The most reliable approach is to follow the mitigation hierarchy: avoid sensitive habitat and high-value areas where feasible, minimize the footprint and duration of unavoidable disturbance, then restore or compensate for impacts that remain. Put the controls into the site plan and contractor specifications before work starts, and inspect them throughout construction.

Noise should be reduced at its source and scheduled around wildlife-sensitive periods. Dust must be suppressed without turning into muddy runoff. Exposed soil, sediment, lighting, vegetation removal, chemicals and temporary materials can all harm wildlife, so noise, air quality, stormwater and habitat controls need to operate as one plan rather than as separate fixes.

Use the mitigation hierarchy first

The U.S. Fish and Wildlife Service (FWS) describes the basic sequence as “avoid, minimize, and compensate.” In practice, that means changing the layout or timing before relying on restoration after damage has occurred. The FWS mitigation policy was issued May 10, 2023, and amended February 13, 2026.

Stage What it means on a construction site Decisions to document
Avoid Keep structures, access routes, staging areas and loud work away from wetlands, streams, riparian vegetation, nests, roosts, dens and other high-value habitat where a feasible alternative exists. Options considered, sensitive features mapped and the reason the selected layout avoids the greatest risk.
Minimize Reduce the cleared area, operating hours, equipment types, lighting, traffic, soil exposure and length of disturbance. Work limits, equipment requirements, noise hours, dust triggers, exclusion fencing and inspection duties.
Restore Stabilize soil quickly, replace or replant vegetation where appropriate, remove temporary hazards and return disturbed areas to an agreed condition. Stabilization dates, repair records, revegetation actions and removal of temporary controls.
Compensate Address unavoidable residual impacts through mitigation required or accepted by the responsible agencies. Agency approvals, mitigation commitments and monitoring results.

Compensation is not a substitute for practical avoidance and minimization. A site-specific review is necessary because species, habitat value, seasons, permits and construction methods differ from project to project.

Plan the site before finalizing the layout

Map sensitive features and constraints

Have the project team identify wetlands, streams, floodplain or riparian zones, nests, roosts, dens, migration or breeding areas and other wildlife features before the final site plan is approved. Show them on the drawings, not only in a narrative report. Mark the limits in the field before clearing with visible stakes, fencing or other durable signs.

Retain existing vegetation and streamside buffers whenever feasible. A buffer can reduce noise and dust movement, provide cover and shade, and protect water quality, but its required width is site- and jurisdiction-specific. Do not assume that a generic setback applies to every wetland, stream or listed species.

Check stormwater coverage early

Earth disturbance that reaches one or more acres generally falls within the scope of construction-stormwater permitting, subject to jurisdiction and permit details. Confirm the applicable requirements with the permitting authority and determine whether a construction Stormwater Pollution Prevention Plan (SWPPP) or equivalent erosion and sediment-control plan is required. EPA’s Construction and Development Effluent Guidelines were promulgated in 2009 and amended in 2014 and 2015; current permit conditions control what your project must do.

Get wildlife advice before a clearing date is fixed

Ask the relevant FWS field office, state wildlife agency or a qualified biologist to review the project when listed species, active nests, wetlands, aquatic habitat or other sensitive resources may be affected. The review can establish survey needs, protective zones, seasonal timing windows, lighting limits, acceptable netting and monitoring requirements. Agency recommendations should be written into the work package so a superintendent can enforce them in the field.

Write controls into the contractor specifications

Reduce construction noise at the source

The National Cooperative Highway Research Program (NCHRP) environmental-stewardship compendium states that a project’s noise strategy should emphasize control at the source. Barriers and distance help, but they are less effective if the equipment itself is unnecessarily loud or poorly maintained.

Specify quieter, well-maintained equipment

  • Choose equipment with lower manufacturer sound emissions when the work method allows.
  • Keep engines, exhaust systems, backup alarms and other noise-producing components properly muffled and maintained.
  • Use the smallest practical number and size of heavy machines; avoid leaving engines idling.
  • Locate generators, compressors and pumps as far from sensitive habitat as the site permits, while keeping them outside protected buffers.
  • Use temporary acoustic curtains or sound barriers between a source and habitat when they can be installed without blocking wildlife movement or creating another hazard.

Do not treat a barrier as a universal solution. It must be continuous enough to interrupt the line of sight to the source, stable in wind, and placed where it does not intrude into a wetland, stream, nest area or wildlife travel route.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Schedule loud and impulsive work carefully

Restrict routine heavy work to the least sensitive daytime period identified for the site. Schedule pile driving, blasting, demolition and other impulse-noise activities outside timing windows recommended by wildlife agencies. A daytime window is not automatically safe: breeding, roosting, overwintering and migration periods vary by species and location.

Sequence the loudest tasks so that they occur in the shortest practical block rather than intermittently over many weeks. Give the superintendent authority to stop a task when a protected animal is observed or when an agency condition is triggered. Document any exception to the schedule, the reason, the approving person and the additional mitigation used.

Respond to complaints and unexpected wildlife activity

Keep a simple noise log with date, activity, equipment, location, operating hours, weather, wildlife observations and complaints. If a complaint or wildlife observation indicates that the agreed control is not working, first stop or move the source when safe, then check mufflers, barriers, hours and the distance to the sensitive feature. Escalate to the project biologist or agency contact when the event involves a nest, den, listed species or a prescribed exclusion zone.

Control dust without creating muddy runoff

Use visible dust as the trigger for action

Water active work areas, haul routes and other exposed surfaces when visible fugitive dust occurs or is likely to occur. Apply enough water to control dust, but coordinate the rate and timing with erosion controls. Excess watering can create muddy runoff, carry sediment to a stream and undermine a slope or access road.

Cover the sources that can blow

  • Cover excavations, spoils, stockpiles and loads during transport when wind can carry material.
  • Use covers that are secured against the expected wind and do not create wildlife-entanglement hazards.
  • Use low-drift application methods and avoid spraying directly toward wetlands, streams or unprotected drains.
  • Stabilize access roads and traffic areas so tires do not pulverize loose soil.
  • Remove dirt tracked onto paved roads promptly rather than washing it into an inlet.

Inspect watering and road controls

Assign a person to check dust controls during dry or windy periods, after traffic increases and whenever nearby residents or workers report visible dust. Record the location, weather, measure used and result. If watering is ineffective, reduce vehicle speed, change the surface treatment, cover the material or pause the activity until a better control is in place.

Keep sediment and contaminated runoff out of water

Construction sediment can reduce sunlight reaching aquatic plants, clog fish gills, smother aquatic habitat and spawning areas, and impede navigation. Protecting water therefore requires more than a silt fence at the property edge.

Install a complete erosion and sediment-control system

A site-specific plan may include the following measures, selected for the terrain, soils, drainage and permit:

  • Inlet protection at storm drains and other collection points.
  • Sediment traps or basins sized and located for the site’s drainage.
  • Diversions or berms that keep clean water away from disturbed soil.
  • Erosion-control blankets or mulch on exposed slopes and channels.
  • Phased clearing so the smallest practical area is open at one time.

Install controls before earth disturbance, inspect them at installation and after rainfall, and repair failures immediately. A fence that is undercut, a fiber roll that has floated away or an inlet protection device packed with sediment is no longer performing its intended function.

Stabilize exposed soil as soon as practicable

Use temporary or permanent stabilization appropriate to the season and site. Erosion-control blankets, mulch, seed, matting or other methods must be compatible with the slope and wildlife. Follow the product and permit requirements for anchoring and maintenance; a loose mat can become both a sediment failure and an entanglement risk.

Manage dewatering and pollutants separately

Dewatering water should not be pumped directly into a stream, wetland or storm drain without the treatment and authorization required for the site. Route it through an approved sediment-control system, monitor the discharge and stop pumping if controls are overwhelmed. Store fuels, oils, concrete washout, chemicals and waste away from surface waters and protect them from rainfall. Keep spill materials available and train workers to stop the source, contain the release and notify the designated response contacts.

Protect habitat during clearing and daily operations

Fence no-go areas before equipment arrives

Stake and fence wetlands, streams, riparian vegetation, nest or den areas and other exclusion zones before clearing or grading. Use a visible, durable system that operators can see from access routes. Do not use fencing as permission to store materials on the protected side; keep equipment, spoil, fuel, waste and wash water outside the boundary.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Retain vegetation and limit access

Preserve existing trees, shrubs and ground cover wherever the design allows. Minimize temporary roads, turning areas and laydown yards. Use a defined route for deliveries and worker vehicles so repeated traffic does not widen the disturbed footprint or crush buffer vegetation.

Control light, chemicals and human presence

FWS identifies vegetation alteration, ground disturbance, noise, light, chemicals and human presence as stressors for migratory birds. Aim lights downward, shield them from habitat and turn them off when safety requirements allow. Avoid unnecessary night work. Keep workers on designated routes, prohibit feeding or handling wildlife, and secure food and waste so it does not attract animals into active work zones.

Use wildlife-safe temporary materials

Choose wildlife-friendly or removable netting and remove temporary netting as soon as it is no longer needed. Inspect it regularly for trapped or entangled animals. Coordinate the material and mesh design with the wildlife agency or project biologist where birds, bats, reptiles or small mammals could be affected. The same caution applies to open pipes, trenches, tanks and uncovered pits: cap, ramp, fence or inspect them as appropriate to prevent animals from entering.

Sequence the work to reduce cumulative disturbance

Phase Priority actions
Before clearing Complete habitat mapping and required surveys; confirm permits and timing windows; mark buffers and exclusion zones; install initial erosion controls; brief every contractor.
Clearing and grubbing Clear only the approved footprint; retain vegetation and buffers; check for nests, dens and animals; keep noise and access within the specified limits.
Earthwork Use stabilized entrances, dust suppression, stockpile covers, diversions, inlet protection and slope stabilization; inspect after rainfall and repair controls.
Structural and utility work Maintain source-noise controls and work-hour limits; keep materials and wash water away from water; minimize night lighting and idling.
Closeout Stabilize remaining soil, remove temporary netting and unused materials, restore approved areas, verify that buffers are intact and complete mitigation records.

Inspect, document and correct controls

A written plan is useful only if field staff can verify it. At minimum, inspect controls when they are installed, after storms and throughout the job. Record:

  • Date, inspector and weather conditions.
  • Active work areas, access routes and nearby sensitive features.
  • Condition of fencing, silt controls, basins, entrances, blankets, covers and barriers.
  • Dust observations, watering or covering performed and any muddy runoff.
  • Noise-producing activities, operating hours and equipment defects.
  • Wildlife observations, nest or den discoveries, injuries and entanglements.
  • Deficiencies, corrective action, responsible person and completion time.

Use a stop-work trigger for a breached exclusion zone, uncontrolled sediment discharge, a spill reaching water, an animal trapped in temporary material, or work occurring outside an approved sensitive-period window. Resume only after the responsible environmental or agency contact confirms the corrective action when the permit or plan requires that confirmation.

Choose products for the site, not as substitutes for planning

An erosion-control blanket, also called an erosion mat, is often useful with site-appropriate mulch, silt fencing or fiber rolls. Select the blanket, anchoring method and netting design for the slope, expected flow and wildlife risk. A blanket that controls erosion but can entangle animals is not an acceptable solution.

Other useful categories include dust-control water tanks or sprayers, stabilized-entrance aggregate, inlet-protection devices and temporary acoustic curtains. Local specifications, permits and site conditions determine which products are suitable. Inspect every temporary product and remove it when it is no longer needed.

When to bring in a wildlife or environmental consultant

Professional help is warranted when the project may affect listed species, active nests, wetlands, streams, aquatic habitat, large areas of clearing, blasting or pile driving, or when permit conditions require surveys or monitoring. A consultant can provide species surveys, habitat mapping, timing-window advice, permit documentation, contractor training and mitigation monitoring. The FWS guidance emphasizes that controls must be tailored to the stressors and resources at the site; no single product replaces that review.

Common failure modes and fixes

What you observe Likely control failure Immediate response
Dust plume from a haul road Insufficient watering, excessive speed or an unstable road surface. Pause or slow traffic, apply controlled water, improve the surface and check that runoff is not carrying sediment.
Brown water leaving the site Exposed soil, failed perimeter controls, an overwhelmed basin or uncontrolled dewatering. Stop the contributing activity, contain the flow, repair or enlarge the control and notify the designated environmental contact.
Silt fence lying flat or bypassed Undercutting, poor installation or flow volume beyond the fence’s capacity. Reinstall or supplement it, divert clean water and stabilize the source area.
Noise during a restricted wildlife window Schedule not communicated or an exception not approved. Stop the impulse-noise task, document the event and obtain direction before restarting.
Animal caught in netting or an open excavation Temporary material was not wildlife-safe or the inspection routine failed. Secure the area, avoid handling the animal unless directed by qualified responders, contact the project biologist or wildlife agency and correct the hazard.
Equipment inside a buffer Boundary was not visible or access routes were poorly defined. Move the equipment, repair the boundary, brief operators and assess any damage with the environmental lead.

What the project team should retain

Keep the approved site plan, survey and agency correspondence, permit and SWPPP documents, contractor specifications, prework briefing records, inspection logs, rainfall and corrective-action records, wildlife observations, spill reports and closeout photographs. These records show that avoidance and minimization were considered, controls were maintained and failures were corrected rather than hidden.
