How to report a dangerous road design or traffic safety concern

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Start with the agency that controls the road. In the United States, that is usually a state department of transportation (DOT) for a state route, or a city or county transportation/public works department for a local street. Report the exact location, describe what you observed and who may be affected, explain when it occurs, and attach safely obtained evidence if you have it. Use an emergency or urgent-hazard channel instead of a routine web form when the condition presents an immediate danger.

The Federal Highway Administration (FHWA) says, “You will likely need to contact the controlling agency—the State DOT, county, or city.” FHWA is not the default complaint desk for every road. The correct agency, reporting channel and follow-up process depend on the road owner and your jurisdiction.

1. Identify who controls the road

Road ownership determines where a concern belongs. A road may pass through a city while being controlled by the state, or a county route may border several municipalities. If you send a report to the wrong department, it may be forwarded, but that can delay triage.

Road setting Likely controlling agency Reasonable starting point
State-numbered highway, freeway or state route State DOT or its regional/district office State DOT safety, traffic operations or roadway-maintenance concern channel
City street, signal or crossing City transportation, public works or engineering department City service-request system or traffic-engineering department
County road County public works, highway or transportation department County road-maintenance or traffic-safety reporting channel
Road with uncertain ownership Not established until checked Ask the city or county public works department which agency owns or maintains that segment

Signs, signals and roadway lighting are commonly maintained by local public works agencies or state DOT public works divisions. That does not necessarily mean the same agency designed the road or controls every nearby intersection, so identify the specific segment and movement involved.

Ways to confirm ownership

  • Check the route number, street signs and the jurisdiction shown on the agency’s transportation or public-works website.
  • Look for a state route marker, county route designation or city-limit boundary.
  • Call a city or county public works office and ask which agency handles roadway engineering or traffic operations at the location.
  • If a work zone is involved, note the project name or contractor sign, but still report the underlying roadway concern to the public agency that controls the road.

2. Decide whether it is an emergency or a routine safety concern

A routine concern report is appropriate for a recurring design or operations problem that is not creating an immediate crisis. An urgent hazard needs a faster channel because waiting for a normal online queue could expose people to harm.

Situation What to do What to include
Immediate danger, active obstruction, failed signal creating a collision risk, or a crash in progress Use the emergency or urgent-hazard procedure for your jurisdiction. If people are in immediate danger, contact emergency services. Exact location, direction of travel, the active hazard and whether anyone is injured or trapped. Do not rely only on a routine form.
Recurring sightline, lane, crossing, signal, signing or lighting problem Submit a detailed report to the controlling agency’s transportation, public works or traffic-operations channel. Location, observed conflict, affected road users, dates/times and conditions.
One-time incident that has ended Report the roadway condition if it may recur; report the incident itself through the appropriate police or emergency process when required. Separate what you directly observed from assumptions about why it happened.

The exact emergency number and procedure vary by location, so a national number or universal web portal cannot be supplied without knowing where the road is. Do not stop in a traffic lane, stand on a median or enter a work zone to document an urgent condition.

3. Make the report precise enough to investigate

Agencies can act on a clearly located observation. A general statement such as “this intersection is dangerous” gives investigators little to verify. Describe the feature, the movement or conflict, and the circumstances in plain language without presenting a personal conclusion as an engineering finding.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Give a precise location

  • Road or route name and number, if known.
  • Nearest cross street, ramp, driveway, bridge, mile marker or other fixed landmark.
  • Direction of travel and the approach or leg of the intersection involved.
  • A map pin or latitude/longitude if the agency’s form accepts one.
  • The lane, shoulder, sidewalk, crossing or path where the problem occurs.

For a long corridor, identify the limits of the concern, such as the segment between two intersections, rather than naming only the road.

Describe what you actually observed

Use concrete observations: a driver’s view appears blocked at a crossing; a lane shift is difficult to follow; a control is missing, obscured or hard to see; turning vehicles and people walking or cycling converge; or a signal does not appear to serve the movement safely. These descriptions communicate the condition without claiming that you have diagnosed the design cause.

Explain the movement involved. For example, state that vehicles turning right across a marked crossing approach people walking from the near-side sidewalk, or that westbound traffic must merge abruptly after a lane ends. Say whether the conflict is occasional or recurring and whether you personally witnessed a near miss, sudden braking or a collision.

State when and under what conditions it happens

Include the days and times when the concern is most prevalent. Add relevant conditions such as darkness, glare, rain, snow, fog, school arrival or dismissal, holiday traffic, construction activity or a queue that blocks the view. FHWA’s sample road safety audit application specifically asks about days or times when a concern is most common.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Distinguish direct observation from inference. “I saw three vehicles brake hard while people were crossing between 5:00 and 5:30 p.m.” is an observation. “The signal timing is defective” is an engineering conclusion that the agency must evaluate.

Identify the people who may be affected

Specify whether the apparent risk involves drivers, people walking, cyclists, motorcyclists, transit users, people using mobility devices, schoolchildren, maintenance workers or emergency responders. Explain the movement or exposure, not a stereotype about who uses the road.

Attach evidence only when it is safe and lawful

Photographs or video can help an owner or design team understand a location. Attach images you already have or can obtain without entering traffic, stopping in an unsafe place or handling a phone while driving. Never create a hazard to collect proof. Do not publish identifiable personal information or imply that an image proves a cause that has not been established.

You do not need to gather crash statistics before reporting. FHWA guidance says agencies can verify public observations with field evidence and available crash or citation records. Your accurate description of a recurring condition is useful even when you do not have a database or engineering study.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

4. Submit the concern: a practical sequence

  1. Confirm the road owner. Determine whether the segment is controlled by the state, county or city. If uncertain, ask a local public works or transportation office which agency handles that location.
  2. Choose the matching channel. Use the agency’s online concern form, telephone line or department contact for roadway engineering, traffic operations or maintenance. Use the urgent-hazard or emergency route when the condition is an immediate threat.
  3. Write a location-first description. Put the route, nearest cross street, direction and landmark in the first sentence so the report can be routed quickly.
  4. Explain the observed conflict. State what happens, which movement is involved and which road users appear exposed. Separate observations from theories about the cause.
  5. Add timing and conditions. Include recurring days, times, lighting, weather, traffic volume or other circumstances that change the risk.
  6. List supporting material. Attach safely obtained photos or video and note dates. If you witnessed near misses or crashes, describe what you saw and when; do not inflate counts or repeat unverified reports.
  7. Submit and save the record. Keep the confirmation number, submitted text, attachments and date. A screenshot or downloaded copy is useful if the agency’s portal does not provide a receipt.

If the form asks for the requested remedy, you can ask the agency to review the location for a safety problem and explain that you are seeking its assessment. Avoid prescribing a specific signal, sign, lane or construction treatment unless you are qualified to do so; the agency must consider standards, operations, access, drainage, maintenance and the needs of all road users.

5. What happens after a report

The agency decides how to investigate. FHWA says public observations and perceptions should be verified with field evidence. Staff may inspect the site, review signal or lighting operation, examine design and maintenance records, or consult crash and citation data. A report may be assigned to traffic engineering, roadway maintenance, a district office or another road owner.

Prioritization is jurisdiction-specific. Indiana Department of Transportation (INDOT), for example, describes a process in which concerns are logged, assigned, urgent safety issues are prioritized and the submitter receives the investigation result. INDOT also says timing depends on issue type, safety concerns, weather and available resources. That is an Indiana example, not a nationwide response deadline or procedure.

Do not assume that submitting a form guarantees a site visit, engineering study, design change or response within a particular number of days. Agencies may determine that a condition is already addressed, requires monitoring, belongs to another owner, or needs a broader project review.

6. When to ask about a road safety audit

A routine public report and a formal road safety audit (RSA) are different requests. FHWA defines an RSA as “the formal safety performance examination of an existing or future road or intersection by an independent, multidisciplinary team.” An RSA considers safety for all road users and produces findings describing issues, their locations and the associated risk. The project owner and design team then prepare a written response describing actions they will take.

You may ask the controlling agency whether an RSA or another formal review is appropriate, especially for a recurring, complex or corridor-wide concern. The agency’s process determines whether an audit is requested, who conducts it and how its findings are handled. A resident cannot assume that a standard complaint automatically commissions an independent multidisciplinary team.

FHWA’s sample RSA application illustrates the information an owner may request: a contact person, assessment type, timing patterns, additional road owners, photos and supporting details. Use that structure to make your inquiry complete, but do not represent it as a universal public application or promise that every jurisdiction offers one.

7. Follow up when the problem persists

Wait for the period stated by the agency, if it provides one, then use the original confirmation number to request a status update. Ask whether the report was assigned to roadway engineering, traffic operations, maintenance or another department. If the agency says it does not control the location, ask for the correct owner and resubmit the same factual description.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

For a continuing immediate hazard, use the jurisdiction’s urgent channel again rather than relying on an old routine ticket. Document new dates, changed conditions or additional observations without putting yourself at risk.

If you receive an investigation result, read what was actually evaluated. An agency may distinguish a maintenance repair from a design review, or may explain that a project is scheduled separately. You can ask a focused follow-up question about the next decision point, but avoid demanding a particular treatment without understanding the operational and legal constraints.

8. Common reporting mistakes and better alternatives

Mistake Why it weakens the report Better approach
Sending the complaint to FHWA by default FHWA provides federal guidance but does not control every city, county or state road. Contact the road’s controlling state or local agency first.
Giving only a broad intersection name Investigators may not know the approach, lane or movement involved. Add direction, nearest landmark, lane or crossing and a map pin when available.
Declaring the engineering cause as fact A conclusion may be unsupported or send the review in the wrong direction. State what you saw, who was exposed and under what conditions.
Waiting to collect crash statistics Residents may not have reliable records, and reporting is useful before a statistical analysis. Report precise observations; let the agency check crash and citation records.
Taking photos from an unsafe position Documentation can create another collision or trespass risk. Use images already obtained safely and lawfully, or omit them.
Expecting a guaranteed redesign or deadline Agencies triage under their own procedures and resources. Request an evaluation and keep the confirmation for measured follow-up.

10. The key points to remember

  • Find the controlling agency before choosing a contact channel.
  • Use emergency or urgent-hazard procedures for immediate danger.
  • Give a precise location, observed condition, affected road users and recurring timing.
  • Separate direct observations from conclusions about engineering causes.
  • Attach evidence only when it can be obtained safely and lawfully.
  • Do not wait for crash statistics; the agency can verify the concern with field and available records.
  • Understand that a public report is not automatically a formal road safety audit.
  • Save the confirmation and follow up through the responsible department, without assuming a universal deadline or guaranteed design change.
