgent report reach a responsible person quickly, rather than waiting for a weekly review?
- Can the reporter attach facts, photographs, sketches, witness accounts, and relevant records?
- Can the investigation distinguish immediate actions from longer-term corrective actions?
- Does each action have an owner, due date, status, evidence, and escalation for overdue work?
- Can workers see useful feedback while protecting personal and confidential information?
- Does the process support the project’s jurisdictional retention, privacy, and regulator requirements?
Review trends without turning a high report count into a league table. More reports can indicate stronger trust and visibility, while a sudden drop can indicate under-reporting, reduced activity, or a broken process. Examine recurring hazards, locations, tasks, contractors, barrier failures, overdue actions, and time from report to control.

Common mistakes and how to correct them
Waiting for the perfect form
Problem: The report is delayed while someone searches for the correct template.

Correction: Give an immediate verbal warning or short alert first, then complete the detailed record.
Photographing an unsafe scene
Problem: A worker enters an unstable or live area to capture evidence.
Correction: Isolate the hazard and use a competent person to decide when and how evidence can be collected.
Stopping at a rule violation
Problem: The conclusion says only that a worker did not follow the procedure.
Correction: Ask why the procedure was not followed, whether it was understood and practical, what supervision and equipment were available, and why the system did not detect the deviation.
Issuing a reminder as the only action
Problem: A toolbox talk is recorded while the physical hazard remains.
Correction: Use elimination or engineering controls where possible, then revise the method, inspection, coordination, and training to support them.
Confusing internal and statutory deadlines
Problem: A project treats an internal 24-hour template instruction as a universal legal rule, or assumes an uninjured event can never require notification.
Correction: Follow the project process for every near miss and separately check the current law, regulator, event definition, and responsible person for the site.
Why near-miss reporting deserves management attention
Near misses provide leading information before a serious outcome. OSHA’s 2015 guide reproduced historical BLS figures of more than a dozen workplace deaths per day and nearly 4 million serious workplace injuries in the United States in 2013. Those are historical figures, not current rates, but they illustrate why a project should not wait for an injury to reveal a failed barrier.
The same guide reproduced a National Safety Council estimate of average savings of $39,000 for preventing a workplace injury and more than $1.4 million for preventing a fatality. The guide does not state the estimate’s original publication year or methodology, so these figures should not be treated as current cost forecasts. The stronger, evidence-based business case is operational: a timely report identifies a condition while it can still be corrected without the human consequences of a serious event.
